Case #2023-148870

Upon arrival, officers located two victims, a Dean at East


High School, and a DPS Security Officer, who each
sustained multiple gunshot wounds. Both victims were transported to DHMC in critical but
stable condition. was shot in the chest and the leg, while was shot
twice in the shoulder.

FAST responded the scene, which was processed along with the Crime Lab, during which four
(4) spent 9mm cartridge casings were recovered from inside room 129 of the school.

FAST was able to interview one of the victims, . He said that he responded to a call
for help in room 129 and saw that the suspect, later identified as Austin LYLE (DOB:
08/31/2005), who is a student at the school, had just shot . The suspect then shot
, before fleeing the school on foot. The suspect returned to his car, a 2005 Red
Volvo XC90 with Colorado License Plate , and was last seen on surveillance footage
fleeing the area in the vehicle.

FAST was unable to interview , as he was rushed into surgery at the hospital.
Responding officers were able to briefly speak with him and prior to surgery,
where they learned that the suspect was brought into room 129 due to a school safety plan
currently in effect due to prior weapons complaints made against him. Once in the room, the
suspect produced a handgun and shot three times.

An arrest warrant for the suspect was authored by FAST, which was immediately provided to the
Fugitive Unit and SAFE Streets.

At approximately 4:15 p.m., Detectives were notified that the suspect vehicle had been found at
a trailhead in Bailey, Colorado by a Park County Sheriff Deputy patrolling the area. The
trailhead was located on Colorado Road 68 (Wellington Lake Road) several miles off highway
285.

Park County Sheriff’s Office requested additional resources from Jefferson County SWAT,
Arvada Police K9, ATF, Safe Streets Task Force, and the FBI.

The suspect vehicle was cleared by Jefferson County SWAT and Mr. LYLE was not inside.
Footprints were located in the snow leading from Mr. LYLE’s vehicle into the forest. A search
team was formed with Arvada Police K9, and Jefferson County SWAT and they began to search
the area.

At approximately 8:09 p.m., the search team found a deceased male along a ridgeline. The male
had an apparent self-inflicted gunshot wound to the head and was wearing a green hoodie and
blue jeans. The male was later identified by the Park County Coroner as Mr. LYLE.

INVESTIGATIVE CHRONOLOGY:

On March 22, 2023, at approximately 9:48 a.m., the Denver Police Department’s
Communication’s Bureau received a call of a shooting at 1600 N Esplanade Pkwy (East High
School). Please refer to the Administrative Report Section of this report for additional. (DEK)

At approximately 9:50 a.m., Detective BAKER while assigned to the Firearm Assault Shoot
Team, was monitoring radio traffic and learned of a possible shooting at East High School, 1600
N Esplanade Pkwy. (BWB)

At approximately 9:52 a.m., responding officers confirmed this incident was a shooting.
Detective BAKER notified Sergeant Troy BISGARD of this incident, who assigned Detective
BAKER to gather intelligence on the suspect. Please refer to the Administrative Reports and
Suspect Information sections of this report for additional. (BWB)

At approximately 9:54 a.m. officers arrived at the location and found the victim. Please refer to
the Victim Section of this report for additional. (DEK)

At approximately 10:00 a.m., Detective KEETON, while assigned to the Firearm Assault Shoot
Team, was called out by Sergeant Troy BISGARD and assigned as primary investigator in this
case. Detective KEETON responded to DHMC. (DEK)

At approximately 10:00 a.m., Detective Katherine URBINA, while assigned to the Firearm
Assault Shoot Team, was called out by Sergeant Troy BISGARD and assigned as secondary
investigator in this case. Detective KEETON responded to the hospital. (KU)

At approximately 10:20 a.m., Detective URBINA arrived on scene. For additional information

At approximately 11:38 a.m., Detective BAKER electronically forwarded a DPD252 (Attempt


to Locate) to the DPD NCIC Unit for entry into law enforcement records. A copy of the
DPD252 is attached to this case file. (BWB)

At approximately 5:26 p.m., Detective URBINA responded to a secondary scene located in


Bailey, Colorado. For additional information refer to the Crime Scene Section of this report.

At 9:20 p.m., Mr. Lyle’s vehicle was towed from the trailhead on CR 68 to 1371 Cherokee
Street by Big Red’s Towing. Detective URBINA followed the vehicle to Crime Lab Bay 1 and
arrived at 10:28 p.m. Please refer to the Crime Scene section of this report. (KU)

On March 28, 2023, at 8:30 a.m., Detective URBINA went to the Park County Sheriff’s Office
to collect evidence in this case. (KU)

CRIME SCENE:

On March 22, 2023, at approximately 10:00 a.m., Major Crimes Division FAST Detective
URBINA, 13022, was notified by Major Crimes Division FAST Sergeant BISGARD 98009 of a
shooting at East High School located at 1600 City Park Esplanade, which is in the City and
County of Denver, State of Colorado. Sergeant BISGARD indicated two victims were
transported to Denver Health Medical Center by ambulance. One victim sustained a gunshot
wound to the chest, another gunshot wound to the leg and a graze wound to the abdomen. The
second victim sustained a gunshot wound to the chest. Major Crimes Division FAST Detective
URBINA responded directly to the scene.

