CONSTITUTION
ARTICLE I: PREAMBLE

We the members of Faculty Physical Sciences Students Association


(FAPSSA), University of Benin, Benin City, having firmly and solemnly
resolved to live in unity and peace as one individual, undivided and
undisputable entity under the divine guidance of God Almighty in one
accord with the Student Union of the University of Benin dedicated to the
promotion of solidarity, dignity and understanding. And for the purpose of
preservation of principle of freedom, equity, justice and the maintenance of
conditions and serene atmosphere conducive to learning research.

We members of Faculty Physical Science Student Association (FAPSSA),


University of Benin, a body under the Nigeria Association of Science
Students (NASS), do hereby make, enact and give to ourselves this
constitution.

ARTICLE II: TITLE, NAME, AND SUPREMACY OF THE FAPSSA


CONSTITUTION

Section 1: Title

This constitution shall be known and cited as the constitution of the Faculty
of Physical Sciences Studens’ Association, University of Benin.

(herein after referred as The FAPSSA Constitution).

Section 2: Name

This Association shall be known, called and addressed as Physical

Sciences Students’ Association (FAPSSA), University of Benin, Benin City.

Section 3: Supremacy

1. Subject to the general laws and regulations of the Student Union


University of Benin, laws of University of Benin, Edo State and the
Federal Republic of Nigeria, this constitution shall be supreme and its
provisions shall have binding force on all members of the Association.
2. Any law or decision of anybody, department, authority or persons
under the Association, which is inconsistent with the provisions of the
constitution, shall be to the extent of the inconsistency be null and
void.

ARTICLE III: FUNDAMENTAL OBJECTIVES AND DIRECTIVE PRINCIPLE OF


THE ASSOCIATION POLICY

Section 4: Aims and Objectives


1. To provide a code of conduct for members and nurture them for the
greater task of becoming the leaders of tomorrow that our nation
Nigeria greatly desire.
2. To encourage and promote selfless service(s) of members of Faculty of
Physical Science in particular and to Nigeria in general.
3. To emphasize the relevance and role of science in the development of
the nation.
4. To work for progress and advancement of science and technology in
Nigeria.
5. To cooperate and exchange ideas with National and International
organization, that is acceptable to the Association.
6. To disseminate current research, findings and development in science
and technology.
7. To encourage and promote harmonious interaction (has) between
members and staff of the Faculty of Physical Science, so as to

protect the rights, privileges and obligation of members of the
Association.

ARTICLE IV: MEMBERSHIP OF THE ASSOCIATION

To be a bonafide member, a person falling under this section is expected to


be a financial member of this Association. That is, he/she must have paid
his/her Association dues.

Section 5: Ordinary Members


These shall include all cleared student of the Faculty of Physical Sciences,
University of Benin, pursuing either a diploma, part-time or full-time degree
course.

All registered Physical Science students shall have the privilege to;

a) Use the facilities of the Association


b) Participate actively in organized meetings and functions of the
Association.
c) Vote and be voted for in approved elections, subject to the provisions
of this constitution.
d) Such rights and privileges the house might deem fit from time to time.

Section 6: Honorary Members

1. A person shall qualify to be conferred with honorary membership of


the Association, if he/she is deem fit by the reason of his/her interest
in student welfare and academic matters.
2. Any person conferred with honorary membership of the
Association, shall have the rights to be awarded a certificate, which
shall be duly signed by the Governor of the Association, Speaker of the
SRC and Dean of the Faculty.

3. Honorary members shall be conferred by the Executive Council with
the approval of the Student Representative Council (SRC).
4. An honorary member shall have the privilege to all section 5 (a, b and
d) stated above.

Section 7: Life Members

1. A person shall be qualified to be a life member of the Association by


reason of his/her past activities in the service of the Association or in
appreciation in his/her role in the society.
2. A past member shall be appointed life membership by the Executive
Council with the approval of SRC and shall have his/her name entered
in the honors roll of the Association.
3. A life member shall be entitled to same rights and privileges as
honorary members.

ARTICLE V: PATRON/PATRONESS, STAFF ADVISER AND THEIR


FUNDAMENTAL DUTIES

Section 8: Patron/Patroness

Patron/Patroness of the Association shall be appointed by the Executive


Council after gaining the approval of the SRC.

Section 9: Staff Adviser

The Assistant Dean, Faculty Officer and other staff of the Faculty as deem fit
by SRC shall be staff advisers of the Association.

Section 10: Grand Patron

The Dean of the Faculty shall be the Grand Patron of the Association.

Section 11: Duties of Patron/Patroness and Staff Adviser

1. The Patron/Patroness shall advise the Association from time to time


and back the efforts and objectives of the Association by giving moral,
financial, psychological and material support.
2. The Staff Adviser shall;
a) Advise the Executive on matters relating to the welfare of the
Association;
b) Be a link between the Association and the Faculty Authority;
c) Be ready to scrutinize the account rendered to him/her;
d) Be a signatory to the Association Account;
e) Give the Association support financially, psychologically &
materially when needs arises.

