INVITATION TO BID

PGB-2023-032- CONSTRUCTION/REHAB OF RURAL ROAD

The Local Government of Concepcion, Province of Iloilo, through the budget from the 5%
MDRRMF 2023, intends to apply the sum of Two Hundred Eighten Thousand Seventy
Five Pesos (₱218,075.00) being the Approved Budget for the Contract (ABC) to
payments under the contract for the PGB-2023-032 - CONSTRUCTION/REHAB OF
RURAL ROAD, Purok Rosas de Baybayon, Brgy. Poblacion, Concepcion, Iloilo Bids
received in excess of the ABC shall be automatically rejected during opening of bids.

The Local Government of Concepcion now invites bids for the said project. Delivery of
the Goods is required within Fifteen (15) calendar days from the receipt of Notice to
Proceed. Bidders should have completed, within Two (2) years from the date of
submission and receipt of bids, a contract similar to the Project. The description of an
eligible bidder is contained in the Bidding Documents, particularly, in Section II.
Instructions to Bidders.

Bidding is restricted to Filipino citizens/sole proprietorship, partnerships, or

organizations with at least sixty percent (60%) interest or outstanding capital stock
belonging to citizens of the Philippines, and to citizens or organizations of a country the
laws or regulations of which grant similar rights or privileges to Filipino citizens,
pursuant to RA 5183 and subject to Commonwealth Act 138.

Interested bidders may obtain further information from the Local Government Unit of
Concepcion, Iloilo and inspect the Bidding Documents at the address given below from
8:00A.M. to 5:00 P.M.

A complete set of Bidding Documents may be purchased by interested Bidders from the
address below and upon payment of a non-refundable fee for the Bidding Documents in
the amount of Five Hundred Pesos (₱500.00).

The Local Government Unit of Concepcion, Iloilo will hold a Pre-Bid Conference on July
21 , 2023, 10:00 AM at the Municipal Engineering Office,Municipal Building,
Poblacion, Concepcion, Iloilo, which shall be open only to all interested parties who have
purchased the Bidding Documents.

Bids must be delivered to the address below on or before June 27, 2023, 10:00 AM at
the Municipal Engineering Office,Municipal Building, Concepcion, Iloilo. All bids must
be accompanied by a bid security in any of the acceptable forms and in the amount stated
in ITB.
Bids will be opened in the presence of the bidder's representatives who choose to attend
at the address below. Late bids shall not be accepted.

2. Business Matters
The secretariat prepared the bidding room, the dropping box and other materials to be used before the
bidding started. The BAC Chairman, Members and Contractor/Representative signed in the attendance log
book. The contactor’s representative dropped their bids for contract PGB-2023-020- Construction Of Stone
Masonry Slope Protection With Drainage Canal, Polopiña National High School, Brgy. Polopiña,
Concepcion, Iloilo with an ABC of Two Hundred Fifty Two Thousand Five Hundred Fifty Five Pesos
(₱252,555.00). The dropping of bids was closed at 10:00 A.M.

3. Opening and Preliminary Examination of Bids

The BAC Chairman called the meeting to order at 10:12 A.M. and introduced the Bidders’ representatives,
BAC embers, and others present. The bidding documents were opened and examined thoroughly by the BAC
using non-discretionary “pass/fail” criterion as stated in the Eligibility Requirements.

THIS AGREEMENT made the 17th day of July, 2023 between LOCAL GOVERNMENT UNIT of
CONCEPCION, Province of Iloilo, Philippines (hereinafter called the “Entity”) of the one part and JFQ
JOEMARI MARKETING, Concepcion, Iloilo (hereinafter called “the Supplier” of the other part:

WHEREAS, the Entity invited Bids for certain goods and ancillary services, viz., PGB-2023-020-
Construction Of Stone Masonry Slope Protection With Drainage Canal, Polopiña National High
School, Brgy. Polopiña, Concepcion, Iloilo of the Local Government Unit of Concepcion and has
accepted a bid by the Supplier in the sum of Two Hundred Fifty One Thousand Nine Hundred
Seventy Pesos (₱251,970.00) (hereinafter called “the Contract Price”).

NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:

1. In this Agreement words and expressions shall have the same meanings as is respectively assigned
to the Conditions of Contract referred to.

2. The following document shall be deemed to form and be read and construed as part of this
Agreement, viz.:
(a) The Supplier’s Bid, including the Technical and Financial Proposals and all other
documents/statement submitted (e.g. bidder’s response to clarification on the bid), including
corrections to the bid resulting from the Procuring Entity’s bid evaluation;
(b) the Schedule of Requirements;
(c) the Technical Specifications;
(d) the General Conditions of Contract;
(e) the Special Conditions of Contract;
(f) the Performance Security; and
(g) the Entity’s Notification of Award.

3. In consideration of the payments to be made by the Entity to the Supplier as hereinafter mentioned,
the Supplier hereby covenants with the Entity to provide the goods and to remedy defects therein in
conformity in all respects with the provisions of the Contract.

4. The Entity hereby covenants to pay the Supplier in consideration of the provision of the goods and
the remedying of defects therein, the Contract Price or such other sum as may become payable under
the provisions of the contract at the time and in the manner prescribed by the contract.

IN WITNESS whereof the parties hereto have caused this Agreement to be executed in
accordance with the laws of the Republic of the Philippines on the day and year first above written.
