It has come to our attention that the Lavares-Labios Ancestral House in Brgy.
Kalumpang, Tayabas will l)e affected by the Department of Public Works and Highways
(DPWH) road widening project and the South Luzon Expressway Toll Road (SLEX-TR4)
Project.
Please be advised that pursuant to Article 111 Section 5 of the National Cultural Heritage
Act of 2009 (R.A. 10066)—as amended by RA 11961—all structures dating at least 50 years
old, including the Lavares-Labios Ancestral House, are considered Important Cultural
Properties. Hence, these must be protected from any modification or demolition. To further
strengthen the implementation of the said law, the DPWH itself—through the attached NBCDO
Memorandum Circular No. 2 Series of 2018 and Department Order No. 12 Series of 2019—
strictly directed all building officials and city/municipal engineers to consult and coordinate with
appropriate cultural agencies (i.e., NHCP) prior to the implementation of any proposed
developments and demolition that might affect the integrity of historical and cultural sites.
The NHCP is enjoining the DPWH Quezon 2"^ District Engineering Office to preserve
and spare the said hertege structures from the road widening project. Furthermore, we also
request your office to submit the proposed development plans for discussion and evaluation.
Attached herewith is a copy of the service requiremerrts for the Proposed Development Work

In order to carry out the intent of NBCDO Memorandum Circular No. 02, Series of 2018 dated
April 13, 2018, for the strict preservation and conservation of Filipino built heritage pursuant to
the National Cultural Heritage Act of 2009 (R.A. 10066) through coordination with the National
Commission for Culture and the Arts (NCCA) and its attached cultural agencies, there is a need
to mainstream the same into the building permit process, considering that Section 301 (1) of the
Revised Implementing Rules and Regulations (IRR) of the National Building Code of the
Philippines (PD 1096) provides that a building permit is mandatory for any construction,
alteration, repair, conversion, use, occupancy, movement, demolition and addition of
building/structure or any portion thereof, any of which could affect built heritage.
For this purpose, the NCCA and its attached cultural agencies shall be included in the list of
various offices/authorities exercising and enforcing regulatory functions affecting
buildings/structures, where written clearance for certain building project that could affect built
heritage shall be obtained as part of the documentary requirements in building permit application.
The following additional Implementing Rules and Regulations (IRR) are hereby promulgated and
issued to read henceforth as follows:

Built heritage shall refer to architectural and engineering structures such as, but not
limited to, bridges; government buildings; houses of ancestry; traditional dwellings;
quartels; train stations; lighthouses; small ports; educational, technological and
industrial complexes; and their settings and landscapes with notable historical and
cultural significance.

In view of the mandate and policy of the State provided under Sections 15 and 16 of the
1987 Constitution to conserve, develop, promote, and popularize the nation's historical and
cultural heritage and resources, all Regional Offices, District Engineering Offices, Project
Engineers, and Offices of the Building Officials are hereby required to:
1. Consult and coordinate with the National Commission for Culture and Arts
(NCCA) in conducting feasibility studies for the design. Improvement or
Implementation of the Infrastructure projects that may affect any Cultural
Property as defined and enumerated under Republic Act No. 10066,
otherwise known as National Cultural Heritage Act of 2009, and its
Implementing Rules and Regulations; and
2. Comply with the directive under Section 32 of R.A. No. 10066 to consult,
coordinate, and work closely with the NCCA and National Cultural Agencies
(NCA) regarding any construction, renovation, retrofitting or demolition
activities that may affect the Integrity of historical and cultural sites under
Its jurisdiction.
For this purpose, all Building Officials, Project Engineers, and Implementing Offices are
directed to consult and coordinate with the NCAA and other NCAs, priOr et any
issuance of permits/certificates for any proposed construction, renovation, re^fitting
or demolition activities that may affect the integrity of historical and cultural sites or any
adjoining historical or cultural sites.
Appropriate sanctions will be taken against those who fall to comply with this directive.
