Cutshaw (brother) Ronnie Hill Florence Hill (mother) Lamar Alexander Latroya Taylor (wife) Page 2 of 66 [initial Response (iR#1) | On Thursday, December 5, 2019, at approximately 1745 hours (hrs.), the Miramar Police Department (MPD) requested the Florida Department of Law Enforcement (FDLE) respond to the area of 12300 Miramar Parkway In order to investigate a use of deadly force incident involving members of the MPD, Miami-Dade Police Department (MDPD), Florida Highway Patrol (FHP) and Pembroke Pines Police Department (PPPD). During the incident, the following people sustained fatal injuries: Frank Brances Ordonez, Richard Steven Cutshaw, Ronnie Hill and Lamar Alexander. Cross reference MPD case #19-12-00936; MDPD case# PD191205434416; FHP case #19-99-21572-10; PPPD case #19-073458. At approximately 1845 hrs., FDLE Special Agent (SA) Alex Villanueva arrived on scene and met with MPD Homicide Detective (Det.) Jonathan Zeller, who was identified as the lead Det. for MPD and Det. Zubair Khan, who was identified as the lead Det. for MDPD. Det. Sgt. Darryl Curtiss was identified as the point of contact for PPPD and Master Sgt. Mark Shoaff was identified as the point of contact for FHP. A briefing of the facts known at the time was provided by MDPD Homicide Bureau, Lieutenant (Lt.) Benny Solis as follows: On Thursday, December 5, 2019, at approximately 1615 hrs., units from the City of Coral Gables Police Department (CGPD) were dispatched to a jewelry store located at 386 Miracle Mile, Coral Gables, Florida 33134, regarding an armed robbery in which one of the employees suffered an injury to her forehead as a result of the robbery, The jewelry owner and another employee subsequently exchanged gunfire with the unknown robbery subject as he (the suspect) entered the passenger side of a U-Haul van driven by another unknown suspect. ‘The suspects then fled the business using the U-Haul van. Coral Gables Fire Department (CGFD) personnel responded and transported the injured employee to Jackson Memorial Hospital (JMH) Ryder Trauma Center (RTC) in stable condition. Approximately twenty (20) minutes after the robbery, CGPD dispatch received a call of a possible carjacking involving a United Parcel Service (UPS) truck at 1261 Mariana Avenue, Coral Gables. According to the 911 caller, two (2) black males carjacked a UPS package truck and abducted the UPS employee. The 911 caller also advised that a U-Haul van with visible gunshot holes damage to the rear and side windows was left abandoned in the 1200 block of Mariana Avenue, Coral Gables. ‘Approximatoly twenty-five (26) minutes after the 911 carjacked called was reported, the UPS truck was located by MDPD officers traveling northbound in the area of Florida Tumpike and NW 106th Street. MDPD officers in marked and unmarked MDPD vehicles attempted to initiate a traffic stop with negative results. Additional units were requested and responded as the UPS truck continued to flee northbound on the Florida Tumpike, entering Broward County, Florida. MDPD Aviation Unit responded and relayed the UPS truck's direction of travel to the ‘other units. During the pursuit, shots were fired from the UPS truck at a MDPD unit. As the UPS truck approached the intersection of Miramar Parkway and Flamingo Road (heading westbound), vehicle congestion resulted in the UPS truck coming to a stop. As officers approached the UPS truck, an exchange of gunfire ensued. During the incident, the two (2) black males and the UPS employee sustained gunshot wounds and succumbed to their injuries. A civilian driver who was stopped at the traffic light at Miramar Parkway and Flamingo Road (westbound), several vehicles in front of the UPS truck, also sustained a gunshot wound during the incident and ‘succumbed to his injuries. No officers were injured during this incident. Page 3 of 66 mie Chronology Events ie Thursday, December 5, 2019. oe arene se ne a 914 Calls / CAD Report / Radio Communications (UR #2) SA Alex Villanueva obtained and reviewed the 911 calls, CAD reports and radio communication recordings provided by the Broward Sheriff's Office (BSO), MDPD, MPD and Miramar Fire Rescue (MFR). The radio ‘communication for this incident was approximately forty-five (45) minutes long. The following is a synopsis of the combined CAD reports and radio traffic communications. It should not be considered a verbatim transcript. For exact details, please refer to the recordings. Note: All times are approximate. 