BRIEF SCOPE OF WORK

Note: All efforts have been made to define the Scope of Work for the
successful bidder in this document in respect of tendered work. However,
defined Scope of Work specified in this document is indicative only but not
limited to. All works, which are required to successfully design, construct, and
handover the complete MEA HOUSING COMPLEX to client, even if they are not
specified in this document comes under the Scope of Work for the successful
bidder. All the bidders are encouraged to send their queries seeking their
clarifications, if any in this respect within the stipulated time. It may be noted
that no extra payment, whatsoever will be admissible to the successful bidder
on account of merely non mentioning of any work / component / equipment /
scheme in this document which is otherwise required / necessary for
successful completion of work as per standard engineering practice/s.

The scope of work for E.P.C. Contract shall include (but not limited to) the following
works. Scope of work in brief for a glance is as below:
1. EPC contract shall include Architectural Planning, Concept Design, Soil
investigation and Survey, Site Clearance, Tree Cutting & Transplantation -
maintenance of transplanted trees till work completion, Design of Structure
and MEP services including allied works, Vetting of structural design from IIT,
obtaining all statutory approvals (Pre construction, During construction, Post
construction) from Local Authorities / Body including services, preparing
submission and execution drawings, getting approval from NBCC, material/
equipment supply, Construction and Commissioning of the project.
2. The contractor’s quoted rates are deemed to include everything from the
award of work up to & including handing over of completed project, defect
liability period. The EPC Contractor is required to connect all the external
services like Water Supply, Sewerage, Drainage, Electric Supply, LAN/WAN,
Broadband/Internet lease line, Telephone Lines, Gas Pipeline etc. to the main
lines of the authorities/service providers which shall be integral part of his
scope of work and deemed to be included in his quoted price. All municipal &
mandatory approvals required for occupation and completion of the project
shall be obtained by the Contractor.

3. Design, Construction & Handing over of RCC double story basements of


heights as per Tender Drawings, having tentative total built-up area of around
11153.7 SQM with diaphragm wall/retaining wall or both in RCC along with
RCC stairs, RCC UG Tanks, WTP, STP, Pump Room, Electrical Panel Room
etc., with all facilities, as instructed by EIC. Basement retaining
walls/Diaphragm wall, raft, all water retaining structures shall be treated with
water proofing materials / layers / compounds / membranes / any other
manner, as directed by EIC. The floor of both basements shall be tremix VDF
concrete with approved traffic signage, markup & accessories. Power on
Ethernet (PoE) System shall be considered for both bases.

4. Design, Construction & Handing over of RCC G+9storeyResidential Building


Block having minimum 3.3mtr, floor to floor height and ground floor height of
4.2mtr, having tentative total built-up area of around 31142 SQM with RCC
Walls using MIVAN Shuttering. All interior works with fittings and fixtures,
MEP equipment fittings and fixtures, HVAC System, IT & AV Service
equipment fittings and fixtures as per DBR, scope of work, approved
architectural drawings, facade drawings, good for construction drawings&
shop drawings complete in all respects as per EIC instructions.

5. Design, Supply and Construction, Testing, Commissioning and Handing over


of Fire Fighting System with Sprinkler System and Automatic Fire Alarm
System (intelligent fire detection and alarm system) for both basements,
G+9storeyResidential Building Block and any other area, as directed by EIC
complete in all respects, as per EIC instructions. The contractor needs to work
on the drawings approved by the Delhi Fire Service (DFS).

6. Design, Supply and Construction, Testing, Commissioning and Handing over


of Internal Water Supply System, Sanitary Installations and all requisite
External Service Connections for both basements, G+9 Residential Block,
Guard Hut, Public Toilet Block, Horticulture Works, External Area to be
developed and any other area, as directed by EIC complete in all respects, as
per EIC instructions.

7. Design, Supply and Construction, Testing, Commissioning and Handing over


of Electrical Works such as : Internal electric installations, power wiring and
plugs, central call bell system, lightening conductor, telephone conduits,
computer conduits etc., for both basements, G+9 Residential Block, Guard
Hut, Public Toilet Block, Boundary Wall, Horticulture Works, External Area to
be developed and any other area, as directed by EIC complete in all
respects, as per EIC instructions.

8. Design, Supply and Construction, Testing, Commissioning and Handing over


of Machine Room Less / Low Height Machine Room Lifts / Elevators as under
:

9. G+9 storey Residential Building Block :15 number of 13passenger capacity


lifts, with minimum speed of 1.5 m/sec upto lower basement (i.e., 12 floors).

The lifts shall have glass doors specifications as per fire norms. The interior
finishes shall be in accordance with the finishing schedule/pictures provided.
The fire Lifts shall be stretcher size compliant.
The contractor shall ensure that before ordering the lifts, the weight of the
finishing materials of the floors, walls and ceiling are taken into consideration
so that the capacity of the lifts isn’t affected. The contractor needs to ensure
that all cosmetic changes on the walls, ceiling and floor of the lifts are in
accordance with the Lift Manufacturer’s guidelines so that there is no
discrepancy in the future regarding maintenance and warranties.

without independent staging of approved capacity for storage and distribution


of both Fire Water and Domestic Water including all equipments, fittings and
fixtures, water proofing treatment, food grade epoxy lining for domestic water
storage tanks complete in all respects, as per DBR, Specifications and EIC
instructions.

11. External Site Development Design, Supply and or Construction, Testing,


Commissioning and Handing over of tentative area of 8203.54 SQM. Broad
activities under External Site Development includes Levelling, Internal Roads
& Path Ways, Sewer Network, Filtered Water Supply Network, All services
distribution lines of 100 mm dia or any size approved by EIC, All peripheral
grid services distribution lines of 300 mm dia or any size approved by EIC,
Unfiltered water supply distribution lines, Storm Water Drains, Horticulture
Operations as per Design Basis Report, approved scheme, Street Lighting -
Electric as approved by EIC, Comprehensive Campus Signage including
electric signage, RBG facade lighting system for complete campus and its
building blocks etc.,

12. Design, Supply and or Construction, Testing, Commissioning and Handing


over of 11/0.433KV Sub-Station equipments comprising but not limited to H.T.
Panel, Transformer, HT Cable, Bus trunking from Transformer to LT Panel, LT
Panel, Automatic power factor corrector panel, Essential Panel i/c Earthing,
inter connecting power cables in sub- station, safety equipments etc., for
minimum capacity of 2000 KVA or the capacity approved by EIC as per DBR,
scope of work, approved architectural drawings, facade drawings, good for
construction drawings & shop drawings complete in all respects as per EIC
instructions.

13. Design, Supply and or Construction, Testing, Commissioning and Handing


over of silent type D.G. Set, AMF Panel, Bus Trunking /cables from DG Set to
essential panel, control cable, Earthing of DG Set and AMF Panel, DG set
exhaust piping as per CPCB norms and minor allied works etc., for minimum
capacity of 2 nos of 650 KVA or the capacity approved by EIC as per DBR,
scope of work, approved architectural drawings, facade drawings, good for
construction drawings & shop drawings complete in all respects as per EIC
instructions.

14. Design, Supply and or Construction, Testing, Commissioning and Handing


over of sandwich bus-trunking including vertical and horizontal bends, adopter
box, flange end and flexible joint with suitable earthing strips having 50KA
breaking capacity and having IP 54 protection. etc., with copper bus bars as
per DBR, scope of work, approved architectural drawings, facade drawings,
good for construction drawings & shop drawings complete in all respects as
per EIC instructions.

15. Providing and Fixing Retractable Mosquito Prevention Mesh Nets in all
outdoor areas like sliding doors, balconies, etc., as per instruction of EIC.

16. Providing and Fixing of Ceiling mounted Retractable Cloth Drying racks in
service balconies or as specified by EIC.

17. Design, Supply and or Construction, Testing, Commissioning and Handing


over (including grid connectivity & net metering) of Grid interactive roof top
solar photo voltaic power generation system i/c space frame etc., for minimum
capacity of 100 KW or the capacity approved by EIC as per DBR, scope of
work, approved architectural drawings, facade drawings, good for construction
drawings & shop drawings complete in all respects as per EIC instructions.

18. Design, Supply and or Construction, Testing, Commissioning and Handing


over of IP based CCTV system for total campus security comprising of PTZ,
Fixed camera, cabling, recording, display system and hardware and software
support etc., for both basements, G+9 Residential Block, Guard Hut, External
Area to be developed and any other area, as directed by EIC complete in all
respects, as per EIC instructions.

19. Design, Supply and or Construction, Testing, Commissioning and Handing


over of Access control system for total campus security comprising of
Controller, E&M locks, Reader, Smart cards (Provide Min. Card 400 Nos. or
as per requirement whichever is more) supply, cabling, recording, display
system and hardware and software support. etc., for both basements, G+9
Residential Block, External Area to be developed and any other area, as
directed by EIC complete in all respects, as per EIC instructions.

20. Design, Supply and or Construction, Testing, Commissioning and Handing


over of distribution cables from Substation to the G+9 Residential Block as per
DBR, scope of work, approved architectural drawings, facade drawings, good
for construction drawings & shop drawings complete in all respects as per EIC
instructions.

21. Design, Supply and or Construction, Testing, Commissioning and Handing


over of active hormonic filter with detuned reactor (Hybrid System) etc., for
minimum capacity of 1200 KVAR/AMP or the capacity approved by EIC as
per DBR, scope of work, approved architectural drawings, facade drawings,
good for construction drawings & shop drawings complete in all respects as
per EIC instructions.

22. Providing and Fixing External surfaces finished with Texture paint finish. This
stone texture coating ceramic stone finish, consisting of water based Natural
fine ceramic stone material which is highly abrasion & scratch resistant, with 6
coat system & PU Based clear topcoat which shall be highly water repellent,
anti-algae & anti-fungal in nature. The coating shall also cover hairline cracks
with application method which includes Surface Preparation, 2 coats of two
component silicate-based primer (a two-component silicate-based inorganic
polymer undercoat), Making groove, 2 coats of Fine Ceramic Stone finish (wet
on wet) & 2 coats of PU based clear topcoat (Turpen based, mild solvent,
super-dirt resistant NAD type two pack polyurethane clear topcoat) complete
at all heights. This work shall be executed by a Company
authorized/Trained/Recommended system integrator/installer or as decided
by the Engineer-in-charge.

23. Providing and Fixing 40mm thick Shot Blasted Gwalior Mint Sand Stone
Cladding upto a height of 7.5Metres and areas specified in drawings and
instructions as per EIC/ MEA/ NBCC.

24. Design, Supply and or Construction, Testing, Commissioning and Handing


over of Energy Efficient VRV/ VRF System i/c indoor, outdoor units, piping,
cabling/ bus-trunking/ rising main (within the building / block), wiring, electrical
panel and also treated fresh air system etc. having minimum capacity of 1200
HP or the capacity approved by EIC as per DBR, scope of work, approved
architectural drawings, specifications, good for construction drawings & shop
drawings complete in all respects as per EIC instructions. The latest air
purification systems as per EIC shall be installed in the Sports areas of the
Basement, common amenities and apartments.

25. Design, Supply and or Construction, Testing, Commissioning and Handing


over of Building Management System (BMS) for basements, G+9 Residential
Block, any other area, as directed by EIC as per DBR, scope of work,
approved architectural drawings, specifications, good for construction
drawings & shop drawings complete in all respects as per EIC instructions.
BMS System should broadly able to manage / control / monitor following
building services:

• Total Plot Energy Consumption with Energy Management System along with
hardware and software.
• HVAC System Complete Control & Management.
• Lifts / Elevators / Escalators.
• Electrical Switchgear, Substations & DG Sets.
• Pumps & Motors for Domestic & Fire Water Supply System.
• Sewerage Treatment Plant & Water Treatment Plant.
• Basements Mechanical Ventilation System.
• Other systems such as UPS, Fire Alarm, Plumbing System etc, as directed by
EIC.
• All systems / sub-systems to be proposed in this work shall be BMS
compatible.

Above BMS System should include all requisite field devices / controllers, wiring,
equipments, computers with display screens, software licences, communication /
compatibility devices if needed etc., complete in all respects as per EIC instructions.
Its contractor’s responsibility to supply such building systems and sub-systems,
which could be readily integrable with BMS System, as above.

27. Design, Supply and Construction, Testing, Commissioning and Handing over
of Basement Ventilation, Smoke Extraction per DBR, scope of work, approved
architectural drawings, specifications, good for construction drawings & shop
drawings complete in all respects as per EIC instructions. The contractor
needs to work on the drawings approved by the Delhi Fire Service (DFS).

28. Design, Supply and Construction, Testing, Commissioning and Handing over
of Electric Geysers of approved capacity for G+9 store Residential Building

Block at appropriate areas/toilets, kitchens, complete in all respects as per


EIC instructions.

Note: Electric Geysers shall be provided in Toilets and kitchens of all


flats.

29. Design, Supply and Construction, Testing, Commissioning and Handing over
of hydro-pneumatic water supply system (along with piping) consisting of
minimum 3 nos pumps (2 working+1 stand by) i/c microprocessor-based
control panel and VFD complete as required. having minimum capacity of
350litres per minute or the capacity approved by EIC as per DBR, scope of
work, approved architectural drawings, specifications, good for construction
drawings & shop drawings complete in all respects as per EIC instructions.
Above system shall be provided for basements, G+9 Residential Building
Block, any other area, as directed by EIC.

30. Design, Supply and Construction, Testing, Commissioning and Handing over
of Sewerage Treatment Plant with requisite civil structures / work having
minimum capacity of 75 KLD or the capacity approved by EIC as per DBR,
scope of work, approved architectural drawings, specifications, good for
construction drawings & shop drawings complete in all respects as per EIC
instructions.

31. Design, Supply and Construction, Testing, Commissioning and Handing over
of Rain Water Harvesting System with requisite civil structures / work at
minimum three locations within the plot area or at the locations finalized by
EIC as per DBR, scope of work, approved architectural drawings,
specifications, good for construction drawings & shop drawings complete in all
respects including compliance letter /certificate from DJB/CGWA as per EIC
instructions.

32. Design, Supply and or Construction, Testing, Commissioning and Handing


over of tube wells with pump and motor System with requisite local bodies
clearances, civil structures / work at minimum three locations within the plot
area or at the locations finalised by EIC as per DBR, scope of work, approved
architectural drawings, specifications, good for construction drawings & shop
drawings complete in all respects as per EIC instructions.

33. Design, Supply and or Construction, Testing, Commissioning and Handing


over of Data Networking System, fibre optical with broadband internet
connection with requisite equipments, fixtures and fittings for basements, and
each residential unit (90 numbers) of G+9 Residential Building Block,offices
and common amenity areas any other area, as directed by EIC at the
locations finalised by EIC as per Design.

34. Design, Supply, Testing and Commissioning of Exterior and Façade lights
with daylight sensors and astronomical timers. The lighting automation shall
be controlled by a DMX controller. The scope includes all necessary
equipment such as drivers, cables, connectors etc. The contractor needs to

submit a Lighting Layout Proposal along with Simulations and Renders for
approval by EIC/ MEA before commencement of works.

35. Supply and or Construction, Testing, Commissioning and Handing over of


IPBX System with requisite equipments, cabling, fixtures and fittings for
basements, G+9 Residential Building Block, Guard Posts, any other area, as
directed by EIC at the locations finalised by EIC as per Technical
Specifications, DBR, scope of work, approved architectural drawings, facade
drawings, good for construction drawings & shop drawings complete in all
respects as per EIC instructions.
Note: Telephone shall be IP Based provided as per DBR and Specification.

