Subject- LEGAL NOTICE

Sir,
I have been instructed and authorized by my client namely Sh. Ranbir Singh,
S/O Sh. Jodh Singh, R/O VPO. Kotli Khas, Tehsil Mukerian, District Hoshiarpur(Id
no.300725) at present working as Junior Engineer 66Kv Sub-Station Ranga
Bhangala, Tehsil Mukerian, District Hoshiarpur to serve you with the following
legal notice:-
1. That my client initially joined as RTM/Trade Mate on 28/12/1990 in the

Punjab Electricity Board now converted as Punjab State Power
Corporation Limited(PSPCL) and posted at DS(Special) Division East,
Jalandhar, thereafter he was transferred to DS Division Dasuya on date
5/1/1994 and to DS Division Mukerian on date 1/7/95. Thereafter he
was promoted to the post of Oiler & Cleaner on 17/9/1998. Thereafter
he was promoted to the post of Sub-Station Attendant(SSA) on date
13/2/2004 and posted at DS Division City Hoshiarpur. Thereafter he was
transferred to Bhakra Beas Management Board (BBMB) on 8/12/2004.
My client was subsequently promoted to the post of Junior Engineer on
18/3/2022. Since then my client has been performing his duties with full
devotion, sincerity and without any complaint and to the entire
satisfaction of his superiors and he has earned each and every increment
whatsoever was due to him. My client is at the fag end of his career and
he is going to retire from service on 31/5/2024 on attaining of
superannuation.
2. That in accordance with instructions and rules of Punjab State Power

Corporation Limited, an employee who has already availed of one
promotion and first promotional/devised promotional scale on
completion of 9 years of service shall be eligible for grant of 2 nd
promotion/devised promotional scale on completion of regular service
of 16 years.
3. That an employee once in his/her entire service can avail the benefit of
only one induction post for getting 9/16 years of time bound
promotional/devised promotional scales and 23 years advance
promotional increment.
4. That the post of Oil & Cleaner has been specifically declared as induction
post for granting time bound promotion/devised promotional scale and
as such my client is entitled to be given time bound scale/promotion on
the induction post being Oil & Cleaner w.e.f. 17/9/2014 and 17/9/2021
after completion of 16 years and 23 years of service respectively.
5. That my client made a representation in writing to the concerned

authorities through Bhakra Beas Management Board (BBMB) in this
behalf but despite my request no positive response was ever given or
matter was ever adjudicated.
6. That the action of yours in not giving the time bound scale/promotion on
the completion of 16 years and 23 years respectively on the induction
post of Oil & Cleaner w.e.f. 17/9/2014 and 17/9/2021 is unjust, illegal,
improper and is not sustainable in the eyes of law in as much as the
department is sleeping over the matter and depriving my client from his
legal right which resulted into irreparable loss and injuries and same
cannot be compensated in the terms of money.
7. That the action of yours in not giving time bound scale/promotion on

completion of 16 years and 23 years respectively is against the principles
of natural justice and detrimental to the interest of legal right of my
client.
8. That the substantial hardship is caused to my client due to non-grant of

time bound scale/promotion on the completion of 16 years and 23 years
respectively on the induction post of Oil & Cleaner and my client is
facing recurring financial loss and as such is entitled to be given the
same from the due date.
By means of this legal notice, you are hereby called upon to
grant/release the time bound devised promotional scale after the
completion of 16 years and 23 years on the induction post w.e.f.
17/9/2014 and 17/9/2021 respectively from the due date and thereafter
arrears be disbursed to my client namely Sh. Ranbir Singh, S/O Sh. Jodh
Singh, R/O VPO. Kotli Khas, Tehsil Mukerian, District Hoshiarpur(Id
no.300725) at present working as Junior Engineer 66Kv Sub-Station
Ranga Bhangala, Tehsil Mukerian, District Hoshiarpur within one month
from the receipt of this legal notice.
My client being prudent and law abiding citizen, for the time
being has only instructed me to serve upon you the abovementioned
legal notice, however, I have clear instructions to adhere to the course
of law in case the needful is not done within the time stipulated in the
notice. I may make it clear that in case force my client to adhere to the
course of law, then in that eventuality, you will be responsible for the
cost and consequences of the litigation along with the expenses of the
present legal notice and other correspondence made by my client.
A copy of this legal notice has been retained in my office for
necessary record and further necessary action if so required.
