COUNTER AFFIDAVIT
I, PEDRO B. LUNA, legal age, single, and a resident of Brgy.
Sambag, Jaro, Iloilo City after being duly sworn in accordance with
law, hereby depose and state that:
1. I am a newly assigned Manager of a Home Depot located
atJaro Iloilo City. In lieu to this new assignment, I decided
to transfer my residence at Brgy. Sambag, Jaro, Iloilo City
which is near my workplace.
2. On January 8, 2020, I was standing outside a convenient
store which is a block away from my residence and was
smoking a cigarette when Juan de la Cruz alyas Jun-jun
approached me holding a half empty bottle of liquor. He
was obviously drunk at that time. He could not speak clearly
and told me that he barely saw me in the neighborhood.
3. I don’t really know him but he was known to be a
“notorious drunkard” in our community as I always saw him
drunk and talking nonsense things to everybody although
he is a decent person if he is not intoxicated by alcohol.
4. I just ignored everything that he was saying because I
know that he was drunk. He keeps on getting my attention
by constantly punching my left shoulder.
5. He was talking about a certain girl named Joy L. Marikit
who is also my neighbor. He was kept on telling me that she
broke up with him several years ago. As he was expressing
how devastated he was because of his heartache, he
forcefully punched me at my left shoulder. I felt pain on my
left shoulders as it was a really heavy blow. Because of the
annoyance that he caused me by constantly punching me
and his last hit that he made on my left shoulder, I grabbed
his collar and I punched him in his face once.
6. There were two by standers and the owner of the
convenience store who saw the incident. The one of the
by standers told me that “Kangina ya pa ka ginasinabaran.
Angay lang na sa iya kay masabad sya.”
7. I immediately left the scene, leaving him sitting on
the ground.
8. This Counter Affidavit is being executed to attest to the
truth of all foregoing facts and events and to disclaim all the
accusations against me.
IN WITNESS WHEREOF, I have hereunto affixed my signature