36. Design, Supply and or Construction, Testing, Commissioning and Handing


over of Audio Video System with requisite equipments, cabling, fixtures and
fittings, licences, softwares etc. (upto DLP period after successful handover to
NBCC/Client in writing) for basements, G+9 Residential Building Block, Guard
Posts, any other area, as directed by EIC at the locations finalized by EIC as
per Technical Specifications, DBR, scope of work, approved architectural
drawings, facade drawings, good for construction drawings & shop drawings
complete in all respects as per EIC instructions.

37. Design, Supply and or Construction, Testing, Commissioning and Handing


over of Boundary Wall, Guard Posts, Meter Rooms, Sliding Gates, RFID
based Boom Barriers, Bollards etc., with requisite equipments, cabling,
fixtures and fittings etc., within the campus, or any other area, as directed by
EIC at the locations finalised by EIC as per Technical Specifications, DBR,
scope of work, approved architectural drawings, facade drawings, good for
construction drawings & shop drawings complete in all respects as per EIC
instructions.

38. Design, Supply and Construction, Testing, Commissioning and Handing over
of (a) Automated Entry / Exit System for Men & Materials and (b) Automated
allocation of Car Parking System complete in all respects as per the scheme
approved by MEA / EIC.

39. SITC of Minimum 4no’s of DC Fast charging equipment (60 KW) as per
technical specification for EV charging. The same needs to be approved by
the Electric power supplier of the area.

40. Design, Supply, Testing and commissioning of fully equipped Stainless Steel
kitchen inclusive of all appliances, refrigeration, cold storage, grease traps,
exhaust hoods, scrubbers and all necessary equipment to cook food for
running a Cafeteria of 100 covers.

41. Design, Supply, Testing and commissioning of fully equipped stainless steel
pantry to be used for heating and catering food to halls. The Pantry shall
include all necessary equipment like refrigeration, grease traps, exhaust hoods
and all necessary items to cater 100 covers.

42. Design, Supply and or Construction, Testing, Commissioning and Handing


over of tennis, badminton and 2 squash courts of size and design approved by
EIC with requisite flooring materials, equipments, cabling, fixtures and fittings
etc., as per Technical Specifications, DBR, scope of work, approved
architectural drawings, facade drawings, good for construction drawings &
shop drawings complete in all respects as per EIC instructions.

43. Design, Construction, Testing, Commissioning and Handing over of


Gymnasium, Yoga Room, Indoor Activity Area, Multi Purpose Halls, Kitchens,
Pantries on the Ground Floor and Basement, Stores in basement for
individual unit with requisite flooring materials, cabling, fixtures and fittings
etc., as per Technical Specifications, DBR, scope of work, approved
architectural drawings, facade drawings, good for construction drawings &
shop drawings complete in all respects as per EIC instructions. Gymnasium
Equipment, Indoor Activity Area Equipment and Kitchen Equipment shall be
supplied by the contractor and all works including elec. cabling, complete
design of these spaces / areas shall be done by the contractor.

The following works shall be executed as per DBR, Specifications, Schedule of


Finishes, approved scheme, drawings etc., complete in all respects as directed
by EIC.

44. All Structural Works – As per Structural DBR

47. Sewerage Treatment Plant of approved capacity.
48. Design, Supply & Installation of various blinds as mentioned in the indicative
items of work for the entire campus.

53. Automatic Swing & Sliding Doors
54. Access Control System
55. IBMS, IBMS Control Room& Systems including all software &licenses.
56. PA & Background Music System
57. Street, Outdoor& Landscape Lighting
58. Façade (RBG Lighting) & Digital Lighting
59. Telephone & IPABX System
60. CCTV Network
61. Boom Barriers
62. External Furniture and Art Works (Murals, Sculptures, etc.)

63. Internet / Broadband connection including laying of fibre optical line, Server,
Wifi over entire campus with minimum download speed of 50 MBPS all over
the complex at any given time and test reports / certificates to this extent shall
be provided.
64. Customized Cable Trays & Race Ways including cable managers and pop-up
boxes.
65. Signage Systems for entire Building Complex, Building, Basements, Roads
etc.,
66. All Horticulture Works for entire campus as per approved scheme.
67. Glass Mosaic Tiles work, Artwork& Murals for entire complex as per approved
scheme, DBR & Specifications. The EPC Contractor needs to make an Art
Master Plan and get it approved by the EIC/ MEA before commencement of
works.
68. Site Development & Landscape (including landscaped roads, dustbins,
Sculptures, water fountain, fire tender path, Paths, Streets feature & furniture)
for entire campus as per approved scheme.
69. Epoxy coated floor in Driveway & parking bays (Over Trimix base) defining
the traffic route clearly with entry and exit signage. Provide all directional
signage and column will be finished epoxy up to full height in both the
basement.
70. Sub-Meters shall be provided in all quarters / flats and public areas measuring
consumption of electricity units as per EIC directions. The submeters shall be
in compliance with the local body regulations and guidelines.

71. PoE (Power on Ethernet) Lighting System for Basements. The scope under
this work covers the Design, built, Supply Installation, testing and
commissioning of LED Light, Lighting automation and Energy Management
for basements area through Power over Ethernet. Which includes, but not
limited to, the following.
• Lighting/Illumination design for parking area as per the NBC 2016/SP72.
• Lux level design, selection of LED fixtures to work on Power over Ethernet, as
per the technical specification.
• Lighting Management System through PoE as per the technical specifications,
DBR etc.,

72. Providing, Designing and Fixing of Powder Coated Aluminum Louvres and
GFRC Jaali Works for screening of service areas, shafts and other areas as
per instructions of EIC/ Client. The contractor needs to get the colour, design
and material approved from EIC/ Client before commencement of works.

73. The project is to be built fully compliant to minimum GRIHA 4 star norms for
the entire scope in this contract & contractor shall obtain GRIHA certification
to this extent.

74. All signage’s will be LED lighted as per concept drawings / as per direction of
Engineer-In-Charge.

75. All external electrical light poles and other electrical equipment in external
façade/landscaping will be powered by electricity as well as with the solar
power.

76. All statutory / municipal approvals during / pre and post construction stages
are to be obtained by the bidder. The statutory fee for such approvals shall be
reimbursed by the NBCC/Employer.

77. The details mentioned in DBR and technical specification / conceptual

78. The area statement given is indicative in nature. The works is to be completed
as per concept design, NBCC/Client requirements, drawings, scope of work,
finishing schedule and prevalent codes, NBC 2016, statutory requirement
guidelines etc.

79. Soil report enclosed is indicative. Bidder/Contractor is directed to do their own


survey/exploration in Bore Locations as specified by the EIC; nothing extra
will be paid on deviation of soil report.

80. All drawings (architectural, structural & services) / specifications or data


sheets or design calculations, reports etc., / makes / shop drawings and
construction methodology etc. are to be prepared by the bidder and got
approved them from NBCC as required prior to execution / procurement.
However, it does not imply that bidder absolves themselves from codal
provisions / statutory requirements.

81. Formwork for all RCC works should be of MIVAN Shuttering for RCC
Structure as per instructions of EIC.

82. All columns/wall corners in the parking area should have approved
rubber/PVC corner protection.

83. All Hand Rails & Guard Rails shall be of SS 304 grade including their
accessories at all staircases as applicable shall be modular, i.e. factory made
of approved design.

84. Entry point/exit point should have boom barriers with RFID facility as well as
PVC speed breakers as required.

85. Parking shall be provided as per NBC 2016/UBBL 2016 DELHI or prevalent
statutory requirements.

86. The scope of work also includes providing mock up/ sample of 3 Sample flat
(Type 6, Type 4 and Transit) Including Lifts, Lift Lobby and Staircase. Mock-
up shall include all internal finishing’s including door windows, glass, flooring,
hardware, electrical and sanitary wares, cabinets, cup boards, furniture,
CCTV, Telephone, Audio Video System all complete etc. as directed by EIC.

mockup will serve as a template for doing rest of the apartments similarly.

87. The facility at each floor as shown may interchange/may add/may delete
within building envelope as conceptualized. The internal partition and allied
services may also change as per functional need and requirement of the
client/ NBCC etc. Nothing extra shall be payable on this account to contractor.

88. All lifts to be fitted with CCTV Cameras, BMS integrated including intercom
facility, connecting with central control room for 2-way communication.

89. All aspects of security, safety in terms of functioning, integration of various


services through IBMS is to be done (for HVAC, Fire, Water Supply, Lifts,
Electrical panels, DG Sets, Sub-Stations, Energy Metres, STP, WTP, CCTV,
Pumps etc.) by bidder.

90. All IBMS / security services are to be controlled through Command centre
which is to be established by bidder as per location in concept drawing with
minimum 4 No.’s 55 inch LED screens and other monitors and equipments
with minimum one month digital data storage. The command centre should be
finished as per requirement with furniture, HVAC, lighting, storage space,
telephone, wifi etc.

91. All specifications are to be followed as given in technical specifications,


however, at any location if any information/specification is of specific make it
has to be treated as or equivalent.

92. Preparation of Detail design and drawings (architectural, structural & services)
based on DBR shall be done by the contractor.

93. Preparation of Shop drawings and its approval from NBCC shall be done by
the contractor.

94. The E.P.C. contractor shall bear the complete responsibility and cost for the
surveys; investigation studies; design development of the employers design/
performance criteria up to detail design level, Engineering (including all
specialised engineering requirements mentioned in the contract or needed for
the successful completion and handover of the project); Manufacture,
Delivery, Construction, Erection and Installation, Testing, Commissioning,
Handing Over and provision of required warranties of the entire facility to the
satisfaction of EIC.

95. The E.P.C. contractor is expected to discharge his responsibility in conformity


with the contract as per the tender documents and those documents specified
therein to constitute the contract document and in conformity with all laws,
regulations, acts, statutes, bye-laws, applicable to all aspects of the
investigation, design, engineering, construction, manufacture, delivery and
shall indemnify the owner against any claims or damages, fines, suits, legal or
administrative actions/ strictures penalties, etc. resulting from the neglect or
inability or avoidance of the above said laws, regulations, statutes, etc..

96. It is re-emphasized that the employer expects the EPC Contractor to comply
with all municipal regulations, environmental regulations, health and safety
regulations and comply with all the requirements spelled out in this regard in
the contract. Where there is a difference between the employer’s
requirements and regulatory requirements the more stringent provision shall
prevail. It is assumed the EPC Contractor has completed his due diligence on
this prior to filling the tender and no change in cost shall be considered for
this.

97. The Transit Quarters (18nos.) shall be fully furnished and ready to move in.
The contractor needs to ensure all works including finishing, appliances,
equipment and all necessary items as mentioned in the DBR, Drawings,
Technical Specifications or as specified by EIC/ MEA are fulfilled.

98. The EPC Contractor shall follow all best practices, codes, standards and
adhere to specifications and shall meet or exceed performance requests as
spelled out in this contract.

99. The EPC Contractor shall engage reputed Architect, Interior Designer,
Experienced Interior Works Executing Agency etc., or any such specialized
agency / agency as instructed by EIC/ MEA for proper works execution,
complete in all respects as per EIC’s instructions.

100. The EPC Contractor shall carry out the procurement of all the materials,
equipments, Installations, accessories as may required for work completion
and Installation & Commissioning of work for the project. No
material/equipment shall be procured without approval /sample approval from
EIC.

101. The EPC Contractor shall undertake the construction of the project in
accordance with the Employer approved Design Development Documents.

102. The scope of the execution work shall be in accordance with the design
development documents, as prepared by the EPC Contractor and approved
by the EIC, inclusive of, but not limited to, civil and structural works,
architectural works, hard and soft landscaping works, signage works, all
building work associated with MEP, Fire Protection, Lifts, Special Systems, LV
and ELV Systems, and all associated works for the Project, as further
described herein and as per the Works Requirements. The work is inclusive of
all coordination with other contractors and consultants working on the Project.
Specific requirements are elaborated below.

103. All Washrooms / Bathrooms, Balcony areas, Roofs , Basement, Raft,


Retaining Wall/D-wall, Construction Joint, Toilet, with/without landscaping,
terrace wet areas in the entire campus shall be treated with water proofing
materials / layers / compounds / membranes as per the manner / method /
scheme mentioned in technical Specification or approved by the EIC.

6.1 Scope of Work
The project is aiming for a GRIHA 4-star certification minimum, the

6.2.26 ETP: Effluent Treatment Plant

6.3 During Construction Guidelines:


The contractor shall ensure the execution, maintenance, and proper
documentation of the following points throughout construction to
achieve GRIHA certification compliance for onsite construction
practices.
6.3.1 Topsoil Preservation: Contractor should ensure preservation of
topsoil cover by following ways:
• Remove topsoil to a depth of 20 – 30 cm from the areas where
construction activity is proposed and reapply top soil in proposed
landscaped area or areas away from the construction activity which
shall remain untouched during the construction period. After
completion of construction work, the preserved top soil should be
reused for landscaping.
• Topsoil to be stacked up to a maximum height of 40 cm (As per NBC
guidelines)
• Grassing or mulching to be done on the stacked soil to ensure the soil
retains its nutrients.
• In areas where slope of the ground is more than 1:10,
small trench/channels to be constructed to reduce run off
velocity.
6.3.2 Existing trees and other forms of vegetation to be preserved by
avoiding disturbance/damage due to construction activities. All
existing vegetation should be marked on the site survey plan. The
tree survey must be carried out and data must be recorded before
starting construction activity. Adequate fencing to avoid
disturbance/damage to trees and other vegetation to be provided.
To compensate for the loss of vegetation/mature trees, replant the
vegetation/trees inproportionof1:4.
6.3.3 Low water consuming materials (curing compounds) to
be used to reduce construction water consumption.
6.3.4 Contractor shall ensure use of BIS recommended waste materials
in building structure as per the following requirements.
Documentation shall be maintained in the form of Narratives, test
certificates/ reports, technical sheets, BOQ and purchase orders.
• 25% replacement of Ordinary Portland cement with fly
ash/BIS recommended waste material by weight of
cement used in structural concrete.
• Minimum 40% composition of building blocks/bricks by fly
ash/BIS recommended waste material by volume, for
100%load bearing and non-loadbearing masonry walls.
• 25% replacement of Ordinary Portland cement with fly

6.3.5 The following points have to been sued for Air pollution Prevention.
• At least a 12 m high barricading shall be installed all around
the perimeter of the construction site.
• Wheel washing facilities are to be provided at all site entrances.
• Covering off in aggregate and excavated earth by geotextile/plastic
sheets.
• Regular water sprinkling on fine aggregate, sand and excavated earth.
• All diesel gensets to have proper chimneys facing away from the site.
6.3.6 Project has to fulfil the compliance requirement as per NBC:
Volume 1 Part 3 General Development Control Rules and
General Building Requirements.
6.3.7 Construction management practices and safety measures
shall be complied with as per NBC: volume – 2 part 6. Broadly,
the following points shall be ensured on site throughout the
construction period.
• Safety Gears (Helmets, Boots, masks, gloves & Harness):
Safety gear shall be provided to all the construction work force,
engineers, staff, visitors and other onsite personnel.
• Safety Nets: Safety nets shall be installed at different
heights as required on the buildings during the course of
the construction.
• Regular workshops or training programs shall be conducted for
the construction workers for proper knowledge of the safety
measures to be maintained onsite.
• Labor Hutment: labour hutment shall be provided for the
construction workers if the workers are not locally sourced.
Hygiene, proper ventilation and natural daylight shall be
maintained.
• Drinking Water Facility: Drinking water facilities shall be provided
onsite at convenient locations. Drinking water test reports shall
be conducted at regular intervals and test reports shall be
maintained for Griha documentation.
• Separate Toilets and Bath Areas for male and female workers to
be provided and hygiene to be maintained.
• Children Day-care Centre to be provided in the labour hutment.
• Clean Environment: Dustbins shall be placed at various locations
in the labour living area to maintain cleanliness and ensure a
healthy environment for the labour living on site
• First-aid Room: First-aid room shall be provided on and general
medicines shall be stocked at site for immediate attention in

case of emergencies and other common ailments for the


laborers.
• Debris Chute : contractor shall have to provide the debris chute
at different location at site to avoid the dust and other pollution
causes.
6.3.8 Contractor shall prepare soil erosion and sedimentation control
plan and waste/scrap reuse plan before starting construction
activity and submit the same for client/GRIHA consultant
approval. The plan is to be prepared as per the following
parameters and is to be executed effectively during the whole
construction phase:
• The sedimentation basin should be constructed to store the
calculated volume of run off. The location of the basins to be
selected by considering topography and slope of the site. The
sedimentation basins should be located at the lowest convenient
points and connected to stormwater drains.
• Temporary seeding, mulching, sedimentation trap, staging
around construction area with level different/temporary
drainage channel and other methods need to be adopted and
should be shown in the plan.
6.3.9 Excavation to be avoided during monsoon season to minimise
and avoid soil erosion due to rainfall.
6.3.10 Contractor to generate and submit a construction activity, material
storage, construction waste storage and vehicular movement plan
before starting the construction activity. The plan is to be prepared
to ensure the following and is to applied effectively during the
whole construction phase:
• Demarcate area on site plan to which construction activity would
be limited by the contractor. The demarcated area should be
separated from the rest of the site by a physical barrier.
• All construction materials to be stored in demarcated areas
with low height enclosures to limit spillage, waste and site
contamination.
• Control plan clearly stating measures to stop and contain spills
to dispose off contaminated materials and hazardous waste (
hazardous waste include pesticides, paints, cleaner and
petroleum products etc.) cover all loose stored materials with
geotextile or any impervious fabric /covering.

