The whole structure of that floor together with the finishes to the floor and walls must be changed and the Contractor requested the Architect/S.0 to issue instructions to accommodate all the changes. The Architect/S.O was too busy to issue a written order for this work, but the Contractor nevertheless carried on with the work as required by the Architect/S.O. On completion of the work, the Contractor was not aid for the extra work, although he contended that the changes were extra, and he was entitled to additional payrrent based ‘on the variation works. i) Define variation based on PWD and PAM Standard Form of Contract ( marks) ii) Discuss the contractual legality of the above situation. (10 marks) b) The S.0 issued an instruction to the contractor to provide three (3) additional shelters for the student's convenience. The instruction was issued out two (2) weeks after the contractor had been awarded the Certificate of Practical Completion (CPC) as fulfil a new requirement by the Kementerian Pendidikan Tinggi (KPT) Malaysia. In response to the instruction, the contractor has written back to the S.O/Architect stating tha’ he would only agree to carry out the works if the S.O agrees to pay all the additioral costs incurred to him. Advise the S.O/Architect regarding the contractor's response.