ARTICLE VI: THE LEGISLATIVE COUNCIL OF THE ASSOCIATION

Section 12: The Student Representative Council (SRC)

There shall be a Student Representative Council (SRC) which shall be the


legislative arm of the Association and shall operate a unicameral legislature
(i.e a legislative assembly with one legislative chamber).

Section 13: Power and Functions of Student Representative Council

SRC shall;

1. Be the highest policy making body of the Association and shall have
power to make regulations for the peace, order and good governance
of the Association;
2. Have power to scrutinize the account, modify and approve the annual
budget of the Association;
3. Approve the annual budget within fourteen (14) days of its
presentation by the Executive Council;

4. Approve an amount not exceeding ten percent of the preceding
annual budget for the Executive Council to work as an interim
measure, pending the approval of the annual budget. Have power to
scrutinize, criticize, ratify, amend or reject proposals by the Executive;
5. Have power to approve any member of the Association of an
approved employee of the Faculty or an external expert to serve the
Association in an advisory or any capacity, with such way SRC deem
fit.
6. Grant self-impeachment to any member who fails to turn up for three
consecutive meetings/sittings subjected to sub-section (8) of this
section;
7. Have the power to scrutinize, modify and approve any amount
presented by the Executives as supplementary budget;
8. Have the sole power to try all impeachment except self-impeachment
defined herein. When sitting for that purpose, there shall be an oath
or affirmation and no person shall be tried in his/her absence, unless
he/she fails to turn up after three (3) consecutive meetings/sittings
for that purpose, in that case he/she shall be communicated in
writing by the speaker at least forty-eight (48) hours informing
him/her that a trial in his/her absence is inevitable upon which such a
trial shall be valid. And no person shall be convicted without the
concurrence of two-third (2 /3) majority of members present in that
sitting. Judgment in case of impeachment shall not extend further
than removal from office of honor, trust or profit under the
Association;
9. Have power to impeach any member of the Executive Council and
such a member shall stand removed by a vote of not less than two
third (2/3) all members of the SRC;
10.Have power to impeach and dissolve the Executive Council for gross
misconduct by a vote for not less than two third (2/3) of all SRC
members;

11. As follow up sub-section (9) of this section, have power to constitute
a caretaker committee. No member of the caretaker committee shall
come from the SRC and the dissolved Executive Council; the
membership of the caretaker committee shall be made up of one
student from each department of the Faculty who are financial
members of the Association. The committee shall be responsible to
SRC and shall perform functions of the Executives Council under the
provisions of this constitution. The caretaker committee shall be
headed by a chairman and shall not stay in office for more than thirty
(30) days from date of swearing-in, in which the electoral committee
shall conduct another election. They shall be sworn in by the Staff
Adviser or in his absence the Speaker or in his absence, the Deputy
Speaker or in his absence a pro-interim elected by the house to
preside over the sitting of the day;
12.Have power to set up ad-hoc and/or standing committee(s) by a vote
not less than two third (2/3) majority members of SRC present in the
sitting;
13.Have power to impeach and remove the Speaker or the Deputy
Speaker by a vote of not less than two third (2/3) majority of
members of SRC present in that sitting. In case a principal officer is
removed from office, the presiding officer shall put in motion
machinaries for the replacement of the removed officer;
14.Have power to impeach or remove the Clerk or Deputy Clerk or
Whip or any officer of SRC by a vote of not less than two third
(2/3) majority of members of SRC present in that siting;
15.Subject to the provisions of this constitution, have power to regulate
its own procedure(s) by drawing up a standing order;
16.A bill shall originate in the SRC and shall be deem to vote been passed
if two third (2 /3) majority of members present in that sitting
approved of it. Every bill which must have been passed by SRC shall
before it becomes law be presented to the Governor of the

Association, if approved, he shall sign but if not, SRC shall proceed to
reconsider it. If after such reconsideration, two third (2 /3) majority of
SRC members present agree to pass the bill, it shall become law not
minding if the Governor signs it or not;
17.SRC shall have power to amend the constitution subject to resolution
passed by not less than two third (2/3) of members present in the
sitting;
18.Notice of the meeting to amend the constitution with intended
amendment stated in precise terms and signed by the mover and
seconder (who must be a member of SRC shall be presented to the
Clerk of SRC);
19.The Clerk of SRC shall forward to every member of SRC statement of
the intended amendment at least twenty-four (24) hours before the
meeting;
20.SRC shall stand dissolved at the setup of Electoral Committee;
21.Have power to proclaim a department/class of emergency if the need
arises especially when the department/class do not follow the
provisions of this constitution. And as a follow-up, have power to take
decisions that will affect the department/class positively.

