I. SUBJECT: MARO INVESTIGATION REPORT PERTAINING THE SEGREGATION OF


TIMBERLAND AND ALIENABLE AND DISPOSABLE AS PER CERTIFICATION OF
PROJECTION PROVIDED BY THE DEPARTMENT OF ENVIRONMENT AND NATURAL
RESOURCE (DENR) BUT THE ACTUAL USE IS AGRICULTURAL EMBRACED BY THE
CCLOA #00165542 WITH OCT NO. P-5280 ISSUED TO CATALINA P. INTOY, ET.AL., LOT
NO./SURVEY NO. GSS-12-000370 WITH A TOTAL AGGREGATE AREA OF 15,139,326
SQUARE METERS, MORE OR LESS LOCATED IN BARANGAYS’ PALO19, DANLAG,
PULABATO, LIBERTY, BUTO, TAMPAKAN, SOUTH COTABATO.

III. BACKGROUND OF THE LANDHOLDING:


The Original Certificate of Title No. P-5280, CCLOA#/Serial No. 00165542, Lot/Survey No. Gss-
12-000370, with a size of 15,139,326 square meters, more or less, situated in Barangays Palo19, Danlag,
Pulabato, Liberty and Buto of the Municipality of Tampakan, Province of South Cotabato is one among the
areas subjected by the Presidential Proclamation No. 2282, series of 1983 re: Reclassifying Certain
Portions of the Public Domain as Agricultural Land and Declaring the same Alienable and Disposable for
Agricultural and Resettlement Purposes of the Kilusang Kabuhayan at Kaunlaran Land Resource
Management Program of the Kilusang Kabuhayan at Kaunlaran of the Ministry of Human Settlements.

By virtue of PD2282 as KKK or government-owned land (GOL), OCT No. P-5280 came into light,
entered on 31st of July 2007 with the records of the Registry of Deeds pursuant to Section 24 of Republic
Act No. 6657.
Where nature of the title is collective, GOL/KKK lands has been subjected to field validation
through the SPLIT Project (Support to Parcelization for Land Individual Titling) to determine the scope:

A. As to the use:
a. Timberland but agriculturally cultivated,
b. Remained timberland in nature;
c. Protected area;
d. Unproductive land;

B. As to ARB/occupants:
a. if the identified ARBs in the Title still exists and actually tilling their awarded land;
b. Whether there are yet to be identified actual tillers (either buyers or actual tillers but
undocumented;
c. ARBs who abandoned their areas and/or sold their rights over the land by virtue of
sale;
d. Deceased;

IV. FACTS ON THE ACTUAL FIELD VALIDATION:


The Field Validation Team particularly the FVT-Team10 covering the areas of Brgy. Pulabato and
Brgy. Liberty with a total aggregate area of 501.2596 (as targeted) under OCT- P-5280 conducted a
series of activities. 474.9262 has. is used for agricultural, the balance 26.3334 has. is consumed by
creeks, ridges, free patent and homestead patent. The FVT’s first take off was the courtesy call with the
barangay officials and staff to make awareness/understanding of the validation to be undertaken, the
tedious process and the purpose of the validation. In so doing, any form of assistance from the barangay
officials, staff and BARC may be welcomed by the FVT in the process. It was followed with the posting of
notices (“Notice of Pulong2x”) with the list of ARBs posted at Barangay Halls and other conspicuous
places in the community. As soon as the notices and schedule of pulong-pulong are ascertained; the
following schedule were undertaken to wit;
1. October 16, 2023 at DURANTA, Pulabato
2. October 18, 2023 at ARBs Residence, Pulabato
3. October 20, 2023 at ARBs Residence, Pulabato

In each pulong-pulong, the attendees/participants were oriented what this validation is all about,
FVT Team thoroughly discussed the objectives of SPLIT, the process that will be undertaken and what
are expected from the stakeholders/participants. Aside from cooperation and participation, the
stakeholders must provide pertinent documents or requirements (e.g. IDs, conveyance, proof of
ownership and tillage); and finally, the validation team explained the benefits of the Support to
Parcelization of Lands for Individual Titling (SPLIT) Project, in which they signified interest and
participation to the program.
V. FINDINGS:
During the validation and conduct of series of consultation meeting (Pulong - pulong), including
initial investigations, CLUSTER 5 finds scenarios such as actual occupants/tillers of the area were found
but were not identified as ARBs in the COLLECTIVE CERTIFICATE OF LAND OWNERSHIP AWARD
(CCLOA) NO. 00165542, OCT -5280, the fact that they are landless. In this cluster the following are
actual tillers:
1. CHRISTOPHER CAGAS
2. RAMIL TRUYA
3. DIONESIO ORONGAN
4. JEMRIEL GARCIA
5. CELSO DOC

Delving more inquiries, the team have also learned that their possession and cultivation continued
uninterrupted and undisturbed for more than two years. Neither of the identified ARBs in the subject
landholding nor members of the locality where the lands are situated questioned nor disturbed their
concept of ownership over the lands they are actually tilling with.
On further investigation, FVT has discovered that there are ARBs who neglected/abandoned their
respective areas of cultivation, for a long period time, with no apparent reason at all. In this cluster, the
following are the ARBs who wilfully abandoned their areas;

To date, those ARBs have not initiated any action to claim repossession thereof which shows
their non-interest in owning the subject land.
Finally, concerns about erroneous entry of names in the CCLOA were likewise raised by the
concerned ARBs. Upon careful referencing of the documents presented to us, we have learned that there
was indeed an inaccurate designation of names in the title. Hence the following ARBs with incorrect
names, are as follows;
Erroneous entry of NAMES in the Title. Correct Entry of NAMES should have
been entered in the Title.

VI. RECOMMENDATIONS:

In view of the above, the following are our recommendations.

A. Landless farmers CHRISTOPHER CAGAS, RAMIL TRUYA, DIONESIO ORONGAN, SR, CELSO
DOC and JEMRIEL GARCIA should be recognized and identified as potential Farmer Beneficiaries
by the Department of Agrarian Reform, being the actual tillers, who possess all the qualifications and
none of the disqualifications as provided by the law, and they are willing to comply and fulfill the
requirements of the government and obligations appurtenant thereto to be an Agrarian Reform
Beneficiaries.

B. ARBs ROMULO S. MATEO, SR, MONALIZA C. ENOPIA, and ALEX CASING should be
disqualified/ excluded as farmer-beneficiaries in view of their abandonment and transgression of the
requirements by the law making the awarded land cultivated and productive.

C. Those who have inaccurate designation of names in the CCLOA should be rectified or corrected
by changing therein the names, to reflect their true and legal names.

It is submitted that petitions for Qualifications and Disqualifications and Petition for Correction of
Names shall be filed before the courts of proper jurisdiction, respectively.