• Location should be identified on the construction site to store


the used/scrap wastes. Both these wastes should be
separately stored in bins and handed over to authorized
agencies for safe disposal.
6.3.11 Contractor shall keep activity wise evidences of all
measures taken on site in form of photographs at every
stage of construction to fulfil the GRIHA compliances
related to sustainable site planning.
6.3.12 Contractor shall get the following tests as per GRIHA certification
requirements:
• Onsite drinking water test report (monthly)
• Construction water test report (every6monthsduringthe entire construction
period)
• Ambient Air quality test report (every6monthsduringthe entire construction
period)
• During construction noise test report (outdoor) (every 6
months during the entire construction period)
• Percentage Fly ash content in concrete (per batch)
• Percentage flyash content in AAC blocks

• Top Soil Fertility test report ( on minimum 2 locations on site


before excavation from an ICAR accredited laboratory )

6.4 Site level GRIHA certification Requirements


6.4.1 Contractor shall substantiate GRIHA certification documentation for
criterion1site selection.
6.4.2 Contractor shall provide analysis and documentation to indicate
reduction in environmental impact through design by adoption of
various passive design and low-impact site planning strategies
as mentioned below as per GRIHA compliance requirement.
• Control annual Heat Gain through favourable orientation and design of
facades
• Internal zoning/layout of the floor plate
• Facilitating cross ventilation in naturally ventilated/mixed-mode ventilation
spaces
• Building design has been done in a manner to not obstruct the
solar access to the neighbouring buildings, especially if the
neighboring building has solar photovoltaics and solar water
heaters installed on the roof
• Massing of the building/campus done in a manner to reduce insolation
• Use of trees to control heat gain
• Site planning according to contours
• Site plan designed to preserve existing vegetation/
existing water bodies /other topographical features
like boulders etc.

6.4.11 Following tests are to be conducted and test report to be
maintained indicating compliance with GRIHA certification
requirements:

• Postconstruction Noise test report
• Indoor: At least two locations in each building typology
• Outdoor: At least two locations
• Transformer test report indicating loss at 50%and 100% load

In addition to the above-mentioned responsibilities, the contractor is also


responsible for providing the ensuring the following input/data in close
coordination with PMC/Architect to fulfil GRIHA compliance
documentation.

5.2.1 Natural Ventilation


Natural ventilation shall comply with the design guidelines for natural ventilation
in NBC 2005 par t8 5.4.3&5.7.1.1
5.2.2 Minimum Equipment Efficiencies for HVAC
Minimum equipment efficiencies are required to be met for all HVAC equipment.
These include chillers, unitary air conditioner, split air conditioner, packaged air
conditioner, and boilers.
Cooling equipment shall meet or exceed the minimum efficiency requirements
presented in Table
5.2.Heating and cooling equipment not listed in the table shall comply with

6.2.3 Supplementary Water Heating System

7.2.1 Lighting Control

Interior lighting systems in buildings larger than 500m2 (5,000ft²) shall be


equipped with an automatic control device.
Within these buildings, all office areas less than 30m2(300ft2) enclosed by
walls or ceiling‐height partitions, all meeting and conference rooms, all
school classrooms, and all storage spaces shall be equipped with
occupancy sensors.
For other spaces, this automatic control device shall function on either a
scheduled basis at specific programmed times. An independent program
schedule shall be provided for areas of no more than 2,500 m2 (25,000 ft²) and
not more than one floor.
Occupancy sensors that shall turn the lighting off within 30 minutes of an
occupant leaving the space. Light fixtures controlled by occupancy sensors
shall have a wall mounted, manual switch capable of turning off lights when
the space is occupied.
Exception: Lighting systems designed for24‐hour use.
7.2.1.2 Space Control
Each space enclosed by ceiling‐height partitions shall have at least one
control device to independently control the general lighting within the space.
Each control device shall be activated either manually by an occupant or
automatically by sensing an occupant.
Each control device shall control a maximum of 250 m2 (2,500 ft2) for a
space less than or equal to 1,000 m2 (10,000ft2), and a maximum of
1,000m2 (10,000ft2) for a space greater than 1,000 m2 (10,000 ft2).
Each control device be capable of overriding the shutoff control required in
8.2.1.1for no more than 2hours
Each control device be readily accessible and located so the
occupant can see the control. Exception: The required control device
may be remotely installed if required for reasons of safety or security.
A remotely located device shall have a pilot light indicator as part of or next to the

7.2.1.3 Control in Day lit Areas

6.5 Building level GRIHA certification Requirements


The contractor shall ensure the execution and proper documentation of
each building for the following points for Griha certification compliance for
building related GRIHA criterions.
6.5.1 CO2, temperature and RH sensors to be installed in the buildings
as per GRIHA certification requirements. Narrative along with the
technical sheet, purchase order and BOQ to be maintained.
6.5.2 Peak heat gain through building envelope (for each AC building
individually) should meet the GRIHA Building Envelope Peak
Heat Gain Factor thresholds as mentioned below. Compliance

6.5.4 EPI to be considered for the admin, academic and other blocks
shall be no less than 54 and for staff housing and hostel shall be
no less than 42 to demonstrate a reduction of 40% from the base
case as defined in GRIHA v 2015. Compliance shall be shown
through energy simulation output results.
6.5.5 On-site/Off-site renewable energy system installation to offset
25% of the annual energy consumption of internal artificial
lighting and HVAC systems to achieve maximum GRIHA
requirement. Documentation shall be maintained in the form of
Narratives, calculation technical sheet, purchase order and
BOQ.
6.5.6 Analysis to be done to meet 75% daylight requirement in each
building by either achieving the space wise daylight factor defined
in SP-41 or by achieving a mean Daylight Autonomy requirements
(300 lux or more in other blocks and 100 lux in residential blocks)
over the total living area for at least 75% of total annual analysis
hours (8 am to 6 pm each day, 3650 hours in a year).
Documentation shall be maintained in the form of narratives,
calculations, analysis results, drawings and technical sheet

1. GENERAL REQUIREMENTS

Contract Requirements

1. The particular section of Specification shall be read in conjunction with the


Drawings and other sections of the Specification. Specification given in any
one section shall apply to other sections unless specifically stated otherwise.
2. Notwithstanding anything contained herein, the EPC Contractor shall be
responsible for complying in all respects with bylaws and regulations imposed
by authorities having jurisdiction, as may be in force at the time of execution
of the Works.
3. The EPC Contractor shall provide and do everything necessary for the proper
execution of the Works according to the intent and meaning of the Tender
Documents, whether the same may or may not be particularly shown on the
documentation comprising the Tender Documents, provided the same can be
reasonably inferable there from.
4. The Works shall be completed strictly in accordance with the Tender
Documents and drawings and specifications approved by the EIC, and
instructions issued by the EIC during the execution of the Works.
5. The work to be performed under this Contract includes, but is not necessarily
limited to, design development, procurement, and the furnishing of all
supervision, labour, materials, temporary works, temporary utilities, false-
work, plant, machinery, cranes, equipment, parts, tools, taxes, duties,
insurance, commissions, supplies, transportation, utilities, construction
facilities, scaffolding, incidentals and logistic support necessary for the
performance and maintenance of the Works, and accomplishing the same in a
workmanlike manner.
6. All work shall be executed by skilled tradesmen who shall be thoroughly
acquainted with all aspects of their trade including any special local customs
and modes of operation.
7. Engineer In charge or EIC, and any person authorized by them shall always
have access to the Works and to the Site and to all workshops and places
where work and/or material or equipment is being manufactured, obtained
and/or undertaken for the Works.
8. The Contract documents include Drawings, Design Basis and Specifications
etc., which indicate the scope of the Works in terms of general design intent.
The Drawings and Specification do not indicate or describe in detail,all of the
work required for the performance and completion of the Works. From the
Concept Designs, the EPC Contractor shall carry on design development and
produce construction documents, from which it shall execute all works. The
EPC Contractor shall provide all items required for the proper execution and
completion of the Works, in so far as such items are consistent with the intent,
quality and character indicated on the Contractor’s Design Development
Drawings and Specification, as approved by the EIC. The EPC Contractor
shall provide all supplementary parts necessary to complete the Works
whether or not each component or detail is specifically shown on the initial
Concept Drawings and Specification which were provided. Modifications

approved by the EIC that appear on the construction documents that do not
materially affect the design intent shall not be considered as a basis for
additional compensation. Such determinations shall be made by the EIC.
9. The scope of the Work includes, without limitation, all engineering, labour,
supervision, material, tools, equipment and other services necessary for the
installation, testing and commissioning of all Works , imparting training to
operating staff under the Contract.
10. All government fees, duties, visa charges, permits, deposits, etc., as
applicable (except for Statutory Approvals related to design and drawing) and
in compliance with the laws, regulations and codes applicable to Delhi State in
particular, and Indian/ Standards/ National Standards or Codes in general,
shall be paid by the Contractor.
11. The EPC Contractor shall include any and all sundry expenses such as
transportation, freight charges, taxes, interim storage, escalation, any special
permits required to carry out the work, related quality control, compliance to
safety requirements as called for in the Specification and in compliance with
applicable laws and regulations applicable to Delhi in particular, and Indian/
Standards/ National Standards or Codes in general.
12. The EPC Contractor is responsible for coordination with the other contractors,
not limited to those identified in these Sections, during all phases of
engineering, construction, testing, commissioning, completion and handover.
Design and Engineering Responsibility

13. The EPC Contractor shall be fully responsible for all design and engineering
for the project and submit to the EIC for review and approval, names and
credentials of their designers, including Professional Indemnity Insurance
coverage, who will perform design services on behalf of the EPC Contractor
and clearly identify the scope elements and areas covered therein. The EPC
contractor shall submit the structural design to NBCC for review & approval.
NBCC will in-turn get this structural design vetted from any IIT. Corresponding
structural design vetting charges shall be recovered from the bill/s of
contractor. The EPC Contractor shall include, as a minimum, the following
design and engineering responsibilities:
14. For all components and elements of the project for which design development
is carried out.
15. Work items and systems that are described in the specifications with
requirements to comply with certain performance parameters.
16. Secondary steel, embeds, concrete and/or rebar work necessitated to install
mechanical, electrical, curtain wall, cladding and conveying systems.
(Secondary work includes works that are not part of the structural system, but
are required for installation of other building systems).
17. Builder’s work associated with mechanical, electrical, curtain wall, cladding,
conveying systems, finishes and other building systems.
18. Any design and engineering of systems as indicated in Specification and as
noted in Drawings, to provide a complete installation.

Work Sequence

22. The overall phasing and sequence of construction shall be agreed between
the EPC Contractor and the EIC. The Works shall be performed in
accordance with the Milestone Dates, Sectional Completion Dates, NBCC
instructions, and the Time for Completion and Schedule requirements in the
Contract Documents. the EPC Contractor shall fully acquaint itself with the
contents of this schedule and ensure compliance therewith. The EPC
Contractor shall note that the Project is based on a fast track approach to
design and construction. Its schedule of works shall be flexible enough to
accommodate the special needs arising there from. The EPC Contractor shall
allow for certain “out of sequence” work and “come-back” work that will be
necessitated on the Project. The EPC Contractor shall allow for all costs
arising out of such phasing, sequencing, out-of-sequence and come-back
work.
23. The EPC Contractor shall refer to the requirements for schedule, phasing and
completion of the Works, as detailed within this document. Other contractors
may be present on the Site and the EPC Contractor shall allow for all costs
reasonably resulting from phasing the Works around these parties.
24. The phasing and the sequencing may be changed during the course of
construction. Any such change shall be considered as a shared tool for use by
The EPC Contractor and the EIC for the benefit of the Project, with priority
given to the requirements of the Employer.
Inspection and Testing

25. The EPC Contractor shall include in its Contract Sum for all costs and time for
carrying out all tests on the Works as required by the EIC, design
development documents to be prepared by the Contractor, as approved by
the EIC.
Licenses, Permits and Approvals

26. The EPC Contractor shall obtain and renew all NOC’s (No Objection
Certificates) and all applicable approvals, permits required for construction
from various government agencies. The EPC Contractor shall coordinate with
the EIC for this requirement.
27. The EPC Contractor shall include for all governmental inspections as required
and applicable fees during the various phases of work, as per the rules,
regulations of various authorities concerned. Include for all necessary
inspections required for the operation prior to final acceptance / hand over.

28. During the construction period, the EPC Contractor shall submit to the EIC
copies of all Certificates of Approval, Permits, or Licenses obtained from
Municipality Departments and other Authorities having Jurisdiction, which are
required for the performance of the work.
29. Prior to the issuance of the Taking-Over Certificate, The EPC Contractor shall
furnish the EIC with a complete set of originals with five (5) copies of all the
above-mentioned Certificates, Licenses and Permits.
30. The requirements under this Clause include also for the provision of all
temporary facilities, utilities and the like, as appropriate; and all costs resulting
thereof shall be borne by the Contractor.

