from any charge or encumb rances on the terms and

NOW THESE AGREEMENT WITNESSETH AND IT IS HEREBY


AGREES BY AND BETWEEN THE PARTIES HERETO AS
UNDER:-
1. The Purchas er has paid to the Vendor a sum of Rs.
50,000 /= (Rupees Fifty Thousa nd Only) by Axis Bank of
Vejalpu r Branch, . Ahmeda bad vide NEFT
No:AXOMB07127685533 on dated. 11-03-2 024 and
another Rs. 10,50,0 00/= (Rupees Ten Lakhs Fifty
Thousa nd Only) by NEFT No: AXOMB 1227654 8948 of
dated. 01-05-2 024 drawn on Axis Bank of Vejalpu r
Branch , Ahmed abad on or before the executi on of this
agreem ent to sale as earnest money i.e (amoun t of
Bana/T oken Money) and the balance amount of the sale
conside ration price will be paid on or before at the time
of comple tion of sale of the Said Flat against executi on
and registra tion of Deed of Convey ance/Sa le Deed, and
also against handing over of the absolut e and vacant
possess ion of the Said Flat by the Vendor to the
Purchas er.

4, The Ve nd0 r shall within a period of this agreemen t make
out a title to the Said Flat clear and marketab le free
from any charge, lien or encumbra nces etc.
s. All outstandings amounts prior . to the date of
c~mpleti on of the sale of the Said Flat such as
Ahmedab ad Municipal Corporation Taxes, Electricit y
bills, Society maintena nce charges or any other
governm ent dues will be get cleared by the Vendor.
6. If, inspite of the Vendor's readiness and willingne ss to
complete the sale, the purchaser fails to complete the
transacti on of Sale within stipulated period of 45 days
herein, the Vendor shall be entitled to forfeit the
amount of earnest money paid by the Purchase r to the
Vendor and this agreemen t shall stand automatic ally
cancelled without any prior notice to the Purchase r and
the Purchase r shall not be entitled to claim any type of
rights on the Said Flat and the Vendor has right to sale
the Said Flat to any other person or either the conflict
issue can be amicably resolve by mutual understan ding
of both the parties.
7. The Vendor declares that the possessio n of the Said Flat
is not handed over to the Purchaser .
8. The Purchase r has to make full payment of sale
considera tion price which is fixed under this agreemen t
before the execution of Sale Deed without any default.
9, The Purchaser will not have any type of right on the
Said Flat or any other right of possessio n until the Deed
of Conveya nce/Sale Deed of the Said Flat is registered
and fall and independ ent n is given to the