Section 14: Composition of Student Representative Council (SRC)
The SRC shall consist of;

1. ( a) Four (4) elected degree members and one (1) elected


member from diploma/part-time from each of the various department
in the Faculty;
( b) Faculty Reps of One hundred level (100L);

2. Membership of SRC shall not exceed thirty-two (32) members,


cutting across all department of the Faculty;

3. Members shall be addressed as Honorable members of the


Association.

Section 15: Officers of Student Representative Council

1. For avoidance of doubt, non-degree members and mandated


members for Industrial Training shall not become an officer of the
SRC.
2. Officers shall be;
(a) The Speaker
(b) The Deputy Speaker
(c) The Clerk
(d) The Deputy Clerk
(e) The Whip

Section 16: Functions of Officers of Student Representative Council

1. The Speaker shall;


(a)Have power to summon meetings of SRC acting through the Clerk of
SRC, and preside over all such meetings;

(b)Convene meetings of SRC acting through the Clerk of SRC on the
advice of the Governor of the Association;
(c)Convene meetings of SRC through the Clerk of SRC on a written request
signed by at least one third (1/3) of members of SRC;
(d)Have no vote except when there is a tie;
(e)Call for extraordinary meeting where issues that concern the
Association shall be deliberated;
(f) Impartially direct the proceedings of the SRC and execute all other
functions conferred to him under the provisions of this constitution.
2. The Deputy Speaker
(a)Assist the Speaker in his/her absence;
(b)Be the chairperson of the in-house committee of the parliament;
(c)Exercise such powers and carry out other functions/duties as are
hereinafter allocated to him/her under other sections of this
constitution.
3. The Clerk shall;
(a)Convene SRC meetings in accordance with the provisions of this
constitution and shall ensure that notice of such meetings
containing the agenda reach members of SRC at least forty-eight
(48) hours before the meeting(s);
(b)Ensure that notice of such meetings containing the agenda is
conspicuously displayed on notice boards within the Faculty;
(c)Record and keep in good order the minutes of the proceedings of
SRC;
(d)Make available resolutions (Hansard) for the preceding session of
Parliament before the next sitting;
(e)Arrange the venue for each meetings;
(f) Perform all other functions hereinafter allocated to him under
other sections of this constitution.

4. The Deputy Clerk shall;
(a)Assist the Clerk of SRC and act in his/her absence;
(b)Keep records of attendance;
(c)During every meetings of SRC, take roll call of all members present
and within twenty-four (24) hours after SRC adjourns, forward a list
of absentee members to the Speaker for necessary action;
(d)Performs all other functions that may be allocated to him/her
within the provisions of this constitution.
5. The Whip shall;
(a)Ensure proper custody of the Mace and produce it at sitting of SRC;
(b)Ensure order and discipline amongst members during sittings;
(c)Perform any other duty as may be assigned from time to time by
SRC.

Section 17: Meetings/Sittings of Student Representative Council

1. Ordinary Meetings;
(a)The inaugural meeting of SRC shall be convened by the Governor
not later than forty-eight (48) hours after the swearing-in of the
Executive Council;
(b)At the inaugural meeting, all members of SRC shall subscribe to and
take an oath of allegiance which shall be administered by the
Governor of the Association;
(c)The principal officers of SR5C shall be elected at this inaugural
meeting;
(d)Every officer of SRC shall subscribe to and take an oath of office,
which shall be administered by the Governor of the
Association at this inaugural meeting in the presence of the
Staff Adviser of the Association;

(e)The Speaker of SRC in accordance with section 16(1) (a, b & c) of
Article (VI) shall summon other meetings of SRC;
(f) The quorum of ordinary meetings shall be two-third (2/3) of sworn-
in members;
(g)The Mace shall be the symbol of authority of SRC;
(h)The Mace shall be presented and placed conspicuously before the
Speaker of any person acting in that capacity. If by any reason the
Mace is not available any object she be adopted as a mace for the
meeting;
(i) The Speaker shall preside at all the meetings of SRC;
(j) If for any reason, the Speaker cannot attend a meeting of SRC,
which is duly convened, the deputy or in his/her absence, a
chairman elected from among members of SRC at that session
shall preside over the meeting;
(k)Any student and other interested persons may attend meetings of
SRC as observers and shall be restricted to the public gallery;
(l) Only members of SRC shall take part in its proceedings;
(m) For security reasons, the House can go into an executive session to
deliberate on vital issues;
(n) Only financial members of the Association shall be allowed to air
his/her view on the matter being discussed. This shall be achieved
by the member presenting his/her receipt of FAPSSA;
(o) SRC shall meet as often as necessary. Resolution from such
meetings shall be binding on all members of the Association except
where proceeding(s) that led to such resolution(s) contravene any
provision(s) of this constitution;
(p) Except otherwise stated in this constitution, every question
proposal shall be decided by simple majority of the votes of

members of SRC present at that session, each member having one
vote, and in the event of a tie the Speaker shall cast a vote;
(q) Voting at meetings of SRC shall be by raising of hands, except when
a secret ballot is considered necessary.

