    I, Shankarappa S/O Late Basaiah, aged about 52


    years residing at Byrnahalli Village, Kasaba Hobli,
    Malur Taluk, Kolar 563130, do hereby solemnly affirm
    and state on oath as under:-

    I state that I have filed the above suit for partition


    and separate possession and permanent injunction
    such other reliefs against you in respect of the suit
    schedule property. I further state that I have also
    filed interim application under order 39 rule 1 & 2
    for seeking interim Ex-parte order of temporary
    injunction against the defendant for not to alienate
    and create third party interest putting up of any
    construction in and over the suit schedule
    properties. Upon considering the documents the
    Hon’ble court was pleased to allow my application
    that IA No.1 and granted Ex-parte temporary
    injunction order.
    And also directed me to comply at 39 rule 3A of CPC
    accordingly I have sent plaint and IA No.1 through
    register post & the postal receipts are herewith
    furnished for kind perusal of this Hon’ble court in the
    interest of equity and justice.
    I, the deponent herein do hereby state and verify
    that this is my name and signature and the contents of
    this affidavit is true and correct to the best of my
    knowledge, belief and information.

    I, Shankarappa S/O Late Basaiah, aged about 52

    1. I am the plaintiff in the above suit I know the fact


    of the case . Hence I am swearing this affidavit.

    2. I submit that the above suit is filed seeking


    permanent injunction against the defendant in respect
    of the plaint schedule property restraining him from
    interfering with my peaceful possession and enjoyment
    of the suit schedule property. The Hon’ble court has
    been pleased to grant an ex-parte order of temporary
    injunction on IA 1 restraining the defendant from
    interfering with my peaceful possession and enjoyment
    of the suit schedule property . I have complied as
    required under order 39 rule 3 to the defendant by
    sending the copy of plaint , IA 1 with affidavit and
    documents on which I have relied upon by R.P.A.D the
    postal receipts of which are herewith filed.
    3. I submit that what is stated above is true to the
    best of my knowledge, information and belief.
