AN ORDINANCE REGULATING STRAY DOGS AND PROVIDING PENALTIES FOR

VIOLATION THEREOF
BE IT ORDAINED by the [Name of Local Government Unit], in session assembled, that:
Section 1. Definition of Terms.
For the purpose of this ordinance, the following terms shall have the following
meanings:
 Animal Shelter - A facility designated by the [Name of Local Government Unit] for
the keeping of impounded animals.
 Animal Control Officer - An officer of the [Name of Local Government Unit]
designated to enforce the provisions of this ordinance.
 Impoundment - The taking and keeping of an animal in an animal shelter.
 Owner - Any person who possesses, harbors, keeps, or has dominion or control
over an animal.
 Stray Dog - A dog that is found roaming or loitering in any public place without a
leash and without an owner present.
Section 2. Prohibition Against Stray Dogs.
It is hereby declared unlawful for any person to allow or permit any dog to roam or loiter
in any public place without a leash and without an owner present.
Section 3. Impoundment of Stray Dogs.
Any Animal Control Officer or any authorized person may impound any stray dog found
roaming or loitering in any public place.
Section 4. Disposition of Impounded Dogs.
(a) Impounded dogs shall be kept at the Animal Shelter for a period of three (3) days.
(b) During the three (3)-day period, the Animal Control Officer shall make reasonable
efforts to locate the owner of the impounded dog. (c) If the owner of the impounded dog
cannot be located within the three (3)-day period, the dog shall be deemed to be
abandoned and may be disposed of in accordance with the Animal Welfare Act of 1998.
Section 5. Redemption of Impounded Dogs.
The owner of an impounded dog may redeem the dog by paying the following fees:
 Impoundment fee of [Amount]
 Rabies vaccination fee of [Amount]
 Spay or neuter fee of [Amount]
Section 6. Penalties.
Any person who violates any provision of this ordinance shall be punished by a fine of
not more than [Amount] or by imprisonment of not more than [Number] days, or both.
Section 7. Implementing Rules and Regulations.
The [Name of Local Government Unit] shall promulgate such rules and regulations as
may be necessary to effectively implement the provisions of this ordinance.
Section 8. Separability Clause.
If any provision of this ordinance is declared invalid or unconstitutional, the remaining
provisions shall not be affected thereby.
Section 9. Effectivity.
This ordinance shall take effect fifteen (15) days after its publication in a newspaper of
general circulation in the [Name of Local Government Unit].
