The issue of this EOI does not imply that the Brihanmumbai Municipal Corporation
(B.M.C.) is bound to select and short-list pre-qualified Applications for Evaluation
Stage or to appoint the selected Applicant, as the case may be, for the Project and
the Brihanmumbai Municipal Corporation (B.M.C.) reserves the right to reject all or
any of the Applications without assigning any reasons whatsoever.
The Applicant shall bear all its costs associated with or relating to the preparation
and submission of its Application including but not limited to preparation, copying,
postage, delivery fees, expenses associated with any demonstrations or
presentations which may be required by The Brihanmumbai Municipal Corporation
(B.M.C.) or any other costs incurred in connection with or relating to its Application.
All such costs and expenses will remain with the Applicant and the Brihanmumbai
Municipal Corporation (B.M.C.) shall not be liable in any manner whatsoever for the
same or for any other costs or other expenses incurred by an Applicant in
preparation or submission of the Application, regardless of the conduct or outcome
of the Application Process.
The information content in the EOI is selective and subject to updating, expansion,
revision and amendment.

1. Invitation for Expression of Interest (EoI)
1.1 Brief Introduction
Animal Birth Control (ABC) program is implemented in B.M.C. since 1998 to
control the stray dog population. The program runs as per High Court order in Writ
Petition no.1596 of 1998 and Animal Birth Control Rules, 2023 under The Prevention of
Cruelty to Animals Act, 1960.
The objective of Expression of Interest (EoI) is to solicit proposals from the
interested participants for participation in a process for selection of Animal Welfare
Organisations (AWOs) for sterilization operations under Animal Birth Control program
for Dog Control Department of B.M.C.’s Veterinary Health Department beyond
September 2023. The Service Provider will be responsible for conducting sterilization
operations of stray dogs and their immunization against Rabies in Mumbai, as per
Animal Birth Control (Dogs) Rules, 2023.

1.3 Scope of Work
a) Sucessful participant will have to carry out de-worming, sterilization operations &
anti rabies vaccine for stray dogs as per Animal Birth Control Rules, 2023.
b) Successful participant conducting the programme of stray dog sterilization on BMC
land or their own place, they will be paid Rs. 1450/- per dog & Rs. 1650/- per dog
respectively if dogs are supplied and released by BMC and Rs.1650/- per dog &
Rs.1850/- per dog respectively if the dogs are caught and released by the
participant.
c) When catching is done by participant, the dogs will have to be released in the same
place from where they were picked up, as per Animal Birth Control Rules, 2023. In
such a case, B.M.C. shall not be responsible for any relocation done by the AWO.
d) For verification of sterilization operations : The sterilization operations of dogs
conducted by successful participant will be verified by B.M.C.’s organ inspection
committee by counting the organs (testes or uterus) vis-à-vis against number of
operated dogs, as mentioned in AWBI’s revised Animal Birth Control module.
e) Successful participant will carry out post-operative care of operated dogs for 5 - 7
days, as per Animal Birth Control Rules, 2023 and AWBI’s revised Animal Birth
Control module.
f) B.M.C. shall not be responsible for any complications whatsoever that arise in the
procedure of sterilization operation(s) and where the participant will be liable for any
litigation/compensation etc.
g) Maintaining appropriate registers for Animal Birth Control Program as directed by
B.M.C.
h) Any other directives issued by B.M.C. officials from time to time.

1.6 Pre-Qualification Criteria
All interested participants are hereby informed that only those who meet the following
pre-qualification criteria shall be considered for further evaluation based on criteria
mentioned in the clause 1.7.
1) AWOs should be registered with the Animal Welfare Board of India (AWBI) and
follow Animal Birth Control Rules, 2023.
2) No. of dog sterilizations the participant is ready to undertake annually and their
housing capacity.
3) Participant’s experience in dog sterilization surgeries. Minimum 1 year
experience is mandatory.
4) Submission of last 3 years audited financial reports.
5) The participant shall be a legal person / entity registered as a Company/ Firm /
Society / Institution under respective Acts in India or in the country of origin.
6) The participant shall not have been black-listed in India / the country of origin.

2. Instructions to Participants
2.1 Authorized Signatory
The ‘Applicant’ mentioned in the EoI document shall mean the one who has
signed the EoI document forms. The applicant should be the duly Authorized
Representative, for which a certificate of authority should be submitted. All certificates
and documents (including any clarifications sought and any subsequent
correspondence) received hereby, shall, as far as possible, be furnished and signed by
the Authorized Representative.
Every sheet and all forms complete in all respects shall be signed and stamped
by the person duly authorized to sign on behalf of the participants. Any / all corrections
/ alterations made in the offer shall be duly authenticated by the signature of the
Authorized Signatory.

