TENANCY AGREEMENT

BETWEEN

SALAMI SULAIMON IKPEMOSI


(LANDLORD)

AND

OLOLADE ADERONKE SARIYU (MRS)


(TENANT)

IN RESPECT OF THAT MINI FLAT SITUATE AT 16,


BELLO STREET, LADIPO, 102214, OSHODI, LAGOS

Salami Sulaimon Ikpemosi, of No 16 Bello Street, Ladipo, 102214, Oshodi,


Lagos State, Nigeria (Hereinafter called the “LANDLORD” which expression
shall where the context so admits include his Legal and Personal
Representatives, assigns and successors-in-title) of the ONE PART.
AND

OLOLADE ADERONKE SARIYU (MRS) of 11, Igbobi-sabe street, jibowu,


yaba, lagos (hereinafter called the “TENANT” which expression shall where

the context so admits include his Legal and Personal Representatives, assigns
and successors-in-title) of the OTHER PART.

WHEREAS:

 The Landlord is the owner of the Mini Flat (A room and a Palor) Situate at
16, Bello Street, Ladipo, 102214, Oshodi, Lagos which the Landlord has
agreed to let and the Tenant has agreed to take same at a fix rent of
N600,000.00 (SIX HUNDRED THOUSAND NAIRA ONLY) PER YEAR.
 The Landlord and Tenant have agreed to observe the covenants herein
contained.

NOW IT IS HEREBY AGREED AS FOLLOWS:

 IN PURSUANCE of the said agreement and in consideration of the rent


herein reserved and the covenants on the part of the Landlord and
Tenant herein contained, the Landlord hereby let UNTO the Tenant A
unit of Room and Palor Situate at 16, Bello Street, 102214, Ladipo, Oshodi,
Lagos; (herein referred to as THE PROPERTY) TO HOLD same UNTO
the Landlord for A FIX period/term of TWO (2) YEARS (BEGINNING
FROM THE 15TH OF MAY. 2024 AND ENDING ON THE 14 TH OF
APRIL, 2026) The Rent date is liable to changes depending on when the
apartment is fully ready to live in, however, if the said apartment is not
ready within the period, tenant will be given an offer to choose from
other available apartment that is fully ready within the premises) at a
fixed rent of N600,000.00 (SIX HUNDRED THOUSAND NAIRA ONLY
PER ANNUM) payable in advance at the commencement of this
agreement, the receipt of which the landlord acknowledges.

THE TENANT HEREBY COVENANTS WITH THE LANDLORD AS


FOLLOWS:

i. To pay all charges electricity fees, and to ensure that all charges
applicable in respect of the said demised premises are promptly paid and
produce evidence of payment every 3 months or on the demand of the
LandLord or his agents.
ii. To pay for security charges and dues were necessary, of which all
occupants in the building are expected to pay for the entire security of
the building.

iii. To cooperate with other co-tenants in keeping the premises in good and
tenantable conditions and repair particularly by making arrangement for
the cleaning of the building and its premises regularly.
iv. Not to suffer or permit anything to be done in or around the demised
premises that may be annoyance to disturb or constitute a nuisance to the
landlord or that will interfere with the rights comforts or conveniences of
the neighbor and occupants of adjoining premises.
v. To use the premises only for residential purposes.
vi. To permit the landlord and/or his agents at reasonable times and on
giving not less than 72 hours notice to inspect the condition of dismissed
premises.
vii. Not to store any dangerous inflammable combustible goods such as but
not limited to petrol, diesel, gas) in the dismise
viii. Tenants and all persons in the compound should live peace and be
tolerant of each other, no physical assult or fighting, report cases as
appropriate to the landlord or relevant authorities.
ix. All facilites should be maintained and compound should be kept clean,
any breakage or damages should be replaced with same quality or
material and high standard of workmanship.
x. All tenant will be required use the assigned area such as the compound
lobby at the roof top, the backyard, inside your flat for laundry and
drying purposes without trespassing to other compound for this
purpose.
xi. Not to assign, sub-let, charge or part with the possession of the demised
premises or any part thereof or carry out any alteration in the apartment
without obtaining previous consent from the Landlord.
xii. To keep the exterior and interior of the apartment and all out-binding in
good and tenantable condition, so as to deliver same up at the expiration
of the term of the tenancy in a very good state.
xiii. To maintain standards of sanitary conditions conformable with the
standard obtaining in the neighborhood.
xiv. Not to make any alteration in the property that will substantially affect
the structure of the apartment without seeking the permission and
consent of the Landlord in writing
xv. To co-operate fully with other tenants and/or occupiers of the building
within the compound in the security arrangement and other necessary
incidental matters thereto.
xvi. The Tenant shall be responsible and pay for the cost of any feasible

