Note:-
1. The period of contract shall be for three year i.e. (01.09.2022 to 31.08.2025) for which work order will be
issued annualy subject to satisfatory performance of the contractor/firm by the sole discretion of Director
MAMC, Agroha.
2. The above contract is in two parts for three years. The tenderer has to quote rates for 1 st year for
Part-A & B seperately. Further a hike of 7% on previous year rate will be givin for 2 nd and 3rd year of
contract.

3. The rates to be quoted should be FOR including GST and Other taxes & gauranty/ Warranty as per
manufacture.

1. Tenderer are requested to quote rates seperately for Part A& B.

2. The reasonability of tender rates will be worked on the basis of total cost quoted by tendere for part -A and
Part- B. Whoseover tenderer with overall lowest cost of part A+Part B will be treated as L1.

3. The rates shall be at F.O.R. M.A.M.C., Agroha (Hisar).

4. The rates quoted above are inclusive of all taxes.


5. No Advance payment will be made.
6. No Charges will be paid for petty items/materials.
7. The quoted rates should be after deducting the cost of old/replacement parts.
8. Warranty period of Compressor will be minimum of one year.
9. The complaint must be attended promptly & rectified within 24 Hours.
10. The rates quoted should be inclusive of fitting /erection of parts i.e. complete job of the fault.
11. Any other work as per requirement for smooth operation of unit/system in respect of above activities shall be
obligatory to carry out by the contractor.
12. The quantity may be increased or decreased as per requirement.

ANNEXURE-B
PRE-QUALIFYING REQUIREMENTS OF TENDERS:-

The following Pre-Qualifying will be required:-

1. The agency / Bidder should have experience of successful Operation & Maintenance work of centralized
air-conditioning system of minimum 160 TR plant capacities or above having screw type compressor
system in Central Govt. / State Govt. / Semi- Govt. / Govt. aided University/Institution/College/NABH
affiliated Hospitals etc. minimum period of two years.
2. The bidders must submit their performance certificate as a proof of successful execution of the work order.
3. Agency should have experience of working on PLC based Air-Conditioning system for minimum of 2 years
period.
4. The bidder must have average annual turn-over in last three consecutive financial years shall not be less
than Rs. 50.00 lakh. Bidder should submit balance sheet and profit- loss statement duly attested by
practicising Charted Accountant as a proof for the same.
5. The Bidder should not be blacklisted from Central Govt. / Semi- Govt. / Govt. aided
University/Institution/College/Department etc. Undertaking must be deposited by the bidder.
6. The Bidder firm must have registration of EPF, ESI, GST & PAN etc may orher applicable mandatory
registration with state Govt.
7. The contractor shal have registered with ESIC & labor department as Contractor. He will be fully rsponsible
for any mihappening (fatal/non fata) with the manpower.
8. The payment of tender fee & EMD shall be made online by the tenderer as per e-tender portal. No interest
shall be paid on EMD by MAMC, Agroha. However any MSME firm will be governed as per state Govt.
MSME policy only.
9. The Contractor /Agency should submit an Affidavit that the firm has not been debarred /black listed by any
Govt. Department/ Autonomous body/ Society.
10. The contractor must have valid license from Chief Inspector of Factories/Chief Electrical Inspector Govt. Of
Haryana.
11. All the documents related to pre-qualification must be uploaded with the tender.

ANNEXURE-C
INSTRUCTIONS FOR TENDERERS:-

All tenderers must carefully observe the following instructions:-

1. If Offers / tenders not found strictly in accordance with these instructions shall be liable to
rejection.
2. Tenders must be completed in all respects/forms.
3. The conditional tenders without EMD shall not be accepted.
4. All E-tendering process should be followed by the tenderer on e-portal tender site.
5. The power of attorney in the name of signatory on behalf of the company/agency/firm, for signing
the tender documents and other papers of the contract should be furnished at the time of
submitting the tender.
6. On acceptance of tender, the name of authorized representative (s) of the tenderer who would be
responsible for taking the instructions from the Engineer In-charge will be intimated by the
contractor to ensure execution of work in conformity with the specifications & tender term
condition.
7. The GST and other taxes on material(s) etc. in respect of this contract shall be born by the
contractor and shall not claim its transportation from the MAMC, what so ever, in this respect.
8. No firm should submit the tender if any of his relatives is posted at MAMC and who is dealing with
day-to-day work including passing of bills etc. MAMC may penalize the contractor, if found
violating and the work entrusted to him may be terminated on this ground alone. The term relative
means wife/husband, son/daughter, brother/sister uncle/cousin and their corresponding in-laws.
9. The tenderer should indeminity that no other Firm/Sister concerns/associates belonging to the
same group is participating / submitting the tender for the said work.
10. Price bid should be submitted as per attached Annexure-A and the rates should be quoted
both in figures & words in English/Hindi of all items and no items should be left unquoted.
The total amount should also be written in the same language. In case of illiterate persons
the rate or the amount quoted should be attested by literate person/witness.
11 In case, the date of opening of tenders happen to be a holiday or a holiday is subsequently
declared on that day, the tenders will be opened on the next working day.