2. Emergency meeting;
(a)An emergency meeting of SRC shall be convened in the same
manner as in Ordinary Meetings under Article VI (17), provided that
where a member collects signatures of members for such meetings,
he/she shall obtain the signatures of at least one-third (1/3) of the
numbers of the sworn-in members of SRC;
(b)Notice of an emergency meeting (which shall the agenda) shall be
delivered by hand personally, or to the rooms of members of all
SRC or by text messages and shall be conspicuously displayed on
the Faculty notice boards at least twenty-four (24) hours before the
time of the meeting;
(c)Procedures and quorum of emergency meetings shall be the same
as those of ordinary meetings pf SRC.

ARTICLE VII: THE EXECUTIVE COUNCIL OF THE ASSOCIATION


Section 18: Powers and Functions of the Executive Council;
1. The Executive Council shall carry out the day-to-day running of the
Association and shall be responsible to SRC;
2. The Executive Council shall implement all project and activities of the
Association as approved by the SRC;
3. The Executive Council shall superintend and control the affairs of the
Association and cater for the interest of its members;

4. Subject to the control and prior approval of the SRC, the Executive
Council shall seek concessions, grant and authorization from within or
outside the University, enter into such contracts and agreements and
carry-out such duties as may in the interest of the Association and
report same to the SRC;
5. The Executive Council shall take proper care of the Association
property;
6. The Executive shall refer cases of misuse relating to sub-section(5) of
this section to SRC and Staff Adviser for appropriate action;
7. The Executive Council shall organize a Physical Science Week on the
approval of the SRC;
8. The Executive Council shall keep the SRC constantly informed of its
actions and shall be responsible for same for such actions;
9. The Executive Council shall within twenty-one (21) days of its
inauguration prepare and present to the SRC its proposed annual
budget for consideration and approval. If at the expiration of twenty-
one (21) days, the Executive Council fails to submit the proposed
annual budget to the SRC, necessary sanctions shall be consider by
SRC;
10.The Executive Council must leave at least ten percent (10%) of the
Association’s funds behind in the Association account for the next
government;
11. The Executive Council must execute a fixable and tangible project that
will affect a good percentage of science students;
12.The Executive Council must carry out science oriented program(s) for
the benefits of the members;
13.The Executive Council shall prepare and present a terminal report to
the SRC for consideration and approval not later than thirty (30) days
before the expiration of its tenure. SRC shall within seven (7) days of

receiving the report, consider and return same to the Executive
Council for circulation to the general members;

Section 19: Meetings of the Executive Council
1. The Executive Council shall meet as often as necessary for the
effective and efficient running of the affairs of the Association;
2. It shall be the duty of Governor acting through the Secretary General
to summon a meeting of the Executive Council;
3. In the absence of the Governor, the Deputy Governor shall preside at
the Executive Council meeting;
4. The Governor shall determine the manner (secret or open ballot) in
which the Executives Council shall vote on any matter before it;
5. Decision of the Executive Council shall be based on a simple majority;
6. The Secretary General shall take minutes at every Executive
Council meeting. In the absence of the Secretary General, the
Assistant Secretary General shall take the minutes at every Executive
Council meeting;
7. On a request signed by not less than five (5) members of the
Executive Council delivered to the Governor and Secretary General,
the Governor shall be compelled to summon a meeting of the
Executive Council through the Secretary General;
Section 20: Composition of the Executive Council
1. Prior to Article (VI), Section (15) sub-section (1), non-degree and
industrial training goer(s) members shall not held executive position;
2. Members of the Executives Council shall be as follows;
(a) Governor
(b) Deputy Governor
(c) Secretary General
(d) Assistant Secretary General
(e) Director of Finance
(f) Director of Science and Technology

(g) Director of Sports
(h) Director of Socials
(i) Director of Welfare/Special Duties
(j) Publicity Secretary/P.R.O
Section 21: Functions of the Executive Officers
1. The Governor shall;
(a) Be the head of the Association and the Executive Council and shall
preside at all the meetings of the Executive Council and General
Assembly of the Association;
(b) Be responsible for coordinating the activities of the other officers
of the Executive Council;
(c) On the recommendation of the Secretary General, appoint and
discipline employees of the Association;
(d) Be a signatory to the Association’s account;
(e) Have power to refer disputes on insubordination, abuse of office
and dereliction of duty within the Executive Council to
SRC after due query and warning had been issued to the Executive
Officer concerned;
(f) Take decisions on behalf of the Association in consultation with the
other Executives, where General Assembly meeting cannot be
convened;
(g) Have the power to inaugurate the SRC. The Principal Officers of the
SRC shall be elected at this meeting;
(h) Have the power to nominate and with the advice and consent of
SRC shall appoint other officers of the Association whose
appointments are not herein;
(I) Shall present the Executive budget of the session of the SRC within
twenty-one (21) days of assumption of office.
2. Deputy Governor shall;