914 calls: The 911 recording revealed eight (8) calls as follows: _Names: Times ‘Comments Tracy McCall Telles | 1633hrs. | Observed @ UPS driver drop a package at her door and gel inside the UPS truck. Observed two (2) black males entered the UPS truck while the UPS driver was in the driver's seat. One (1) of the black males was wearing a blue shirt and had blood on his shirt. She noticed a commotion inside of the UPS truck between the two (2) black males and the UPS driver. The UPS river had his hands up. Telles stated she never saw any weapons. The UPS truck then drove away with the two (2) black males and the UPS driver. A statement was taken please refer to IR #298 __ for specifics. Marlene (unknown last | 1735 hrs. ‘She was an employee at The Beauty Mall, 12204 Miramar Parkway, and name) ‘stated, "someone is shooting over here". Her co-workers told her that there was a shooting. She did not hear nor see the shooting. _ Anonymous male 1735 hrs. He called from his cellular phone because his wife was at a hair salon _ near Miramar Parkway and Flamingo Road and she heard shots fired. Page 4 of 66 Deymi Baez 1757 hrs. | She drove away from the UPS shooting and as result had a flat tire along | with some bullet holes on her vehicle. Baez's vehicle was later identified as a Nissan Rouge, (tag# LKEQ35). A statement was taken please refer to IR #52 for specifics ‘Anonymous female | 1806 hrs. She called on behalf of her employee (Emst Jean) to report thal his vehicle, a gray, Hyundai Sonata (tagi# NBFK08) was damaged during the UPS shooting. A statement was taken please refer to IR #80 for specifics. 4815 hrs. He called and reported that he was present in the UPS shooting and drove away from the scene. He later noticed a few bullet holes to the rear tailgate of his Dodge Ram pickup truck (tag# SNE4A). He also saw a round on his daughter's car seat, located in the rear seat of his truck Tosado's daughter was not inside his Dodge Ram pickup at the time. A statement was taken please refer to IR# 107 for specifics Carle Brown 2137 hrs. ‘She reported that she was near the UPS truck at the time of the shooting. She drove away and while at her home, she discovered some bullet holes damage to her black, Honda Accord (tagi# LYRP97). A statement was taken please refer to IR# 94 for specifics. Notes Source Dispatch: B.0.L.O. with a five (5) minute delay, on | CGPD a shooting that occurred at 386 Miracle Mile, Coral Gables. The subject fled in a U-Haul van northbound on Le Jeune Road. “They are now advising itis an injury to the head” 1632 hrs. Dispatch: Update on B.0.L.O: “Advised it was an | CGPD armed 29 (robbery) to a jewelry store at 386 Miracle Mile. Two (2) subjects armed with handguns’. (4647 his. 1646 hrs. | 1652 hrs. Dispatch: Aviation dispatched. MDPD Dispatch: Update on B.O.L.0: “Advised 29 | MDPD (carjacking) at 1267 Mariana Avenue, advised the subject dumped the U-Haul and are now in a UPS. truck”. Dispatch: Advised “it is now a 53 (kidnapping)’. | MDPD “Confirmed they believe the UPS driver is still in the truck. UPS is attempting to track the UPS truck at the moment”. 1703 hrs. Dispatch: “UPS advised they are getting a ping | MDPD from out of their truck” (State Road 836, east of 72nd Avenue). 