    dated 08.04.2010 in Suit No. 122/06, vide

    which suit of the plaintiff has been

    Dismissed and Counter Claim of the Defendant

    no. 1 to 4 has been Decreed by Civil Judge

    (Jr. Div.), Dhuri; with a prayer to accept

    the appeal and to decreed the suit of the

    plaintiffs with costs and to dismissed the

    counter claim of the defendant no.1 to 4.

    Sir,
    The grounds of appeal are submitted as under:-

    1. That the judgment and decree under appeal

    was announced on 08.04.2010. The appeal is being filed

    today within the period of limitation. The Certified

    copy of judgment and decree dated 08.04.2010 are

    attached.

    2. That the judgment and decree under appeal

    are against the law and facts of the case.

    3. That the ld. Lower court has not properly

    and meticulously examined the evidence of the

    plaintiff. The evidence of the plaintiff clearly shows

    that the plaintiff is entitled to the relief as prayed

    for.

    4. That the facts of the rulings cited by the

    Plaintiff are fully applicable to the facts of this

    case.

    5. That the judgment and decree of the ld.

    Lower court are based on surmises and conjectures and

    the same is liable to be set aside.

    It is, therefore, respectfully prayed that


    the appeal may kindly be accepted and judgment and
    decree dated 08.04.2010 may kindly be set aside and
    suit of the plaintiff may kindly be decreed with costs
    and counter Claim of the defendant no.1 to 4 is
    dismissed with cost.