At approximately 10:20 a.m., Detective URBINA arrived on scene. The outside of the building
was secured with marked Denver Police cars, yellow crime scene tape was placed at East 16th
Ave and City Park Esplanade; both north and south bound, preventing any vehicle or foot traffic
in front of the building. The scene was located inside the school, on the first floor in Room 129.
The north side of the hallway was secured with yellow crime scene tape, a metal security gate
and Officer Kaylan CAMPBELL 18022 was standing in place securing the scene. The south side
of the hallway was secured with yellow crime scene tape and Technician Amanda GRODMAN
17005 was standing in place securing the scene. Room 129 was the second doorway along the
west wall, just north of the main entryway to the school. The door to Room 129 was a dark
colored wooden door that was propped completely open with an orange handled screwdriver.
The room number was printed on the wall to the left of the door in red paint. Officer Joseph
SIEMER 08008 was standing outside of the door securing the scene.

Detective URBINA observed the crime scene location. The scene was located inside of Room
129 which is a small office or conference room. The room consisted of a large conference table,
several chairs, boxes of school supplies, a small refrigerator and a bookshelf. Large windows
lined the west wall and brown radiator spanned the west wall just below the windows. A small
supply closet with a brown door was positioned along the west wall and a conjoined door was
positioned on the south wall that led to faculty offices in Room 128.

Detective URBINA saw evidence of a physical fight inside the room. The conference table and
two chairs with red upholstery were pushed against the bookshelf on the north wall. The
conference table was crooked and not straight. There were no chairs on the other side of the table
and several chairs were crowded together at the ends of the table. A clear plastic cup with a small
amount of a purple smoothie was laying on the ground near boxes of school supplies stored near
the supply closet. Most of the smoothie was spilled on the carpet in front of the conjoining door.
The smoothie was not pooled in a circle, rather, spilled in a long swath approximately two feet in
length. A footprint impression was observed in the smoothie.

Detective URBINA saw four 9mm casings laying in the middle of the room, between the
conference table and the conjoining door. A large amount of blood was located on the floor near
the radiator and a bullet was lodged in the floor in the middle of the blood. There was a bullet
hole in the lower part of the radiator next to the blood on the floor.

Detective URBINA contacted Sergeant Nathan BEIRIGER 06070, who related


was in the process of patting-down Mr. LYLE and that the pat-down was part of Mr. Lyle’s
safety plan with Denver Public Schools. During the pat-down, and Mr. LYLE
got into a physical fight. During the fight, Mr. LYLE shot in the chest, leg and
abdomen. called for help on his radio and ran into the office.
When entered the room, he was shot by Mr. LYLE in the chest. Mr. Lyle grabbed
his backpack and ran from the office. Mr. LYLE fled through the front doors on the west side of
the building, then northbound on the school property.

Detective URBINA contacted Officer Francisco ALBA 14016, who was the first Officer on
scene. Officer ALBA arrived to find paramedics already at the school on an unrelated medical
call in Room 130. Officer ALBA entered Room 129 and found laying on the
floor next to the radiator and bleeding from his stomach and left leg. Officer ALBA saw
laying on the floor next to bleeding from the chest. A student,
was sitting on the floor next to and was not injured.

Officer ALBA helped lift onto a gurney and then helped left onto a
second gurney. Officer ALBA spoke to who stated she was in the Nurse’s Office
(Room 130) experiencing an allergic reaction and Denver Paramedics were tending to her.
was concerned that she was going to go into anaphylactic shock from her allergic reaction
when someone came into the room and told the paramedics two people were shot in the next
room. The paramedics brought into Room 129 with them so they could monitor her
condition while treating the victims. did not witness the shooting or hear any
gunshots.

At approximately 11:00 a.m., Criminalist (CR) Kylie VERDOROSA 19090, CR Thomas


GIANNASCA 13043, CR Benjamin PALMER 19091 and Supervisor Marci TREFZGER arrived
on scene. The scene was photographed, videotaped and scanned with the FARO imaging
machine. The following items were collected as marked in the crime scene:

in Denver, Colorado. Detective URBINA arrived at the Crime Lab at 10:28 p.m. and the vehicle
was secured in Bay 1.

Detective URBINA cleared the scene at 11:30 p.m.