12 Since the contractor will be handling costlier deligated equipments, he must have good skilled &
qualified staffs who have already have worked on similar jobs/ contract plant.

13 Before quoting, the tenderer shall carefully study all the clauses and specifications of the tender
documents. If tenderer has any doubt for the meaning of any context of the tender specifications
or find discrepancies or omissions in the drawings or the tender documents issued seems
incomplete or need clarification in technical aspects, scope of work etc., he shall at once contact
the authority inviting the tender for clarification before submission of the tender. No arguments on
this account what so ever, shall be entertained after submission of tenders/ closure of tender
submission schedule.
14 Before submission of tender, the tenderer is advised to inspect the site of work, the environment &
get himself acquainted with the actual work & other prevalent conditions, facilities available. No
claim will be entertained later, on the ground of lack of knowledge on this account

a) The tenderer shall be required to deposit earnest money of Rs.82000/- & tender fee Rs.
2500/- online as per e-tender portal.
b) The earnest money of successful tenderer shall be treated as part of the security deposit for
faithful execution of the contract/work.
c) The Bank charges, if any, will be of tenderer.
d) No claim shall be entertained against the MAMC in respect of interest on earnest money deposit.

e) The failure on the part of tenderer to honor his commitment/agreement given in the tender will
constitute a default and in that event, his earnest money will stand forfeited by MAMC without any
notice.
f) EMD shall also be forfeited in case the tenderer withdraws his tender not honur his commitment
/agreement at any stage during the currency of the validity period.
16. a) The tenderer shall quote the prices word and figures in English Language and international
numerals.
b) The tender can be participating by a registered firm (Firm/Company etc.) only, not by individual.
c) All the taxes considered while submitting the offer must be defined. The applicable rate of GST
shall be indicated. If there is any variation i.e. increases / decrease in these taxes, during the
contract period, the same shall be borne by the firm/contractor.
17. The Tenderers should record acceptance all instructions, terms & conditions of the tender. If not
recorded then it must be understood that all the terms & conditions are accepted in to to.
18. The tenderer will quote his rates STRICTLY AS PER THE RATE QUOTING SHEET AT ANNEXURE– A
19. At any time before dead line for submission of tender, MAMC may modify the tender
document by issuing an addendum/corrigendum and extend the date of receipt and opening of tender.
20. The Director MAMC reserves the right to reject the tender without assigning any reason and no
claim on this account shall be entertained.
21. The validity of tenders should be a period of 120 days from the date of opening of price
bid/tenders.
22. The contract shall be awarded to the tenderer whose total overall rates are lowest.

23. All bidders shall provide following information and documents with their bids:
a) Copies of original documents defining the constitution or legal status, place of registration,
and principal place of business, written power of attorney of the signatory of the Bid to
commit the Bidder.
b) Total monetary value of similar nature work performed during each of the last three years.
c) Experience in works of similar nature and size for each of the last three years and details of
work underway or contractually committed, and clients who may be contacted for further
information on these contracts.
d) Reports on the financial standing of Bidder, such as profit and loss statements / auditor’s
reports for the past three years.
24. Bids from Joint ventures are not acceptable.
25. Sub-contractors’ experience and resources shall not be taken into account in determining the
Bidder’s compliance with the qualifying criteria.
26. Even though the bidder met the above qualifying criteria, they are subject to be disqualified if
they have:
- Made misleading or false representations in the forms, statements and attachments
submitted in proof of the qualification requirements; and/or.
- Record of poor performance such as abandoning the works, not properly completing
the contract, inordinate delays in completion, litigation history, or financial failures,
poor quality work etc.
- Participated in the previous bidding for the same work and had quoted unreasonably
high bid prices and could not furnish rational justification to the employer.

The bidder who had abandoned the work or his contract was rescinded or was terminated due to
non completion of work/ or any other default on the part of the contractor in any contracts
during last three years, shall be considered as non performer and no work will be allotted to him. No
specific order for debarment shall be needed for this purpose.
27. In case of dispute between Contractor and the Institute, the arbitrator will be appointed by MAMC,
Agroha, whose decision will be final and binding on both the parties.
28. The contractor shall provide suitable measuring arrangement at site for various articles brought by
him.

29. Approximate quantities have been given in the contract may very at the time of actual execution of
the work. The payment will however be made according to the actual work done by the contractor.

30. The department reserves the option to take away any items of the work or any part thereof at any
time during the currency of the contract and re-allot it to another contractor with due notice to the
contractor without liability of compensation.

31. The successful contractor shall have to sign an affidavit to the effect that he has no relation or
connection with the firm/contractor blacklisted by Govt. of Haryana /Govt. of India from time to time.

32. The items/materials brought at site of work should be ISI marked/specified make and as per the list
approved appended in the DNIT. In case there in any dispute regarding its quality then the same will be got
checked from any approved laboratory at his own cost by the contractor within 10 days from the date of
order given by the Engineer-in-charge in writing.

