JUDGEMENT WRITING COMPETITION- PROPOSITION
5. The streets of the city, which had previously been alive with activity,
became eerily quiet as people fled inside out of fear for unknown threats
that might be present. As the immediate crisis developed, focus shifted to
the gas leak's effects on the environment. Even as an epicentre of
business and industry, Metropolis was not immune to the attraction of the
natural world. Once filled with life, the city's river lay silent and still, its
waters polluted by the poisonous remains of the Muelo gas. Birds that had
danced in the sky now lay grounded, their wings coated in a deadly film,
and fish floated lifelessly to the surface, their scales shimmering with an
oily sheen.

6. In the wake of the catastrophe, speculation about how such a disastrous
event could have happened in the first place started to grow, were negligent
handling practices concerning hazardous substances was exhibited by the
corporation where regulatory authorities demonstrate shortcomings in fulfilling
their duty to ensure public safety and welfare? Ultimately, who will bear
responsibility of the devastation inflicted upon Metropolis and its inhabitants?
Amidst the fervent public outcry subsequent to the gas leakage incident in
Metropolis, MegaChem Corporation, the focal entity amidst the crisis, has
initiated a sequence of endeavours aimed at rectifying the situation and
ameliorating the resultant harm.
9. The PIL alleges grave violations of fundamental rights envisaged under the
Constitution of India. The assertion posits that the purported lack of due
diligence by MegaChem Corporation in managing perilous materials has
resulted in extensive societal detriment and anguish, thereby justifying prompt
judicial interposition. Additionally, the PIL endeavours to procure sufficient
recompense for the gas leak victims, underscoring the imperative requirement
for expeditious redressal and reintegration strategies to mitigate their
multifaceted physical, psychological, and socioeconomic encumbrances. As the
highest court of the land, the Supreme Court is now tasked with adjudicating
this pivotal case, balancing the interests of industrial development with the
imperatives of environmental protection and social justice.
The case is now before the Supreme Court of Republic of Maria for final hearing.
The Laws of Republic of Maria are in parametria with the Laws of India.
The respective Counsels are required to prepare minimum of three
issues.