(a) Assist the Governor in his/her duties and act in his/her absence;
(b) Receive and treat complaints in consultation with the Governor;
(c) Direct he activities of the University of Benin Physical Science
Students Association week as chairperson;
(d) Perform any other duties that may be assigned by the Executive
Council to him/her as approved by the SRC.
3. Secretary General shall;
(a)Be responsible to the general duties of the Union Secretariat and
supervise all staff of the Association;
(b) Supervise in conjunction with the Governor the use of the
Association buildings, the Secretariat and the facilities contained
therein;
(c) Convene the Executive Council meeting of the Association in
accordance with the provisions of Article (VII), Section 19b of this
constitution;
(d) Except in respect of financial matters, be a signatory to all
correspondence from the Association;
(e) Keep attendance register, minutes and records of Executive
Council meetings in a proper and up to date manner;
(f) On the advice and approval of the Executive Council compile a
comprehensive terminal report of the activities of the Executive
Council for the year and thereafter present same through the
Governor to the SRC at its penultimate meeting.
4. Assistant Secretary General shall;
(a)Assist the Secretary General in his duties and act in his absence;
(b) Act as the Secretary towards FAPSSA week activities;
(c) Perform other duties as may be assigned to him/her from time to time
by the Secretary General or the Executive Council.
5. Director of Finance shall;

(a) Monitor the payment of annual dues of the Association into
specified bank account as approved by SRC;
(c) Be responsible to the Executive Council and SRC for disbursement of
the approved budget;
(d) Give the statement of the Association’s account when necessary;
(e) Keep statutory books of accurate and up to date accounts of the
Association;
(f) Be a signatory to the Association Account;
(g) Present an annual audited account of finances of the Association to
the SRC through the Executive Council;
(h) Ensure that no member of the Executive Council exceeds the
approved budget for his/her office;
(I) Keep an impress account as determined by the SRC;
(j) Be a member of the Budget/Finance Committee as in Article (VIII),
Section (22) (1a)
(k) Carry out other duties as may be assigned to him by the Executive
Council or SRC.
6. Director of Science and Technology shall;
(a) Oversee the science and exhibition day;
(b) Be a Student Representative in the National Association of
Science Student body;
(c) Through the aid of the Governor and other Executive Officers
promote science and technological projects in the Faculty;
(d) At all-times relate science and technological events/proceedings
through the office of the Publicity Secretary/P.R.O to the entire
members of the Association;
(e) Perform any other duties that may be assigned to him/her by the
Executive Council.
7. Director of Sports shall;

(a) Implement the University Sport Policy of developing students’
bodies and minds through mass participation and organization of
sports within the Faculty;
(b) Develop and keep a register of officials of various student’s sport
club within the Faculty;
(c) Present to the Association an annual report of sporting activities of
the students. Be in charge of all sporting events within the Faculty.
(d) Perform other duties as may be assigned to him by the Executive
Council or SRC.
8. Director of Socials shall;
(a) Be responsible for all social functions in conjunction with members
who shall be appointed by the Executive Council for such purpose;
(b) Direct the activities of the Association during the welcome and send
off parties;
(c) Take custody and maintain proper inventory of all audio-visual
equipment of the Association;
(d) Remit the proceeds from shows, promotions, concerts and related
activities organized by the Association to the Director of Finance
forty-eight (48) hours before or after the activity;
(e) Direct orientation and welcome week organized by the Association
(f) Perform other duties as may be assigned to him by the Executive
Council.
9. Director of Welfare/Special Duties shall;
(a) Be responsible for the general welfare of the Association members;
(b) Be a member of the welfare committee that may be constituted by
SRC in accordance with Article (VIII), Section (20), Subsection (5) of
this constitution;
(c) Liaise with the Staff Adviser to ensure the good upkeep of the
general sanitary condition of the Faculty;

(d) Be one of the Student Representative in all relevant Faculty
committees on Students Welfare Services;
(e) Liaise with the authorities of the Medical Center of the University
and other paramedical clubs to facilitate proper medical attention
to Association members at all times;
(f) Perform other duties that may be assigned to him by the Executive
Council or SRC.
10. Publicity Secretary/P.R.O shall;
(a) Be the mouthpiece of the Association;
(b) Be the chairman of the Publication Committee which shall be
responsible for the publication of the Association annual magazine
and other periodicals;
(c) In consultation with the Governor and/or the Executive Council
carry out the internal and external publicity of the Association
activities;
(d) Through appropriate releases with the approval of the Executive
Council, encourage members to live up to the fundamental
objectives and directive principle of the Association Policies;
(e) Carry out other duties as may be assigned to him by the Executive
Council.

