    Subject –withdrawal of undertaking dated 26-06-2015 and 19-12-2019 filed by the


    applicant to resolve the case of promotion viz-a-viz claim of Shri Azad Hussain
    and Balraj Sharma.

    Madam,

    The applicant most humbly submits as under-

    1. That with a view to resolve litigation filed by Azad Husain & Balraj Sharma against the
    applicant and the counter writ petition filed by the applicant against these two officials,
    the worthy Addl. Registrar convened a joint meeting of both the parties to the litigation
    to resolve the issue out of the court so that department can be saved from litigation.

    2. That in the said meeting the applicant was assured that in case he withdraws his case
    from the Honable High Court, his case for promotion to the post of inspector shall be
    cleared by the DPC within a period of 6 months. On this assurance the applicant gave
    an undertaking to the effect in the year 2019 and subsequently on 19-012-2019.
    Unfortunately since 2015 despite giving these two undertakings, the department has
    not resolved the issue of seniority /promotion of the applicant even though he has been
    promoted under ST quota and has his own roaster as per the reservation rules.

    3. Since the issue has not been resolved, I hereby withdraw both the undertaking
    reserving my right to get same determined to the judicial process/CAT.

    4. This application is given by way of an information to your good office that I am no


    longer bind by the undertaking given in 2015 and 2019.

    5. I would also request that I shall cooperate with the department in any effort to resolve
    the issue through departmentally.
