COUNTER-AFFIDAVIT
I, SINTO L. SINTO, of legal age, Filipino, with office address at
Gulong Transport Terminal, No. 43 Brgy. Gulugod, Kawayan, Pampanga
and with assistance of a counsel, after having been duly sworn to in
accordance with law, do hereby depose and say:
01. That I am one of the Respondent in the above-titled case
pending before this Honorable Office;
02. That I vigorously deny the allegations and accusations of
complainant, Dado A. Quintano;
03. That the complainant has no cause of action and the filing
of this frivolous complaint had been purely motivated by ill-will
intended to harass me;
04. That the truth of the matter is that on August 2, 2017, at
about 03:30 o’clock in the afternoon, while I was then conducting a
Gulong Transport Bus unit bearing Body No. 6075 and Plate No. UTE-
578, a male person tries to flag down our bus along EDSA-Monumento
(in front of Araneta Square). My driver did not embark said male
person as the place is a NO LOADING ZONE, instead, he stopped at the
nearest designated bus stop in order to fetch passengers. The male
person, who is later identified as the complainant herein, ran after us
and boarded our bus.
05. That upon boarding, he told me in an annoyed manner the
following words: “MAGBABAYAD NAMAN AKO AH”, to which I responded
with an apology and explained that fetching of passenger in the said
area are prohibited;

06. That upon reaching the area of EDSA-Muñoz, Quezon City
(in front of Waltermart), the complainant signaled that he will alight
and called my attention to help him with his belongings, to which I find
weird due to the fact that his belongings are too light and small, but
nevertheless, as courtesy to our passengers, I willingly help;
07. That upon reaching the door of the bus, without going
down to the road pavement, I gave him his belonging but to my
surprise, he uttered the word: “PUTANG INA MO KA NGAYON”, then
threw a punch towards me which fortunately I dodged. Not satisfied,
he then grabbed may right foot and kept on dragging me down the
bus;
08. At that point, my driver comes to my aid. The complainant
let go my foot when he saw that my driver was already at my back.
09. That my driver and I went back inside our bus and close all
the doors. The complainant then goes in front of our bus and twice
threw an object which causes panic on our passengers and shattered
the windshield glass of our bus;
10. That my driver and I decided to ran after the complainant
so as to make him answerable for the damages he had made, but to no
avail as he ran toward the market place;
11. That to our surprise, he came back a few minutes later and
having in his possession, a bladed weapon which he used to ran after
us;
12. That each and all of the facts stated herein are true and
correct; and
13. That I am willing to testify before this Office or any Court of
Justice to substantiate the truth and veracity of each of the foregoing
facts.