1723 brs. “Attention all units, do not approach the vehicle. | MDPD Again, attention all units, do not approach the vehicle, the subject has shot at units multiple times’. Eastbound on Pines Boulevard towards | Flamingo Road at this time. Somebody shot out from the door, “UPS driver is shooting out the door’ (I-75 and Pines Boulevard exit) 1722 hrs. | PRT-84 _| Advised that his vehicle was shot (I-75 and Pines Boulevard exit). 1723 hrs. | Air-24 | Eastbound on Pines Boulevard approaching 136" Avenue. 1724 hrs. | Air-24 | “Southbound on 136” Avenue. Entering Century Village”. | 1726 hrs.__| Ai-24 | “We are westbound on Pembroke Road from Flamingo west’ | 1728 hrs. | Air-24 | “Southbound on 145" Avenue’. 1730 hrs. | Air-24 | “Westbound on Miramar Parkway from 145" Avenue". | 1730 hrs. | Air-24 “U-turn, we are coming up to 145" Avenue, eastbound on Miramar Parkway”. We are about a mile east of Flamingo”. “Traffic is being held 1735 hrs. | Ai-24 | “He is boxed now. He is boxed in with all the traffic. Definitely no way out now, not for him there. Have Pines and Miramar not let any traffic through on the intersection on Flamingo. Any units here go to the intersection and stop all the traffic there. Shots fired, shots fired, shots fired. Note: Broward County Air Rescue 85 (AR-85) Miramar Fire Rescue 84 (MFR-84) Miramar Fire Rescue 19 (MFR-19) Miramar Fire Rescue 100 (MFR-100) Frank Brances Ordonez, Richard Cutshaw, and Ronnie Hill were treated and pronounced deceased at the scene, Lamar Alexander was transported to East Memorial Hospital by AR-85. During this incident a total of five (5) CAD reports were received and reviewed. Four (4) CAD reports were from MDPD as follows: PD191205-846549, PD191205-846560, PD191205-846671, PD191205-846778, and one (1) CAD report from City of Doral Police Department, DR191205-051324. Only relevant events we summarized from each of the CADs. Please refer to IR #114 for complete details, [Hospital Response (R43) | On Thursday, December 5, 2019, at approximately 2000 hrs., FDLE SA Nathaniel Harris responded to EMH. At the hospital, a Rapid Mobile Identification Fingerprint Scanner (RAPID-ID) was administered to the unidentified black male victim transported from the officer involved shooting crime scene. The RAPID-ID identified the black male victim as, Lamar Alexander. Alexander was pronounced deceased at the hospital by Doctor Rafael Sanchez at approximately 1834 hrs. Next of Kin Notification (IR#4) The initial next of kin notification for Frank Ordonez, Richard Cutshaw, Lamar Alexander and Ronnie Hill were handled by the Federal Bureau of Investigation (FBI). On Thursday, December 12, 2019, FDLE Special Agent in Charge (SAC} Troy Walker, Assistant Special Agent in Charge (ASAC) Christopher Woehr, Regional Legal ‘Advisor (RLA) Jackie Boswell and SA Alex Villanueva met with Frank Ordonez’ next of kin, and on Tuesday, December 17, 2019, the same listed FDLE members met with Richard Cutshaw's next of kin. SAC Walker also met with Hill's and Alexander's family members Grime Scene Activities (#5) | ‘On Thursday, December 5, 2019, at approximately 1830 hrs., FDLE SA Lisa Lamey was assigned to work the crime scene along with the FBI. SA Lamey met with FBI Supervisory Special Agent (SSA) Heather Koch. Numerous evidentiary items were collected from the crime scene and submitted to the FBI Crime Lab in ‘Quantico, Virginia for comparison analysis. A synopsis of the evidentiary items collected is listed below. ‘Shooting Scene: The crime scene was located in the eastbound and westbound lanes of Miramar Parkway, on the east side of Flamingo Road, and in the northbound and southbound lanes of Flamingo Road, on the north side of Miramar Parkway. The roadway was cordoned off with yellow crime scene tape on both the east side and the west side of the scene on Miramar Parkway, and on both the north side and the south side of the scene on Flamingo Road. Page 7 of 66 SA Lamey observed a large number of spent bullet casings in both the eastbound and westbound lanes of Miramar Parkway adjacent to the UPS truck. Some