Other Facts:
 Reservation for SC/ST staff for allotment of quarter – 10%, where 50 or more Type I/II quarters are exists.
 Retention of quarter beyond two months, on transfer from one station to another station within same
railway is permissible with double rate of license fee.
 General Managers of Zonal Railways / Production Units may retain accommodation at the place of
previous posting for the entire tenure of their current posting, plus another two months thereafter on
payment of normal rent. On completion of tenure simultaneously with the retirement, the retention will
be permitted for maximum 8 months as per existing provisions i.e. normal rent for first four months and
double the normal rent for remaining four months.

Other Facts:
 The report of the complaints committee on sexual harassment on working women should be treated as
misconduct against the accused railway servants.
 Quotation by a Railway servant in his representation to official superior to him from the notes on any file
to which he is not authorized to have access shall amount to misconduct.
 Group ‘C’ employee shall not accept a gift without the sanction of the government if the value exceeds Rs.
7500/- from near relatives
 Group ‘B’ Railway servant may take gift of worth not exceeding Rs. 15000/- from his near relatives.
 Group ‘A’ Officer can accept gift worth upto Rs. 25000/- from relatives on customary occasion.
 The Running staff should not take intoxicants eight hours before signing on.
 Frequent purchase or sale of shares, securities or other investments shall be deemed to be misconduct
within the meaning of Rule 16(1) of conduct rule.
 A Railway servant shall avoid accepting lavish hospitality from any individual, industrial or commercial
firms, organizations etc. having official dealings with him.
 A Railway servant may accept gifts, if the value of such gifts does not exceeds as follows (Rule 13-Gift):

Facts:
1. Suspension is not a penalty under D&A Rules,1968
2. Retired Railway servant of same railway cannot act as defense helper in more than seven (7) cases at a
time.
3. No appeal shall be entertained unless preferred within 45 days.
4. The period of 45 days for preferring an appeal is reckoned from the date of receipt of penalty order by CE.
5. No appeal lies against any order of an interlocutory nature or of the nature of step-in-aid of the final
disposal of disciplinary proceedings.
6. Rule 25A of the RS (D&A) Rules deal with Review. Only President of India has powers to take decision on
Review under this rule.
7. An authority not lower than appointing authority shall impose the penalties of dismissal/ removal/
compulsory retirement.
8. Disciplinary authority decides to conduct inquiry either by himself or by nominating inquiry officer or by
nominating Board of Inquiry.
9. If no presenting officer is appointed, Inquiry authority will perform the function of the presenting officer
in an inquiry.
10. The time limit for submission of written statement of defense by the delinquent railway servant is 10
days.
11. Rule No. 12 of RS (D&A) Rules, 1968 deals with communication of orders to Railway servant.
12. Schedule III of RS (D&A) Rules, 1968 deals with authority to impose penalties/suspension in respect of
Group ‘A’ & ‘B’.
13. Special provisions to Group ‘C’ and ‘D’ (Non-Gazeted) are contained in Rule 24 of RS (D&A) Rules, 1968.
14. A typical charge sheet for major penalty necessarily contains four annexure.
15. A trade union official can act as defense council in a DAR case.

17. Subsistence allowance is equal to leave salary, which the employee would have drawn had he been on

employee, the subsistence allowance may be increased by an amount not exceeding 50% of subsistence
allowance.
19. In case the suspension period is prolonged beyond three months for reason attributable to the
employee, the subsistence allowance may be decreased by an amount not exceeding 50% of subsistence
allowance.
20. No order imposing /enhancing a penalty shall be made by any revising authority unless the Railway
servant concerned has been given show cause notice against the penalty proposed. (A reasonable
opportunity to represent.
21. Every order or notice under RS (D&A) Rules,1968 shall be served in person on the Railway servant
concerned or communicated to him by Registered post with Acknowledgement due.
22. If DRM functions as Disciplinary /Appellate authority, PHOD/AGM shall be the appellate/revision
authority.
23. The Inquiring authority may refuse the request of the delinquent employee for documents, if they would
be against public interest or if they are not relevant to the case.
24. Charges framed against a delinquent employee should not be ambiguous. They should be specific and
definite to convey exact nature of the alleged misconduct.
25. If IO/PO authority is a legal practitioner, the defense assistant can also be a legal practitioner.
26. The ten days time allowed for submission of the written statement may be extended by the D.A.
authority, if he satisfies that there is enough justification to do so.
27. A Railway servant under suspension can be given One sets of privilege passes in a calendar year at the
discretion of the authority not lower than DRM/Dy.HOD.
28. The authority competent to reduce or increase the subsistence allowance after a period of three months
of suspension is the authority who placed the employee under suspension.
29. No appeal shall lie against any order passed by an Inquiry Officer in the course of an Inquiry under Rule 9
of RS (D&A) Rules, 1968.
30. Railway Servants (D&A) Rules, 1968 is not applicable to Casual labour, RPF, any member of the All India
Services.
31. If an employee is placed under suspension on the date of retirement, then who is competent authority to
sign the charge sheet? – Disciplinary Authority.
32. If more than 6 months has passed since imposition of punishment, who is empowered to undertake Suo-
Moto revision of the same? – Above the Appellate Authority (General Manager/Railway Board/President)

INDUSTRIAL RELATION CODE-2020
 Industrial Relation Code : In this code, following Acts/ Rules are amalgamated:

 Person employed in a supervisory capacity and earning less than Rs. 18,000/- per month is classified as
‘Worker’ under IR Code’2020.

Other Facts:
 NPS : National Pension System (The pension scheme is notified on 22.12.2003 and w.e.f 01.01.2004).
