Nuremberg Trials

The story began on 8 may,1945 . It was the moment when Germany
signed on the surrender paper and then the world war 2 was over.
After that the Nazi leaders thought that the military leaders and
some top Nazi leaders who were caught , should be punished.

Britain Churchill wanted that they should be punished through


summary trail. But American leadership wanted that firstly there
should be filed a case then they should be tried and then they should
be punished( not through the summary trial).

The Nazi party mainly wanted to conduct this trial for showing to the
German people that they were wining the world war 2 but because of
some Nazi leaders and military generals they did not win the war. By
conducting this trail the Nazi party wanted to bring strong evidences
in front of the German people and wanted to achieve their trust and
support.

If once all the evidences are presented before the court then it will
be recorded and it will become a documentary evidence. For
conducting the trial , Nuremberg city was chosen.

On 8 August, 1945 , four countries named America, Britain, Soviet Union and
France created International Military Tribunal under article 1 of the London
Charter. Many confused were raised and a question was also arose that ‘how do
you punish someone from another sovereign country for crimes that are not
actually illegal in that country?’ The allied powers answered this question with
the London Charter of the International Military Tribunal. This charter laid down
a system where the 4 different legal codes of France, Soviet Union, USA and UK
had been incorporated into a single tribunal.

There were prosecutors and defense lawyers according to British and US laws
but decisions and sentences were imposed by a group of judges according to
France and Soviet legislation.
The judges fixed some charges against the top Nazi leaders, military leaders and
against few people. These were:
1. Crimes against peace.
2. Crimes against humanity
3. War crimes
4. A common plan or conspiracy to commit any of the three aforementioned
crimes.

This trial was also conducted against some organizations like: Gestapo, security
services etc. On 20 November, 1945 , 21 defendants came before the court
and all the allegations against them were read. In this trial the main Nazi leader
Hitler was not tried because he committed suicide. After the day of Hitlers’
death , Joseph Goebbels committed suicide. Heinrich Himmlar also committed
suicide when he was caught. The main three Nazi leaders had died before the
trial started. 3
Conducting the trial was difficult because in past, this type of trial
had not been conducted. Prosecution lawyers and defense lawyers
were present during the trial time. The chief prosecutor name was
Robert H. Jackson and he was an American.

The most difficult part of the trial was that the prosecutors, Judges
and the defense lawyers spoke in different languages. So, to solve the
problem some translators worked who translated the languages
instantly.

The most important evidences were the photos of the Concentration


camp. Britain and France captured those pictures and submitted them
before the court against Germany. The prosecution lawyers also
submitted more such pictures and documents to prove the
defendants guiltiness. The trial was continued till one year. And the
next year on 1 October, 1946 the tribunal passed judgement against
19 accused persons and acquitted 3 persons .

Among the 19 people , 12 people were sentenced to death,
3 people were sentenced to life imprisonment and 4 people were
sentenced to prison terms ranging from 10 to 20 years.

The tribunal was bound to give reasons for its judgement as to the
guilt or the innocence of any defendant. The judgement was
considered to be final and not subject to review as per article 26 of
the London Charter.
