TERMS AND CONDITIONS OF EMPLOYMENT


1.0 Wages
1.1 All monies are in Singapore dollar currency.
1.2 The Employer shall pay the Seafarer's salary on the last day of every calendar month (or not later than the 5th day of the
following month).
1.3 Minimum 70% of the monthly salary shall be remitted to the seafarer's designated bank account, and the remaining
of the monthly salary shall be paid cash on board.
1.4 Incentive, if any, will be paid after completion of this Agreement.
1.5 Exchange Rate for any currencies shall be as per Singapore bank's published rate.
1.6 The Seafarer's employment agreement shall continue to have effect while a seafarer is held

captive on or off the ship as a result of acts of piracy or armed robbery against ship.
1.7 The employer shall continue to pay the seafarer wages while he is held captive on or off the ship
as a result of acts of piracy or armed robbery against ship.
1.8 Definitions
a. Fixed Overtime covers time worked in excess of the normal work hours in any 7-day period for the entire month
and shall commerce when seafarer is on board.
b. Fixed Leave Pay is calculated equivalent to min. 2.5 days leave per month.
c. No. of day of leave will be stated if no fixed leave pay is given per month.
d. Tanker Allowance shall commerce when seafarer is on board.
e. Incentive (if any) shall not be included as parts of Gross Salary when calculating monthly leave pay or
overtime.
1.9 While on transit / serving quarantine for sign on/off, only basic wages will be paid.

2.0 PRE-EMPLOYMENT MEDICAL FITNESS EXAMINATION


2.1 The Seafarer shall be subjected to pre-employment medical fitness examination and must be certified medically fit to
work on board ship by a registered medical practitioner for his capacity prior to engagement. The Employer shall pay
for the medical examination.
2.2 The Seafarer shall subject himself to any drug and alcohol tests at any time and at the discretion of the 's Employer,
Charterer or Employer appointed agency. Failure to go for any of such tests shall automatically allow the Employer
to early terminate this Agreement without giving prior notice to the Seafarer. In this instance, the Seafarer shall bear
his repatriation expenses.

3.0 MEDICAL AND WORK INJURY COMPENSATION


3.1 The Employer shall not be responsible or liable for any pre-existing illnesses or any medical conditions before
the seafarer is under the employment of the Employer.
3.2 The Employer shall not be responsible or be liable for any medical or hospital expenses or provide medical
care or leave for any injuries, illnesses or diseases that are self-inflicted.
3.3 The Employer shall not be responsible or liable for any medical or hospital expenses or provide medical care or
leave for any injuries,illnesses caused or arising out of or resulting from any misconduct or indiscretion of the
seafarer.
3.4 The Employer shall only be responsible or liable for medical or hospital expenses or to provide medical care or
leave and sick wages, for injuries or illnesses that arise out of and in the course of the seafarer's service onboard
the vessel or whilst carrying out official duties ashore as instructed by the Master/Employer.
3.5 The Employer shall only be responsible or liable to pay compensation for death or injury by accident arising out of
and in the course of the seafarers' service onboard the vessel or whilst carrying out official duties ashore as instructed
by the Master/Employer, such compensation to be determined and made in accordance with the Laws of Singapore".

4.0 HOURS OF WORK OR REST


4.1 The limits on hours of rest shall be as follows:
i. A minimum 10 hours of rest in any 24-hour period,

ii. 77 hours of rest in any 7-day periods, and
iii. The hours of rest may be divided into no more than 2 periods; one of which shall be at least 6 hours in length.
(The interval between consecutive periods of rest shall not exceed 14 hours.) However, in the event of
an emergency, or to assist other ships or persons in distress, the shipmaster can suspend the work schedule.

5.0 EXCEPTION APPLICABLE TO SINGAPORE FLAGGED SHIP ONLY


5.1 Exception from the required hours of rest in paragraph 4.1 can be allowed
for seafarers certified under the STCW for watchkeeping duties on board the ship, taking into account the
guidance of STCW 2010 (Manila Amendments) and complying with Merchant Shipping
(Training, Certification and Manning), as follows:
i. Rest period is not less than 70 hours in any 7-day period and shall not be allowed for more than 2 consecutive
weeks. (The intervals between 2 periods of exceptions on board shall not be less than twice theduration
of the exception.)
ii. Hours of rest may be divided into no more than 3 periods; one of which shall be at least 6 hours in length
and neither of the other 2 periods shall be less than 1 hour in length. (The intervals between
consecutiveperiods of rest shall not exceed 14 hours. This shall not extend beyond 2-day periods in
any 7-day period.)
iii. Exception when given shall take into account more frequent or longer leave periods or compensatory
leave.
5.2 Exception from the required hours of rest in paragraph 4.1 can be allowed for all other seafarers whose ship calls
at two or more ports in any 24 hours, taking into account of paragraph 5.1 (iii).

6.0 REPATRIATION
6.1 The Employer shall arrange and pay for the Seafarer repatriation to his home port as stated herein by the most
appropriate and expeditious means under the following circumstances:
i. After completion of this Agreement;
ii. In the event of illness or injury or other medical condition which requires his repatriation when found
medically fit to travel;
iii. In the event of shipwreck;
iv. In the event of the vessel being bound for a war zone, as defined by national laws or regulation to which the
Seafarer does not consent to go.

7.0 TERMINATION
7.1 During the period of this Agreement, the Employer reserves the rights to terminate this Agreement immediately
without prior notice or payment in lieu of notice to the Seafarer should the Seafarer commits
any of the followings:
i. Willfully neglects his duties and responsibilities, which compromise the safe navigation and operation of the
vessel.
ii. Caught or awaiting trial or jailed for a criminal or unlawful act committed by Seafarer in the country of

operation, which prevents him from reporting for work during this Agreement period.
iii. In possession of or consume alcohol or illegal drugs on board the ship.
iv. In possession of deadly weapons or other dangerous goods on board the ship.
v. Embezzlement of the vessel's property and/or willful damage to such property or the ship's equipment.
vi. Misbehavior such as physical attacks willfully, disobeys lawful commands, misconduct, theft, or sabotage.
vii. Absence from place of work without informing the Shipmaster and/or the Employer of the reasons for the absence.
viii. Commit an act of smuggling or harboring of illegal immigrant and stowaway
7.2 Under any of the above circumstances, the Seafarer shall bear his own repatriation expenses.

8.0 TAXES
8.1 The Seafarer shall be responsible for his personal income taxes or contribution to any provident fund which may be
due to any state or other sovereign government and any other deductions required by the law of any state or other
sovereign government. The Employer, as required, will withhold the Seafarer's one month salary or final month salary
for personal income tax or contribution to any provident fund,
until the relevant authorities authorizes the Employer to release it.

9.0 FINAL SALARY PAYMENT


9.1 The balance salary and the accumulated fixed leave pay, after deduction of taxes or contribution of provident fund
as required by any state or other sovereign government, if any, shall be paid at the end of the calendar month (or
not later than the 10th day of the following month).

10.0 APPLICABLE LAW


10.1 This Seafarer's Employment Agreement shall in all respects be governed by the jurisdiction of the Courts of the
Republic of Singapore and the same shall be interpreted and applied in accordance with such laws, and parties
hereto submit.

CONFIRMATION OF THE AGREEEMNT
