Part 3: Prioritise 3 actions with justification for the selection
Suggested word counts
Moral and financial arguments for all actions: 300 to 350 words
For EACH action:
Specific legal arguments: 100 to 150 words
Likelihood AND severity: 75 to 150 words
How effective the action is likely to be in controlling the risk: 100 to 150 words

Moral and financial arguments for ALL actions

Moral, general legal and financial The Reliable construction main moral goal is to achieve complete safety of workers and zero
arguments incident/accident at site, so every time we take care about our workers safety & health. Every
workers working at site earn wages to look after their families. When health and safety is not
achieved appropriately any workers at site can get injured or sometimes death might also occur,
other than these some may suffer by severe disease that will huge impact not only on workers, but
also on their children’s, families, friends and co-workers. This suffering is ethically undesirable and
society as a whole demands that people are safe during work. So the company will be fully
responsible for safeguard the workers at site.
Financial impacts could be broken down into Direct cost and Indirect cost:
Direct costs: Compensation payable to the victim or his/her family in case of death, fines in the
criminal court, first-aid treatment, worker sick pay, repairs to or replacement of damaged equipment
of building, lost or damaged product, lost production time while dealing with the injury, overtime to
make up for lost time and costs associated with the recovery of the injured worker.
Indirect costs: Loss of staff morale, cost of remedial action following an investigation, cost of
recruiting and training temporary or replacement staff, loss of goodwill of customers, difficult in
recruiting and retaining staffs as an indirect result of the accident and damage to public image and
business reputation.
The company will face civil trial by the enforcement agencies, they will make the prohibition on
certain activities or they will give improvement notice meaning that the action will be improved on
given time or else face serious consequences. This will major business impact if the activities are
stopped. Other than this organisation will be fined or sued by the civil court for the civil claims made

by the ill health workers. There will be compensation paid to the worker by the company and courts
and lawyers’ fees will be also high.

Justification for action 1

Provide SCBA (Self-contained breathing apparatus) to the worker who is working in the confine
Action
space (hazard category- Working in Confined spaces)
Specific legal arguments As per the International labour organisation (ILO) C167 safety and health in construction
convention, 1988 in Article 30 it stated that Employer should provide appropriate PPEs ,PPEs
should be as per the standard provide to the Employee . As per the International labour
organisation (ILO) “Working in confine space” Reduced oxygen levels, risks from noxious fumes, or
a risk of fire while working in a confined space it’s very dangerous Other danger like flooding or
asphyxiation from other source .
Other dangers may include flooding/drowning or asphyxiation from some other source such as
dust, grain or other contaminant. Working in confine space required breathing apparatus or
ventilation if there is not enough oxygen. Make sure that person is enough train to work inside the
confine space.
The likelihood of the workers getting ill suddenly while working in confined spaces without a
Consideration of likelihood AND severity
breathing apparatus is very high. This is due to low oxygen levels in the confined space area. 2-3
workers will be involve in this activity for at least 1-2 hours.
The severity rating for this hazard is set at high. As the low oxygen levels will make unconscious
and there will be oxygen deficiency, breathlessness causing fatal accident. Immediate treatment will
be required for the ILL worker and worst case scenario will be death.
How effective the action is likely to be in
The SCBA will protect users against oxygen deficiency, dust, gases and vapours in confined
controlling the risk. This should include:

 justification for the timescale that you cost of accident. Breathing apparatus will reduce the risk who is working inside the confine space

equipments are inspected before use.

Justification for action 2

Action Setting up of MCBs at all the electrical supply boarding (hazard category ‘electricity’)

Specific legal arguments International labour organisation has convention C167 - Safety and Health in Construction Convention,
1988 in that it states in Article 26 that all electrical equipment and installations shall be constructed,
installed and maintained by a competent person, and so used as to guard against danger.
International labour organisation has discussed in their ELECTRICAL SAFETY that The risk
assessment should take into consideration the type of electrical equipment used, the way in which it
is used and the environment that it is used in and Employers must make sure that the electrical
installation and the electrical equipment is suitable for its intended use and the conditions in which it
is operated.

Consideration of likelihood AND severity The likelihood of accident from an electrical distribution board without MCB is very likely. Every day
3 technicians and 4 workers used the electrical equipments which is connected to the Power
distribution board. In case of current load, cables will be inflamed resulting in electrical fire.
The severity rating electrical accident is major. Electrical fire spreads very fast and causes severe
injuries like ventricular fibrillation, respiratory paralysis, muscular contraction, physical trauma,
cardiac arrest and even death. People can get killed or severely injured. Electrical equipment can
also get damaged from overloading of electrical circuits.

How effective the action is likely to be in

The installation of MCBs at all the electrical distribution boards will be very much effective to
controlling the risk. This should include:
prevent the current overload in the electrical circuits. MCBs will give protection to the circuit when
 the intended impact of the action; there is an overcurrent/overloading When current overload occurs, MCB trips and disconnects the
 justification for the timescale that you electric circuit. It can be reset further.
indicated in your risk assessment; I have given timescale of 1month is for this action because it is a specialised electrical devices. The
and Project manager will discuss with the finance manager about the installation of MCBs at site and
 whether you think the action will fully thus he will approve and get it installed by the electric technician.
control the risk.
This action will fully control the risk as MCBs are very much effective in breaking the circuit in case

of current overload

Justification for action 3

Action Provide guard like fixed guards, inter locked guards, and adjustable guards to all machines for
prevent a person protected from dangerous moving parts. (Hazard category- Work Equipment)
The international labour organisation (ILO) has convention C199- Guarding Machinery Convention
Specific legal arguments
1963 in that it had states in Article 6 that the use of machinery any dangerous part of which,
including the point of operation, is without appropriate guards shall be prohibited by national laws or
regulations or prevented by other equally effective measures: Provided that where this prohibition
cannot fully apply without preventing the use of the machinery it shall apply to the extent that the
use of the machinery permits and Machinery shall be so guarded as to ensure that national
regulations and standards of occupational safety and hygiene are not infringed.
International labour organisation has Recommendation R118 - Guarding of Machinery
Recommendation, 1963 has states in point no 12 that No worker should use any machinery without
the guards provided being in position, nor should any worker be required to use any machinery
without the guards provided being in position.
Consideration of likelihood AND severity The likelihood of injuries happening from operating machines were not covered the rotating parts is
very high. Because every day construction site starts with machinery equipment’s and most of
activities depends on it. And there is a regular work of equipment for at least 4-hrs daily.
The severity rating for this hazard will be very major. During steel cutting with grinder or chop saw
machine grinder wheel might be break and cause major cut injuries which will require hospital
treatment. Sometime operator or co-workers can chance to fatal, it depends on severity of injury.
While operator operate the machine without cover the rotating parts it may cause of body parts like
fingers, hands or other limbs will chance to trapped into the machine and get injury’s like deep cuts,
crushing and fractures.
How effective the action is likely to be in
Machine guarding will provide protection workers from injury as it provides defence to operators
controlling the risk. This should include:
