Purpose of the Inspection

At the request of Buyers, the undersigned marine surveyor did attend W42#22 at Cesenatico, Italy on
13 February 2024 whilst side moored, hauled out and during sea trials.

The purpose of this marine survey inspection was to determine, insofar as possible within the
limitations of visual and physical accessibility, through non-invasive and non-destructive means, her
present condition and levels of compliance with the sales contract and commonly accepted industry
standards and practices. This report is not to be used for any other purpose.

Unladen Displacement: 9,5 tons

Engines: 2 x Volvo Penta D6-440, each producing 440 hp @3700 rpm

Fuel capacity: 1.180 ltr

Water capacity: 200 ltr

She was a typical Wallytender 43.

Measurements and capacities were taken from available published information. The surveyor made
no actual measurements.

Survey Details

1. Hull and Topsides

The yacht’s hull was inspected whilst she was hauled out by travel lift at Cesenatico Marina.

The overall condition of the underwater hull area was as new.

Despite of the fact that the yacht had been launched two months ago antifouling was in perfect
condition. Antifouling next to the underwater light, scupper and bow thruster tunnel had obviously
been applied (or touched up) at a different point in time compared to the rest of the hull hence cut
lines.

Anodes were noted with some wastage. It was requested that they are renewed prior to delivery.

The bow thruster was noted with some gear backlash. It was subsequently confirmed by the maker
that this backlash was normal.

Paint polish paste remnants were witnessed at places. Some marks witnessed at places were removed
during the inspection.

In way of balconies a soft compound is glued on to the hull to keep sea water from entering the open
deck area when at closed position. Though aesthetic, the sealant glue compound was not nicely
applied.

Towing eye hooks were installed port and starboard in way of allegedly reinforced areas of hull.

Serial number plate on the transom was not the correct one. Subsequently it was confirmed changed
to reflect actual date ….A424.

The anchor locker cover was noted installed misaligned. Subsequently it was confirmed rectified.

2. Open Main Deck

A hull joint was visible when the balconies were open. The one on the starboard side was noted not
properly sealed. It was subsequently confirmed that it was retouched.

As mentioned earlier in the report, in way of balconies there was a soft compound glued on to the
hull to keep sea water from entering the open deck area when at closed position. There was a
rubberlike friction sound emanating from the joint when opening or closing the balconies. It was more
intense on the starboard balcony. It is believed that in the future this noise will decrease as the soft
compound will wear/compress.

Teak margin planks were noted installed without any caulking at their ends. It was confirmed that this
is standard Wally practise. However, it was also noted that in some of these ends glue had emanated
on the edge. We requested its removal and were subsequently advised that “Due the temperature and
humidity the teak planks were swollen, so pushing a bit the caulking "out". If we cut them to be at the
level of the teak with this temperature and humidity they would be not enough with summer
temperatures. We suggest keeping it as it is, check with usual weather and temperature”.

A couple more points on the decking as follows: a. Forward starboard of helm caulking was not nicely
applied. b. Forward port side margin plank edge was not evenly spaced across the breadth of the plank.

The aft awning was roughly installed and noted saggy. It was supposed to be fixed. Photos that were
subsequently received indicated that the awning was not sufficiently stretched out. Clarifications were
requested.

Paint polish paste remnants were jointly witnessed at places. Light polish marks were noted on blue
paint flat surface on aftermost part starboard side before rubbing strake and on the black flat inclined
surfaces supporting the hard top aft. It was requested (and agreed) that this comment should be added
in the delivery documentation.

3. Under Main Deck

The accommodation area was packed with the outside cushions etc. outfit however there was space
for an overall inspection and testing of the systems (lights, ac, toilet operation).

4. Machinery

There were three compartments containing various machinery.

As a general comment the machinery compartments appearance was very good.

They were all accessible through hatches flush on deck, manually operated except for the engine room
hatch that was operated by hydraulic cylinders.

The forward compartment accommodated the water heater, freshwater pump and manifold, ac chiller
plant, cockpit ac compressor and fan coil unit, grey water tank, black water tank, electronics
motherboards, main power distribution breaker, electrical power breakers switchboard, fire alarm
panel.

A couple of points worth mentioning:

1. The chiller condensation tray was marginal in size. Some drops of condensation may
eventually go outside of it.

2. Some superficial painting was noted on the top port side, however it was not very obvious.

The compartment in the middle was just forward of the engine room.

It accommodated the fuel oil tanks, gyro stabiliser, battery charger and storage for passerelle
upstands, shore power cable etc.

The engine room accommodated the following machineries:

1. 2 x Volvo Penta D6-440, each producing 440 hp @ 3700 rpm


Serial numbers were A1222572 for the port and A1222571 for the starboard respectively.
2. Masse generator set, VS 8.5, 8,5 kW, 50 Hz, 230VAC
3. Battery charger
4. Remotely operated fire extinguisher
5. Starting batteries for main engines and generator as well as service batteries.
6. Passerelle box
7. Shore power breaker
8. Anchor light mast

There was a hatch door on the forward port side bulkhead leading to the compartment just forward.
Practically it could be accessed by a person very small in size.

5. Sea Trials

Trials took place on 13 February 2024. The loading condition was fuel oil 470 liters against a full load
of 1.180 liters and fresh water of 200 liters against a full load of 200 liters. Total 5 persons onboard.

Sea state was good with significant wave height of 0,5/0,6 meters. Air temperature 12 deg. Celsius.

Engines controls were on synchro mode.

A summary of the speed trial was as follows:

• Gyro stabilisers on and off
• Windscreen wipers and wash
• Horn
• Passerelle
• Shower aft and midships
• Dropping and heaving of anchor, chain counter
• Navigation lights
• Searchlight
• Fridges/freezer were in operation
• AC system was in operation
• Toilet flushing was tested
• Taps and showers were tested
• Sound system was tested

Comments:

1. We were advised that Wally recommends that the last steps of heaving up the anchor are
carried with the local handheld control which ensures safe handling and proper stowage of
anchor.

2. The water tank was initially empty and subsequently filled to 100%. The fresh water pump
had to be primed manually to commence pumping.

6. Conclusions / Opinion

As far as it could be ascertained from the dock and sea trials as well as the areas, compartments and
equipment superficially seen the yacht appeared to be in compliance with what is stipulated in the
sales contract dated 12 January 2024.

7. Inspection Practise Statement

This report is for the benefit of Messrs Odessa Pty Ltd, as Buyers, and is not transferable except for
the named client and may not be used for other purposes and may not relied upon by any other
person without written consent by the surveyor.

The surveyor warrants that this report is a true and unbiased opinion of the yacht, based upon a visual
inspection on the dates of the inspection.

The findings, opinions and conclusions are based upon the best professional judgment of the
undersigned surveyor. While every effort has been made to conduct a thorough inspection, there can
be no guarantee or warranty, express or implied, as to the condition or suitability of the yacht and
her equipment or machinery.

This report makes no representation and does not purport to describe any condition, which may
have changed since the date of the inspection, and the observations herein are limited to those that,
in the opinion of this surveyor, are reasonably necessary and appropriate, based upon the conditions
and circumstances, as they existed at the time of the inspection.

The surveyor assumes no responsibility for any defects and is to be held harmless for conditions
subsequently arising.

The undersigned has no present or prospective interest in the subject yacht. There is no bias or
interest toward the parties involved. Compensation for this service is not contingent on any action
or event resulting from the findings, opinions or conclusion in this report.