33. All testing charges of various equipments if required by any electricity authorities/ Pollution Control
Board shall be borne by the contractor.

34 The contractor shall not be entitled for any payment on account of work done by him till he signs the
contract agreement.

35. Tender quotations which are dependent upon the quotations of other tender shall be summarily
rejected.

36. The actual quantities of the work completed successfully and accepted shall be paid.

37. The revision of price bid after opening of Part-I i.e. technical and commercial part of the tender is not
allowed. In case of withdrawing the same within the validity period, EMD shall be forfeited

38. Arithmetical Errors: - in case of any inconsistency in the prices furnished, the purchaser shall be entitled
to consider the lowest prices for the purpose of evaluation and award of contract. All arithmetical errors
will be rectified on the basis of the unit price or total price (in figures and in words) whichever is more
beneficial to the purchaser/MAMC.

Technical Terms & Conditions
(Scope of work)

1 a) Annual ACMC along with spare parts, maintenance & operation of complete Central A.C. Plant at
M.A.M.C., Agroha, which consists of following equipments:-

(i) 3 nos. Chiller of capacity 3 x 190 TR, screw type water cooled with microprocessor based
panel along with their allied equipments installed in the A.C. Plant room & used in the
A.C. system which relates to A.C. Plant (BLUE STAR MAKE).

(ii) 3 nos. Chilled water Primary pumps with motors, having capacity of 500GPM, Head- 32
MWC / 15 HP, 3 phases along with pipe & valves etc.
(iii) 3 nos. Chilled water Secondary pumps with motors, having capacity of 500GPM, Head- 32
MWC / 15HP, 3 phases along with pipe & valves etc.
(iv) 3 nos. condenser pumps with motors having capacity of 735GPM/52 lps head
12MWC/7.5 HP, 3 phase each along with pipe & valves etc.
(v) 3 nos. Electric hot Water generator 150KW each, 3 phase.
(vi) 3 nos. VFD
(vii) 12 nos. Floor mounted double skin Air Handling Unit with 4/6 rows deep coil filter pads
with blower & motors etc.
(viii) 24 nos. Ceiling suspended double skin Air Handling Unit with 4/6 row deep coil filter pads
with blower & motors etc.
(ix) 3 nos. FRP induced draft cooling towers, 220TR multicell and multifan with pipes & valves
etc.
(x) 12 nos. Humidifier of 8 KW / 9 KW capacity - PAN type Wall mounted / floor mounted.
(xi) The comprehensive maintenance of Air –conditioning Plant LT electric control panels 5 nos.
installed for AHU’s & 1 no. installed for AC Plant in the scope of contractor.
(xii) Watch and ward of duct Insulations and pipe cladding for floor mounted AHU’s & get repair/
replaced in case of its damages by weather /monkies etc.
(xiii) All allied equipments relates to Central Air-conditioner Plant and Air-conditioner system
which are not described from (i) to (xiii) will also be covered in this contract.
(b) (i) Complete overhauling of above Ac plants along with their allied equipments such as Electrical
equipments, Electrical Motors, Valves, Panels, Electrical/Electronic control system of A.C. Plant
covered under the above scope of work.
(ii) Cleaning of equipments, electrical panels, AHU’s, cooling tower covered under the scope of work.
(iii) Any other operation/maintenance work not included in scope as detailed above but is required for
operation & Maintenance of AC system is deemed to be included in contractor’s scope.
(iv) All HAU’s pre & fine filters shall be replaced with new one as & when required as per
conditions of the filters & entire satisfaction of the Officer Incharge of the plant.

2. The firm will arrange and maintain registers & log sheets/ records for:-
(i) Temp. & humidity record of AC rooms on hourly basis.
(ii) Daily reading of all the gauges and meters provided in the AC plant, AHU’s and cooling
towers.
(iii) To maintain the record of servicing carried out by contractor as per manufacturer norms
specifications and recommendation as described by the Engineer-in-Charge.
(iv) Log book register duly page marked with certificate to thiseffat should be bounded will be
as per practice of reputed firms and will be maintained in good condition by the
contractor.