2. REGULATORY REQUIREMENTS
Building Codes
1. All references to codes, specification and standards referred to in the Concept
Design Drawings and Specification shall mean, and are intended to be, the
latest edition, amendment or revision of such reference standard in effect as
of the date of the Drawings and Specification. The EPC Contractor shall
provide a copy, on the request of the EIC, of the latest edition of all codes and
standards.
2. The Contractor’s design development documents shall be prepared in
accordance with the National Building Code of India, 2016 Edition, as
published by the Bureau of Indian Standards. Other codes, regulations and
standards may be deemed applicable to the Works by the authorities having
jurisdiction.
3. In the specifications to be prepared by The EPC Contractor during the design
development, other Codes and Standards should be prescribed, as applicable
and pertinent, for the fabrication, testing, safety, etc., for items, materials and
components in technical specifications.
4. The standards and codes, in their latest edition shall be applied to the works
covered by the Contractor’s Specification being prepared as part of the design
development. Where no such standard exists, as for example in the case of
patents or special materials, all such materials and workmanship shall be of
the best quality, and full details of the materials and any tests to which they
are subjected shall be submitted to the EIC for review.
Labour Requirements
5. The EPC Contractor shall make its own arrangements for the engagement of
all labour, local or otherwise, and, save insofar as the Contract otherwise
provides, shall be solely liable and responsible for the transport, housing,
feeding and payment thereof. Any idling of labour at the Site shall be within
the Contractor’s scope and included in the Contract Price.
6. The EPC Contractor shall, having regard to local conditions, provide on the
Site, to the satisfaction of the EIC, an adequate supply of drinking and other
water for the use of the Contractor's staff and workforce. Further, The EPC
Contractor shall comply with model rules framed by the Government or any
authority for labour welfare, protection of health, and sanitation, failing which
the Employer reserves the right to effect such arrangements at the

Contractors' risk and cost. The NBCC and the Owner shall not at any time be
liable for any such provisions and The EPC Contractor shall indemnify the
Contractor’s Personnel in this regard.
7. The EPC Contractor shall not import, sell, give, barter or otherwise dispose off
any alcoholic drinks or drugs or permit or suffer any such importation,
consumption, sale, gift, barter or disposal by the Contactor’s Personnel. The
EPC Contractor shall not give, use, barter or otherwise dispose off to any
person or persons, any arms or ammunition of any kind or permit or suffer the
same as aforesaid.
8. The EPC Contractor shall in all dealings with its labour in its employment in
connection with the Works have due regard to all recognized festivals, days of
rest and religious or other customs.
9. In the event of any outbreak of illness of an epidemic nature, The EPC
Contractor shall comply with and carry out such regulations, orders and
requirements as may be made by any local medical, sanitary and other
Government or authorities for the purpose of dealing with and overcoming the
same.
10. The EPC Contractor shall at all times take all reasonable precautions to
prevent any unlawful, riotous or disorderly conduct by or amongst the
Contractor’s Personnel and for the preservation of peace and protection of
persons and property in the neighborhood of the Works against the same.
The EPC Contractor shall maintain harmony and good industrial relations and
solve problems among the personnel employed in connection with the
performance of its obligations under the Contract and persons located on or
near the Site and with law enforcement agencies.
11. The EPC Contractor shall, at its cost, provide, equip and maintain throughout
the construction period and so far as may be necessary during the Defects
Notification Period, in a position on or near the Site approved by the
Employer, suitable and sufficient first aid facilities for the general use of the
Contractor’s Personnel.
12. The EPC Contractor shall be responsible for observance by its Personnel of
the foregoing provisions. The EPC Contractor shall ensure that its
Subcontractors also adhere to the obligations of The EPC Contractor under
the Contract and assume its liabilities under the Contract, to the extent any
portion of the Works sub contracted to them.
13. The EPC Contractor shall, in respect of labour employed by him, comply and
shall ensure compliance by its Subcontractors without limitation with the
requirements of Laws, and specifically all labour legislations in relation to the
performance of Works, such as the Apprentices Act, 1961; the Building and
other Construction Workers Welfare Cess Act, 1996; the Child Labour
Prohibition and Regulation Act, 1951; the Children (Pledging of Labour) Act,
1933; the Contract Labour (Regulation and Abolition) Act, 1970; the
Employees Provident Funds and Miscellaneous Provisions Act, 1952; the
Employees Provident Funds Scheme, 1952; the Employees State Insurance
Act, 1948; the Works Liability Act, 1938; the Equal Remuneration Act, 1976;
the Industrial disputes Act, 1947; the Industrial Employment (Standing Orders)
Act, 1946; the Inter-State Migrant Workmen (Regulation of Employment and
Conditions of Service) Act, 1979; the Labour Laws (Exemption from
Furnishing Returns and Maintaining Registers by Certain Establishments) Act,

1988; the Maternity Benefit Act, 1961; the Mines Act, 1952; the Minimum
Wages Act, 1948; the Payment of Wages Act, 1936; the Personal Injuries
(Compensation Insurance) Act, 1963 the Weekly Holidays Act, 1942; the
Workmen’s Compensation Act, 1923; The Employees State Insurance Act,
1948; The Building and Other Construction Workers (RECS) Act 1996
(BOCW ACT) and modifications thereof in force or amended from time to time
and any other labour legislations, which may be applicable to The EPC
Contractor from time to time.
14. The EPC Contractor shall provide the quantum of labour it deems necessary,
or required by the EIC, for the performance of the Works. The EPC Contractor
shall employ local labour, as far as possible. Arrangements which affect the
engagement, transport, paying, feeding and housing of labour and all other
matters in connection therewith shall be subject to the regulations and orders
of the Government or authorities now in force or which may be made from
time to time during the continuance of the Contract.
15. The EPC Contractor shall, in respect of all Contractors’s Personnel ensure or
procure the payment of rates of wages, emoluments and expenses and
observe hours and conditions of labour according to the conditions
established for the trade or industry or prescribed by Law in force in the place
where the Work is carried out.
16. The Employer shall, on report having been made by an inspecting officer as
defined in the Contract Labour (Regulation and Abolition) Act, 1970 and rules
made there under, have the power to deduct from the moneys due to The
EPC Contractor any sum required or estimated for making good the loss
suffered by a worker or workers by reason of non-fulfilment of the provisions
of the relevant Laws for the benefit of workers, non-payment of wages or of
deductions made from his or their wages which are not justified by the
provisions of the relevant Laws or non-observance of the Contract Labour
(Regulation and Abolition) Act, 1970 and rules made there under.
17. The EPC Contractor shall maintain all prescribed registers, records and other
documents in compliance with applicable labour laws and allow The EPC
Contractor to have access to these documents for inspection. However these
inspections shall not absolve The EPC Contractor of its responsibility for any
breach or violation of rules and regulations under Laws. The EPC Contractor
shall deposit all necessary contributions in this regard regularly with the
prescribed authority and in token of which shall submit, every month,
necessary documentary evidence as may be required by the Employer.
18. The EPC Contractor shall obtain prescribed recommendations from the
Regional Provident Fund Commissioner under the Employees' Provident
Fund and Miscellaneous Provisions Act, 1952 and shall cause provident fund
contributions from all eligible employees to be deposited regularly with the
prescribed authority and in token of which shall submit, every month,
necessary documentary evidence as may be required by the Employer.
19. The EPC Contractor shall indemnify and hold harmless the Works Personnel
against any payments, suits, lien or default charges to be made under and for
observance of the aforesaid provisions.
20. The EPC Contractor must fully satisfy itself as to the requirements of labour
legislations and other Laws and The EPC Contractor represents and warrants
that the cost, risk and expense of the same, has considered the same and

accordingly agreed to the Contract Price. There will be no increase in the


Contract Price on the grounds of complying with any labour legislation or the
provisions of any other Laws.
21. The EPC Contractor shall, if required by the Employer deliver a return in
detail, in such form and at such intervals as the Employer may prescribe
showing the supervisory staff and the numbers of the several classes of
labour from time to time employed by The EPC Contractor on the Site and
such information regarding the constructional plants and equipment as
deployed.
22. A breach of any of the provisions of this Schedule shall be treated as a
material breach of the Contract.
Technical Literature

1. The EPC Contractor shall have a hard & soft copy of the latest technical
literature, NBC 2016, CPWD Specifications & IS codal provisions referred in
DBR / in its Design Development Drawings and Specifications. This literature
shall be kept at Project Site and maintained in good order and make it
available to the EIC at all times.
Contractor Use of Site

23. The EPC Contractor shall not use the Site for any purpose other than carrying
out the Works.
24. Access to the Site shall be agreed with the EIC prior to commencement. The
EPC Contractor shall take all necessary steps to ensure the safety of all
authorized persons. In addition, The EPC Contractor shall be responsible for
all damage resulting from the use of the agreed access.
25. The EPC Contractor shall have possession of the Site at the location of the
Works only and be subject to the rights and obligations of other contractors
and be responsible for arranging its own working space, labour camps, the
storage of materials, locating all temporary accommodations, utilities and
other logistical issues at locations to be agreed with the EIC. No claim
whatsoever will be entertained for any reason regarding the location,
allocation or relocation of any working space regardless of the distance.
26. The EPC Contractor shall be responsible for consulting regularly with the
relevant authorities to confirm that its method of working is not such as to
impede in any way vehicular road traffic and for modifying its method of
working if any operations or activities are adversely affected by its activities.
On the instruction of the EIC, The EPC Contractor shall promptly remove any
vehicle or equipment and plant within its control that may be causing
obstruction to the use of the existing facilities by others.
27. Additional Precision Air Conditioning system should be provided in Fire
command center, IT Hub rooms, NOC rooms, IPABX room or any other
locations where 24 hours air- conditioning system is required.
28. The EPC Contractor shall be provide and install the Lighting control through
Daylight and motion sensors to use presence/Occupancy sensors in offices,
common areas like corridor, offices, lift lobbies, toilet etc. in MEA Complex
,which will result in considerable saving in energy.

Two way programmable High performance, compact presence detectors


/occupancy sensors will be used which provide automatic control for lighting
loads. It detects human presence and automatically turns the lights ‘ON’.
When the area is vacated, the lights turn ‘OFF’ after a preset time period. The
sensor has advanced presence detection by passive infrared (PIR)
technology along with Sensitivity level adjustments. The sensor has
Adjustable off delay timing 10 sec – 99 min which can be programmed &
changed using a remote control. The sensor has a Passive photocell that
holds lights OFF in extremely bright ambient conditions. The occupancy cum
day light sensors will be used which are used for switching off the luminaries
when the areas are unoccupied & also used for dimming the luminaries when
there is day light coming inside the building & thus help to reduce the power
consumption. This sensor is basically used in the areas along the building
façade where the day light contribution is high. Along with presence detection,
this sensor has built-in adjustable photocell which regulates the lighting level
as per availability of natural daylight in an area, thus maintaining uniform
illumination.
29. 1% of the total project cost will be dedicated towards artwork as per the
guidelines of Delhi Urban Art Commission. Artwork may include Stone
sculpture/murals/artifacts, paintings & wall arts.
30. During the Construction Period , The EPC Contractor shall be provide a
model of the project and a walk through Video to the Employer for every
calendar quarter , which will be minimum 3-4 minutes in compact disc or
digital video disc, or pen drive as the case may be, covering the status and
progress of Works in that quarter. The walk through Video shall be provided to
the Employer no later than 14 (fourteen) days after the close of each quarter
after the Key Date.
31. In addition to Main Consultant, The EPC contractor appoint a acoustic
consultant which will provide the certificate that the Multi-Purpose Halls or any
other location in MEA Complex is acoustically feasible.
32. TV outlet points are provided in rooms and offices or any other location as per
requirement.
33. Penta scanning of cables is in the scope of EPC contractor.
34. The EPC Contractor shall be provide and install the Suitable size (As per
Design) of OWC (Organic Waste Converter) to use decentralized Waste
Management system to large amount of organic waste such as kitchen waste,
garden waste, food processing waste etc. into compost. The system is
designed such a way , system eliminate odour and also remove the problem
of irritants as files and rates
35. The cost including travelling, boarding, lodging, DA etc. for the inspections of
materials, equipment before dispatch anywhere in India or abroad made by

the consultant or NBCC officials or MEA officials or by all shall be borne by


the contractor, as per the admissibility of an officer as per NBCC/MEA/GOI
rules. The final decision in this regard remains with the NBCC and it shall be
binding on the contractor. The rates quoted by the contractor shall be deemed
to be inclusive of the expenditure to be incurred on this account(s). No extra
payment or claim will be entertained/ payable on this account to the contractor
by NBCC / MEA.
36. The installation of the Sewage Treatment Plant (STP) should be certified by
an independent expert and a report in this regard should be submitted to MEA
before the project is commissioned for operation. Treated affluent emanating
from STP shall be recycled/ reused to the maximum extent possible.
Treatment of 100% grey water by decentralized treatment should be done.
Discharge of unused treated affluent conforms to the norm and standards of
the Delhi Pollution Control Committee. Necessary measures should be made
to mitigate the odor problem from STP.

SCOPE OF WORK FOR ARCHITECTURAL PLANING & ENGINEERING


CONSULTANCY AND WORKS

1. The EPC Contractor is required to complete the project on Design& Build


basis as specified in the Scope of Work, Technical Specification & Drawings,
tender documents etc. covering the entire site area up to & including the
boundary wall. Site everything complete in all respect i.e. including all internal
services so as to make the complex fit for purpose i.e. handing over to
prospective buyers and the contractor’s quoted rates are deemed to include
everything from the award of work up to & including handing over of
completed project, defect liability period and Operation and Maintenance
period. However, The EPC Contractor is required to connect all the external
services like Water Supply, Sewerage, Drainage, Electric Supply, LAN/WAN,
Telephone Lines etc. to the main lines of the authorities/service providers
which shall be integral part of his Scope of work and deemed to be included in
his quoted price. All municipal & mandatory approvals required for occupation
and completion of the project shall be obtained by the Contractor. However,
all statutory fees will be paid by NBCC/Client.
2. The detailed Design Basis Report (DBR), Technical Specifications and
Drawings for each function like Civil, Electrical, HVAC, Plumbing, Fire,
STP/WTP, External Development, Lifts are attached as various Sections to
the tender documents. The same also includes specific scope of each work &
conditions particular to the work.
3. Indicative Items of Civil, Electrical, HVAC, Plumbing, Fire, STP/WTP, External
Development, Lift works etc. is given in Technical Specification for reference
purpose only. The bidders, before quoting the tender are deemed to have
ascertained/verified/worked out all the items & quantities etc. from the Design
Basis Report, drawings, technical specifications for complete scope of work to
make the buildings & complex fit for its intended purpose i.e. handing over for
use to the end user. The EPC Contractor shall submit their detailed Items and
quantities of each item within 30 days to NBCC from the date of award of

work for NBCC’s reference & records. No claim on account of any


discrepancies, left over items etc. in Indicative Items given in the tender, and
submitted by the contractor, and as actually executed at site, shall be
admissible. Thus The EPC Contractor is required to execute all the
works/items and quantities as per Scope of work, Design basis reports
(DBR)/specifications, Technical Specifications, Drawings etc. and to quote
their amount/financial bid accordingly. In case of contravention of stipulation
of this clause from any other clause/provision elsewhere in the tender
document, then this clause shall have superseding effect to the extent of
contravention and decision of Engineer-in-charge shall be final & binding on
the contractor.
4. The ‘Design Basis/Brief Report’ is also enclosed for reference of the bidders
in their Design purpose. The Design Basis/Brief Reports are the minimum
standards that the construction agency has to fully comply with operational
and functional part of the project.

5. NBCC will bear no responsibility for the lack of such knowledge and also the
consequences thereof to the contractor. The information and site data shown
in the drawings and mentioned in the tender documents are furnished for
general information and guidance only. The Engineer-in-Charge in no case
shall be held responsible for the accuracy thereof or/and deductions,
interpretations or conclusions drawn there from by The EPC Contractor and
no claim shall be entertained whatsoever on this account, if the site
conditions/information is different or otherwise incorrect. It will be presumed
that The EPC Contractor has satisfied himself for all possible contingencies,
situations, bottlenecks and acts of coordination which may be required
between the different agencies.
6. The EPC Contractor is required to submit all its submittals like Drawings,
Documents, Reports, Schedules, invoice copies, etc. (whether original or
revised) in 6 (Six) Coloured Hard & 6 (six) soft (Pen Drive) copies. This clause
applies to every submittal of contractor under this contract.

