INTERNSHIP DURATION: 2ND NOV – 29TH NOV

PLACE OF INTERNSHIP: I had an opportunity to intern under the advocate Pravin H.

Parekh in High Court Delhi. He has about 1 associate in his office and 2 interns. Each intern is
assigned to one associate and is supposed to work under that associate, attend all court
proceedings every day and as many client-conferences as happens in a day. It was a pleasant
experience to be at office and meet various clients and work directly. Conferences happen in
the office as well as in Court. An intern here is expected to assist his/her assigned associate in
whatever manner. I was lucky to assist at his office and his hearings. Internship at Mr. Pravin
H. Parekh, apart from improving my legal knowledge and practical insights to law, increased
my work capacity as here literally all boundaries are pushed. Below is an account of a daily
diary followed by some of the work assigned and submitted.

 DAY-WISE SUMMARY

DAY 1 Date-2|11|2023
Place: - District and Sessions Court and High Court, Delhi

Course of Events:

• At around 9AM I reached at Pravin Parekh Office, for my internship. His chamber no.
is 322. I went to the chamber I introduced myself to Sir and his associates. Sir told me
about the rules and regulation, proper decorum that is needed to follow in the court
premises and court room especially. He told what to do and what not to do in the court
room. He asked me about my future plans and so I told.
• Sir introduced me to his clerical assistant and told me that if I have any doubt, I can
always ask her. Later, I tagged along with her, and I was shown the copy branch of the
court as well as the filling office. Later I went along with the junior advocates which
have already been working in that office and went to notary office with them. After a
while all of us came back to the chamber office.

Observation and learning:

• In the chamber Advocate sir asked the junior to prepare a bail bond/surety bond for a
client.
• The format was printed by using office laptop then the name and the amount were put.
The amount was 50,000 so with that copy of registry documents of a vehicle with
estimate value on insurance more than that of 50,000 and identity proof were attached
to it.
• This application was to be signed by two sureties and once it was done the same was
taken by junior for applying it in the court.

Observation and Learning:

• In the morning each occupant of the chamber had some tasks to do. So, I as an intern
assisted them with the tasks and learned the way of working of the office during a busy
day.
• Juniors were busy getting the exemptions prepared and applying them in the courts.

• I observed that a ticket is to be stamped on the application and it acted as the court
fee. Such ticket was dated with pen with date on which it is applied.

• Advocate sir was busy preparing the cross for a case set for today.

• After some time, I went along with Advocate sir to the courtroom on third floor.

Place:

Court of Ms. Swati Sehgal, Additional Session Judge courtroom no 20, District and
Sessions Court, Delhi

In the matter of:

State vs Abhishek and Others

 Matter is:

It was a matter of threat and grievous hurt for which the victim is present in the court
and giving his statement.

Stage of Matter:

Examination-in-chief of witnesses

Act and Sections involved:

• Section 503 IPC

• Section 320 IPC
• Section 506,326 IPC

Observation and Learning:

• Before entering the Courtroom Advocate sir checked the cause list on the outer wall
of the courtroom in which all the matters held for today were listed.
• After entering the courtroom Advocate sir reached to reader sir sitting in front of the
judge.
Two of the witnesses were also present from the accused side and two i.e., father and
his daughter were present in the courtroom.
• Investigating officer was also present as her presence was crucial for the court
proceeding.
• The public prosecutor started with her remarks by stating the facts of the case.
• Then after the due permission of the Hon'ble Judge the public prosecutor started
asking questions with one of the victims and the victim statement is recorded within the
provisions of CrPC.
• The father of the victim in his statement said that he confiscated the phone of one of
the accused's associates. Later, he received a threat call on the same phone as the
accused was aware of the situation.

 • The statement was given out in Hindi but was Tran scripted into English by the judge
and typed down by the writer (steno).
• After all the statement was given the public prosecutor gave the narration of the matter
himself and prayed before the Hon'ble Judge to give proper punishment to all the
accused.
• The father of the victim in his statement said that he confiscated the phone of one of
the accused's associates. Later, he received a threat call on the same phone as the
accused was aware of the situation.