damages to the apartment caused by him or dependents.
xvii. To keep the let property including the fixtures, fittings and other
conveniences constituting the demised property in good and tenant-like,
repair and condition (fair wear and tear excepted) throughout the term
hereby granted, and to replace any damaged or missing fittings or
fixtures caused by him.
xviii. To use the demise property for a fixed period of two year after which
the tenancy automatically expires.
xix. After the expiration of the tenancy and the tenant refused/neglect or fail
to deliver up possession, the tenant shall pay to the Landlord the sum of
N3,000 (THREE THOUSAND NAIRA) per day as mesne profit until
delivery of the demise property is given up.
xx. Either before or after the expiration of this tenancy, the tenant is desirous
of renewing the tenancy for further term, the tenant shall give notice to
the Landlord or his agents of his intention to renew tenancy for further
term 30 days before the expiration date.
xxi. At the renewal of the tenancy, parties shall draw and execute a new
agreement before the commencement of new term. However, where a
new tenancy agreement is not drawn before the commencement of a
further term, this agreement shall regulate the tenancy pending when a
new tenancy agreement is draw. FOR THE AVOIDANCE OF DOUBT,
THIS TENACY CYCLE SHALL COMMENCE AT THE BEGINNING
OF YOUR 2 YEARS RENT PAID, AND EXPIRE AT THE END OF THE
RENT.
xxii. To peaceably yield up the let property to the Landlord or his Agents at
the expiration of the tenancy.
xxiii. To agree with the landlord that the interior of the each flat will not be
painted and the interior roof will not contain Plaster of Paris (POP).
xxiv. In case of fire or other accident caused by the tenant, the tenant will take
full responsibility of all damages caused.
xxv. In case of natural and un-natural disaster such as fallen fuel tankers,
heavy flooding, landslides, global diseases like Covid-19, soil / coastal
erosion, oil spillage, gas linkage, explosions sand-storms or other under-
ground disaster that leads to foundation slides, structural defect, human
life risks, the landlord will not be responsible for such incidence. If the
structure is not livable or collapse, the tenant will be ready to wait for the
entire stated duration that will be required to renovate or rebuild the
structure to a livable state before he/she can continue his/her rent in the
building, rent refund will not be provided to the tenant.
xxvi. The structure was approved by Lagos State Physical Planning Permit
Authority (LASPPPA), Incase of any governmental laws that leads to
sealing or rebuilding the said apartment, the tenant shall be ready to wait
for the stated duration that will be required to renovate or rebuild the

structure to a livable state before he/she can continue his/her rent in the
building, rent refund will not be provided to the tenant.
xxvii. If the tenant is not fully comfortable with the apartment or the full
agreement stated above, he or she is required to request for an immediate
refund and must not sign the agreement.

xxviii.Signing the agreement means you have read the agreement or the
agreement has been translated to you in your local language, understood
the agreement, fully comfortable with the structure and flat.

xxix. If the tenant changes his/her mind on an apartment after the agreement
has been signed and want a refund, he/she should be ready to wait till
another tenant rent the apartment that you occupy, the rent duration will
not be paused during this wait, agreement and commission fee will not
be refunded, only the calculated remaining rent will be refunded after the
new tenant has made his/her payment and has signed his/her
agreement.

THE LANDLORD HEREBY COVENANTS WITH THE TENANT AS


FOLLOWS:
i. That the Tenant paying the said rent and performing the covenants on his part
herein before contained, shall peaceably hold and enjoy the property during
the said term without any interruption by the Landlord or any person
claiming from, under or in trust for him.
ii. Not to withhold consent reasonable sought by the tenant herein
iii.That before the expiration of the tenancy to give ONE-MONTH NOTICE to
deliver vacant possession. Such notice shall be sufficient for recovery of
possession of the demise property. This agreement obviates the
requirement of statutory notices.

IN WITNESS OF WHICH the parties have executed this Agreement in the


manner below, day and year first above written.