On March 23, 2023, at 12:30 a.m., Detective URBINA was notified by Coroner KINTZ that the
deceased male was positively identified as Mr. LYLE. Coroner KINTZ stated Mr. LYLE had
died of a single gunshot wound to his head. The bullet entered Mr. LYLE’s right temple and
exited out the left temple. One 3D printed handgun was recovered near Mr. LYLE’s body, and a
set of car keys were found on his person.

At approximately 12:00 p.m., Detective URBINA authored a search warrant for the suspect
vehicle and the warrant was signed by the Honorable Judge Renee A. GOBLE at 1:52 p.m. At
2:10 p.m., Criminalist (CR) Thomas GIANASSCA 13043, CR Kylie VERDEROSA 19090 and
CR Bill MCCLELLAND 14018 responded to Bay 1 to process the vehicle. The following items
were marked and collected as evidence:

Detective URBINA completed a Return and Inventory and left a copy, along with a copy of the
search warrant, in the glovebox of the vehicle. At 3:45p.m., the vehicle was towed by Extreme
Towing to the Denver Police Impound.

Detective URBINA cleared the scene at 3:50 p.m.

On March 28, 2023, at approximately 8:30 a.m., Detective URBINA went to the Park County
Sheriff’s Office located at 1180 CO Rd 16, Fairplay, Colorado 80440. Detective URBINA
arrived at approximately 10:00 a.m. and met with Evidence Technician Frank JONES (#9312).
Mr. JONES produced evidence found at the site Mr. LYLE’s body was found and gave the
following to Detective URBINA:

At 11:00 a.m., Detective URBINA went to the Park County Coroner’s Office located at 911
Clark Street in Fairplay, Colorado 80440 and met with Chief Deputy Coroner Don
COMSTOCK. Detective URBINA collected the following items:

Detective URBINA cleared the Coroner’s Office at 11:30 a.m. and arrived at the Denver Police
Department’s Property and Evidence Bureau at 1:45 p.m. Detective URBINA placed the green

hoodie, blue pants, white tennis shoes, socks and underwear into drying room number 6
(Property Numbers 1328423: 1-8). Detective URBINA photographed the clothing and uploaded
the photos to the case.

This concludes Detective URBINA’s involvement, nothing further. (KU)

On March 23, 2023, at approximately 11:00 a.m., Detective KEETON arrived at East High
School. Detective KEETON contacted school staff who showed Detective KEETON to room
129. Detective KEETON then did a walk through of the area and noticed several cameras near
the room 129 that potentially captured the suspect coming and going. Detective KEETON verify
with Detective URBINA that all the cameras were uploaded to evidence.com. Camera V14 was
not uploaded, and staff was sent another link to upload the video footage. At approximately
12:25 p.m., Detective KEETON left the location.

Detective KEETON reviewed the DPS video footage and learned the following (all times listed
below are approximate):

Park County Sheriff Office

On April 14, 2023, at approximately 10:30 a.m., Detective KEETON requested the Park County
Sheriff’s Office (PCSO) report related to Mr. LYLE.

On April 17, 2023, at approximately 9:32 a.m. (CAD notes) and 2:22 a.m. (report), PCSO left a
message requesting a call back.

On April 18, 2023, at approximately 2:00 p.m., Detective KEETON contacted Park County
Sheriff’s Office Records (Robin) via phone number 303-816-5908. Detective KEETON was
advised to send an email to the records unit to request the report. Detective KEETON sent an
email ([email protected]) requesting the report at approximately 2:04 p.m.

On April 18, 2023, at approximately 2:15 p.m., Detective KEETON sent an email to PCSO
dispatch requesting the CAD notes.

On April 19, 2023, at approximately 2:34 p.m., Detective KEETON received the Park County
Sheriff’s Office Report (S23-0152) via email from PCSO Record Manager Robin BODE. The
report was attached to this case.

On August 20, 2023, at approximately 2:11 p.m., Detective KEETON received the Park County
Sheriff’s Office CAD notes from maria MITCHELL. The CAD notes were attached to this

On March 24, 2023, at approximately 3:30 p.m., Detective KEETON contact


via phone number . advised Detective KEETON that he was
taking several East High School students out of thew country for Spring Break and wouldn’t be
around the following week to complete an interview.

On April 10, 2023, at approximately 11:57 a.m., Detective KEETON contacted


via phone number . agreed to be interviewed on
April 10, 2023, at 4:15 p.m.

On April 10, 2023, at approximately 4:24 p.m., arrived at Denver Police


Headquarters to complete an interview with Detective KEETON. At approximately 4:38 p.m.,
Detective KEETON completed an interview with in interview room 304D.

reported that Mr. LYLE began school at East High School on January 13,
2023. Prior to enrolling a meeting was conducted with a high school counselor. After a meeting
with a counselor the staff learned that Mr. LYLE was expelled from Overland High School for
trying to sell a gun and ammunition (Safe to Tell tip). During that investigation Mr. LYLE’s
mother located a gun, ammunition, and a medical kit in Mr. LYLE’s room. Aurora Police
Department responded and completed a report and Mr. LYLE was charged accordingly.
Overland High School provided East High School with transcripts (grades) and discipline
history. LYLE attended a school in Florida prior to attending East High School and they
provided transcripts and noted no behavior issues. A threat assessment was completed (school
staff and Mr. LYLE’s father was present), and it was determined that Mr. LYLE would meet
with prior to going to his first class each day, to complete a verbal check in. Its
also important to note that stated that Mr. LYLE’s father
search his son every day for weapons.