7. Integration of Internal Services & Facades etcIntegration of drawing of internal


services given by NBCC into his Civil/structural Design & Drawings and
execution of the same i.e. Plumbing & Sanitary HVAC & Electrical Works etc.
complete for the building including all pipes, conduits, fittings, fixtures, testing,
commissioning etc. complete as approved by NBCC. Similarly, The integration
of designs for façade, glasswork, stone work, landscaping, site development
etc shall be integrated into the structure & integrated BIM design by The EPC
Contractor so as to retain the spirit & detail of designs given to the contractor.

8. GRIHAAs the entire MEA COMPLEX is to be constructed as per GRIHA


norms and intended for minimum 4 Star rating, The EPC Contractor has to
comply all the specific requirement at their own cost such as Barricading the
site at required height, covering the construction material, sedimentation tank,
conserve the top soil, arrangement of wheel wash for all inward and outward
vehicle, segregation of all scrap material, disposal of hazardous extract
generated during construction at appropriate place etc as per GRIHA norms.
The EPC Contractor should extend their all-out support to GRIHA Team as

and where required for achieving the desired GRIHA rating and assist them
with complete documentation, conveyance, boarding & lodging etc.,
Successful bidder shall apply and obtain minimum 4 Star GRIHA rating for
complete MEA COMPLEX.

9. Statutory Requirements

The EPC Contractor along with others shall carry out all statutory tests and
trials, under the supervision of the Engineer, necessary for obtaining sanction
of the competent authority.

SITE INVESTIGATION

1. Brief tasks to be carried out:

a) Collect sub-soil data, undertake detailed survey, wind data, earthquake


data, & sub soil investigations including water table depth.
b) Prepare key map (with scales 1:100) showing the location of the buildings
investigated and the important structures, in the vicinity. The reference to
the position of the benchmark, location of the trial pits or bore holes giving
identification number for each bore connected to the datum and location of
all nallahs, buildings etc.
c) Prepare detailed designs and drawings.
d) Whenever required or necessitated by the site conditions, modify designs as
well as suggest solutions to the problems come across during actual
execution.
e) Obtain approval of design of each component of buildings (or) System (or)
Sub-System from the EIC/NBCC before execution / procurement.
f) Preparation of any such report / document which is necessary for smooth
execution of work and as instructed by the EIC.

2. Tenderer may satisfy himself/themselves by conducting pre-soil tests if


he/they so requires. However, an indicative soil investigation report is
uploaded for general guidelines of the Bidders, although this will not have any
bearing on the quoted rates by the Bidders. Tenderer will be required to
conduct detailed soil investigation including detection of harmful chemicals for
the buildings separately at their own cost for carrying out structural design of
buildings, through soil consultants and also for advising the type of cement to
be used in foundation to take care from the harmful effect of the chemicals
encountered in the soil in contact with foundation.

The contractor will be required to carry out Geotechnical investigations and sub
soil Exploration at each proposed building location and conduct all relevant
laboratory and field tests on soil and rock samples. Soil bore particulars duly
indicating the classification of soils within a bore log chart and soil test report

conducted in NBCC approved soil testing laboratory on undisturbed and


disturbed samples for all the geo-technical parameters like C, ᵠ, Atterberg limits,
DFS, SPT and silt factor etc., worked out from the mean diameter of the particle
size to the maximum scour level, safe bearing capacity of soils or rocks, core
recovery (RQD) for rock, erodibility test for rocks, consolidation settlement
parameters etc.

The contractor will get the detailed soil investigation done as per relevant IS
code, NBC 2016 etc. As applicable through the soil consultant having
professional experience of 15 years & one set of test report (both soft & hard
copy) shall be deposited with NBCC.

After award of work, the contractor shall carryout detail survey and soil
investigation for preparation of detailed designs as per the scope of work, DBR
and technical specifications. The contractor (Bidder) shall be deemed to have
inspected and examined the site, its surroundings, collected the data and all
other information, and to have been satisfied before submitting the Tender as to
all relevant matters, including (without limitation):

a. The form and nature of the site, including sub surface conditions.

b. The climatic conditions.

c. The extent and nature of the work and Goods necessary for the
execution and completion of the works and the remedying of any defects.

d. The contractor’s requirements for access, accommodation, facilities,


personnel, power, transport, water, and other services.

e. Availability of required materials.

The topographical survey conducted of site is attached in the tender documents


for reference purpose. The contractor shall, however, ascertain the contour
levels, location of proposed boundaries, any other site feature present at site for
which he shall get conducted fresh topographical survey done at his own cost.
The contractor shall be held fully accountable for accuracy of levels/design,
position of buildings/facilities etc. on account of details obtained from
Topographical survey.

3. Insurance:
The construction work shall be carried out in the proposed MEA plot at KG Marg,
New Delhi, wherein, local public with their families are already residing in the
adjacent areas /buildings. Therefore, it shall remain in the responsibilities of
the contractor to ensure the safety, security of these persons WRT proposed
construction work as well as the safety of the adjacent structures, if any. The
contractor is required to take insurance of works etc., as per the General
Conditions of Contract / its sub clauses / amendments.

4. COMPLIANCE WITH STATUTES, REGULATIONS AND LAWS

The Contractor shall familiarize themselves and conform in all aspects with:

1. the provisions, their legal interpretation in respect of any enactment and


relevant judicial/administrative/quasi-judicial orders in India, as is and/or
may become, applicable from time to time, related to or having impact on
any aspect affecting the works.

(b) The regulations or byelaws of any local body and utilities.

(c) The Contractor shall be bound to give all notices required by statute,
regulations or by- laws, as aforesaid and to pay all fees and bills payable
in respect thereof. The Contractor will arrange necessary clearances and
approvals before the work is taken up.

(d) Ignorance of Rules, Regulations and Bylaws shall not constitute a basis
for any claim at any stage of work.

(e) The Contractor shall indemnify the Employer against all penalties and
liabilities of every kind of breach of any such enactment, laws, regulations,
byelaws, or rules.

5. As-Built Drawings and Documents:

Prior to issue of any taking over certificate, the Contractor shall furnish to the
EIC a complete set of as-built Drawings, Operation & Maintenance Manuals,
Guarantee / Warrantee Certificates along with contact details of respective
OEM in 6 (six) hard copies and in pen drive or in such other medium as may
be acceptable to the EIC, reflecting the Project as actually designed,
engineered and constructed, including an as-built survey illustrating the layout
of the Project and setback lines, if any, of the buildings and structures forming
part of Project Facilities. The work shall not be completed for the purpose of
taking over until such documents have been submitted to the EIC to his / her
satisfaction.

1 Change In Design If any modification in Civil/ Structural design/ drawing is


needed as per site conditions and /or change in Architectural Design and/or
change in client’s requirement, the agency shall do/ redo the design without
any extra cost. The decision of the Engineer-in-charge shall be final and
binding in this regard.

The Contractor/its Consultants shall adhere to disaster-resistant design &


construction and shall refer to Vulnerability Atlas of India. The Vulnerability
Atlas of India(VAI) is a comprehensive document which provides existing
hazard scenario for the entire country and presents the digitized state/union
territory-wise hazard maps with respect to earthquakes, winds and floods for

district-wise identification of vulnerable areas. It also includes additional


digitized maps for thunderstorms, cyclones and landslides. The main purpose
of this Atlas is its use for disaster preparedness and mitigation at policy
planning and project formulation stage. This Atlas is a single point source to
ascertain proneness of any city/location/site to multi-hazard which includes
earthquake, winds, floods thunderstorms, cyclones and landslides. While
project formulation, approvals and implementation of various urban housing,
buildings and infrastructure schemes, this Atlas provides necessary
information for risk analysis and hazard assessment.

This Atlas has been prepared by Building Materials and Technology


Promotion Council under the Ministry of Housing and Urban Affairs,
Government of India and available at their website www.bmtpc.org.

It is mandatory for the bidders to refer to Vulnerability Atlas of India for multi-
hazard risk assessment and includes the relevant hazard proneness specific to
project location while planning and designing the project in terms of:

i) Seismic zone(II to V for earthquakes);


ii) Wind velocity(Basic Wind Velocity:55,50,47,44,39&33m/s);
iii) Area liable to flood sand probable maximum surge height;
iv) Thunderstorms history;
v) Number of cyclonicstorms / severe cyclonic storms and
maximum sustained wind specific to coastal region;
vi) Landslides incidences with annual normal rainfall; and
vii) district-wise probable maximum precipitation.

2 Tests after Completion

a) Contractor’s Obligations

The Contractor shall carry out the Tests on Completion at his own cost in
accordance with the contract after providing the documents in accordance
with provisions of the agreement. The Contractor shall give, to the Engineer,
14 (fourteen) days' notice of the date after which the Contractor will be ready
to carry out the Tests on Completion. Unless otherwise agreed, such tests
shall be carried out within 28 (twenty eight) days after this date, on such day
or days as the Engineer shall instruct. If it is not possible to carry out all tests
within 28 (twenty eight) days, then Engineer shall draw a programme in
consultation with contractor.

Unless otherwise stated in Special Conditions of Contract, the Tests on


Completion shall be carried out in the following sequence.

1. pre-commissioning test, which shall include appropriate instructions and


(“dry” or “cold”) functional tests to demonstrate that each item of the Plant,
goods and Work can safely undertake the next stage;

2. Commissioning Test shall include the specified operational tests to


demonstrate that Works or Sections can be operated safely and as
specified under all available operating condition;

3. Trial operation which shall demonstrate that the Works or Section perform
reliably and in accordance with the Contract

The Contractor at his cost shall arrange all tools, equipments, gadgets,
facilities or as deemed necessary by the Engineer for such tests, In
considering the results of the tests on completion, the Engineer shall make
allowances for the effect of any use of the Works by the Employer on the
performance or other characteristics of the Works. As soon as the Works, or a
Section, have passed the tests on completion described in subparagraphs (a),
(b) or (c), the Contractor shall provide the Engineer with a certified report of
the results of all such Tests.

3. Mock/Model Flat,

The contractor shall construct Mockup / Model Flat, i.e. one number of sample unit of
each category (Type 6, Type 4 and Transit), lift lobbies at his own cost as per the
drawings and specifications mentioned in the tender document and as per the
directions of Engineer-in-charge, NBCC. He shall complete the same within twelve
(12) months with all fittings, fixtures, furniture etc., and do modifications, re-
modifications, in all respects as per the directions of Engineer-in-charge, NBCC till its
approval. The cost of which is deemed to be included in the rate quoted by the
contractor and nothing extra will be paid to the contractor in this regard. The entire
above mock (or) sample Flat shall be made in any area of their respective building /
tower, as directed by EIC.

4. The Contractor shall carry out rework / rectifications works on basis of


observations /comments /orders of TPQMA to the satisfaction of TPQMA /NBCC
/Client. The Contractor shall submit the timely reports after compliances in
respect of observations /comments/orders of Third Party Quality Monitoring
Agency (TPQMA) with in suitable time period on priority. Approval of
methodology for such rectification work to be obtained from NBCC in writing prior
to taking up the rectification works. Contractor shall not become eligible for any
extra payment on account of rework/rectification works arising out of
observations /comments /orders of Third Party Quality Monitoring Agency
(TPQMA).

5.Durability aspects of Reinforced Cement Concrete (RCC) structures:

durability and perform well over their service life. However, deterioration of
concrete may occur due to a number of mechanisms. Corrosion of
reinforcement steel is the most common form of damage affecting durability
and strength of concrete structures.

Limit of Chloride content


Knowing the chloride content of concrete is critical in determining the
potential for reinforcing steel to corrode within the concrete. Chloride is a
negatively charged ion that causes reinforcing steel to corrode. Chlorides
can be introduced to the concrete from a number of sources. The most
common source of chloride ions is from water (unfit for construction) but
they can also come from aggregates, cement, admixtures, and even from
adjacent soils. The total soluble (acid soluble and water soluble)
chlorideneed to be determined as per the Indian Standards (IS 14959).
Limit of chloride content atthe time of placing is given in para 8.2.5.2 and
Table 7 of Section 2 of IS 456: 2000,summaryofwhichis given below:

Limit of Sulphate content - Sulphates are present in most cements, some


aggregate sand other mix constituents of concrete. Excessive amounts of
water-soluble sulphate in the concrete can cause expansion and disruption
of the concrete itself. The total sulphate content should be calculated from
various constituents of the mix and to have durable concrete, total Water-
soluble sulphate content of the concrete mix, expressed as 503,should not
exceed 4%(in compliance ofIS456) by mass of cement in the mix.

c) Intermittently during execution at interval of 3months or change of
any source of concrete whichever is earlier.

Cost of testing Concrete for Chloride and Sulphate Content. Contractor


shall not be come eligible for any extra payment on account of the testing
conducted on concrete for as certaining chloride and sulphate content.

Prohibition of use of Crystalline Admixtures: Contractor shall ensure that


integral crystalline admixtures are shall not be used in concrete as a part of
water proofing treatment.

Note:-3rd party testing shall be done as per said frequency is in scope of contractor.

6.Permeability test of concrete-reg.

Permeability of concrete has particular significance in structures. Besides functional


considerations, permeability is also intimately related to the durability of concrete,
especially its resistance, against progressive deterioration under exposure to severe
climate and leaching due to prolonged seepage of water, particularly when it
contains aggressive gases or minerals in solution. The determination of the
permeability characteristics of concrete, therefore, assumes considerable
importance.

So, in cases where concrete is permeable, deleterious materials like water, CO2,
SO2 & CI etc. permeates through the pores of the concrete and reacts with the
reinforcement; forms corrosion which decreases the strength of the reinforcement
and thereby damages the structure. Therefore, Permeability tests become very
important especially for Reinforced Cement Concrete (RCC).
There are various methods to check the permeability of concrete, out of them the
most commonly used methods are:

1. Water permeability test/Determination of depth of penetration of water under


pressure; Testing and specification shall be complying with IS 516 (P-2/Sec-
1):2018Cl. 5, DIN-1048 (P-5) & MORTH Sec. 1700, Cl. 1717/7.5.
2. Rapid Chloride Permeability Test (RCPT Test): Testing and specification shall
be complying with ASTM C-1202.

8 Avoidance of Interference

8.2 The access to and use and occupation of all roads and footpaths, irrespective
or whether they are public or in the possession of NBCC or of others. The
Contractor shall indemnify and hold NBCC harmless against and from all
damages, losses and expenses (including legal fees and expenses) resulting
from any such unnecessary or improper interference.
8.3 During construction, free flow of traffic movement shall be maintained for the
residents living in the MEA Plot Vicinities, New Delhi. Contractor, if
necessary, shall build motorable temporary access roads for the smooth flow
of the traffic for the persons already residing in the site vicinities at his own
cost. Contractor, if necessary, shall also make separate entry and exit gates
for the safety of the persons already residing in the site vicinities at his own
cost. The contractor shall maintain the same in motorable condition at all the
times as directed by Engineer-in-charge at his own cost. The decision of
Engineer-in-charge, NBCC in this regard shall be final and binding on the
contractor. The rate quoted by the bidder is deemed to be inclusive of all the
expenditures to be incurred in making free and smooth flow of traffic including
providing, erecting gates etc. No extra payment, whatsoever, on this account
shall be payable to contractor.
8.4 The construction of the project shall be executed by Contractor without
causing disturbance of any nature to the public residing in the site vicinities
and any other agencies working nearby.
8.5 The contractor shall abide by security regulations of NBCC & MEA.
8.6 It shall be deemed that all the expenditures to be incurred in the activities as
mentioned in sub-clauses 3.6.1 to 3.6.5 and all other related activities are
inclusive in the rates quoted by the contractor. No extra payment whatsoever
on this account will be payable to contractor.
9 Contractor shall use the land for the purpose for which it has been handed
over and not for any other purpose.
10 The trees, if any, situated on the plot will be government property and shall
not be removed without prior approval of the concerned statutory authority.
11 Contractor shall get the works executed and hand over to NBCC in phased
manner, if required, in mutually agreed schedule.

