MAYOR OF SAN VICENTE TO APPLY FOR GRATUITOUS SPECIAL USE
PERMIT (GSUP) FOR ALL MUNICIPAL PROJECTS LOCATED IN FOREST
LANDS”

WHEREAS, majority of the land areas of Municipality of San Vicente are classified as
forestland or timberland;
WHEREAS, in the exigency of delivery of better government services and public

infrastructures the utilization of timberland areas is inevitable for the progressive development;
WHEREAS, the Department of Environment and Natural Resources (DENR) released an

Administrative Order No. 2022-01, Guidelines in granting government agencies gratuitous
permits for the special uses of forest lands;
WHEREAS, the objective of this guidelines is to ensure that government agencies

partaking in the development of government-managed projects of national interest and
infrastructures for public use within forest lands are appropriately granted with a permit which
is gratuitous in concept and in conformity to government plans and standards;
WHEREAS, the Local Chief Executive at the Municipal, City of Provincial level is qualified
applicant of GSUP upon authorization by the local legislative body;
WHEREAS, Chapter III, Section 444 of the Local Government Code of the Philippines - RA
7160, the Municipal Mayor, upon authorization by the Sangguniang Bayan, represent the

municipality in all its business transactions and sign on its behalf all bonds, contracts, and
obligations, and such other documents made pursuant to law or ordinance ;
WHEREAS, Local Government Code of the Philippines - RA 7160 CHAPTER II, SECTION 16
of General Welfare - Every local government unit shall exercise the powers expressly granted,
those necessarily implied there from, as well as powers necessary, appropriate, or incidental for
its efficient and effective governance, and those which are essential to the promotion of the
general welfare. Within their respective territorial jurisdictions, local government units shall
ensure and support, among other things, the preservation and enrichment of culture, promote
health and safety, enhance the right of the people to a balanced ecology, encourage and
support the development of appropriate and self-reliant scientific and technological
capabilities, improve public morals, enhance economic prosperity and social justice, promote
full employment among their residents, maintain peace and order, and preserve the comfort
and convenience of their inhabitants;
NOW, THEREFORE, in motion duly seconded, be it;
RESOLVED, AS THIS BODY HEREBY RESOLVED, to authorize the Municipal Mayor, Hon.
Amy Roa Alvarez to apply to gratuitous special use permit from DENR for all the municipal
projects located in forestlands or timberlands;
RESOLVED, FURTHER, that within a year from the approval of GSUP the MLGU shall
apply for the issuance of Presidential Proclamation to ensure effective management and
sustainability of the projects and its long-term use of the area where the infrastructures and
facilities are located. In case of failure, the MLGU shall apply for FLAG pursuant to DENR
Administrative Order No. 2004-59;
RESOLVED, FINALLY, that copies of this Resolution be forwarded to all concerned

agencies for their perusal, consideration, and appropriate action.