ARTICLE VIII: STANDING COMMITTEE OF THE STUDENT
REPRESENTATIVE COUNCIL, COMPOSITION AND FUNCTIONS
Section 22: Committees of SRC;
1. Committees of SRC shall compose of;
(a) Budget Review/Finance Committee
(b) Project Monitoring Committee
(c) In-House Committee
(d) Constitution Review Committee(if SRC deems it necessary)
(e) Welfare and Price Control Committee
(f) Sport Committee
(g) Audit Committee
2. SRC shall have power to create other Committee(s) as they deem fit.
Section 23: Composition and Functions of Committees;
The above named committees Section (19) of this constitution shall be
composed of members of SRC except where otherwise stated;
1. Budget/Finance Committee shall;
(a) Compose of six (6) members of SRC cutting across each
departments in the Faculty and the Director of Finance;
(b)Be given the annual budget presented to scrutinize, modify in
accordance with the provisions of this constitution and present
their report to SRC for final approval;
(c)Assist the Governor and Director of Finance in the discharge of their
constitutional duties.
2. Project Monitoring Committee shall;
(a)Compose of six (6) members of SRC
(b) Monitor all projects executed by the Executive Council
3. In-House Committee shall;
(a)Be in charge of all welfare of SRC members;

(b) Be chaired by the Deputy Speaker of SRC
4. Constitution Review Committee shall;
(a)Be composed of a minimum of six (6) members of SRC cutting
across each departments in the Faculty;
(b) Review the Constitution from time to time for the effective
governance of the Association;
5. Welfare and Price Control shall;
(a)Shall be constituted by SRC with membership drawn from the
various constituencies (departments);
(b) Be in charge of the welfare committee of the Association members;
(c) Be in charge of the Regulation of prices of goods and services in the
Faculty;
(d) Work hand in hand with the Director of Welfare/Special Duties in
the discharge of his/her duties to the general Physical science
members;
(e) Work in hand with the Director of Welfare/Special Duties to
checkmate the sales of goods, conditions of lecture halls, conditions
of laboratories and the premises of the Faculty.
6. Audit Committee shall;
(a) Be constituted by SRC members and membership also drawn from
ordinary members of the Association;
(b) Composed of at least six (6) members;
(c) Be constituted four (4) weeks after the beginning of second
semester;
(d) Be responsible for the examination and verification of the financial
records of the Association
(e) Have power to summon any member of the Association to appear
before it in the respect of financial matters under investigation;

(d) Have the duration of two (2) weeks from the day of its
inauguration by the SRC to be in power. SRC shall have the power
to extend their duration if it deems it necessary;
(e) Submit reports to the SRC on completion of each financial
investigation or audit and at the end of its tenure in power.
Section 24: Other Committees;
SRC shall have powers to create other committees as it may deem fit.
ARTICLE (IX): ELECTIONS
Section 25; Conduct of FAPSSA Elections
1. At the beginning of new academic session and in any case not later
than the Sixth (6th) week after the commencement of the session,
the outgoing SRC shall constitute an Electoral Commission;
2. The Electoral Commission shall organize and effectively supervise
all the Association elections and bye elections with utmost good
faith;
3. The Commission shall be independent of any organ of the
Association and shall stay in office until a new Commission is
constituted in accordance with sub-section (1) of this section;
4. The Commission shall be composed of ;
(a) The Chief Supervisor who shall be the Staff Adviser (Assistant Dean)
or his representative;
(b) One representative from each constituency (department) of the
Faculty; Be a SRC member or an Ordinary Member.
Provided they get approval from their various departmental
Presidents;
(b) A Chairman and a Secretary shall who shall be elected by the
members of the Commission; while the speaker will be the chief
supervisor of the election.

5. No member of the Commission shall by election or appointment be
a member of the incoming Executive Council, SRC or any of the
Association Committees.
Section 26: Electoral Regulations
1. The Electoral Commission shall draw up and enforce electoral
regulations subject to the provisions of this constitution. Such
regulations shall be published at least fourteen (14) days before the
date of the election;
2. Elections shall be held not later than six (6) weeks from the date of
commencement of the new session;
3. Except as otherwise stated, a candidate for election shall be a
matriculated student that has spent at least one full academic
session in the University and shall remain a student after his/her
tenure of office. For avoidance of doubt, non-degree students,
student going on Industrial Training and spill-over student are not
eligible to contest for any elective office in the Association;
4. Any ordinary member holding an office in any society, club or
organization in whatever form is not eligible to contest any election
under the Association;
5. Any candidate for election shall have a Grade Point Average(GPA) of
at least 2.50
6. Any officer of the Association shall hold office for one academic
session and may be eligible for re-election for another term only
subject to sub-section (3) of this section.
7. Registration of candidates shall close seven (7) days before the day
of election.
8. Candidates aspiring for offices shall register by paying the specified
amount for form, pertaining to the office of interest into the
Association account and thereby proceed to complete registration
with the Electoral Commission;