12 Escalation :

12.1 Escalation shall be payable as per prevailing CPWD Norms.(Details are


provided in SCC)

13 Sanction/Approval from Local Statutory Authorities or any other

construction around historical monuments from National Monument Authority
(NMA), NOC from Central Ground Water Authority (CGWA), NOC from Delhi
Metro Rail Corporation Ltd. (DMRC), NOC from Mahanagar Telephone Nigam
Limited (MTNL/ BSNL), NOC from Delhi Jal Board (DJB), Traffic clearance
from Delhi Development Authority (DDA)/UTTIPEC, Central Electricity
Authority and all other authorities, as per requirement.
13.2 Approvals during construction from Local bodies:

13.2.1 During the construction of work, the contractor shall be responsible for
bringing in approvals such as Plinth Completion Certificate, etc as required.

13.3 Post Construction Approvals from the Local bodies:

13.3.1 It shall remain in the responsibility of contractor to obtain completion


certificate, occupancy certificate, fire safety certificate, License/s for lifts for
operation,CTO, CEA clearance for electrical panels / DG / Transformers
energization, Solar Power Plant grid connection, Water & Electricity
Connections, Telephone & Broadband Connections and various all other
clearances required to use the accommodations/structures / buildings
constructed by the Contractor from all the local authorities, at his own cost.

13.4Consultant will provide him the drawings and assistance as and when required.
13.5 The fees/charges payable to local statutory authority(ies) shall be payable
/reimbursable by NBCC/ MEA.
13.6 The letters / authorizations, if any, required shall also be provided by
NBCC/MEA to contractor.
13.7The sanctions and clearances from local authorities shall be obtained by
contractor in expedited manner, on priority basis as directed by EIC.
13.8 The rates quoted by the contractor shall be deemed to be inclusive of all the
expenditures to be incurred in the activities stated under this clause 3.13. No
other payment as otherwise specified under this condition shall be payable to
contractor.

14 Operation and Maintenance Manual :


14.1 The contractor shall submit the operation and maintenance manual along with
preventive maintenance procedure / manual regarding operation and
maintenance of equipments, fixtures& fittings etc. provided and installed by
him at project along with drawings, Guarantee / Warranty Certificates,
Company’s contact details etc both in hard copies and soft copy.
14.2 The operation and maintenance manual shall be submitted, as per the
format decided by Engineer-in-charge, NBCC.

14.3 The contractor shall also arrange / impart the trainings to the skilled workforce
/ O&M Team engaged by NBCC/ MEA for operation and maintenance of
major equipment by the OEM’s engineer, as directed by Engineer-in-charge,
NBCC.

14.4 The rates quoted by the contractor shall be deemed to be inclusive of all the
expenditures to be incurred in the activities stated under this clause 14. No
extra payment on this account shall be payable to contractor.
14.5 The operation and maintenance of all the equipments till the handing over of
the projects to NBCC/MEA whichever is later is in the scope of Contractor

15 Integration with other Phase / Block / Tower:


Construction of various blocks, external development works and other allied
works shall be done under this contract. While finalizing the structural design,
RCC design and MEP design, the contractor to take all the care, so as to
integrate all the structures, buildings, services, roads, drains etc. to be
constructed under this contract with the adjacent structures, buildings,
services, roads, local drains, external service connections etc. if any, as per
the site layout plan attached in the tender document.No extra payment,
whatsoever, shall be payable to the contractor on this account.
16 Reinforcement Steel
As far as possible, the contractor shall bring, reinforcement steel cut to size as
per the bar bending schedule, to the project site.

17 Protection of Environment:

The Contractor shall take all reasonable steps to protect the wildlife
&environment on and off the site and to avoid damage or nuisance to persons
or to property of the public or other resulting from pollution, noise or other
causes arising as a consequence of his methods of operation. The contractor

shall be required to follow all the rules/norms of Forest Dept. / National Green
Tribunal applicable to this work.

The contractor shall indemnify NBCC/its officials against any claims or


obligations arising out of any damage to adjacent property, structure or to
building work done by him.

During continuance of the contract, the Contractor and his sub-contractors


shall abide at all times by all existing enactments on environmental protection
and rules made there under, regulations, notifications and bye-laws of the
State or Central Government, or local authorities and any other law, by-law,
regulations that may be passed or notification that may be issued in this
respect in future by the State or Central Government or the local authority.
However, Salient features of some of the major laws that are applicable are
given below:

a) The Water (prevention and Control of Pollution) Act, 1974: This


provides for the prevention and control of water pollution and the
maintaining and restoring of wholesomeness of water. ‘Pollution’

means such contamination of water or such alteration of the physical,


chemical or biological properties of water or such discharge of any
sewage or trade effluent or of any other liquid, gaseous or solid
substance into water (whether directly or indirectly) as may, or is likely
to, create a nuisance or render such water harmful or injurious to public
health or safety, or to domestic, commercial, industrial, agricultural or
other legitimate uses, or to the life and health or animals or plants or of
aquatic organisms.

b) The Air (prevention and Control of Pollution) Act, 1981: This


provides for prevention, control and abatement of air pollution. ‘Air
Pollution’ means the presence in the atmosphere of any ‘air pollutant’,
which means any solid, liquid or gaseous substance (including noise)
present in the atmosphere in such concentration as may be or tend to
be injurious to human beings or other living creatures or plants or
property or environment.
c) The Environment (Protection) Act, 1986: This provides for the
protection and improvement of environment and for matters connected
therewith, and the prevention of hazards to human beings, other living
creatures, plants and property. ‘Environment’ includes water, air and
land and the inter-relationship which exists among and between water,
air and land, and human being, other living creatures, plants, micro-
organism and property.
d) The public Liability Insurance Act, 1991: This provides for public
liability insurance for the purpose of providing immediate relief to the
persons affected by accident occurring while handling hazardous
substances and for matters connected herewith or incidental thereto.
Hazardous substance means any substance or preparation which is
defined as hazardous substance under the Environment (Protection)
Act 1986, and exceeding such quantity as may be specified by
notification by the Central Government.

18.1 SPECIFIC CONDITIONS:


18.1.1 PRE-CONSTRUCTION PHASE

a) “Consent to establish” shall be obtained from Delhi Pollution Control


Committee (DPCC) under Air (Prevention & Control of Pollution) Act, 1981
and Water (Prevention & Control of Pollution) Act, 1974 and a copy of the
same shall be submitted to the regional office of Ministry of Environment &
Forests & State Level Environment Impact Assessment Authority before the
start of any construction work at site.

b) The Contractor shall obtain all other necessary requisite


clearances/permissions from concerned authorities/agencies before
commencement of work.
c) The Contractor shall obtain water assurance from Delhi Jal Board/Authorised
source for the proposed campus development work. It must be obtained
before starting the construction.

d) Under the provisions of Environment (Protection) Act, 1986, legal action shall
be initiated against the project proponent if it was found that construction of
the project has been started without obtaining environment clearance.
e) A first aid room to be provided in the project during construction phase of the
project.
f) The Approval of competent authority shall be obtained for structural safety of
the building due to earthquake, adequacy for fire fighting equipment etc as per
National Building Code including protection measures from lightening etc.
g) All required sanitary and hygienic measures should be in place before starting
construction activities and to be maintained throughout the construction
phase.
h) Provision may be made for the housing of construction labour within the site
with all necessary infrastructure and facilities such as fuel for cooking, mobile
toilets, mobile STP, safe drinking water, medical health care, creche etc. The
housing may be in the form of temporary structures to be removed after
completion of the project.

2. CONSTRUCTION PHASE:

a) The Contractor shall ensure that the guidelines issued by Ministry of


Environment, Forests & Climate Change (MOEF & CC), vide OM No. 19-
2/2013-IA.III dated 09.06.2015, to be followed for building and construction
projects to ensure sustainable environmental management in pursuance of
Notification No. 3252 (E) dated 22.12.2014 under the EIA Notification, 2006,
as applicable, are followed in this project.

b) During the construction phase for control of dust pollution all precautionary
measure should be ensured in compliance of Hon’ble National Green Tribunal
order dated 04.12.2014 & 10.04.2015 in O.A. No.21 of 2014 and O.A. No.95
of 2014 in the matter of Vardhaman Kaushik Vs. Union of India & others and
Sanjay Kulshreshtha Vs Union of India &others.

c) The Contractor shall ensure that the guidelines issued, regarding dust
mitigation measures for construction and demolition activities for projects
requiring Environmental Clearance, by Ministry of Environment, forests &
Climate Change (MoEF&CC). vide Notification No. G.S.R.94(E) dated
25.01.2018, are to be followed.

d) All the top soil excavated during construction activities should be stored for
horticulture/landscape development within the project site.

e) Disposal of muck during construction phase should not create any adverse
effect on the neighbouring communities and be disposed off after taking the
necessary precautions for general safety and health aspects of people, only in
approved sites with the approval of competent authority. The Rules on the
Solid Waste Management including Construction waste issued by MOEF &CC
as amended will be applicable.

f) Construction spoils, including bituminous material and other hazardous


materials must not be allowed to contaminate watercourses and the dump
sites for such material must be secured so that they should not leach into the
ground water.

g) Any hazardous waste generated during construction and operation phase


should be disposed off as per applicable rules and norms with necessary
approvals to the Delhi Pollution Control Committee.

h) Vehicles hired for bringing construction material to the site and other
machinery to be used during construction should be in good condition and
should have a pollution check certificate and should conform to applicable air
and noise emission standards and should be operated only during non-peak
hours. The material loaded or unloaded should be covered (especially sand,
excavated soil) before transportation to avoid fugitive emissions etc.

i) Techniques like, air extraction equipment, and covering scaffolding, hosing


down road surfaces, reducing the speed of vehicle, use of covering sheets for
vehicles carrying construction materials and cleaning of vehicles to reduce
dust and vapour emissions. Measures should include appropriate containment
around bulk storage tanks and materials stores to prevent spillages entering
watercourses.

j) Ambient noise levels should conform to prescribed standards both during day
and night. Adequate measures should be made to reduce ambient air and
noise level during construction and operation phase, so as to conform to the
norms stipulated by CPCB/DPCC. Ambient air and noise monitoring should
be done by an accredited lab and data should also be submitted, on six
monthly bases, with DPCC & Regional Office of MoEF & CC. Incremental
pollution loads on the ambient air and noise quality should be closely
monitored during construction phase.

k) Fly ash should be used as building material in the construction as per the
provisions of Fly Ash Notification of September,1999 and amended to date.
Red Bricks shall be used in washrooms and wherever deemed necessary as
per directions of EIC.

l) The contractor can either establish concrete batch mixing plant at site for
production of RMC after getting approval from authorities concerned or
procure RMC from approved vendors as specified in the tender at no extra
cost.

m) Water demand during construction should be reduced by use of pre-mixed


concrete, curing agents and other preferred best practices.
n) Contractor shall obtain prior permission for ground water withdrawal from
Delhi Jal Board, in compliance of notification dated 12.07.2010.

o) Fixtures for showers, toilet flushing and drinking should be of low flow either
by use of aerators or pressure reducing devices or sensor based control.

p) Construction/provision of the STP, DG Sets, Utilities etc, earmarked by the


project proponent on the layout plan, should be made in the earmarked area
only. In any case the position/location of these utilities should not be changed
later-on.

q) Health and safety norms of CPWD should be followed during construction.

r) Soil and water samples of the site should be tested by the Contractor through
DPCC recognized laboratory to ascertain that there is no threat to ground
water quality by leaching of heavy metals and other toxic contaminants, on
quarterly basis for inclusion in the six monthly reports.

s) Adequate steps shall be taken to conserve energy by limiting the use of glass
suitably to reduce the electricity consumption and load on air-conditioning. If
necessary, use high quality double glass with special reflective coating in
windows, provision of proper thermal insulation and taking measures as
prescribed under the Energy Conservation Building Code.

t) Energy Conservation Building Code to be strictly adopted in all aspects of


buildings design and construction.

u) Regular supervision of the above and other measures for monitoring should
be in place all through the construction phase, so as to avoid disturbance to
surroundings.

3. OPERATION PHASE

a) Consent to Operate shall be obtained from DPCC under Air (Prevention &
Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution)
Act, 1974 and a copy of the same shall be submitted to the Ministry of
Environment & Forests/State Level Environment Impact Assessment
Authority, before operation, failing which the Environment Clearance herein
shall be deemed to be withdrawn.

b) Authorization from Delhi Pollution Control Committee shall be obtained as


applicable under Bio-Medical Waste (Management and Handling) Rules, 1998
as amended.

c) The Zero wastewater discharge condition to be achieved with installation of


on-site Sewage Treatment Plant & treated affluent shall conform to the norms
and standards prescribed by Delhi Pollution Control Committee. The STP
should be certified by an independent expert and adequacy report in this
regard should be submitted to Delhi Pollution Control Committee & State
Level Environment Impact Assessment Authority before the project is
commissioned for operation. Necessary measures should be made to mitigate
the odour problem from STP.

d) The Contractor shall provide electromagnetic flow meter at the inlet & outlet of
the water supply, Inlet & outlet of the STP &WTP and any pipeline to be used
for re-using the treated wastewater back into the system for cooling, flushing
and for horticulture purpose/green etc. and shall maintain a record of readings
of each such meter on daily basis.

e) The quantity of fresh water usage and water recycling shall be measured and
recorded to monitor the water balance as projected by the project proponent.
The record shall be submitted to the Delhi Pollution Control Committee, State
Level Environment Impact Assessment Authority & Regional Office, MoEF&
CC along with six monthly Monitoring reports.

f) The treated wastewater shall be recycled and reused for Cooling, flushing &
for Horticulture/landscape purposes to reduce the demand of fresh water as
committed.

g) The Operation and Maintenance of STP& WTP shall be made in the MoU with
STP / WTP supplier. Contractor shall ensure regular operation and
maintenance of the STP / WTP.

h) Rain water harvesting, as per plan submitted, for roof top run-off should be
implemented. Before recharging the run-off, pre-treatment must be done to
remove suspended matter, oil and grease. The depth of the bore for rainwater
recharging should be kept in consultation with NBCC / DJB/CGWA. No
wastewater (such as sewage, trade effluent, backwash of treatment unit, floor
washing wastewater etc) should be discharged into the rainwater harvesting
structure in order to avoid groundwater contamination.

i) The ground water drawn from existing/proposed bore well during construction
and operation phase should be done only with the prior permission of DJB
/concerned local body. The ground water level and its quality should also be
monitored regularly.

j) The position/location of the other Utilities, installed by the Contractor as per


the provisions made in the layout plan, should not be changed later-on under
any circumstances except with prior approval from NBCC.

k) Separation of grey and black water should be done by the use of dual
plumbing line. Treatment of grey water by decentralised treatment should be
done as per approved design.

l) All the pipelines carrying water/waste water should be distinguished using


colour coding on raw & potable water pipes, grey water, black water, reuse
lines of treated water for flushing, cooling & Horticulture etc.

m) Noise should be controlled to ensure that it does not exceed the prescribed
standards. During night time the noise levels measured at the boundary of the
building shall be restricted to the permissible levels to comply with the
prevalent regulations.

n) Energy Conservation measures such as solar lighting for common areas,


solar water heating system, LEDs for lighting of areas, signage, solar inverters
etc should be adopted as per approved design.
o) Used CFLs/LEDs should be properly collected and disposed off/sent for
recycling as per the prevailing guidelines/rules of the regulatory authority.

p) A Report on energy conservation measures conforming to energy


conservation norms finalized by Bureau of Energy Efficiency should be
prepared incorporating details about building materials and technology, R & U
factors etc and submit a copy to Ministry of Environment & Forests, Regional
Office, Lucknow and DPCC in three months time with intimation to SEIAA.

q) Thick green belt of adequate width and density with local species, as per plan
submitted, shall be raised along the periphery of the plot so as to provide
protection against particulates and noise. The open spaces inside the plot
should be suitably landscaped and covered with vegetation of indigenous
species/variety.

r) Traffic congestion near the entry and exit points from the roads adjoining the
project site must be avoided. Parking should be fully internalized and no
public space should be utilized.