of the spent casings appeared to be rifle rounds and others appeared to be handgun rounds. Firearms on Scene: Two (2) firearms were recovered from the scene. Both firearms were confirmed by a Firearms Trace Summary from the Federal Bureau of Alcohol, Tobacco and Firearms (ATF) as not reported stolen. The firearms were described as follows: + Kimber 9mm caliber, model Pro Aegis II, serial number KRF6424 + Glock .40 caliber, model 22, serial number KDN145 Impounded Vehicles: The below listed vehicles were impounded by the FBI and secured at the FBI Building located at 2030 SW 145th ‘Avenue, Miramar, FL, 33027. On Wednesday, May 27, 2020, the listed impounded vehicles were transferred to the Miami Regional Operations Center (MROC) secured evidence storage warehouse (please refer to IR #339 ‘or specifics). + Mercury Grand Marquis, 2009 sedan, Florida license plate Y67PAY: Registered to Richard Steven Cutshaw, 18336 NW 6" Street, Pembroke Pines, FL 33029, The front end of the vehicle was protruding into the southbound lanes of Flamingo Road and was positioned against the front end of a black Toyota (later identified as Hernan Mirabal-Basto's, 2018, Toyota Camry, bearing Florida license plate# CHBY80) which was located in the southbound lanes of Flamingo Road facing south (please refer to IR #40 for detalls). A deceased white male, later identified as Richard Steven Cutshaw, was sitting in the driver's ‘seat of the vehicle with what appeared to be a gunshot wound located on the rear of Cutshaw's head. * UPS delivery truck, Florida license plate GBV575: Registered to United Parcel Service, 1335 Northmeadow Parkway, Suite 119, Roswell, GA 30076-9923, The truck was facing west in the inside westbound lane of Miramar Parkway, east of Flamingo Road + U-Haul van, Arizona tag AJ63505: Registered to U-Haul Company of Arizona, 2727 N. Central Avenue, Phoenix, AZ 85004. Note: The U-Haul van was left abandoned and it was impounded west of 1261 Mariana Avenue, Coral Gables, Florida. Page 8 of 66 Diagram: Page 9 of 66 Officer Processing ae (IR #6, 7, 8 & 70) On Thursday, December 5, 2019, at approximately 1930 hrs., FDLE SA Michael Stein, along with MPD Crime Scene Technician (CST) Supervisor Michael Kelly and CST Liza Cruz, coordinated the processing and round count as follows: Ofc. Garcia was wearing a PPPD uniform with PPPD patches on the sleeves of the shirt. There was a police badge affixed to the upper left chest area of the PPPD shirt and a name tag with G. Garcia affixed to the right side of the shirt above the right shirt pocket. Ofc. Garcia was wearing a duty belt with a handgun located on the right side and two (2) spare pistol magazines in a holder on the left side. The duty belt also contained handcuffs, gloves, police radio with external microphone and an expandable baton. The duty belt also held a "Taser" in a holster located on the left side of the belt Weapon Discharged: Personally-owned, Bushmaster, Model XM15-E2S, 223 - 5.56 caliber rifle serial# L445293, equipped with a Streamlight, TLR-1, tactical light, and a tactical sling. Round Count: © Chamber was empty * 0 rounds in the inserted (30 round capacity) magazine + Could have fired up to 30 rounds Ofc. Jerome Bowerbank - MP! Ofc. Bowerbank was wearing a MPD police uniform with MPD patches on the sleeves of the shirt, a MPD uniform tactical vest with a police badge sewed to the upper left side. A name tag with J. Bowerbank, was affixed to the right upper side of the uniform tactical vest, above the right pocket. The uniform tactical vest had POLICE visible on the front and back and was equipped with the listed police equipment on the front portion of the vest: handcuffs, first aid kit, "Taser", two (2) spare pistol magazines, one (1) spare rifle magazine and body worn camera. There was a cell phone located within the right upper pocket of the uniform tactical vest and an external microphone was attached to a police radio