9. The Electoral Commission shall display the names of all cleared
candidates and the respective offices they are vying for on the
notice boards at least three (3) days before the day of election;
10. A candidate found eligible for election to an executive office shall
present an election manifesto to an assembly of the Association on
the day before the day of the election;
11. Members of the SRC shall be elected of departmental basis not
later than seven (7) days before the election of the Executive
Council of the Association;
12. Each department shall be represented in the SRC in accordance
with Article (VI), Section (14) of this constitution;
13. A voter shall cast only one vote for a candidate of his/her choice;
14. All elections shall be by secret ballot;
15. At the end of voting, the Electoral Chairman or any member of the
Electoral Commission as may be delegated, shall open the ballot
boxes at the polling station and count the votes in presence of the
candidates and/or their representatives. In the case of an electronic
voting, the same procedure(s) shall be observed.
16. The result of the election shall be announced immediately and
directly as they are known, and a detailed list of candidates and the
votes obtained shall be published within twenty-four (24) hours
after the election;
17. A candidate shall be declared elected by a simple majority. If no
winner emerges because of a tie, the Electoral Commission shall
arrange another election within three (3) days for the candidates
who tied.

Section 26b; Eligibility for Election
1. Any student going for industrial training (IT) is not eligible for
positions in the faculty.
2. Any financial member of the association can vote and be voted for.
3. Any member that is indebted to the association cannot be voted
for.
4. Any member that has been indicted for any offence(s) cannot be
voted for.
5. Any member of the association contesting for the offices of
Governor and Secretary General must have held an elective
position within the Faculty or recognized association or
organization.
6. Any member contesting for the other offices except those stated in
sub-section five (5) of section 26b above must have held a position
in any recognized organization or association either by
appointment or election.
7. Governor or Speaker of FAPSSA cannot be re-elected for same
position in the next election.
Section 27: Electoral Petition
1. All electoral petitions shall be filed not later than forty-eight (48) hours
of the publication of the election results;
2. All petition on Electoral malpractice shall be directed to the Staff
Adviser of the Association whom shall determine all cases on its merits
and make public his decisions within seven (7) days of receipt of the
petitions. For the avoidance of doubt, there shall be no swearing-in of
an Officer whose election is in dispute and who has a petition pending
against him before the Staff Adviser.
3. All Electoral commissioners sent to SUG as representatives of FAPSSA
must remit at least 25% of all monetary revenues allocated to him to
the Faculty account.

Section 28: Swearing-in/Handing Over
1. The newly elected Executive Council shall assume office after being
sworn-in by the Chairman of the Electoral Commission in the presence
of the Dean of Physical Science or his representative at a ceremony
organized for this purpose by the Electoral Commission not later than
fourteen (14) days after the elections;
2. At the swearing-in of the new Executive Council, there shall be a
formal handing over of the Association’s leadership to the new
Governor by the outgoing Governor. Consequently, the former
Executive stands dissolved.

ARTICLE 10: CODE OF CONDUCT

Section 29: Code of Conduct for Association Members

1. It shall be the duty of every officer and other members of the


Association to adhere strictly to the provisions of this constitution, as
failure to do so shall attract appropriate sanctions.
2. Offences shall include;
(a)A breach of any provisions of this constitution;
(b)Acting in a manner likely to bring the name of the Association to
ridicule, disrepute and contempt;
(c)Fraudulent or dishonest practices, which are likely to embarrass or
disgrace the Association;
(d)Disclosing secrets of the Association without the authority to do so;
(e)Subversion of the activities of the Association;
(f)Any unlawful or arbitrary act prejudicial to the right of any person.

Section 30: Code of Conduct for the Officers of the Association
1. An Officer of the Association shall not put himself/herself in a position
where his/her personal interests conflict with his duties and
responsibilities to the Association;
2. An Officer of the Association shall not be a member of, or belong to,
or take part in any society, club or organization of which is
incompatible with the dignity of his/her office;
3. No officer of the Association shall accept any inducement or bribe for
the discharge of his duties;
4. An officer of the Union shall not do or direct to be done in abuse of
his/her officer, any arbitrary act prejudicial to the right of any person;
5. An Officer of the Association shall not abuse his office;
6. Dereliction of duty shall constitute an offence on the part of an Officer
of the Association;
7. Gross incompetence shall constitute an offence;
8. Calling, convening or presiding over a meeting of the Association
without authority as provided for in this constitution by an Officer of
the Association shall constitute an offence.
Section 31: Sanctions
The form of sanction which shall depend on the gravity of the particular
offence shall include;
(a) Caution
(b) Censure
(c) Refund or Restitution
(d) Suspension from office
(e) Suspension from the Association
(f) Impeachment from office
(g) Barring from holding office.

