the Divine Wisdom of God which oversees the
common good and governs everything. Eternal law
Eternal Law is God’s plan to lead all creation towards God’s
eternal salvific plan to be holy and blameless
before Him through Jesus Christ. verything in
nature reflects the Eternal Law in their own
natures. Things act according to their nature, so
they derive their proper ends (final cause)
according to the law written into their nature.
based on the belief that there is a higher power
or force that governs the universe and sets the
Divine Law standards for moral and ethical behavior. It is
considered to be universal and unchanging, and
is believed to apply to all people, regardless of
their culture or religion.
is a system of law based on a close
observation of natural order and human
nature, from which values thought by the
Natural Law proponents of this concept to be intrinsic to
human nature can be deduced and applied
independently of positive law. Natural law
maintains that these rules of right and wrong
are inherent in people and are not created by
society or court judges.
While natural law applied to all humans and
was unchanging, human law could vary with
Human Law time, place, and circumstance. Aquinas defined
this last type of law as "an ordinance of reason
for the common good" made and enforced by a
ruler or government. He warned, however, that
people were not bound to obey laws made by
humans that conflicted with natural law.
LEGAL MAXIMS
A legal maxims is an established principle or
proposition of law that is universally admitted as being
just and consonant. It is a rule that connects an action
to the reasons for the action.
EXAMPLES:
Running a red light if
someone's life depended
on it.
EXAMPLES:
Helping a holocaust victim
escape from Nazi Germany.
EXAMPLES:
Anonymously publishing an article
undertaking a company's private documents
to show how it charges customers a service
fee.
Dura Lex Sed Lex
Concept:
The law may be harsh, but it is still the law.
The law may be difficult to obey but it must be therefore
complied with because ignorance of the law excuses no
one, Ignorantia legis non excusat. It is presumed that
every individual or every inhabitant of such nation knows
the law.
Dura Lex Sed Lex
• originated in the 11th century as a principle of cannon law
(church law) by Bishop Buchard of Worms.

•it stands for the 'Rule of Law', that is the letter of

the law must be followed by everyone and no one is
above the law.

• the Latin phrase uses the term Lex as opposed to

Jus.
Lex- is law created by men.
ex: speed limit along a certain street.

Jus- is law which exists in natural

order of things and which cannot be
modified by the act of a legislature.
ex: murder and slavery are always wrong regardless of local law.
FOR SOCIETY TO FUNCTION EFFICIENTLY,
EACH PERSON MUST OBEY THE LAW AND NO
ONE SHOULD BE ABOVE IT, EVEN IF THERE IS
INJUSTICE AND THE LAW MAY BE DIFFICULT
TO COMPLY WITH, THE UNJUST LAW
REMAINS.
Dure Lex Sed Lex
Example:
Expanded Value Added Tax (EVAT) Law, a value-added tax equivalent
to ten percent (10%) of the gross selling price or gross value in money
of the goods or properties.

The E-Vat as a law is unfair because the very poor and the
very rich are taxed same amount in their purchase of
consumer goods.
everybody has exactly the same
standing, the same basic human dignity,
and the basic human rights "before the
law. This is the cornerstone of the
majesty of the law: it bows to no one
for consideration of power and
wealth.
DIFFERENCE OF LAW AND ETHICS
Law cannot equate to ethics because;

Conforming to ethics or being ethical is a choice from the

free will of a person, while law is a mandatory rule that
should be strictly followed or else there will be
consequences.