3. The firm will carry out the periodic maintenance required for successful satisfactory functioning
of A.C’s screw Chiller Plants as per detail given below:
a) Daily
i) Attending break down if any.
ii) Checking the system for gas leakages.
iii) Checking of AHU filter sets.
iv) A.C. Plant room cleaning.
v) To check up the water level in the cooling water tank as well as makedefficient up water
tanks.
vi) To check any abnormality/malfunctioning in the system.
vii) Gas charging if required.
b) Weekly
i) Checking of glands /seals of condensate water pumps /chiller pumps and tightening &
replacement if required.
ii) Checking of glands of refrigerant line and tightening & replacement if required.
iii) Checking and tightening of electrical connections in main control panels as well in
M.C.C.B. panels.
iv) Cleaning of water lines and strainers replacement if asked.
v) Refrigerant gas charging, if required.
vi) Cleaning of Air Filters of AHUs.
vii) Checking of oil level of compressors and bearing housing of pumps and air washer blower
sets it top up / rplacemnt of oil if required.
c) Monthly
i) Checking of oil level of compressors & top up if required.
ii) Cleaning of suction line strainer of compressor.
iii) Checking and tightening of foundation bolts of compressor, blowers and other allied
equipments also to treat them to avoid rusting of iron parts.
iv) Checking of loading and unloading system of A.C. Compressor.
v) Oiling and greasing of respective bearing of motors, blower fans, pump bearing etc. &
rewinding of any abnormals sound.
vi) Cleaning of liquid line strainer of the compressor.
vii) Checking and calibration of all the safety and auto controls.
viii) Replacement of defective parts of the equipments of mechanical and electrical items if
any.
ix) Gas charging if required.
d) Annually
i) Overhauling of compressor shall be got done by the qualified/specialized (experienced)
personals.
ii) Changing of compressor Oil.
iii) Checking of suction and discharge valves assemblies and replacing if required.
iv) Checking of loading and unloading system of A.C. Compressor.
v) Checking of oils pumps seals of compressor and replacement if required.
vi) Checking of bearing cleaness for smooth operation of A.C. Plant.
vii) Descaling of all AC Plants (PAC & Screw Chillers) with dilute acid and changing of its end
coverage asked probably in the month of December /January or as per requirement
conditions.
viii) Cleaning, greasing and oiling of all the bearing of the equipment’s of A.C. and AHU Unit.
ix) Cleaning of all the water line valves and non-return valves.
x) Adjustment of all air distribution system.
xi) Maintenance of all the electrical wiring, earthing contactor starters, switches of the main-
control panels and MCCB panels /Control panels installed for A.C. Plant & AHU’s.

xii) Gas charging if required.


xiii) Cleaning of all air duct and diffusers of AC Plant.
xiv) All the spare parts of same make and capacity for replacement will be provided by the
contractor.
4. TECHNICAL TOOLS & PLANTS & EQUIPMENTS ARRANGED BY THE FIRM

(i) Consumables like MS welding electrodes, oxygen and acetylene gas, cleaning acid (descaling
material including tools), salt (for water softening plant), cloth, cotton waste, emery paper, sealing/
fixing compound, kerosene oil, rust line, refrigerant gas leakage detector, hack saw blades grinding
wheel PVC pipes, torches, Teflon tapes, araldite, soldering flux, solder, old dhoti, cleaning agent,
flexible pipes for cleaning with instrument air, lugs, ferrules, Nitrogen cylinder for flushing, oxygen
cylinder & commercial LPG cylinder for welding etc. and compressor oil, refrigeration gas, all petty
items such as all spares, bolts, nuts, grease, lubricants, AHU’s belts, AHU’s filters, temperature
controller, actuator valve and gaskets, seals rings, soaps, old dhoti etc. required for handling &
maintenance jobs will be arranged/provided by the Firm. All the suitable paints for M.S. pipe &
stands etc. will be repainted periodically i.e. as & when required. Incase contractor fails to bring
sufficient, consumables to site for which MAMC work is suffering, MAMC shall be procuring the
same from the market and recover from the contractor's bill@ 1.5 times the purchase price of the
item. The comprehensive rates should be after deducting the cost of old /replacement parts.
(ii) All the unforeseen spare parts or complete units which are not covered above has to be provided
by the contractor of same make and capacity which may be of chillers, compressors, AHU’s etc.
being contract is comprehensive along with all spare parts, operation staff for operation and
maintenance of Central A.C. Plant. The AC plant shall be made in healthy working conditions by the
contractor.
(iii) The contractor has to make his own arrangement including leads, screws, oil, brushes, welding
torch gloves, bulbs, wires & holders for temporary lighting at work place.
(iv) All tools & tackles like spanners, multi meters, Insulation tester, current source, box-spanner, chain
pulley blocks, pull lift, hydraulic jacks. Hoisting arrangement, portable grinding machine, personnel
protective equipments for safety of workers, safety belt, scaffolding material and other general
purpose tools and tackles have to be arranged /provided by the contractor.
(v) The entire work of operation and maintenance shall be completed by the contractor within the
time schedule or given by the Engineer-in-Charge in view of emergency services and to achieve
this, contractor has to work round the clock. Any number of jobs can be released for planned
mtc/overhauling and contractor has to carry out the work by deploying sufficient no. of workers in
addition to attending to break down faults. However, in case of any delay in the supply of spare
parts in time or any job involving machining etc., the time extension shall be given accordingly by
the MAMC.

(vi) Electricity & water supply for the purpose of operation and maintenance will be provided free
of cost by the MAMC, Agroha and extension of electricity if required by the contractor from
existing points will be arranged by him, but no electricity charges will be taken.
(vii) The descriptions of works have been given in the scope of work in this tender document.
However, in case of any new job, the rate shall be decided by MAMC on the representation of
the contractor. It will be obligatory on the part of the contractor to carry out left over jobs
relating to the system.

(viii) The work shall be started on the allotment of work after getting written instructions from the
MAMC, Agroha.
(ix) Any temporary Platform / scaffolding etc. required to execute any work shall be in the scope
of contractor.

