AN ORDINANCE MANDATING THE PLANTING AND GROWING OF TREES IN THE
MUNICIPALITY OF SANCHEZ MIRA AND FOR OTHER PURPOSES.

Be it enacted by the Sangguniang Bayan of Sanchez Mira herein assembled

that :

Section 1. Shah Title -This ordinance shall be known as the "TREE PLANTING AND
GROWING ORDINANCE OF THE MUNICIPALITY OF SANCHEZ MIRA, CAGAYAN."

Section 2. Declaral'ion Of Policy, -it is the policy of the Lc>cal Government Unit c>f
Sanchez Mira to suppc)rt the Billion Trees Program in compliance in
Memorandum Circular 2011-21 issued by the Department of Interior and Local
Government to mitigate climate change.

Section 3. Definition Of Terms. - For purposes of this ordinance, the following

phrases/terms are hereby defined:
a. To Grow -take care of the plants for a period of time.
b. Ecoparks -refer to areas having abundance c)f trees, plants, grasses and
various facilities (such as benches, playgrounds, fountains and othe
eciuipment) that allow people to enjoy the leisure and rest.
c. Open qreqs - refer to open portion of land that are undeveloped and
have no buildings or structures
c]. School Campus - refers to the lot where the school is situated including
other lots owned by the same educational institutions.
e. Road slde -side of either National, Prc]vincial or Barangay road.

Section 4. Scope and Coverage

The following are required to plant and grow trees under this ordinance:

1. All franchisee of tricycle;

2. All First Year High School and College student recipients of LGU
Schc]larship and Financial Assistance Grants.

Three seedlings suited in the designated planting areas per approved

Municipal Tree Planting Master Plan (MTPMP) Ecopark, Open Areas, School
Campus, Roadsides, Riverbanks, Cocoland shall be planted by those required tc>
plant and grow trees by this ordinance, Planted seedlings shall be provided with
tree guards labelled with the planter's name. (for uniformity, see attached
illustration of tree guard and label)

SMTODA Zone Presidents and Barcmgay Captains from where the

franchisee resides shall designate the area to be planted per (MTPMP) and shall
inspect the planted seedlings before issuing a certificate of compliance as a
requirement for the release of the franchise. A certificate of tree survival of the
same planted seedlings issued by the Barangay Captain and SMTC)DA Zone
President is required for the renewal c>f the franchise.

Schc}ol Heads shall designate the area to be planted within the premises
of the school campus. In case of limited area in the campus, the school head
shall coordinate with the MENRO to identify areas to be planted per (MTPMP).
Cc}nsolidated Certificate of Tree planting compliance signed by the School
Head is a requirement before the release of the LGU financial assistance. Fc>r
subseciuent releases, an annual consolidated c:ertificate c)f tree survival is
required until the student graduate.

Section 5. Establishment of Seedling bank.

For the continuous supply of seedlings to be planted, a seedling bank shall
be established in a portion of the lot owned by the Municipal Government at
Sitio Carillc], Dammang, Sanchez Mira. The Seedling bank shall be established
ancl maintained by the Municipal Environment and Natural Resources C)ff ice in
cc>c]rdination with the Municipal Agriculture C)ffice with the suppc]rt c]f Sangera
members who are recipients of farm inputs. Sangera members are requested to
submit seedlings of coconut and other trees as they receive their farm inputs.
These seedlings shall be stored in the seedling bank to be planted by required
participants c)f this c)rdinance.

Section 6. Municipal Tree Planting and Tree Growing Working Committee

There shall be created LGU Sanchez Mira Tree Planting ancl Tree Growing
Working Committee composed of the following:

Functions of the Working Committee.

a. To prepare and adopt the Municipal Tree Planting Master Plan.
b. To ctversee, monitor and evaluate the implementation of the
Ordinance;
c. To attend regularly in all meetings of the Tree Planting and Tree
Growing Committee and participate in the deliberations

Section 7. Budgetary Requirements -The Municipal Government shall allocate
funds under the Municipal Environment and Natural Resources C)ff ice for the
implementation of this Ordinance.

Section 8. Scinctions, Prohibited Acts clnd Penalties,

For non-cctmpliance to the provisions ctf this C)rdinance:
• NO Tricycle Franchise shall be issued.
• LGU Financial assistance of ciualified students will nc)T be
released.

a. Prohibited Acts and Penalties

• Any persc>n who cuts down or willfully cause any destruction to
the plantecl trees in the areas provided for by this Ordinance
shall be fined One Thousand Pesos (F1,000.00) and required to
plant and grow 3 seedlings of the same tree in areas
designatecl by the Municipal Environment and Natural
Resources C)ff ice.
• Owners of animals that cause any clamage to the plantecl
seedlings shall be fined Five Hundred Pesos (P500.00) and
Recommended required tc> change/replant the damaged seedling,
for deletion by • Any person who remove or destroy tree guards shall be fined

Section 9. Repealing Clause. -All ordinances, orders, rules and regulatic>ns which
are inconsistent with any of the provisions of this Ordinance are hereby repealed
or modified accordingly.

Section 10. Separability Clause. - lf for any reason c>r reasons, any part
provision of this Ordinance is held to be unconstitutional or invalid, other parts
provisions hereof not affected thereby shall continue to be in full force and in
effect.

Section 11. Effectivify Clause. -This ordinance shall take effect upon approval
and due publication as required by Law

"RESOLUTION APPROVING ORDINANCE NO. 2021-01 0F THE

SANGGUNIANG BAYAN OF SANCHEZ MIRA, CAGAYAN"

Submitted for review is the Ordinance No. 2021-01 of the Sangguniang Bayan of
Sanchez Mira, Cagayan entitled: "AN C)RDINANCE MANDATING THE PLANTING AND
GROWING OF TREES IN THE MUNICIPALITY a SANCHEZ MIRA, AND FOR OTHER PURPOSES".

WHEREAS, the last phrase under Section 8, paragraph 8, which states "All collected
fines shall accrue to the General Fund of the LGU of Sanchez Mira", declared invalid,
since all collected fines shall accrue to the national government. Thus, the Body
recommends for the deletion of the said provision;

RESOLVED, as it is hereby resolved, to approve the Ordinance No. 2021 -02 c}f the
Sanggijniang Bclyan of Scinchez Mira, Cagayan, 5ubjec:t to the deletic>n of the last
phrase under Section 8, paragraph 8. of the said ordinance,

RESOLVED FURTHER, that a copy c}f this Resolution be transmitted to the

Municipality of Sanchez Mira, Cagayan, for its information and appropn.ate action.