2.3 Documents to accompany EoI: The applications shall be complete with the following
documents:
1. Letter of Authorization.
2. Each page of the EoI document duly signed by the authorized person.
3. Expression of Interest in Form – I.
4. Pre-Qualification Criteria in Form-II
5. Details of experience in Animal Birth Control Activities & Information about
projects completed / in hand in Form-III
6. Details about participant in Form-IV.
7. Affidavit or Self declaration in Form –V.
8. Additional supporting documents in accordance with Evaluation Criteria
mentioned in Clause 1.7.
9. Any other information applicant likes to provide to substantiate their claims.
The entire EoI along with supporting documents shall be submitted through E-mail on
[email protected] or at the Office of General Manager, Deonar Abattoir.

d) The evaluation shall be carried out on the basis of data available in the
application documents received in the first instance. However, B.M.C. reserves
the right to call for such clarifications confined in scope to the contents of the
application, should such a clarification become necessary for proper judgment
in evaluation.
2.6 Evaluation
The procedure of evaluation of the applications is indicated below:
a) B.M.C. has specified the pre-qualification criteria (Clause 1.6) in the EoI
document. The applicant shall submit the proposals in the same sequence
indicating the pre-qualification criteria on each certificate.
b) Only the Participants, who meet the Pre Qualification Criteria, will be evaluated
for selection as per Evaluation Criteria mentioned in Clause 1.7.
c) Participants, who score at least 50 marks in the Evaluation, shall be considered
for short listing.
2.8 Disclaimer
B.M.C. shall not be responsible for any late receipt of applications for any reasons
whatsoever. Applications received late will not be considered.
1. AWOs applying for the programme of stray dog sterilization and working on
BMC land will be paid Rs. 1450/- per dog if dogs are supplied and released by
BMC & Rs. 1650/- per dog if the dogs are caught and released by the AWO.
AWOs applying for the programme of stray dog sterilization and working on
their own / rented land will be paid Rs. 1650/- per dog if dogs are supplied and
released by BMC & Rs. 1850/- per dog if the dogs are caught and released by
the AWO.
2. AWO shall follow Animal Birth Control Rules, 2023 under Prevention of Cruelty
to Animals Act, 1960 and the Revised ABC Module published by AWBI.
3. It is mandatory for the AWO to acquire a Certificate of Project Recognition from
the Animal Welfare Board of India. Terms & Conditions regarding Project
Recognition will be as per Animal Birth Control Rules, 2023 under Prevention of
Cruelty to Animals Act, 1960.

4. Minimum 100 stray dogs shall be sterilized per month (participants capable of
quoting maximum target will be given preference in selection. Dogs should be
released only after proper post operative care and Anti Rabies vaccinations.
5. The programme will be supervised by BMC officers. The participants shall
follow the BMC rules of supervision and produce the documents / reports
whenever asked by supervising officers. The reproductive organs removed from
male and female dogs will have to be preserved as specified in Animal Birth
Control Rules, 2023 for verification of sterilization surgeries, by organ inspection
committee.
6. The process of catching, transportation, drop at ABC centre, sterilization,
vaccination against Rabies and subsequent release after complete recovery
shall be done through a mobile application as directed by BMC’s Veterinary
Health Department.
7. No water bills, electricity bills or any taxes shall be payable by BMC, if place of
work is owned / rented by the AWO.
8. A contract agreement will be made between successful participant and BMC. It
should be registered with Registrar along with Stamp Duty & Registration fee.
9. Submission of last 3 years audited financial reports along with statement of
accounts & balance sheet is mandatory.
10. The participant(s) shall have atleast 1 year experience in the field of Dog
Sterilization activities.
11. Municipal Commissioner will be at liberty to discontinue the agreement if AWO
fails to achieve the target agreed by them, continuously for 3 months and the
AWO will not approach to the Court or file any litigation against the BMC.
12. Security deposit payable by participant to BMC is Rs.25,000/- .
13. EMD payable by participant to BMC is Rs.10,000/- .
14. In case of any dispute, the decision of Municipal Commissioner will be final.
15. General contract conditions will be applicable.

Participant shall be excluded from participation in the selection procedure if the
participants
1. are bankrupt or being wound up, are having their affairs administered by the courts, have
entered into an arrangement with creditors, have suspended business activities, are the
subject of proceedings concerning those matter, or are in any analogous situation arising
from a similar procedure provided for in national legislation or regulations;
2. have been convicted for an offence concerning their professional conduct by judgment,
which has the force of res judicata;
3. have been guilty of grave professional misconduct proven by any means, which the
contracting authority can justify;
4. have not fulfilled obligations in respect of payment of social security contribution or the
payment of taxes in accordance with the legal provisions of the country in which they are
established or with those of the country of the contracting authority or those of the country
where the contract is performed;
5. have been the subject of a judgment, which has the force of res judicata for fraud,
corruption, and involvement in a criminal organization or any other illegal activity
detrimental to the communities’ financial interests;
6. Following another procurement procedure or grant award procedure financed by the
community budget, they have been declared to be in serious breach of contract for failure
to comply with their contractual obligations.
In response to your call for expression of interest, I / We hereby declare that:
1. I am / we are not in any of the situations excluding me/us from participation.
2. I / we agree to abide by the highest ethical standards in the profession and, in particular,
have no potential conflict of interest;
3. I / we will inform the Authority immediately if there is any change in the above
circumstances at any stage during the EoI procedure or during the implementation of the
