1. Explain the Rule of law.
 This means that no one is above the law. Laws must be applied the same
regardless of race, gender, status or any other consideration. People elect
incumbents for the purpose of governing the nation through implementing and
reinforcing laws. Rule of Law generally prevents the arbitrary use of power.
2. Explain the 3 inherent powers of the Gov’t.

 These three powers—of eminent domain, police, and taxation—were
acknowledged as legitimate attributes of government by natural law theorists,
and they are today the principal means by which our gov’t regulate and control
property.
 Police power – the power of the State to enact laws in relation to persons and
property so as to promote public health, public moral, public safety and general
welfare of the people.
 Power of eminent domain – the power of the State or those to whom the power
has been delegated to take private property for public use upon paying the owner
a just compensation to be ascertained according to law.
 Power of taxation- the power of the State by which the sovereign raises revenue
to defray the necessary expenses of the government.
3. Why is it that 1987 constitution is considered wordy?

 Isagani Cruz called the 1987 Consititution wordy because of “the blessings of
democracy” and “regime of truth, justice, freedom, love, equality and peace”. As you
can see, a lot of words have been added to the modified preamble. The drafters
wanted to go into details.
4. Explain the difference common good and general welfare.

 “General welfare (Makakabuti sa nakakarami), which covers everything conducive to
the public safety, public health, public comfort, and convenience, while the term
“common good” (Makakabuti sa lahat) itself may refer either to the interests that
members have in common or to the facilities that serve common interests. These
includes the road system; public parks; police protection and public safety; courts
and the judicial system; public schools; museums and cultural institutions; public
transportation; civil liberties, such as the freedom of speech and the freedom of
association; the system of property; clean air and clean water; and national defense.
5. Explain the difference of 1935 and 1987 constitution their used of 1 st person power and
3rd person power.
 The preamble of the 1935 Constitution spoke of “The Filipino people” that was
when we were still governed by America, while that of the 1987 Constitution says
“We the Filipino people”. The word “people” is a third person noun while “we” is in
the first person. This is to remove any traces of our colonial past, the present
Constitution uses the first person “We”, which indicates that the Filipinos
themselves are expressing that they are the authors of the Constitution.