Place:

Court of Ms. Renu Goyal Additional Session Judge court room no.4, District and
Sessions Court,

In the matter of:

State vs. Mohan Lal and Ors.

Stage of matter: Production Warrant

Matter is:

It is a case of Application for exemption from personal appearance of accused and

issuance of the production warrants of the applicant.

Act and Sections Involved:

• Section 21 N.D.P.S. Act

• Section 323,324, 506,148,201 of I.P.C.

Observation and Learning:

• The accused has been charged under NDPS act and different section of IPC. The
accused side i.e., the defence counsel is denying it.

• All of the accused has been arrested. Out of the 3 accused 2 has been granted bail from
the high court and one accused has been send to judicial custody.

 • All the accused were supposed to be present at the date of the hearing of the case.
While one is present other one is presented by the jail authorities and the third has filed
an application for exemption from personal appearance through his counsel.

• The Hon'ble Judge has taken the application and approved the exemption of one of
the accused. After hearing both the public prosecutor and defence counsel the Hon'ble
judge gave the next date of hearing.

• After hearing the proceeding, I learnt about a different act and its major section. I was
able to understand the different cases. And how to note down the points given out by
the client.

Observation and Learning:

• In the chamber a client entered who had been in contact with Advocate Sir and came
to the office as directed.

• Sir asked the junior to take out a copy of Vakala Nama from the cabinet.

• The client was asked to sigh the Vakala Nama and at the same time his identity proofs
were being photocopied.

• After that some payment was given by the client in cash and he was assured that his
work would be done. After this when the client asked if he could leave was sent by
Advocate sir.

Observation and Learning:

• In the Chamber a junior advocate was asked to prepare an application for putting up
the case file.
The application when printed was stamped and signed was taken to the court.

• I was also taught the process to apply the copy of a case file and how the cost is to be
calculated.

Place:

Court of Sh. Mayank Marwaha Civil Judge Jr. Division Court Room No.-9 District
Court, Delhi

In the matter of: - Ankur vs Sneha

Stage of matter: Prayer before the court

Matter is-

It was a suit for of Divorce and Maintenance which has been filled by the wife against
her husband.

Act Involved: -

 Section 13,25 of H.M.A. (The Hindu Marriage Act, 1955)

Observation and Learning:

• The wife's counsel prayed before the Hon'ble Judge to grant her divorce and
permanent alimony of a sum of 20 lakhs.

• According to her, before the marriage the petitioner family made it clear that the
petitioner will work and live an independent life.

• Also, that the marriage was solemnized as per Hindu rites and ritual. After one week
of her stay at the matrimonial home the petitioner saw the true colour of her husband
and husband's family. They stopped the petitioner from doing many things as the
petitioner wanted to work. The husband's family stopped her from re-joining her work.
Even so the husband's family took away all of her educational certificates.

• The petitioner counsel further prayed to grant the petitioner immediate divorce as she
could not carry on with her life.

• The respondent counsel prayed before the Hon'ble Judge to grant the respondent
Restitution of Conjugal right under section 9 of the Hindu Marriage act as the wife had
left the matrimonial home within the week as the petitioner had mis-judged the
respondent family.

• Then after hearing both the parties the Hon'ble Judge decided to listen the rest of the
case on another day.

Place:

Observation and Learning:

• There was a reference diary being used in the chamber on which the previous date,
next date as well as the name of the court was updated.

• The diary provided the convenience to all the members of the chamber in case
advocate sir were not present and it helped avoiding the situation of missing out any
date.

• The diary was updated on daily basis and could be done by anyone working in the
office.

Place:

Court of Ms. Justice Pratima Singla, District and Sessions Court, Delhi

In the matter of:

Hariom Steel vs. Shri Dhan Lakshmi Steel

Stage of matter: Evidence

Matter is: -

It is a case of dishonour of cheque due to insufficiency of funds. And till now the
company has not received its payment.