which was within a holder on the duty belt. He was wearing a duty belt with @ handgun located on the right side, an expandable baton, flashlight and police radio which had a microphone affixed to the front of his tactical vest. Ofc. Bowerbank was also wearing a ballistic helmet equipped with @ communication set. Weapon Discharged: Department issued Daniel Defense, Model M4SF Carbine, Cal Multi, serialt DD002750C. The rifle was equipped with a sling, suppressor, Streamlight tactical light and Sig Romeo Optics. Round Cou * Chamber was loaded ‘+ 24llve rounds in the inserted (30 round capacity) magazine * Could have fired up to § rounds ‘Sat. Peter Bermudez - MPI ‘Sgt. Bermudez was wearing a MPD uniform with patches on the sleeves of the shirt and sergeant chevrons ‘sewed onto the sleeves just below the MPD patches. There was a police badge affixed to the uniform shirt above the left pocket, a name tag above the right pocket of the uniform shirt with the name of P. Bermudez. There was also an MPD issued body wom camera affixed to the front of Sgt. Bermudez’ uniform shirt. He was wearing a Page 10 of 66 duty belt which had a firearm in a holster located on the right side. The duty belt contained three (3) spare pistol magazines within a magazine holder on the left side, police radio, handcuffs, "Taser" and nunchucks in @ holder. Frank Delaaudio - MPD: Ofc. Delgaudio was wearing a MPD police uniform with MPD patches on the sleeves of the shirt, MPD uniform tactical vest with a police badge sewed to the upper lef side and a name tag with F. Delgaudio affixed to the right upper side of the uniform tactical vest, above the right pocket. The uniform tactical vest had POLICE visible ‘on the front and back and was equipped with the listed police equipment on the front portion of the vest: frst aid kit, "Taser" and spare "Taser" cartridge, two (2) spare pistol magazines, one (1) spare rifle Pmag and body worn camera. There was a cell phone located within the right upper pocket of the uniform tactical vest and an external microphone was attached to a police radio which was within a holder on the duty belt. He was wearing a duty belt with a handgun located on the right side. The duty bell also contained a flashlight, pepper spray, expandable baton and police radio which had a microphone affixed to the front of his tactical vest. Weapon Discharged: Department-issued, Glock, Model 34, 2mm semi-automatic pistol, serial## BKCK829, which was equipped with a Streamlight, TLR-1 tactical light. Alonso was wearing a FHP uniform with patches on the sleeves of the shirt. There was a police badge affixed to a uniform tactical vest above the left pocket and a name tag above the right pocket of the uniform tactical vest with the name of Alonso. He was wearing a duty belt which had a firearm in a holster located on the right side. The duty belt contained two (2) spare pistol magazines within a magazine holder on the left side, police radio, handcuffs, pepper spray and a “Taser” Weapon Discharged: Department-issued, Glock, Model 37, .45 caliber, semi-automatic pistol, seriali# PTZ588, which was equipped with a X300, Surefire tactical light Round Count: Chamber was loaded 8 live rounds in the inserted (10 round capacity) magazine Tops off magazine Could have fired up to 2 rounds Page 11 of 66 ‘Sgt. Machado was wearing silver cargo-type pants, blue shirt and a silver sweater. There was a police badge affixed to a black tactical belt on Sgt. Machado's right side and a firearm in a holster located on her left side. Weapon Discharged: Department-issued, Glock, Model 17, 9mm semi-automatic pistol, serial## REF278. Round Count: * Chamber was loaded + 15 live rounds in the inserted (17 round capacity) magazine + Tops off magazine * Could have fired up to 2 rounds Ofc. Jose Mateo - MDPD; Ofc. Mateo was wearing a MDPD police "Priority Response Team" (PRT) uniform with MDPD patches on the sleeves of the shirt and