    AN ORDINANCE DECLARING SANCHEZ MIRA, CAGAYAN AS A "NO BLACK SAND
    MINING MUNICIPALITY"

    WHEREAS, Republic Act Nc>. 7160 cptherwise known as the Local Government
    Code of 1991 provides, in part, that all Local Government Units (LGUs) are
    mandated to exercise their pc}wers to enact statutes for the protection anc]
    promotion of general welfare within their territorial jurisdiction;

    WHEREAS, the Local Government Unit is the primary agency, other than the
    Department of Environment and Natural Resources (DENR) responsible for the
    protection, conservation, management development and proper use of its
    environment and natural resources;

    WHEREAS, everyone is aware of the destructive impacts of black sand mining to


    the environment;

    NOW THEREFORE, on unanimous accord of all the members;

    BE IT ORDAINED by the Sangguniang Bayan of Sanchez Mira, Cagayan, in a


    session herein assembled that;

    SECTION I. Shorl title -This ordinance shall be known as "THE ANTl-BLACK SAND
    MINING ORDINANCE OF SANCHEZ MIRA, CAGAYAN".

    SECTION 2. Declaration of Policy


    lt is the policy of this Local Government Unit to exercise its powers to
    protect and promote the general welfare of all its human and natural resources.

    SECTION 3. Objective

    lt is the objective of this ordinance to STRICTLY PROHIBIT THE


    CONDUCT OF BLACK SAND MINING WITHIN THE TERRITORIAL
    JURISDICTION OF SANCHEZ MIRA in c)rder to prc)tect its natural
    environment from severe damage.

    SECTION 4. Definition of Terms

    The following terms are defined as used on this ordinance:


    a. BIack Sand Mining - refers to the collection of sand wherein its
    black particles knc)wn as magnetite are collected.
    b. Territorial Jurisdiction - refers to all land areas and inland waters
    within the municipality including waters fifteen (15) kilometers from
    the shoreline,

    SECTION 5. Scope and Coverage

    This ordinance shall apply to all individuals or companies with an intention


    to cc>nduct black sand mining, both land and water, within the territorial
    jurisdictic>n of Sanchez Mira, Cagayan.

    SECTION 6. Separabilfty Clause

    lf any part of this ordinance shall be declared by any competent authority


    as invalid, other parts not affected shall remain in effect.

    SECTION 7. Repealing Clciuse

    All ordinances, resolutions and administrative issuances inconsistent


    herewith are hereby repealed and or modified accordingly.

    SECTION 8. Effectivify

    This ordinance shall take effect upon its approval and posting as required
    by law.