Section 32: Impeachment/Suspension/Removal from Office
1. The holder of any Executive office or Principal Officer of SRC in the
Association may, without prejudice to any other provisions of this
constitution be relieved of his/her office whenever a notice of
impeachment for misconduct, malpractice, abuse of office, dereliction
of duty, gross incompetence or maladministration signed by not less
than two-third (2/3) of sworn-in members of the SRC is made in
writing and presented to the Speaker of the SRC. Details of the
allegations shall be provided;
2. The Speaker shall within seven (7) days of receipt of such notice cause
a copy thereof to be served on the holder of the office and on each
member of the SRC;
3. The Speaker shall within seven (7) days of receipt of such allegations
cause investigation by a seven (7) man Committee from the SRC
nominated by the Speaker and ratified by SRC;
4. The Committee shall submit its report within fourteen (7) days of its
being constituted unless SRC grants an extension of time;
5. An Officer whose conduct is under investigation shall, depending on
the gravity of allegation stand suspended from the time the notice or
report is laid before SRC until determination of the case;
6. Where the allegation is against the Speaker, the same provisions as
the foregoing shall apply except that the Deputy Speaker or any other
member of SRC so appointed shall perform the duties of the Speaker
set out in this section;

ARTICLE X: FINANCES OF THE ASSOCIATION
Section 33: Sources of Association Funds
1. Donations
(a)The Association shall accept aids, grants and gifts from individuals
and organizations, provided that such donations shall not in any
way be prejudicial to any section of this constitution or undermine
its policy and the objective of the Association and University;
(b)The Association may organize fund raising activities when necessary
provided that it shall be done by the Executive Council subject to
the approval of SRC;
2. Dues
The membership dues shall be determine by the Executive Council and
the Staff Adviser at the beginning of every academic session of which
shall be paid into the Association’s account and subject to review from
time to time by SRC;
3. Profits
The revenue of the Association d
Shall include proceeds, dues and profits from its legitimate activities
and investment.
Section 34: Expenditure of the Association Funds
1. Liabilities
The Liabilities of the Association shall include;
(a) Furnishing and maintenance of the Association properties;
(b) Salaries in respect to the employed personnel of the
Association;
(c) Expenses’ in respect of approved functions and activities of the
Association;
(d) Other expenses may, from time to time be approved by SRC in
accordance of this constitution.

2. Disbursement of Association Funds
(a) The disbursement of any fund of the Association shall be duly
authorized at any time under the signatures of; Staff Adviser (Assistant
Dean), Governor and Director of Finance.
(b) During the period between the inauguration of the Executive
Council and the approval of the approval of budget by the SRC, the
Governor shall have power to authorize the payment of salaries of
all employed personnel of the Association;
(c) Payment vouchers shall be raised for all withdrawals by the
Director of Finance.
Section 35: Budget
1. The Executive Council of the Association through the Governor shall
present to SRC an annual budget showing estimated income and
expenditure for the period covering the Council’s tenure of office;
2. All expenditure shall fall within the budget approved by SRC;
3. A copy of the annual budget shall after approval by SRC, be presented
to the Faculty authorities for its information;
4. The annual budget shall not after its approval by SRC be amended
except of recommendation of the Executive Council and approval of
the SRC;
5. At least ten percent (10%) of the Association Funds for a particular
session shall be left behind for the incoming government to start with.
Section 36: Signatories to Association’s Account
For clarification, the signatories to the Association’s account shall include;
1. The Governor
2. Director of Finance
3. The Staff Adviser (Assistant Dean)

ARTICLE XII: MISCELLANEOUS PROVISIONS

Section 37: Commencement and Review of the Constitution

1. This Constitution shall come into force with effect from 2019/2020
academic session and shall be reviewed only in accordance with its
provisions.
Section 38: Amendment
1. Sections of this Constitution shall be subject to amendment upon a
resolution passed by not less than two-third (2/3) of members of SRC;
2. Notice of meeting to amend the Constitution with the intended
amendment stated in precise terms and signed by the mover and
seconder (who must be a member of SRC) shall be presented to the
Clerk of the SRC;
3. The Clerk of the SRC shall forward to every Member of SRC statement
of the intended amendment at least twenty-four (24) hours before the
meeting.
Section 39: Right of Association to Own a Copy of this Constitution
A member of the Association shall be entitled to a copy of this
Constitution subject to the fulfilment of the provisions of Section 5, 6, 7 & 8
of this Constitution.
Section 40: Definitions
“Caretaker Committee” as used in Section 13 means an interim committee
constituted by SRC following the dissolution of the Executive Council by SRC
on grounds of gross misconduct.
“Executive Council” means the organ of the Association which is responsible
for its day-to-day affairs.
“Impeachment” means a process of investigation which may lead to
removal from office.
“Officers of the Association” means any member of the Executive

Council, SRC and others who may be either duly elected or appointed to
serve the Association in any capacity.
“Association” means the Student Association, Faculty of Physical Sciences,
and University of Benin, Benin City.