a MDPD uniform tactical vest. The uniform tactical vest had “POLICE - Priority Response Team" visible on the front and back and was equipped with the listed police equipment on the front portion of the vest: tourniquet, police radio, two (2) spare pistol magazines, one (1) spare rifle Pmag with a capacity to carry thirty (30) live cartridges of ammunition and a body worn camera holder. There was also a cell phone located within an upper pocket of the uniform tactical vest. He was weering a duty belt with a handgun located on the right side. The duty belt also contained handcuffs, three (3) spare pistol magazines, flashlight, tourniquet, multi tool and an empty radio holder. Weapon Discharged: Department-issued, Glock, Model 17, 9mm semi-automatic pistol, serial## REF410. Both rear doors on UPS truck were open. Multiple marked and unmarked units were pursuing the UPS truck. A MDPD vehicle pulled into intersection. PPPD marked SUVs turned westbound on Pines Boulevard, from Southwest 136" Avenue (IR# 325, 295 & 23) Notes - A person dressed as a United States Postal Service (USPS) employee (later identified as Ronnie Hill, who had a white mask on and was wearing USPS. uniform) was observed out by the front door. Hill was buzzed in by Rafael Almuyna (employee) at Regent Jewelry. Hill then pulled out a black handgun that was concealed in an envelope he had been carrying underneath a package. Hill then pointed the handgun al Almuyna and fired one shot at Aimuyna’s feet. Hill then ordered Almuyna to the back room where Erik Diamond (owner of store) and Liliana Sardi (employee) were located. Hill then ordered everyone to the ground. Almuyna noticed that when Sardi got down onto the ground, she was bleeding from her forehead. Hill demanded for Almuyna to put all the jewelry and cash into a silver drawstring, laundry-type bag that Hill had placed on the top of, the display case. Almuyna complied and had the opportunity to hit the silent alarm button without Hill noticing. Hill then grabbed the gray bag and screamed "stay on the floor’, as he exited the store out the rear door leading to an alleyway. Once Hill was out of the store, Diamond and Almuyna retrieved their respective firearms from a desk located inside of the store and followed out the door after Hill, Diamond was observed shooting multiple times by the rear door of the Regent Jewelers. The U-Haul van, Hill nor Lamar Alexander were captured in the camera view. Note: There were a total of five (5) surveillance cameras with audio and different angles inside the Regent Jewelers store. Please see IR# 325 for specifics. The UPS truck was parked in front of 1261 Mariana Avenue, facing west, towards Madrid Street. The U-Haul van entered the camera view and drove past the UPS truck traveling westbound. A few minutes later, Alexander entered the camera view. He was wearing dark pants, a gray long-sleeved shirtsweatshirt, and black shoes. He walked past the UPS truck on the driver's side. Alexander appeared to stop at the back of the UPS truck and have a conversation with Ordonez. Alexander then walked back westbound and came into full camera view while walking on the sidewalk, directly in front of 126 Mariana Avenue. At that time, his whole body was visible, to include his face. Ordonez walked towards 1261 Mariana Avenue with @ box deliver, Alexander walked back towards the UPS truck and Ordonez was seen entering the UPS truck from the passenger side. A male is overheard shouting in Spanish what sounded as “tiroteo, tiroteo”, meaning in English, gunshots, gunshots. The video panned to the left and captured an older male, salt and pepper hair, wearing glasses, a gray long- sleeve t-shirt, and blue jeans (later identified as civilian Ricardo Nunez). The male was kneeling on the road's median. A MDPD officer (later identified as Ofc. |_Yariel Mata) grabbed Nunez and pulled him to safety. The video was recorded from inside his vehisle.
