JUDGEMENT WRITING COMPETITION- PROPOSITION

1. Seventy years after gaining independence, the Republic of Maria has

shown a remarkable desire to embrace further industrial development and
an unwavering goal of trillion-dollar economic growth. It has profited from
a number of scientific developments that it has incorporated over time
and factor. Globalisation has always been a major factor in the emergence
of newer technologies and industrial developments, but it has also been
important for Maria to demonstrate its power in a modern setting.

2. Advancements in Industrial development have demonstrated the ability

to transform the Republic of Maria. Located among the sprawling
manufacturing facilities and distribution centres of “Metropolis”, a
bustling industrial city, the “MegaChem” Corporation is a towering symbol
of industrial expertise. MegaChem has long been an essential component
of the city's economy, supporting thousands of jobs and making a sizable
contribution to the industrial output of the surrounding area. But on
12.12.2023 fateful day, plumes of toxic gas escaped across the city
landscape from the focal point of the MegaChem plant, announcing a
disastrous event that would persist throughout the surrounding area and
beyond.

3. The incident sent shockwaves through Metropolis, causing confusion,

chaos, and creeps. It was later determined that the incident was caused by
a massive leak of Muelo gas. One of the storage tanks had leaked Muelo, a
highly toxic and corrosive material used in many industrial processes, as a
result of a catastrophic breakdown in the plant's safety systems. Residents
panicked as they rushed to shield themselves and their loved ones from
the invisible threat as the gas escaped into the atmosphere and a strong
smell filled the air.

4. The Muelo gas leak had immediate and catastrophic consequences. In a

matter of minutes, reports from all over the city started coming in about
people having nausea, burning feelings in their throats and eyes, and
trouble breathing. Calls for assistance to emergency services increased
dramatically as hospitals and clinics prepared for a surge of patients with
chemical burns and respiratory distress.

5. The streets of the city, which had previously been alive with activity,
became eerily quiet as people fled inside out of fear for unknown threats
that might be present. As the immediate crisis developed, focus shifted to
the gas leak's effects on the environment. Even as an epicentre of
business and industry, Metropolis was not immune to the attraction of the
natural world. Once filled with life, the city's river lay silent and still, its
waters polluted by the poisonous remains of the Muelo gas. Birds that had
danced in the sky now lay grounded, their wings coated in a deadly film,
and fish floated lifelessly to the surface, their scales shimmering with an
oily sheen.

6
6. In the wake of the catastrophe, speculation about how such a disastrous
event could have happened in the first place started to grow, were negligent
handling practices concerning hazardous substances was exhibited by the
corporation where regulatory authorities demonstrate shortcomings in fulfilling
their duty to ensure public safety and welfare? Ultimately, who will bear
responsibility of the devastation inflicted upon Metropolis and its inhabitants?
Amidst the fervent public outcry subsequent to the gas leakage incident in
Metropolis, MegaChem Corporation, the focal entity amidst the crisis, has
initiated a sequence of endeavours aimed at rectifying the situation and
ameliorating the resultant harm.

7. The Corporation with the concerned authorities were cooperating to ascertain

the root cause of the gas leak, alongside immediate clean-up measures were
underway, with specialized teams deployed for containment and neutralization
of hazardous substances. Additionally, significant resources for compensating
victims, providing financial aid for medical treatment, relocation, and livelihood
restoration were allocated by MegaChem. Preliminary investigations into the
leak have revealed that MegaChem Corporation was strictly adhering to industry
regulations, norms, and guidelines, implementing robust precautionary
measures in line with relevant laws and acts.

8. Residents of Metropolis demanded answers, justice, and most importantly,

ensures that a tragedy like this would never be allowed to occur again as
investigations progressed and the full extent of the damage became clear. In the
wake of the devastating Muelo gas leak in Metropolis, a Public Interest Litigation
(PIL) has been swiftly filed in the Supreme Court of India by “Teach Peace”, an
NGO on behalf of the affected residents and environmental advocacy groups.

9. The PIL alleges grave violations of fundamental rights envisaged under the
Constitution of India. The assertion posits that the purported lack of due
diligence by MegaChem Corporation in managing perilous materials has
resulted in extensive societal detriment and anguish, thereby justifying prompt
judicial interposition. Additionally, the PIL endeavours to procure sufficient
recompense for the gas leak victims, underscoring the imperative requirement
for expeditious redressal and reintegration strategies to mitigate their
multifaceted physical, psychological, and socioeconomic encumbrances. As the
highest court of the land, the Supreme Court is now tasked with adjudicating
this pivotal case, balancing the interests of industrial development with the
imperatives of environmental protection and social justice.

The case is now before the Supreme Court of Republic of Maria for final hearing.

The Laws of Republic of Maria are in parametria with the Laws of India.
The respective Counsels are required to prepare minimum of three
issues.

This Proposition is drafted by Mr. S Kathiravan, Assistant Professor.

The teams are asked not to contact the drafter of proposition by any
means failing which the teams are liable to be disqualified.
