AFFIDAVIT OF LOSS

We, Francisco O. and Aurora B. Tongco, both of legal age, Filipino, married, and a
residents of Coast Pacific St., Mahiga Creek, Kasambagan, Banilad Cebu City, after having
been sworn in accordance with law, hereby deposes and states the following:

1. We are the purchaser / vendee of a parcel of land situated in the Barrio of Banilad,
City of Cebu, Island of Cebu containing an area of four hundred (400) square meters
identified as Lot 736-C-1 covered by the subdivision plan Psd-07-015083 and
particularly described in Transfer Certificate Title (TCT) No. 101463 of the Registry
of Deeds of Cebu City—as evidenced by the Deed of Absolute Sale of a Registered
Land which was executed in our favor by spouses Saturnino Ouano and Consorcia
Cortes which was thereupon acknowledged before Notary Public Priscilla S.
Lumapas and docketed in her Notarial Registry as “Doc. No. 396 (1396); Page No.
81; Book No. XX; and Series of 1988.” A copy of the said Deed of Absolute hereto
attached Annex “A” and the certified true copy of said register is attached herein as
Annex “B”;

2. Immediately after the Deed of Absolute Sale was executed, on February 22, 1988,
Saturnino Ouano delivered to us the possession of the subject parcel of land and
since then we have openly exercised and maintained all rights of ownership
thereon;

3. The original duplicate owner’s copy of Transfer Certificate of Title No. 101463 was
never turned over to us by the Saturnino Ouano nor did we ask for the same since
we did not know that such document was required in buying properties. We were
under the impression that the Seller would transfer the title in our name and and we
would be given the copy of owners duplicate once the application was done;

4. That around five (5) years ago, we heard that Saturnino Ouano passed away in 1996
and his wife Consorcia Cortes in 2012 yet the title to the property is still under their
names as shown in the certified true copy of the TCT No. 101463 from the Register
of Deeds of Cebu City is hereto attached as Annex “C”;

5. We then decided to demand from the remaining heirs of the Spouses to turn over
the duplicate owner’s title of the property to our custody so that we can process the
transfer on our own;

6. However, their daughter Anabelle Ouano Senerpida said that all the land titles under
their parent’s name were with his brother Jeffrey Ouano who has long been
estranged to the family so she does not know the whereabouts of her brother and
the land titles;

7. As prompted by us and the Ouano family, all diligent efforts were exerted over the
years to locate the brother and retrieve the title but was all in vain; hence for all
legal intents and purposes it is now deemed missing, lost, and beyond recovery;

8. Because we were unable to secure the owners duplicate to the said property, we
were not able to register the Deed of Absolute Sale nor process the transfer of
ownership over the Lot 736-C-1 to our names;

9. We are executing this Affidavit of Loss to support my application for reconstitution

of an owner’s duplicate copy of Transfer Certificate of Title No. 101463 as well as for
all lawful intents and purposes it may serve;

10. We attest to the truth of the foregoing statements to the best of my own personal
knowledge and based on authentic documents or records;

for Francisco Tongco and Voters Identification Number #226-0615A-A2415ABT2000-5
issued by Commission on Election for Aurora Tongco, personally signed the foregoing
instrument before me and vowed under penalty of law to the whole truth of the contents of
said instrument.