(x) The transportation of material from the market to site & vice versa will be in the scope of

contractor. The contractor will be responsible for loading/unloading of spares, if the same are
to be got repaired from any private workshop as such all the transportation charges will be
scope on the contractor.

(xi) The old /defective/dismantled parts kept by the contractor. Hence, no storage are allowed nearby
the AC plant. No storage will be provided by the MAMC for old/defective parts.

ANNEXURE-E
GENERAL TERMS & CONDITIONS.

1. PRICES

a) The rates shall be inclusive of GST & FOR with other applicable taxes during the period of the
contract.
b) The above contract is in two parts for three years. The tenderer has to quote rates for 1st
year for Part-A & B seperately. Further a hike of 7% on previous year rate will be givin for
2nd and 3rd year of contract.

c) The reasonability of tender rates will be worked on the basis of total cost quoted by tendere for
part -A and Part- B. Whoseover tenderer with overall lowest cost of part A+Part B will be treated
as L1.

2. PERIOD OF CONTRACT

The period of contract will be for three year i.e. 01.09.2022 to 31.08.2025 for which work order
will be issued annualy subject to satisfatory performance of the contractor/firm

3. PENALTY / DEDUCTIONS
a) In case of any leftover work/unsatisfactory work in the opinion of Engineer-in-charge, the work will
be got done from some other contractor at the contractor's risk and cost penalty will be imposed
@ 10% of monthly contract value or on actual cost incurred on left over work which ever is higher.

a) On the report of Engineer-in-charge a penalty @ 5% of monthly contract value per day or actual
cost incurred on deploying of comptable staff agaisnt defficient deployed staff as per prevailing
market rates which ever is higher shall be levied in case of incompatible and sufficient qualified
staff not posted for operation and maintenance of AC plant.

b) If the contractor fails to maintain/operate any of the Central A.C. Plant within stipulated time up to
entire satisfaction of Engineer-in-charge due to fault of contractor, a penalty @ 2% of the monthly
contract value for each default or the actual cost incurred in maintaining for corresponding system
which ever is higher will be deducted from the monthly bill of contractor for each default

c) A penalty @ 1% of monthly contract value for that day shall be levied if proper cleaning in Central
A.C. Plant, ducts and AHU’s not found as per satisfaction of Engineer-in-charge.
d) The fault should be attended properly by the firm and will restore the fault within 24 hours further
regarding major fault such as replacement of chiller compressor & motor. Hot water generater etc
time will be 3 days otherwise penalty @5% of monthly contract value per day shall be levied
beyond schedule time till restoration of fault. However, in case of any emergency critical
circumstances, the fault will be required to be attended at once.
4. FORCE MAJEURE
Contractor shall not be liable for any delay for reasons arising out of compliance with regulations,
orders or instructions of Central / State Govt., acts of the God, acts of civil and Military authorities,

fires, floods, strikes, lockout, freight embargoes, war-risk, riots, civil commotion, epidemics and
accidental. If the contractor wants, the reasons may be explained through in time request
application.

5. NEGLIGENCE

If the contractor neglects to execute the work with due diligence and expedition or refuses to do
the work, then MAMC may serve 15 days notice, in writing to the contractor to make good the
failure within the stipulated time otherwise MAMC shall be at liberty to take the work wholly or
partially at the risk and cost of the contractor at a reasonable price. It shall be lawful for the MAMC
to retain any balance which may otherwise be due to the contractor on any account, if dues of the
contract are not sufficient to cover the amount thus recoverable from the contractor and to
recover the whole of the balance of the amount from the contractor by action at law or otherwise.
The remedy under this clause will be in addition to and without prejudice to rights available to the
MAMC under other clauses of the terms and conditions.

6. SUBLETTING NOT ALLOWED

Contractor shall neither sublet the contract nor suspend the work at any time during the above said
period of contract without any lawful excuse and without the earlier permission of the MAMC
authorities.

7. SECURITY DEPOSIT AND EMD


10% of the monthly running bill will be retained as security deposit from each running / monthly
bill of the contractor. However, the earnest money deposited by the contractor shall be adjusted
into the security deposit. Security Deposit shall be returned to the contractor after the faithful
execution and satisfactory completion of contract including guarantee / warranty period and
completion of all pending documentary formalities. No claim for interest on security amount shall
be acceptable. If the contractor fails or neglects to observe or perform any of his obligations under
the contract, it shall be lawful for the MAMC to forfeit either in whole or in part at its absolute
discretion, the security deposit furnished by the contractor.

The forfeiture of security deposit shall be without prejudice to the right of the MAMC to recover
any further amount of any liquidated or other damages, under payments or over payments made
to the contractor under this contract or any other contract.

8. PERIOD OF LIABILITY
The contractor shall give guarantee for the work done for a period of one year from the date of
successful commissioning of equipment repaired. During the liability period, if any defect is
observed in the equipment, which is attributed to poor workmanship or poor quality of material
used by the contractor, the same shall be attended by the contractor at his own cost & will have no
right of reclaimed.

