WRIT APPEAL No. 127 of 2024

JUDGMENT: (Per the Hon’ble the Chief Justice Alok Aradhe)

Mr. T. Vijay Hanuman Singh, learned counsel for the

appellant.

Mr. Aadesh Varma, learned Standing Counsel for Bar

Council of India appears for respondent No.1.

Mr. G.M. Mohiuddin, learned Standing Counsel for Bar

Council of Telangana appears for respondent No.2.

2. This intra court appeal has been filed against the order dated

05.12.2023 passed by the learned Single Judge by which

W.P.No.30938 of 2023 preferred by the appellant has been

dismissed.

3. In the aforesaid writ petition, the appellant has prayed for the

following relief:

“For the reasons stated in the accompanying affidavit the


petitioner herein prays that this Hon’ble Court may be pleased to

issue writ, order or direction more particularly one in the nature


of writ of Mandamus declaring the action of the 2nd respondent
(Oral rejection) in not allowing the enrolment to the Bar Council
of Telangana to the petitioner herein as illegal, arbitrary and
contravention to the provisions of Article 14, Article 19 (1) (g),
Article 21 of the Constitution of India and consequently pending
disposal of the Writ Petition direct the 2nd respondent to enroll
the petitioner as an advocate into Bar Council of Telangana on
the basis of affidavit to be furnished and pass such other order or
orders may deem fit and proper in the circumstances of the case.”

4. After arguing the matter to some extent, learned counsel for

the appellant submits that the appellant be granted liberty to submit

a detailed application to the Bar Council of Telangana for his

enrolment and the Bar Council of Telangana be directed to decide

the aforesaid application by a speaking order in a time bound

manner.

5. The aforesaid submission of the learned counsel for the

appellant has not been fairly opposed by the learned Standing

Counsel for the Bar Council of Telangana and it has been urged

that suitable decision in accordance with law shall be taken within

such time as this Court may deem fit.

6. In view of the aforesaid submissions and in the facts of the

case, the appellant is granted liberty to submit a detailed

application seeking his enrolment on the rolls of the Bar Council of

Telangana within a period of three days from the date of receipt of

a copy of this order. Thereupon, the Bar Council of Telangana

shall consider and decide the application submitted by the appellant

within a period of three weeks from the date of receipt of such an

application by a speaking order. It is made clear that this Court has

not expressed any opinion with regard to the eligibility of the

appellant for his enrolment as the aforesaid issue has to be

adjudicated by the Bar Council of Telangana.

7. With the aforesaid directions, the writ appeal is disposed of.

Miscellaneous petitions, pending if any, stand closed. There

shall be no order as to costs.
