Subject: Standard Procedure regarding issuance of occupation certificates under self


certification for residential houses on individual plots, falling within licensed
residential plotted colonies in Haryana.

On the subject noted above, in order to streamline and expedite the process of grant of
occupation certificate of residential houses within the licensed plotted colonies in the State of Haryana,
it has been decided that the ‘Competent Authority’ for issuance of occupation certificates as per Code
1.2 (xxv) of HBC-2017 under self certification in such cases shall be concerned Architect as defined in
clause 1.2(viii) of HBC-2017. Henceforth, the occupation certificates regarding subject cited cases shall
be issued under self certification by Architects only.
The standard procedure to the followed by the Architects is as under:

i. The owner of the building shall submit request to the Architect/Engineer as defined under
HBC-2017. Architect should keep record of all such applications in his office.
ii. The Architect/Engineer shall inform in writing that he has not been issued any show cause
notice or blacklisted by any of the Government agency and also as per clause 4.11 of HBC-
2017 shall examine and prepare all documents like; approved building plans, deviations
marked on the plans (as built drawings), photographs of front/rear set back area, internal
finishing/furnishing works alongwith CD, structural stability certificate and self-certification on
BRS-V.
iii. Architect shall also fill template attached as Annexure-R with self-certification of all the facts
and certify that the building is complete in all respect and fit for grant of occupation
certificate.
iv. The concerned Architect shall also obtain certificate of XEN, HSVP regarding services
before issuance of occupation certificate.
v. The concerned Architect shall also fill template attached as Annexure B regarding
composition performa as per latest composition policy dated 28.10.2022 and certify that
composition charges are paid and shall attach online receipt showing successful status.
vi. The concerned Architect, after ascertaining all the points from sr no. i to v above and
confirming that there is no non compoundable violation and finishing/ furnishing works are in
order, shall issue OC under self certification within 8 working days from the receipt of
application of owner as per ‘i’ above. The date of application made by the owner shall be
referred in the OC issued under self certification.
vii. The concerned Architect, in case find out that there is non compoundable violation or
finishing works are not in order, shall not issue any such certificate failing which he shall be
held responsible. He shall also be responsible to get the non compoundable violations
removed from the site.
viii. The concerned Architect shall submit the case file alongwith all the above documents and
the copy of OC issued by him under self certification in the office of DTP/DTP(P) and
DTP(E) (wherever posted separately) within 3 working days and field offices shall maintain
the record of the same.

There may be chance that Architects/ Engineers are not following the professional
ethics in issuance of occupation certificate under self certification therefore, it would be appropriate that
the concerned DTP in all districts or by DTP(P) wherever separately posted shall be liable to check 10%
of total OCs received from Architects from 1st to 15th day of the month. The following shall be followed
in this regard:
i. 10% checking as mentioned above shall be done within 7 working days only at the level of
ATP/DTP.
ii. For removing the subjectivity in selecting 10% cases, the concerned DTP may form some
rational procedure at their level.
iii. In case any deficiency is found at the level of the Architect/Engineer specially in terms of
non compoundable violation or incomplete building, the concerned DTP shall issue show
cause notice, if required, may blacklist the concerned Architect/Engineer in future and even
withdraw the OC issued under self certification with recommendation to registration authority
for not registering any floor/building on the said plot and/or send recommendation to
Counsel of Architects for cancellation of his professional license.
iv. In case any Architect comes under purview of sr no. iii above, DTP/DTP(P) shall not accept
any certificate issued by him till the time show cause notice/ blacklisting of Architect is
withdrawn.
Even to check/ monitor the field offices, circle office STP in person may randomly check
5% of any of the occupation certificates received under self certificate in a month by DTP offices and
may take necessary action, for which the list shall be provided to concerned STP within next 7 days
after end of every month.
DTPs shall issue instructions to all Architect/Engineers to strictly follow the above
guidelines/ procedure to be followed under self certification of occupation certificates and also shall hold
meeting with the Architects by informing the action which may be initiated against them in case self-
certification is not found in order. This shall be done within 7 working days from the issuance of these
instructions. The guidelines mentioned above shall be immediately implemented and no fresh case for
grant of occupation certificate shall be received from the date of issuance of the said instructions.

Subject: Composition policy to compound the violations/offenses made under the


provision of the Haryana Scheduled Roads and Controlled Area Restriction
of Unregulated Development Act, 1963 and Rules of 1965.

The composition rates proposed herein are for hyper potential zone. Further,

for all other zones, composition rates derived out of following indexation formula shall be

adopted.