9. MEASUREMENT AND BILLING


All measurement shall be in metric system. All the works completed will be measured by the
representative of the Engineer-in -Charge. The contractor will submit the bill in duplicate on
approved Performa to the Engineer-in -Charge.

However, contractor shall have to provide additional manpower as per the requirement of work. The
operation and maintenance staff (technical) must have an experience of 3 years for similar type of jobs.
The work shall have to be started immediately as per the instructions of Engineer-in-Charge or his
representative. The contractor should be able to mobilize the working force as per the quantum of work
and should be capable of executing maintenance work simultaneously at all the heads depending upon
the site requirements. If more persons are required for completion of work in the time schedule as per
emergency defined by Engineer- in-Charge, the same shall be arranged by the contractor without any
extra payment to complete the work. It is also made clear that the deployment of the workers of

contractors will be subject to approval of Engineer- in-Charge of the works. It may be insured by the
contractor regarding 24 X 7 hours duty.

11 The contractor would be responsible for the following:-


a. All the labour / workmen deployed during the execution of the contract shall be adequately got
insured as pe law by the contractor at his own cost.
b. Any mishappening / accident to any workmen at site of work & compensation payable to workmen
on this account, all liabilities arising out of any provision of Labour Act / Workman's Compensation
Act shall be the responsibility of the contractor. Any expenditure incurred by MAMC arising out of
the negligence of the contractor would be recovered from his bills / pending dues. The contractor
will be fully responsible for any mishappening with men & material/equipments.
c. The good conduct of all the workmen at work site.
d. The loss / damage caused to the property of MAMC or any other agency of the contractor or any of
his workman / employee.
e. The contractor may employ such employees, as he may think fit to ensure the execution of the
work to the entire satisfaction of Engineer-in-Charge. The employees would not be deemed to be
in the employment of MAMC for any purpose whatsoever. The contractor shall abide by the rules,
laws and regulations that may be enforced from time to time regarding the employment conditions
of service of his employees.
f. Under no circumstances whatsoever, MAMC would be held responsible to the labour of the
contractor. MAMC shall have the right to pass on the responsibility on the contractor for any
expense incurred by MAMC as a result of certain dues on the part of employees of the contractor.
MAMC shall be entitled to recover / claim dues / compensation from the contractor in that event.
g. The labour / employees engaged by the contractor shall not be below the age of 18 years and
above 58 years.
h. Further, the contractor would furnish an undertaking on non judicial stamp paper of appropriate
value by each and every worker employed by him, that the worker will not claim any lien as a
worker of MAMC for the services, he is rendering to the contractor.
i. The contractor shall also indemnify MAMC against any liability towards its labour for non-
compliance of laws etc.

12. TERMS OF PAYMENT

Subject to any deduction which the MAMC may be authorized to make under this contract, the
payment shall be made as follows “90% payment shall be made against the running bill or monthly
bills for the work done & balance 10% shall be kept as security which shall be released after the
satisfactory completion of one year contract including the period of guarantee / warranty”. No
interest shall be paid by MAMC on the security amount.

In case the AC plant remained closed/shutdown more than 25 days due to any reason, then
payment of that period shall be paid 60% of the quoted rate.

13. CONTRACTOR TO REMOVE INCOMPATIBLE LABOUR

On instruction of the Engineer-in-Charge, the contractor would immediately remove any person
employed on the work, who misbehaves or causes any nuisance or otherwise in the opinion of the
Engineer-in-Charge is not fit to be deployed on the work, such person shall not be re-employed or
allowed on the work without the prior written permission of the Engineer-in-Charge.

14 MODE OF PAYMENT

The payment shall be made through account payee cheque in favour of contracting firm on
monthly billing system by the MAMC, AGROHA (Hisar). No Bank charges etc. shall be paid by
MAMC.

15 INCOME AND OTHER TAXES DEDUCTIONS

The income tax plus surcharges and any other statutory levies required to be deducted by the
MAMC will be deducted at source at the rate applicable from time to time.

16 SERVICE TAX/GST

No GST will be paid extra until and unless it is liable on the services provided by the contractor and
specifically demanded for the same in his offer. However, non-claiming of GST from the MAMC by
the contractor cannot help the contractor in escaping from his liability to the Govt. against the
taxable supply service. In case, the GST the Contractor as per the contract charge the separately
the GST then the contractor will have to submit the proof of deposit GST claimed to the MAMC
authority.

17 TAXES AND DUTIES

No taxes or duties will be paid extra until and unless the same has been demanded by the firm in
its offer specifically. In case the same is to be paid by the MAMC, an undertaking is to be submitted
by the firm in this regard stating that the taxes or duties as claimed from the MAMC have been
dully deposited with the relevant authority.

18 EPF REGISTRATION

The contractor / firm should be registered with the Regional Employees Provident Fund
Commissioner, Govt. of India and should possess valid EPF Registration number. Contractor shall
ensure the deposit of monthly EPF contribution of his workers engaged on said works with EPF
Department in the accounts of the workers. Documentary evidence in respect of the amount
deposited for the previous month must be submitted before submitting the bill for the following
month by the contractor. Annual EPF inspection from the respective inspector is also required to be
submitted by the contractor before closing of the contract.