Act and Section involved:

• Section 138 Negotiable Instrument Act.

• Section 3 of the Evidence Act.

• Order 18 Rule 4(2) of the CPC.

Observation and Learning:

In this case the cheque was presented within a period of its validity of 3 months.
However, once notice is served and amount is not paid within stipulated period, the
cause of action prosecute starts. Accused counsel was praying before Hon'ble judge for
more time as the counsel was gathering more evidence related to the case.

 • After a few minutes of discussion and debate Hon'ble judge took a small break and
went to her office.

• After 20 minutes court again started. This time again some new facts were shown in
the court room. About which the accused counsel had no idea of. The accused side
asked the other side to give him the copy of new evidence. Then he again prayed before
the hon'ble judge to give it to the counsel.

• After some time of going through the new evidence was not known to him. A long
discussion took place and after that the Hon'ble judge passed an order to give counsel
side answer after 2 weeks from today.

• After hearing the proceeding, I observed that court proceeding was covering many
cases on daily basis, and the matters of many cases were disposed immediately.

• Throughout watching the cases progress I realized how fast court processes are, as the
magistrate opened the trial and immediately heard from both prosecutor and defendant.
I observed that the magistrate generally maintained eye contact with whomever was
presenting their argument centred all his attention on them.

Entry 11

Place: Judicial Courts Complex, Sector 76, Sahibzada Ajit Singh Nagar, Punjab

Observation and Learning:

• The Court environment in Mohali was a little different from that of Chandigarh court.
The infrastructure of the building differed in ways like parking was underground,
hallways were longer, the entry of courtrooms differed on each floor.

• Sir after having a cup of tea in his chamber went to meet his associate and I tagged
along with him while carrying the files and my diary.

• After then we went to a courtroom on third floor and met some client, sir went into
the courtroom and after he came out asked them to wait if they are called in for their
proceeding..

Entry 12

Place: - District and Sessions Court, Chandigarh, Punjab

Observation and Learning:

• While I was going from court parking area to our chamber room someone asked me
about where traffic challans are to be submitted.

• Since I only had a clue that it's a possibility and were not aware of the whole process,
I called the munshi of our office asking about the same.

• After talking to her on the phone, I brought those people with myself so that I could
introduce them to her.

 • Once that was done, I followed the same routine as usual. Later, during the lunch
break I asked one of the juniors about the process of getting the challan submitted.

• I learned that it was somewhat similar as filing a fresh case. Also, I was told that why
reputed lawyer doesn't refer getting it done by themself as it stains their image among
others

Place: Lawyer's Chamber, 99 Neeti Bagh, New Delhi

Observation and Learning:

• I reached early and waited for sir to arrive, once advocate sir got there, we entered the
chamber.

• Sir carried some files with himself which he placed on the table, I asked sir and took
a file folder to read.

• When I was done reading sir asked me to write down an application for exemption. I
had a photo of the application from earlier in my phone which I used as example.

• Once done writing the application, I took a photo of it and then handed it over to sir
so that he could check it.

• After that I stamped the application, and I went to the courtroom to apply. Once the
matters in Mohali court were dealt with, we came to High Court Delhi.

Entry 14

Place: Court Complex, District and Sessions Court, Chandigarh, Punjab

Observation and Learning:

• As I reached our chamber at District and Sessions Court, Chandigarh, I was asked to
escort a client to the courtroom for his attendance and collect the cost which he was
going to receive with the direction of the judge.

• After waiting the opposition party showed up and with the direction of the court
handed over an amount of seven hundred rupees in cash. This was later submitted to
Advocate Sir.

 • After this I stayed in the Chamber reading the case files, while sir was busy on the
phone communicating with the clients.

Observation and Learning:

• As I reached our chamber it came to my knowledge that for one of the matters set for
today, the parties were directed to mediation by the court.

• So, I along with a junior went to the mediation centre which was in the same building
as that of notary office just on second floor.