4. OTHER SPECIFIC CONDITIONS:

1. After Treated from RO plant water of DJB, STP should be used for
construction purposes up to the maximum extent possible.

2. Packaged/mobile STP shall be provided for labour camp during construction


phase.

3. Ground water should be extracted only after prior permission from DJB.

4. Boring for Rain Water Harvesting system should not be permitted/done before
completion of structure work, All recharge should be limited to shallow aquifer.

5. STP should be adequate to treat the waste water so that BOD level should
not exceed 10 mg/l in treated water.

6. Flow Meters should be installed to monitor consumption of fresh water as well


as treated water and log book for these flow meters be maintained in a regular
manner. Flow meters shall be installed at Inlet of STP, outlet of STP, inlet of
flushing tanks, inlet of cooling water tanks and reuse line for horticulture
purposes.

7. The Contractor, before starting the construction, will reconfirm the


nonexistence of any water body in and around (within 500m) the project site.
It will be ensured that water body/bodies (identified as per guidelines MPD
2021) in and around the project site shall not be affected due to proposed
development work.

8. Solar Photovoltaic (SPV) system should be installed to meet electricity


generation as per DBR/Scope of Work . Solar water heating shall be provided
to meet its hot water demand as far as possible.

9. Only LEDS should be used.

10. Green Building norms should be followed with achievement of minimum 4star
GRIHA rating for entire MEA COMPLEX.

waste processing unit.

13. During the Construction Phase for control of dust pollution all precautionary
measure should be ensured in compliance of Hon’ble National Green Tribunal
order dated 4.12.2014 & 10.04.2015 in O.A. No.21 of 2014 and O.A. No.95 of
2014 in the matter of Vardhaman Kaushik Vs. Union of India & others and
Sanjay Kulshreshtha Vs Union of India & orsand as per MOEF &CC, GOI
Notification No. G.S.R. 94(E) dated 25.01.2018 regarding mandatory
implementation of dust mitigation measures for construction and demolition
activities.

14. Contractor shall be responsible for establishment and operation of all common
facilities and also for compliance of EC conditions during operation stage.

15. In view of MoEF&CC Office Memoramdum No. 21-270/2008-IA.III dated


19.06.2013 read with MoEF&CC Office Memorandum No, 22-154/2015-IA.III
dated 10.11.2015, this environmental clearance is granted focusing only on
the environment concerns. The project will be regulated by the concerned
local Civic Authorities under the provisions of the relevant provisions of the
extant MPD-2021, Building Control Regulations and Safety Regulations.

16. The Contractor shall obtain water assurance form SDMC/Delhi Jal
Board/authorized source during construction/operation phase for the
proposed development work. It must be obtained before starting the
construction.

17. The Environmental Clearance is subject to the condition that concerned local
civic agencies will give the permission for use/occupation of the building only
after the written assurance of DJB/South Delhi Municipal council/other such
local civic authority (as the case may be) regarding supply of adequate water
for the residents/occupiers.

18. Grant of environmental clearance does not necessarily implies that


water/power supply shall be granted to the project and that their proposals for
water/power supply shall be considered by the respective authorities on their
merits and decision taking.

19. The investment made in the project, if any, based on environmental clearance
so granted, in anticipation of the clearance from water/power supply angle
shall be entirely at the cost and risk of the contractor and NBCC shall not be
responsible in this regard in any manner.

20. Green area should not be less than 25% of the plot area out of which
minimum 15% should be of soft green area, so that there should be sufficient

recharging of ground water. Further along boundary wall, minimum of soft


green space of 2m width be kept for better tree growth & ground water
recharge, based on area of 6’ x 6’ / tree being a norm.

21. Ambient air quality monitoring in construction stages should be done as per
CPCB criteria on weekly bases during winter season, in view of the location of
the project.

22. Adequate ventilation should be provided in the basements and during the
operation phase the concentration levels of Carbon dioxide, Carbon Monoxide
should be monitored periodically and also be reported in periodical
compliance reports to be submitted. NOx, Sox and PM are also be maintained
in basement as per EPA norms.

23. Sign board be placed at project site indicating the Brief Project Details along
with Khasra No. of the land as per revenue record.

24. If needed, Contractor shall also submit six monthly reports on the status of
compliance of the stipulated EC conditions including results of monitored data
(both in hard & soft copies) to Regional Office, Ministry of Environment,

Forests & Climate Change, Govt. of India, SEIAA-Delhi and Delhi Pollution Control
Committee.

19 Prevention of Nuisance and Pollution

The contractor shall take all necessary precautions to prevent any nuisance or
inconvenience to the owners, tenants or occupiers of adjacent properties and
to the public in general and to prevent any damage to such properties and any
pollution. He shall make good at his own cost and to the satisfaction of the
Engineer-in-charge, any damage to roads, paths, drainage works or public or
private property whatsoever caused by the execution of the work or by traffic
brought thereon by the contractor. All waste or superfluous materials shall be
cleaned away by the contractor without any reservations entirely to the
satisfaction of the Engineer-in-charge at no extra cost.

The site has to be kept clean of all debris, rubbish and dirt & surplus/waste
material all the time. It also includes maintenance, cleaning & de-silting the
pipe lines laid by the agency for all internal services etc. executed by the
agency to the entire satisfaction of the Engineer-in-charge during the
execution and maintenance periods. Cleaning and de-silting will also be done
by the agency before handing over the completed structures to NBCC. All
machines, equipment and labour for this purpose will be arranged by
contractor at no extra cost to NBCC.

20 Statutory Fee Payment

Statutory fees, if any paid to the local bodies/Authorities in connection with the
approval of the project / connection of the services/shifting of the services by

the contractor shall be reimbursed by NBCC on submission of vouchers/ bills /


receipts issued by the concerned local bodies/Authorities. The cost of
restoration of any services damaged by the contractor during execution shall
however be borne by the contractor.

21 Contractor’s Warranty of Design

1. The Contractor shall be fully responsible, for the suitability, adequacy,


integrity, durability and practicality of the Contractor’s proposal.

2. The Contractor warrants that the Works have been or will be designed,
manufactured, installed and otherwise constructed to the highest standards
available using proven up-to-date good practice. By submitting the Drawings
for review to the Engineer, the Contractor shall be deemed to have
represented that it has determined and verified that the design and
engineering, including field construction criteria related thereto, are in
conformity with the Scope of the Project, the Specifications and Standards
and the Applicable Laws.

3. The Contractor warrants that the Contractor’s Proposals meet the


requirements and is fit for the purpose thereof. Where there is any
inadequacy, insufficiency, impracticality or unsuitability in or of the
requirements or any part thereof, the contractor’s proposal shall take into
account, address or rectify such inadequacy, insufficiency, impracticality or
unsuitability at contractor’s own cost.

4. The Contractor warrants that the Works will, when completed, comply with
enactments and regulations relevant to the Works.

5. The Contractor shall also provide a guarantee from the Designer for the
design for suitability, adequacy, and practicality of design for Employer’s
Requirements.

6. The Contractor shall indemnify the Employer against any damage, expense,
liability, loss or claim, which the Employer might incur, sustain or be subject to
arising from any breach of the Contractor’s design responsibility and/or
warranty set out in this Clause.

7. Notwithstanding that such design may be or have been prepared, developed


or issued by the Employer, any of Contractor’s consultants, his sub-
contractors and/or his qualified personnel/persons or cause to be prepared,
developed or issued by others.

1. Notwithstanding any warranties, guaranties and/or indemnities that may be or


may have been submitted by any other person.

2. Notwithstanding that the same have been accepted by the Engineer, the
Contractor shall be fully responsible for the Equipments, Fixtures & Fittings,
Plants, Materials, goods, workmanship, preparing, developing and
coordinating all design Works to enable that part of the Works to be

constructed and/or to be fully operational in accordance with the Contract’s


requirements.

No claim for additional payment or extension of time shall be entertained


and/or no review and/or observation of the Engineer and/or its failure to
review and/or convey its observations on any Drawings shall relieve the
Contractor of its obligations and liabilities under this Agreement in any manner
nor shall the Engineer-in-Charge or the Employer be liable for the same in any
manner, and if errors, omissions, ambiguities, inconsistencies, inadequacies
or other Defects are found in the Drawings, they and the construction works
shall be corrected at the Contractor's cost, notwithstanding any review under
this section.

22 Guarantee/Warranty

All plant/ equipments / machinery installed/commissioned shall be guaranteed


or warranties (as per applicability of guarantee/warranty given in technical
specifications for each plant/ equipments/ machinery) for a period of 24
months (minimum) from the date of acceptance and taking over by NBCC
against un-satisfactory performance and/or breakdown due to defective
design, material, manufacture, workmanship or installation. The
guarantee/warranty period given above is the minimum period for which a
plant/ equipments/machinery is required to be covered under
guarantee/warranty. However, if required guarantee/warranty period in
technical specification is specified more than 12 month for any plant/
equipments/machinery from the date of acceptance and taking over of the
installation by NBCC; then the higher period will be the required period of
guarantee/warranty for that particular plant/ equipments /machinery. The
plant/ equipments/machinery or component or any part thereof so found
defective during the guarantee/warranty period shall be repaired or replaced
free of cost to the satisfaction of the Engineer in-charge. In case it is felt by
NBCC that undue delay is being caused by the contractor in doing this, the
same will be got done by NBCC at the risk and cost of the contractor. The
decision of Engineer-in-charge in this regard shall be final and binding on the
contractor.

23 Security of the Site

The Contractor shall be wholly responsible for security of site and Works,
unless otherwise stated in Special Conditions of Contract.

a) The Contractor shall be responsible for keeping unauthorized persons off the
Site, and

b) Authorized persons shall be limited to the Employees of the Contractor,


Subcontractor or persons authorized by the Engineer.

The contractor shall provide sufficient lighting at project site, of the right type
and at the right place / location for it to be properly effective. Lighting must be
properly planned not to introduce the risk of electric shock.

Therefore, 230V supplies should be used for those fittings, which are robustly
installed, and well out of reach e.g. flood lighting or high-pressure discharge
lamps. The contractor shall ensure that luminaries should always be so
placed that no person is required to work in their own shadow and that the
local light for one person is not a source of glare for the others. Strongly made
clamps should be available for attaching luminaries to poles and other
convenient supports.

Luminaries should be robust, resistant to dust, corrosion and rain proof


especially at the point of the cable entry. The correct type of lamp for each
luminaries should always be used and when lamps need to be replaced, it
shall be in accordance with the supply voltage. Lamp holders not fitted with a
lamp should be capped off.

The contractor shall take every effort to illuminate the work site as per the
direction of Engineer-in-charge. The compliance of above provisions are
deemed to be included in the quoted amount of the contractor and no claim /
payment whatsoever shall be entertained on this account.

25 Traffic Management:

1) The basic objective of the following guidelines is to lay down


procedures to be adopted by contractor to ensure the safe and efficient
movement of traffic and also to ensure the safety of workmen at
construction sites.

All construction workers should be provided with high visibility jackets


with reflective tapes as most of construction activities shall be done
within right-of-way of the roads. The conspicuity of workmen at all times
shall be increased so as to protect from speeding vehicular traffic.
The guiding principles to be adopted for safety in construction zone are
to-

i) Warn the road user clearly and sufficiently in advance.

ii) Provide safe and clearly marked lanes for guiding road users.

iii) Provide safe and clearly marked buffer and work zones.

iv) Provide adequate measures that control driver behaviour through


construction zones.

2) Permission from competent authorities-

i) Wherever operations undertaken are likely to interface with public


traffic, specific traffic management plans shall be drawn up and
implemented by the contractor in consultation with the approval of
local police authorities, and /or the concerned metropolitan/civil
authorities as the case may be.

ii) Such traffic management plans shall include provision for traffic
diversion and selection of alternative routes. If necessary, the
contractor shall carry out road widening before commencement of
works to accommodate the extra load. The contractor shall be
responsible for getting the “Traffic Management Plan” approved
from Traffic Police before taking up any construction activity on
the road.

The rates quoted by the contractor shall be deemed to be inclusive of


all the related cost except the cost of road widening.

3) The primary traffic control devices used in work zones shall include
signs, delineators. barricades, cones, pylons, pavement markings and
flashing lights, deployment of sufficient number of Marshalls on
diversion roads and nothing shall be paid on this account.

4) Regulatory signs-
Signs impose legal restriction on all traffic. It is essential, therefore, that
they are used only after consulting the local police and traffic authorities
and nothing shall be paid on this account.

5) Warning signs-
Warning signs in the traffic control zone shall be utilised to warn the
drivers of specific hazards that may be encountered.

The contractor shall place detour signage at strategic locations and


install warning signs. In order to minimize disruption of access to
residences and business, the contractor shall maintain at least one
entrance to a property where multiple entrance exist.A warning sign
shall be installed on all secondary roads which merges with the primary
road where the construction work is in progress at sufficient distance
before it merges with the primary road so as to alert the road users
regarding the “Construction Work in Progress”.

Materials hanging over/ protruded from the chassis / body of any vehicle
especially during material handling shall be indicated by red indicator
(red light/flag) to indicate the caution to the road users.

The compliance of above provisions are deemed to be included in the


quoted amount of the contractor and no claim / payment whatsoever
shall be entertained on this account.

26 Dewatering of Site

The rates for all items, shall be considered as inclusive of pumping / bailing
out water, wherever necessary for which no extra payment shall be made.
The area shall be kept dry when the work is in progress even below water
table. Nothing extra shall be paid for removal of slush / sludge due to sub-soil
condition, rains, spring etc.

27 Incidental Works Such as Bailing-Out Water, Shoring etc.

For execution of any items of work where incidental works such as bailing out
water, shoring etc. are actually required but not specifically stated in the
scope of item and/ or tender document, it is to be understood that the contract
amount quoted by the contractor shall cover such charges also and nothing
extra on account of such incidental charges, if any, shall be paid.

28 Water Supply and Electricity

Arrangement of water for drinking purpose in addition to the water required for
construction work is also to be made by the contractor at his own cost. The
contractor shall also make his own arrangement for obtaining electric
connection (s) and make necessary payment directly to the department
concerned. NBCC will however make all reasonable recommendations to the
authority concerned in this regard.

The contractor shall make his own arrangement of water for completion of
work and nothing will be paid on this account. The contractor shall get the
water tested with regard to its suitability and conforming to the relevant IS
Code. The contractor shall obtain written approval from the Engineer-in-
Charge before he proceeds by using the same for execution of work. The
Contractor shall arrange recycled water for construction purpose from STPs of
nearby areas/colonies at his own cost. In case the above supply is short of
total requirement of water for construction purpose, then the contractor shall
arrange suitable water at his own cost.

29 Various Ancillary Provisions at Site

I) Traffic cones and cylinders


Traffic cones of 500mm, 750mm and 1000mm height and 300mm to
500mm in diameter or in square shape at base and are often made of
plastic or rubber and normally having retro-reflectorised red and white
band shall be used wherever required.