19 INSURANCE

Immediately before the commencement of the work, a group insurance policy of appropriate value
valid for the term of the contract in respect of all the workers deployed on work under Workman
Compensation Act 1923 shall be obtained by the contractor to cover up the risk of injury / death
/fatal / non-fatal accident. The documentary proof of the same shall have to be furnished with the
first running bill. The contractor shall be fully and wholly responsible for any mishappening, injury,
fatal / non-fatal accident sustained by him / his employees / workers at site during performance of
the work under the contract and MAMC shall not entertain any claim of this account. However, if
MAMC is forced to pay any compensation to any workman employed / engaged by the contractor,
the amount so paid shall be recovered from the contractor from his pending dues against this
contract or any other contract with the MAMC.

20 LABOUR LAWS

I. The contractor must get himself registered with the Labour Department, Haryana under Section-7
of Labour Contract Act 1970 / any latest amendment thereof.

II. He should also obtain a valid Labour License as applicable under Section 12 of Act for the work
awarded to him immediately after the allotment of work and a copy of the same must be
submitted alongwith the contract Agreement.

III. The contractor shall abide by all labour-laws required to be followed under Factories Act, 1948,
Industrial Dispute Act 1947, Workmen Compensation Act 1923,

Employees State Insurance Act 1948, EPF Act 1952, Payment of Wages Act 1936 & Minimum Wages
Act 1948 and other rules & regulations framed by Central / Haryana Govt. from time to time in this
regard.

IV. The contractor shall maintain necessary records viz. Register of wages, Muster roll / Attendance
register, Employment card / Gate Pass, Overtime Register and other necessary records etc. as
required under aforesaid Acts and the same shall be made available to the Engineer-in-Charge /
Project Authorities / Govt. of Haryana for checking / inspection as and when required.

V. The contractor shall indemnify the MAMC against all the obligations of the Labour Rules and
Regulations under any Statutory Act as mentioned above.

VI. The contractor shall submit an undertaking stating that all risks & responsibilities towards labour
will be owned by him.

VII. The contractor will engage labour after getting the character antecedents verified from the Police
department.

VIII. The workmen engaged by the contractor shall not be treated as employees of MAMC. The MAMC
shall have no relation with workers engaged by the contractor. An affidavit from the labour /
workmen shall be submitted by the contractor that they will not claim themselves as employees of
MAMC.

IX. The contractor shall deduct labour welfare fund @Rs. 5/- from each worker with employers share
@ Rs. 10/- per worker (i.e. total Rs. 15/- for each worker or any other further amendment by the
competent authority) deposit the same with the Welfare Commissioner, Haryana, Chandigarh and
present its documentary proof alongwith the bill.

X. The contractor shall made the payment/wages of his employee before the 7th day of each month
and proof of the same shall be submitted to the institute with his monthly bill of part A.

21 SAFETY RULES

I. Contractor shall have to comply with all the provisions of safety rules. The Engineer-in-Charge or
The Chief Safety Officer shall impose penalty of Rs.100/-per day per head if the workers of
contractor are found to be working carelessly or in violation of use of proper protective
equipments i.e. safety helmets, shoes, safety belts, goggles, ear plugs etc. and against violation of
any other clause. A penalty of Rs. 500/- per violation (minimum) shall be levied in case of repeated
violation. Further, if the violation made by the contractor / labour which may cause any serious
accident or direct loss to the corporation or threatens to cause severe consequences, the higher
penalty may be imposed including suspension / termination of the contract.

II. Following undertaking is also required to be submitted by the contractor :-

"I / We have gone through all the terms & conditions on safety regulations and undertake to
strictly enforce the same during the execution of this contract including mobilization period, if

any”. In case of violation of these terms & conditions, the MAMC is free to take action as deemed
fit.

III. In case of any fatal / non fatal accident or any other violation of Factory Act 1948. Pb Hr
Factory Rules 1952 or as per any latest amendment thereof under other Industrial or Labour Act
are made by / with the workers of the contractor and if prosecution is launched by Chief Inspector
of Factories, Chandigarh against occupier / Factory Manager or any other authority of MAMC, the
contractor shall be liable to deposit the amount of fine / penalty decided by the Court, on the same
day. In case of default, the amount will be recovered from the outstanding dues / liabilities of the
contractor against this contract or any other contract of MAMC.

IV. The liability of the injured person shall be borne by the contractor, irrespective of the location at
which the accident has occurred.

22 LOSS OF PLANT / MAMC PROPERTY DURING EXECUTION OF THE WORK

The contractor shall ensure that no damage or loss is done to MAMC / Plant property or any other
agency in the jurisdiction of work site. In case, it is found that there is any loss to the plant
equipment, MAMC property or human being due to negligence of the labour / worker of the
contractor, the same shall be made good to MAMC by the contractor at his own cost.