• We were just supposed to check if the parties showed up for mediation and after
mediation process escort our client to the chamber.

Stage of matter:

Evidence by way of Affidavit

Matter is: -

cases on daily basis but for most of it new date of hearing was being given out.

Observation and Learning:

• I reached the court early as usual just because I did not want to miss out any learning
opportunity and get the most productivity out of it.

• When advocate sir reached, we altogether entered the chamber and shortly after that
went to the court complex.

• Sir gave me some files to hold as walked through the corridor and asked to hand over
different files from time to time.

• While some to the clients were asked to wait of the whole day some were shortly freed
to leave.

Place: Court Complex, High Court, Delhi

Observation and Learning:

• When I was on our way to the chamber, I received a call from the munshi, and we
were asked to attend to a client standing in front of a courtroom.

• Also, I was asked to inform if our case has come up, so that advocate sir would reach
there when required.

In the matter of: Jaspal Kaur Versus Didar Singh and Others

Stage of matter:

Waiting for reply to the application

Matter is: -

The applicant on the last date of hearing applied an application in front of the court
seeking permission from the Hon'ble court to file a fresh suit.

Observation and Learning:

• I entered the courtroom with the junior and saw that the judge wasn't there.

• So, the junior reached the reader mam and asked about the case.

• Reader mam asked to check the tray in which all the order copies are stacked.

• I learned that for such application to be approved cost is to be paid and the same is
mentioned in the application.

Place: Court Complex, District and Sessions Court, Chandigarh, Punjab

Matter is: - Superdari to get the vehicle out of the custody.

Observation and Learning:

• The client and his brother were sitting in the chamber waiting for advocate sir.

• As the conversation started, I heard that our client's bike was falsely taken away from
him by the police just on the basis of suspicion.

• Sir asked the junior to prepare a file of superdari bail bond and apply it in the filing
branch.

• I assisted the junior and did most of the work so that I could learn how its done.

• I learned that through superdari custody of something is handed over to a person till
the next order and the person receiving the vehicle gives an undertaking on his behalf
or on behalf of a person who has authorised him.

Place: Judicial Courts Complex, Sector 76, Delhi High Court

In the matter of:

State of Punjab Versus Mohal Lal and Ors.

Stage of matter:

Applying for exemption and issuance of the production warrants.

Observation and Learning:

• The accused was supposed to be present at the date of the hearing of the case.

• On the application it was mentioned that the accused was out on bail in this matter but
was behind the bars for some other offence.

• The court must wait till further orders were given by the other court.

Place: Court Complex, District and Sessions Court, Delhi

Observation and Learning:

• We were sitting in the chamber reading case files. As I observed most of the matters
were disposed or decided. within 2-3 years of time period.

• After that we went on a walk in the corridor with advocate sir and visited some other
advocate's office.

• From their conversation we learned the process of getting a chamber in session court
as well as the high court and difference between the two.

Observation and Learning:

• I was assigned to do some research work on legal propositions for a civil matter. I was
also given some drafting work. Later that day, I went to the Chamber in order to attend
a scheduled client meeting.

• Client meeting was related to a criminal case and our client was complainant in it.

• My task was to observe the meeting and write down the information being provided
by the client. I learned that it is very important to hear the client patiently and if he is
not able to present facts clearly, then they should be asked questions related to the case.

• The questions should be such that they are able to present a chronological picture of
the whole case.

Place: Saket District Court, New Delhi

Observation and Learning:

•I visited Saket District Court where I attended court proceedings in the matter relating
to execution. Decree was passed in favour, so I learnt the procedure decree is passed
like how Nazarat officer has to file his report, bailiff is appointed etc.

•Later that day, I was given work to Draft a complaint U/s 138 of Negotiable
Instruments Act, 1881. During my internship, I learnt that good drafting skills play a
vital role in the case. If you are able convey your case through drafting, you can win
half of the case at the beginning only.

