Lodgers Licence Agreement

SHARE HOUSE LICENCE AGREEMENT

THIS IS NOT A RESIDENTIAL TENANCY AGREEMENT.

YOU NEVER GAIN EXCLUSIVE USE OR QUIET POSSESSION OF THE PROPERTY.

THIS agreement is made on the 8th of December 2023 at 4 Corringle Grove, South Lake WA
6164.
BETWEEN:
ANGELIKA LIMMARJA of 4 Corringle Grove, South Lake WA 6164 (“the Owner”)
AND
BRUNO LOMBARDI of Repubblica Italiana (“the Licensee”)
The parties agree as follows:-
1. PREMISES
1.1. The Owner agrees to allow the Licensee to share their house at 4 Corringle Grove, South
Lake WA 6164 (“the Premises”) together with the microwave, fridge, vacuum cleaner,
kettle, oven, stove, washing machine, other kitchen equipment and furniture during the
periods set out below.
1. The Licensee’s room contains the following furnishings, that are clean and in a good state of
repair:
(a) Double bed mattress and frame; and
(b) Wardrobe.
2. The Licensee will be able to only access the following areas (“Shared Areas”):
(a) Bathroom;
(b) Toilet;
(c) Kitchen;
(d) Living Room;
(e) Dining; and
(f) Laundry Area.
2. PERIOD
1. This Agreement will commence on 20 FEBRUARY 2024.
2. The initial end date of this Agreement will be 20 MAY 2024. After the end date, the
agreement will be periodic and will end by either the Owner or the Licensee giving written
notice of termination to the other party. The notice may be given at any time. The Owner
must give at least 35 days' notice and the Licensee must give at least 21 days' notice.
3. Other grounds for ending the Agreement include sale of the Premises, breach of this

Agreement by the Licensee/Owner, where the agreement is frustrated (e.g. where the
Premises are destroyed or become uninhabitable) and hardship.
2. LICENCE FEE
The Licensee agrees to pay the Owner a fortnightly licence fee of $460 (including GST) in
advance starting on the 20th day of FEBRUARY 2023 (“the Licence Fee”).
The Licence Fee must be paid to the Owner in person with cash or direct into the following account
(or any other account nominated by the Owner in writing):

The Licence Fee may be increased by the Owner by giving 30 days’ notice in writing to the
Licensee, but not more than once every 6 months.
4. ADDITIONAL COSTS
2.1. Internet is included in the Licence Fee.
2.2. Telephone is not included in the Licence Fee.
2.3. The following bills will be included in the Licence Fee with the following conditions:
(a) Electricity: $35 a month allowance included in this Agreement. If the total bill exceeds
the combined allowances of all occupiers of the Premises, the additional cost will be
equally divided between all occupiers;
(b) Gas: $35 a month allowance included in this Agreement. If the total bill exceeds the
combined allowances of all occupiers of the Premises, the additional cost will be
equally divided between all occupiers; and
(c) Water: $50 a month allowance included in this Agreement. If the total bill exceeds the
combined allowances of all occupiers of the Premises, the additional cost will be
equally divided between all occupiers.
3. SECURITY BOND
1. The Licensee must pay the Owner a security amount of $920. A bond receipt will be issued
by the Owner. The bond will be held by the Owner.
3.1. The Owner may draw on the security to recover any monies owing by the Licensee at any
time, including but not limited to Licence Fees, damage to the Premises or any other
amounts owing under this Agreement. If the Owner draws on the security amount, the
Licensee agrees to top up the security amount to the original amount, at the Owner’s written
request.
3.2. The Licensee must not refuse to pay any Licence Fee due under this agreement with the
intention that the amount of such Licence Fee be recovered by the owner from the security
bond.
4. AS LICENSEE, YOU AGREE:

4.1. to conduct yourself in a quiet manner, respectful of the other occupants of the Premises, this
includes no parties or big gatherings (limit of 3 guests in total at the Premises at any one
time).
4.2. to respect the property of the Owner and ensure that reasonable care is taken to avoid
damaging the Premises or any fittings, fixtures, furniture and/or appliances. If the Licensee
becomes aware of damage, then you must give notice to the Owner as soon as practicable;
4.3. to keep the areas you use clean and tidy;
4.4. not to use, or allow the Premises to be used, for any illegal purpose;
4.5. not to use, or allow the premises to be used, in such a manner as to cause a nuisance or
cause an interference with the reasonable peace, comfort or privacy of any other occupier of
the Premises or the occupier of any neighbouring premises;
4.6. supply your own kitchen consumables, towels, sheets and other personal use items;
4.7. use your own telephone service at your own expense;
4.8. not to attach any fixture, or make a structural change, to the Premises without the Owners’
permission. An attachment may include, for example, something glued, nailed or screwed to
a wall;
4.9. to repair any damage caused by removing any fixture or compensate the Owner for the
reasonable cost of repair;
4.10. not to put anything harmful down any sink, toilet or drain or do anything likely to cause a
blockage or damage to the plumbing. The Licensee further agrees to pay the cost of repairs
for any damage or blockage caused by the Licensee's negligence;
4.11. to reimburse the Owner for the amount of any fees paid by the Owner to a bank or other
authorised deposit-taking institution as a result of funds of the Licensee not being available
for rent payment on the due date;
4.12. when this agreement ends, to remove all the Licensee’s goods from the Premises, and to
leave the Premises in as nearly as possible in the same condition, fair wear and tear
excepted, as at the commencement of this Agreement.
4.13. to allow the Owner access to the Licensee’s room for inspections, carrying out repairs and
showing the premises to prospective occupiers/purchasers.
4.14. Shared Areas will be regularly inspected by the Owner without notice.
4.15. That each occupant can only store one standard motor vehicle at the front of the Premises.
Fees will apply for extra vehicles.
4.16. to follow any House Rules provided by the Owner that are within reasons to the general
upkeep or maintenance of the Premises.
4.17. In the event of a violation of any rule, the Owner can terminate the agreement at their
discretion with minimal notice.
5. THE OWNER AGREES:

5.1. the Premises will be in a reasonably state on the day on which it is agreed that the Licensee
is to enter into shared use of the Premises;
5.2. to maintain the Premises in a reasonably good state of repair throughout the term of this
Agreement;
5.3. to make arrangements for repairs as soon as possible the Owner becomes aware that
something is in need of repair;
5.4. the room and Premises are secure and will provide the Licensee with the necessary keys;
5.5. to provide the Licensee with a copy of this Agreement at the time at which it is signed by the
Licensee.
6. ASSIGNMENT OR SUB-LETTING
6.1. The Licensee must not allow any person other than the Owner or their nominee to stay
overnight in the Premises without the written consent of the Owner.
7. GENERAL
7.1. The Residential Tenancies Act, 2010 does not apply to this agreement.
7.2. The Licensee must pay on demand interest on any moneys payable by the Licensee which
remain unpaid for 14 days after the due date at the rate of 0.4% per week or part thereof,
computed from the due date for payment and accruing on a weekly basis until paid.
7.3. Where glass is damaged (cracked or broken) by the failure of the Licensee to ensure that
care was taken to avoid the damage, the Licensee must immediately replace the damaged
glass with glass of the same thickness and quality.