II) Drums
Drums about 800mm to 1000mm high and 300mm in diameter can be
used either as channelising or warning devices. These are highly
visible, give the appearance of being formidable objects and therefore
command the respect of drivers.

The contractor shall ensure the cleanliness of roads and footpaths by


deploying proper manpower for the same. The contractor shall have to
ensure proper brooming, cleaning washing of roads and footpaths, at
all the time, throughout the entire stretch till the currency of the contract
including disposal of sweepage without any extra cost.

IV) The required number of traffic guards /marshals as decided by Delhi


Traffic Police /Engineer-in-charge shall be provided during construction
period so as to ensure safe movement of traffic without any extra cost
to NBCC. In case of default, the traffic guards/ marshals shall be
provided by NBCC and cost thereof shall be recovered from the
contractor in addition to recovery for violation of tender provisions. No
claim whatsoever shall be entertained on this account.

V) Diversion of Services

All works pertaining to services including rerouting/diversion of


services, routine testing, installation etc., embracing in one or more
than one process shall be subject to examination and approval to each
stage thereof by the Engineer-in-charge or concerned department as
would be notified by the Engineer-in-charge or his accredited
representative when such stage is ready. In default of such notice, the
Engineer-in-Charge shall be entitled to appraise the quantity and extent
thereof and the decision of Engineer-in-Charge or his accredited
representative in this regard shall be final and binding.

The contractor will not have any claim in case of any delay in removal
of trees or shifting, raising, removing of telegraph, telephone or electric
lines (overhead or underground), water and sewer lines and other
structures etc., if any, which may come in the way of the work.
However, suitable extension of time will be granted to cover such
delays.

30 Excavation and Disposal off Excavated Earth:

30.1 The contractor shall deposit royalty, any other duty / taxes, fees and obtain
necessary permit for excavation from concerned local/statutory authority(ies),
if any, required. The quoted rates shall be inclusive of the payments to be
made for royalty, if any.

30.2 The contractor shall also retain the top layer of 150mm of earth for its
utilization as per GRIHA Norms.

30.3 The contractor shall ensure to retain the excavated earth to the extent of
required for back filling at the site of work or otherwise, he will have to arrange
the good earth required for the back filling at the site of work, at his own cost
and no extra payment on this account is payable to contractor.
30.4 Contractor shall carry this excavated earth/rock at the locations arranged by
him at his own cost. The rates quoted by the contractor deemed to be
included of all the costs to be incurred in loading, unloading, carriage of

earth/rock outside the Campus at any distance and all other activities required
to dispose-off the excavated earth/rock. The disposal of earth/rock by
contractor shall be as per the rules and laws applicable in Delhi/NCR. Fine,
penalty, if any, imposed for violation of rules and laws shall be payable by
contractor. No extra payment, whatsoever, on this account shall be payable to
contractor.

31 Existing Services & Storage/Labour Camps within Site

a) Existing Services-

Existing drains, pipes, cables, overhead/UG wires, sewer lines, water


lines and similar services encountered in the course of the execution of
the work shall be protected/ maintained against the damage by the
contractor. The contractor shall identify all underground / overhead
services and take necessary measures to protect the services before
starting any excavation / activity. All temporary supports and other
measures required to protect and maintain the services during
construction period as per direction of Engineer-in-charge, shall be
deemed to be included in the quoted rate / amount of the contractor and
nothing extra shall be paid on this account. For any permanent shifting,
contractor shall arrange to shift the services as and when required. The
decision of the Engineer-in-Charge in this regard shall be final and
binding.

b) Land for Storage/Labour Camps/RMC

The land for labour camp/storage/RMC may be provided to the


contractor as per the availability at site.Otherwise, the contractor has to
make their own arrangement for providing/installation and
commissioning of their ready mix cement concrete plant and material
stocking/stacking yard, labour camp etc. at a place/location separate
from site, at their own cost. No extra payment shall be entertained by
NBCC towards any lead on account of transportation of Ready Mix
Concrete or any other material / labour whatsoever.

The contractor has to make their own arrangement for storage/stacking


of all construction materials, labour camps, fabrication yard etc.

The Contractor’s proposal /bid shall be deemed to have seen the site
and considered this while making his proposal and his quoted price is
deemed to have included the above. Further, the lease / rent charges of
land, if any, shall be borne by the contractor. The Engineer-in-Charge
shall only extend necessary help and issue necessary recommendations
etc. to the concerned department for temporary allotment of land during
construction period.

32 Contractor's care of the Works

The Contractor shall bear full risk in and take full responsibility for the care of
the Works and Materials, goods and equipment for incorporation therein from
the Commencement Date until the Completion Certificate is issued, except
and to the extent that any loss of or damage to the same shall arise out of any
default or neglect of the Employer.

The Contractor shall throughout the execution of the Works including the
carrying out of any testing, commissioning (including Integrated Testing and
Commissioning), or remedying of any defect:

a) Take full responsibility for the adequacy, stability, safety and security of the
Works, Plant, Goods, Contractor's Equipment, Temporary Works, operations
on Site and methods of manufacture, installation, construction and
transportation;

b) Have full regard for the safety of all persons on or in the vicinity of the Site
(including without limitation persons to whom access to the Site has been
allowed by the Contractor), comply with all relevant safety regulations,
including provision of safety gear, and insofar as the Contractor is in
occupation or otherwise is using areas of the Site, keep the Site and the
Works (so far as the same are not completed and occupied by the Employer)
in an orderly state appropriate to the avoidance of injury to all persons and
shall keep the Employer indemnified against all injuries to such persons.

c) Provide and maintain all lights, guards, fences and warning signs and
watchmen when and where necessary or required by the Engineer or by laws
or by any relevant Employer for the protection of the Works and for the safety
and convenience of the public and all persons on or in the vicinity of the Site;
and

d) Where any work would otherwise be carried out in darkness, ensure that all
parts of the Site where work is being carried out are so lighted as to ensure
the safety of all persons on or in the vicinity of the Site and of such work.

Contractor is required to take note of all the necessary provisions in


Employer’s Safety, Health and Environment Manual (SHE Manual) and the
Contractor’s price shall be inclusive of all the necessary costs to meet the
prescribed safety standards. In the case, the Contractor fails in the above, the
Employer may provide the necessary arrangements and recover the costs
from the Contractor.

33 HOUSE-KEEPING

a) Housekeeping is the act of keeping the working environment cleared of


all unnecessary waste, thereby providing a first-line of defence against
accidents and injuries. Minimum one Housekeeping Officer with
adequate workers is required to be at site at all times. General House-
keeping shall be carried out by the contractor and ensured at all times
at Work Site, Construction area, Fabrication Yard, Workshop, Batching

Plant, Labour Camp, Stores, Offices and toilets/urinals etc. The


contractor shall be responsible to provide segregated containers for
disposal of debris at required places and regular cleaning of the same.

ii. All stairways, passageways and gangways shall be maintained without


any blockages or obstructions. All emergency exits passageways, exits
fire doors, break-glass alarm points, fire-fighting equipment, first aid
stations, and other emergency stations shall be kept clean, un-
obstructed and in good working order.

iv. All surplus earth and debris shall be removed/ disposed-off from the
working areas immediately. Trucks carrying sand, earth and any
pulverized materials etc. shall be covered while moving in order to
avoid dust or odour impact. The tyres of the trucks leaving the site shall
be cleaned with water, wherever the possibility of spillage on
carriageways meant for regular road traffic exists.

v. No parking of trucks/trolleys, cranes and trailers etc. shall be allowed


on roads, which may obstruct the traffic movement.

vi. Roads shall be kept clear and materials like: pipes, steel, sand
boulders, concrete, chips and brick etc., shall not be allowed on the
roads to obstruct free movement of road traffic.

vii. Water logging or bentonite spillage on roads shall not be allowed.

viii. Proper and safe stacking of material are of paramount importance at


fabrication stores, stores and such locations where material would be
unloaded for future use. The storage area shall be well laid out with
easy access and material stored / stacked in an orderly and safe
manner.

ix. Flammable chemicals, compressed gas cylinders etc. shall be safely


stored. Unused/surplus cables, steel items and steel scrap lying
scattered at different places within the working areas shall be removed
to identified locations(s). All wooden scrap, empty wooden cable drums
and other combustible packing materials, shall be removed from the
site. Lumber with protruding nails shall be either bent/ removed and
properly stacked.

x. The compliance of above provisions are deemed to be included in the


quoted amount of the contractor and no claim / payment whatsoever
shall be entertained on this account.

34 Safety
Minimum one Safety Officer/ Manager is required to be at site at all times.

Qualifications of Safety Coordinator/ Manager should not be less than those


prescribed in local regulations/ in building and other construction

or as directed by EIC. Contractor shall arrange for initial Site orientation /
induction of all Workmen / Supervising personnel on ‘Safety practices’ before
beginning of work at site. This shall include a briefing about project, safety
policy, site safety rules and site facilities.

Contractor shall conduct daily toolbox talk for all workers previous to starting
to work. These tool box talks should include topics related to ongoing work
activities and precautions to be taken on daily activities.

Contractor shall ensure participation of his site in-charge and the safety
coordinator in the safety meetings arranged at intervals decided by the
supervisor / owner.

Contractor shall also submit a Health & Safety report on monthly basis to
NBCC.

Contractor’s Safety Engineer / Safety Officers

He shall Assist the Contractor’s Construction Manager and coordinate with


NBCC’s Safety Supervisor / Engineer the implementation of the HSE program
within corresponding work groups.

Get familiarized with all government, and Owner’s safety and health
regulations, including reports and work permits procedures.

Inspect the construction area on a regular basis in order to verify appropriate


corrective actions and prepare reports to their Construction Manager.

Review the SAP (Safety Action Plan) prepared by line supervisor.

Co-ordinate with supervisors and foremen periodical safety meetings and lead
daily safety meetings.

Conduct safety training classes for all workers.

Participate in Tool Box Talks.

Suggest safety promotional activities.

change during the course of the project to meet changing site requirements :

i. Introduction to the site and project, with a brief overview of the project
under constructions.
ii. Owner and consultant’s HSE policy and safety philosophy.
iii. Personal Protective Equipment (hard hats, safety glasses, safety steel-
toed boots)
iv. Housekeeping
v. Working in and around excavations
vi. Working at height (ladders, scaffolds, free edges and openings)
vii. The Safe Plan of Action (SPA)
viii. First aid facilities, Accident reporting system
ix. Emergency procedure
x. Smoking restrictions, prohibition of alcohol and drugs.
xi. The contractor will conduct a site visit for his new employees in groups
of less than 25 so that they get acquainted with essential services, their
work place, and general site layout.
xii. Gate pass will be issued only after completion of the site orientation /
induction.

The following PPE are of mandatory use at Site. However special equipment
may be required for other specific operations depending on risks involved :

Equipments (PPEs), safety during working at heights etc. The rates


quoted by the bidder shall be inclusive of the cost involved in this factor
and no extra cost shall be payable to the contractor.
ii) Proper scaffolding and working platforms with handrails should be
provided to work at higher elevations.
iii) Tools and loose material should not be left on the scaffolding from
where they are likely to fall.
iv) Things should not be thrown from heights. They should be brought
down or taken up with the help of ropes.
v) While work is carried on at higher elevations, warning notices should
be posted below or barricade the area so as to draw the attention of
persons and prevent them from coming under the falling objects.
vi) Defective scaffoldings, damaged ladders, insufficient working platforms
etc. should not be permitted.
vii) Wherever necessary, light weight mobile tower scaffolds or hydraulic
platforms should be used.
viii) Persons should use safety belts while working near open edge where it
is not possible to provide hand rails.
ix) Proper access should be available to the work spot.
x) Nobody should jump over open area between equipment, pipes and
rails etc. from where they may slip.
xi) Walking over beams, narrow pipes etc. should be prohibited.
xii) The area from where the materials are pulled up with ropes etc. should
have hand railings and the person should keep firm footing.
xiii) They should not lean over the handrails and should use safety belts to
protect themselves from fall due to body imbalance.
xiv) Reduce the hazards associated with falls
xv) Control fall hazards first through engineering controls
xvi) Institute personal fall arrest systems, administrative controls and
training when engineering controls are not feasible
xvii) Have a formal fall protection program in accordance with Factories Act
requirements
xviii) Have the necessary fall protection equipment to safely perform the job
xix) Have workers properly trained in the use of fall protection equipment
xx) Have supervisors (or competent personnel) who ensure the use of fall
protection equipment as required

expenditures incurred in the safety procedures. No extra payment on this account
shall be payable to contractor.

PERSONAL PROTECTIVE EQUIPMENTS (PPEs)

A) The contractor shall provide required PPEs to workmen to protect


against safety and/or health hazards. Primarily PPEs are required for
the following protection.

iii) Body Protection (High visibility clothing (waistcoat/jacket, Apron,
etc.)

The PPEs and safety appliances provided by the contractor shall be of


the standard as prescribed by the EIC / Bureau of Indian Standards
(BIS). If materials conforming to BIS standards are not available, the
contractor shall procure PPE and safety appliances, as approved by
the Engineer-in-charge.

B) All construction workers should be provided with high visibility jackets


with reflective tapes confirming to the requirement specified under BS
EN 471: 1994. The conspicuity of workmen at all times shall be
increased so as to protect them from speeding vehicular traffic.

provide required PPEs for all visitors, Client& NBCC staff. Towards this
required quantity of PPEs shall be kept always at the security post or
any other place suggested by NBCC.

D) Notwithstanding the above, the contractor shall at their expense


arrange for the safety provision as per all relevant Indian Standard
Safety Codes & local bye-laws. The contractor shall provide all facilities
in connection therewith and shall also issue the identity card to his
labourer.

3.35 Unforeseeable Difficulties

Except as otherwise specifically stated elsewhere in the Contract:

a. The Contractor shall be deemed to have obtained all necessary


information as to risks, contingencies and other circumstances which
may influence or affect the Works;

b. By signing the Contract, the Contractor accepts total responsibility for


having foreseen all difficulties and costs of successfully completing the
Works; and

c. The Contract Price shall not be adjusted to take account of any


unforeseen difficulties or costs.

NBCC shall not provide any material either on chargeable or on free


issue basis to the contractor for execution of the project.

3.36 Contractor Team Leaders

The Contractor shall appoint a design director (the "Design Director") who will
head the Contractor's design units and shall be responsible for surveys,
investigations, collection of data, and preparation of preliminary and detailed
designs.
The contractor shall intimate to NBCC its project in charge, as its
representative for the Project within 7 (Seven) days of the issue of Letter of
Award. The Contractor shall intimate to NBCC the name, Designation and
address of his such project in charge.

3.38 Mandatory Construction Equipments, Plants & Machinery

Whereas it is entirely the responsibility of the Contractor to deploy sufficient


construction plant and equipment to ensure compliance with his obligations
under this Contract. The below list constitutes the Employer’s estimate of the
minimum essential basic holding of construction plant and equipment, which
the contractor must deploy at site during course of work execution.
The Contractor shall deploy following Mandatory Construction Equipments,
Plants & Machinery during course of construction and as per EIC instructions.

condition.
The above list is not exhaustive and any other Machinery, Equipments , tool
and plants required to be procured for successful execution and completion of
project as per milestones / targets / EIC instructions shall be brought by the
Contractor, without any additional cost implication.

It shall be deemed that rates quoted by the contractor are inclusive of all the
expenditures incurred in deployment of above listed Mandatory Construction
Equipments, Plants & Machinery. No extra payment on this account shall be
payable to contractor.