23 BREACH OF CONTRACT

If the contractor fails to adhere to the time schedule or if his services are found to be
unsatisfactory, the MAMC will be entitled at its option either:-

a) To recover damages as per penalty clause mentioned as above, if the said delay is not covered
under the Force Majeure reasons; or,

b) To get the work done from any other agency after serving a notice of three days to the contractor
at his risk and cost and without prejudice to the other provisions of the work order; or,

c) To cancel the contract by giving 15 days notice & forfeit the security.

Note: Both party can terminate the agreement in case of any Order/Instruction/Direction(s) of the
Government or Court, or Both parties also reserves the right to terminate the agreement by giving
six months prior notice without assigning any reason

24 CONTRACT AGREEMENT

The contractor shall execute a contract agreement on specific Performa on Rs. 300/- Non judicial
Stamp Paper of appropriate value within 7 days of date of issue of LOI / W.O. Cost of the stamp
paper will be borne by the contractor. The person who has signed the tender papers should have
got authority to sign on behalf of the contractor. If it is discovered at any time that the person so
signing has no authority to do so, the MAMC without prejudice to any other right or remedy
available to it, may cancel the contract and get the work done from any other agency at risk and
cost of the contractor. The contractor shall mean the contractor's legal representatives, successors
and assigns.

25 ARBITRATION

In all cases of disputes or disagreements between the parties arising out for the settlement of the
differences, the matter shall be finally settled by the Arbitrator appointed by the Director, MAMC,
Agroha & the dispute will be dealt in accordance with provision of the Arbitration & Conciliation
Act, 1996.

26 JURISDICTION

All legal proceedings in connection with contract shall be subject to the territorial jurisdiction of
local court at Hisar (Haryana).

27 ELECTRICITY / WATER

Electricity/ Water will be provided free of cost as per requirement of job. The contractor will use
electricity / water judiciously.

28 ACCOMMODATION

The contractor will be responsible for the accommodation of his employees / workers deployed for
execution of work. The MAMC will not provide any type of accommodation for their employees.

29 TRANSPORTATION OF MATERIAL

a) The contractor shall make his own arrangement for transportation of the material from site to
anywhere and by vice versa.
b.) The contractor shall make his own arrangement for removal of old as well as unused material from
the site to the place as specified by the Engineer-in-Charge after completion of work.

30 PRESERVATION & STORAGE OF MATERIAL

All the material issued to the contractor by the MAMC or brought by the contractor for its
bonafide use shall be stored and preserved against any loss, damage, shrinkages or deterioration in
any form. Any damage / loss suffered on this account shall be considered as loss due to willful
negligence on part of the contractor and shall be liable to compensate MAMC for these losses
suffered at penal rates to be determined by the MAMC. The rates charged for the purpose of
recovery shall be final and binding on the contractor.

31 SUPERVISION OF WORK

The Engineer-in-Charge shall have the general supervision of the work. The work shall have to be
started by the contractor as per the instruction of Engineer-in-Charge or his authorized
representative at any time on working day, on holiday or after office hours, and shall be confirmed
by post dated indent. The indent will indicate the date / time of start of work, details of work and
scheduled time of completion of work as per contract. The time allowed for a work maintained in
the indent will be addition of time of all the jobs / activities as per contract. The Engineer - in-
Charge may reduce the total cumulative time of various activities, keeping in view of emergency to
bring back the equipment in time. The total time allowed by the Engineer-in-Charge will be final &
binding on the contractor. He has the authority to stop the work whenever such stoppage is
necessary to ensure the proper execution of the contract. He shall also have authority to reject all
works or part thereof and give necessary direction to carry out work again to his satisfaction. No
claim whatsoever on this account will be entertained. The work shall be subjected to the inspection
by Engineer-in-Charge all the time.

b) The decision of Engineer-in-Charge shall be final with regards to all matters relating to his contract.

c) The decision of Engineer-in-Charge for determining the category of the work with reference to the
items not mentioned in scope of work shall be final.

d) The execution of work may entail working at all the sites and weather conditions and no extra claim
will be considered on this account. The contractor may have to carry out jobs and work round the
clock, as per the requirement to be decided by Engineer-in-Charge. No extra claim / over time will
be paid on this account.

e) In case the contractor fails to do the extra / substituted work, Engineer-in-Charge will have the
option to get the work done through any other agency at the risk & cost of the contractor.

f) In case of any dispute, the contractor may represent in writing to the Engineer-in-Charge.

32 TELEPHONE

MAMC will provide the landline intercom phone facility in the Central A.C. Plant for emergency
purpose.

33 AUTHORIZED REPERSENTATIVE

The firm will intimate (in writing) the name of authorized representative at site to whom necessary
instructions regarding the works can be imparted and who will make correspondence regarding
contract related issues. The signatures of the aforesaid authorized representative shall be got
attested from First Class Magistrate or Notary Public.

34 OWNERSHIP DEED

The firm will give ownership deed / partnership deed / proprietorship deed (as applicable) duly
attested by Notary Public for record and reference of his office.