•Later, I visited State Public Service Tribunal Delhi with my Ld. Counsel Mr. Pravin
Parekh sir I observed arguments on the application on the condonation of delay. The
Ld. Judge of the Tribunal heard arguments and condone the delay with subject to cost
of Rs. 2,000/- on the applicant.

Observation and Learning:

• On this day I drafted a legal notice for suit for recovery which is attached herewith
below. I was also asked to do legal research work on a criminal matter.

LEGAL NOTICE FOR SUIT FOR RECOVERY

Dear Sir,
On behalf of and under the instruction of my client, Sh. Rajiv Sehgal, S/o Sh. Inder Raj
Sehgal, R/o -29, Indira Park Ext. Gali No. 8, Near Krishna Nagar, Delhi, I have been
authorized and instructed to serve upon you this legal notice.

•That my client is the self- made business man, running his business under the head of
M/S RAJU TRADING COMPANY, dealing in the manufacturing and trading of the Oil
Engine spare parts.

•That my client was in continuous business relationship with you from almost last one
decade. •The orders placed by you were always delivered by my client and on the other
hand the bills raised vide GR No. 39729 dated 28-12-16 of amount Rs 25,398/-, by my
client were paid by you in the reasonable period of time.

•That the last order placed by you to my client for the supply of the good was also duly
delivered to you by my client on time, but the payment for this order placed by you for
Rs. 25,398 is not yet delivered to my client. The amount of this transaction is pending
for approx. one year.

•That my client visited your office, Addressed Raghunath Ganj, Katni, Madhya Pradesh
several times in this 1-year period to collect the due payment of the good supplied to
you. But every time you made a false promise that you will deposit the due amount of
money in the account of my client.

 •That several times my client called you on your mobile number and also on your office
number but every time only new excuses were given to my client for the delay of the
due payment. That my client waited for all this long time due to the respect of the
business relation that he had with you from last 1 decade.

•That with your repetitive excuse for non-payment of the due amount, it is clear that
you don’t have the good intention to pay the due amount of the last order placed by you
to my client. We, therefore, call upon you through this legal notice to pay Rs.25,398/-
i.e. (Twenty-Five Thousand Three Hundred Ninety-Eight) with interest @24% p.a.
which is the market rate, trade practice and general usage.

•Take notice that you are liable to comply with this legal notice latest within a period
of 15 day-time from the date of receipt of this legal notice failing which my client will
positively initiate civil suit for recovery of money in courts against you entirely on your
risk and cost which you may please note. Take further notice that you are also liable to
pay Rs.11,000/- being the cost of this legal notice within same 15-day time as stated
above, along with the amount claimed above. Copy Kept.

In Matter Of: Oriental Air Conditioning Vs. Dimple Enterprises

Observation and Learning:

• I Visited in the Court of Judge Ms. Ruchi Asrani, in the case of Oriental Air
Conditioning Vs. Dimple Enterprises and under the guidance of Pravin Parekh Sir,
Ld. Counsel, I observed that the court proceedings at the state of Examination of
witness who was employed in Bank.

•Witness was firstly examined by Plaintiff counsel and thereafter he was cross-
examined by Defendant counsel Ld. Sh. Dalip Singh and his evidences were tendered
by way of affidavit before the court.

•Statement of the witness was opposed by the counsel for Defendant as he deposed
falsely and all three document which were produced by him before court were fake.
After heard arguments of both parties, Ld. MM Judge gave next date of hearing.

•This was the last day of Internship, wherein Sir congratulated me for working very
hard and diligently during my internship. Later on, Sir gave me my certificate of
internship and wished me best of luck

 CONCLUSION

Summarizing it all, I would like to deliver the message that the real legal practice is
completely different from the theoretical version of law which we learn about through
books. Without exposure to the actual working of the profession, one cannot gain the
experience that is requires to progress in his field and attain success. Through books we
get the body of law, practice of law gives it the soul required to run that body.

I was amazed to see how lawyers can use the law to their benefit and their opposition
by drafting turn the case around using the same law. I also observed that law is
constantly developing and changing as per the applicably.

This Internship helped me expand the horizons of my knowledge and happy I chose to
spend my time in court trying to learn as much as I can while avoiding wasting my time
on other things that can wait in life. Cause if I master this early on in my life, I would
be given the opportunity to do the other things and in a better way.

 WEEK WISE SUMMARY
This internship is divided in 4 weeks. Every week a topic was given to each intern and
they had to do research and write an article on that topic. My topic are as follows:

WEEK 1
In week 1 research topic was on Deepfake Technology:
Research Activities:
• Reviewed academic journals and legal articles on the technical aspects and legal
implications of deepfakes.
• Analyzed relevant case studies in the US and India regarding deepfake-related
defamation and privacy violations.
• Read Interviewed article on newspaper of a cybercrime expert on the challenges
of investigating and prosecuting deepfake misuse.
Article Progress:
• Developed an outline with sections on the potential harms of deepfakes, existing
legal frameworks, and proposed solutions.
• Drafted the introduction, outlining the pervasiveness of deepfakes and their
threat to individual rights and social trust.
• Researched the California Deepfakes Video Technology Detection and
Disclosure Act for a comparative analysis.
• Researched on the latest Deepfakes Video of popular actress Rashmika
Mandhana

WEEK 2.
In week 2, I was given opportunity to research on Adultery Laws in India:
Research Activities:
• Studied the historical evolution of adultery laws in India, particularly the
decriminalization in 2018.
• Analyzed the Supreme Court judgment in Joseph Shine v Union of India,
understanding the social and legal arguments underlying the decision.
• Interviewed a family law advocate on the practical implications of the
decriminalization for divorce proceedings and domestic violence cases.

• Created an outline with sections on the history of adultery laws, the landmark
judgment, and the current legal and social landscape.
• Drafted the first section, explaining the previous penal provisions and the
arguments for and against their removal.
• Researched similar debates in other countries like Singapore and Malaysia for
a comparative perspective.

WEEK 3.
In week 3 I was given opportunity to research and write an article on Road Rage in
India:
Research Activities:
• Reviewed statistics and reports on road rage incidents and fatalities in India.
• Analyzed academic research on the psychological and societal factors
contributing to road rage.
• Interviewed a traffic police officer on the challenges of enforcement and
awareness campaigns.
Article Progress:
• Developed an outline with sections on the prevalence of road rage, its causes
and consequences, and potential solutions.
• Drafted the introduction, highlighting the severity of the issue and its impact on
safety and mental health.
• Researched international initiatives and best practices for tackling road rage
through driver education and traffic calming measures.

WEEK 4.
In week I researched on the topic on Access to Justice through Pro Bono Legal
Services:
Research Activities:
• Reviewed reports and analyses by NGOs and legal aid organizations on the
access to justice gap in India.
• Studied the role of pro bono legal services in bridging this gap and providing
representation to disadvantaged groups.

 • Interviewed a pro bono lawyer at Know Law about their experiences and the
challenges faced in the field.
Article Progress:
• Created an outline with sections on the access to justice gap, the importance of
pro bono services, and success stories of pro bono initiatives.

limitations of the existing legal system for underprivileged communities.
• Researched pro bono programs abroad, particularly in the US and UK, for
potential adaptations and inspiration.

 SUMMARY

This period on 30 days has been productive and insightful. I have made significant
progress on all four research projects, conducting initial research, developing article
outlines, and drafting introductory sections. The interviews with experts provided
valuable insights and practical perspectives that will enrich the articles. I am excited to
continue my research and delve deeper into each topic in the coming weeks.

Continue my research on each topic, focusing on gathering specific data, case studies,
and expert opinions.
Draft the remaining sections of each article, ensuring a comprehensive and balanced
analysis.
Edit and refine the articles, ensuring clarity, coherence, and proper citation of sources.

Challenges:

The main challenge I encountered this week was juggling research on four diverse
topics simultaneously. To overcome this, I have developed a schedule and allocated
specific time slots for each project.