On March 02, 2023, students reported to Mr. LYLE’s mother that Mr. LYLE removed a gun
from his backpack and placed it into his pocket while in class. School staff contacted Mr. LYLE
and explained to him that a search was needed due to a student making a complaint about him
possessing a weapon. Mr. LYLE initially complied with the search emptying the contents in his
backpack and pockets. After taking the items out of his pocket Mr. LYLE placed the items back
into his pocket and became hesitant with continuing with the search and walked out the office,
eventually leaving the school. Mr. LYLE father was contacted and advised of the incident and
another meeting was requested.

That following Monday (March 06, 2023) a meeting was conducted, and it was determined that
would search Mr. LYLE prior to going to his first class. During the meeting
Mr. LYLE’s father stated that he would search his son prior to going to school and noted that his
son didn’t have access to firearms.

Out of the 12 days prior to the shooting noted that no searches were completed
on two days. One day because he believed Mr. LYLE wasn’t present at school and the other day
when he was working backdoor duty and Mr. LYLE showed up late, so he completed a verbal
check in.

wasn’t sure if he had any training related to searching students, but stated he
never received a certification for any training related to searching students.
also related the following regarding the Support Plan (safety plan) for Mr. LYLE. No Campus
Safety Officers were present due to Mr. LYLE’s prior history with Overland High School
Campus Safety Officers, and no waistbands were checked due to completing the searches alone.
The staff at East High School believed this process was the safest for all involved.

During the incident was inside the auditorium when he heard the lock down
tone. went to the hallway and noticed DPS Campus Safety Officers with their
guns out. AT that moment learned that two staff members were shot. The
interview was concluded at 5:17 p.m. (DEK)

On April 11, 2023, at approximately 12:30 p.m., Detective KEETON responded to East High
School and gave an Apple iPhone (1327315-7) that was property of the high
school.

On April 14, 2023, at approximately 8:52 a.m., sent Detective KEETON Mr.

The information provided to me through the investigation is that Lyle has a Threat Assessment
and Safety Plan in place to the point that it requires Lyle to be searched by school staff every day
he responds to school. It should be noted, in the first week of March,
had called for help because a student had fled when he was going to get contacted for a
search. That student from the beginning of March and today's suspect is the same person. The
same person who has a history of running from administrative staff when conducting the Safety
Plan on Lyle. Today, Lyle was contacted at the front doors of the High School and escorted to
room #129 where the search was scheduled to take place. While in room #129, stated to
Lyle that he was going to search Lyle's person and backpack and a wrestling match ensued
between the two. asked for help on the school radio and began running to room
#129. As and Lyle were still wrestling with each other, Lyle pulled a handgun and shot
. When walked into the room, Lyle shot in the chest. Soon after, Lyle
fled the school with his backpack wearing blue jeans, a greenish colored hooded sweatshirt with
an astronaut logo on it. The school was then placed on a lock down.

Among the many officers and many agencies, East High School students were moved throughout
the school and later facilitated in the Egress of all the students for the re-unification with family.

At this time, there is an active warrant for Lyle's name for attempted murder X2. Lyle has yet to
be apprehended.

On 03/22/23 at approximately 0950 Hrs while working partner car 191A with Officer Grodman
(17005), I Ofc Campbell (18022) responded to East High School located at 1600 N City Park
Esplanade reference a Shooting. This location is in the City and County of Denver, State of
Colorado.

Dispatch aired information for an active shooter situation where two victims were shot inside the
school. The suspect was said to have fled in an unknown direction. It was aired for cover officers
to respond city wide.

Ofc Grodman and I responded to the scene. Upon arrival, I observed a female being transported
on a stretcher to the back of a DHMC ambulance. Denver Fire and Paramedics on scene related
she was not a victim of the shooting. Paramedics were responding to the school for an unrelated
medical issue for this female when the shooting occurred.

I then went inside the front doors of the school where I learned the shooting occurred in room
129, which connected to room 128. I observed officers both ends of the hallways with perimeter
tape. Ofc Grodman and myself assisted in clearing classrooms to the room south of room 128. I
was provided a master key to the building from a staff member. At this time, I learned the
suspect was identified as Austin Lyle (08/31/05).

I then took post on the northernmost part of the hallway to provide scene security. While there, I
escorted the school nurse identified as into the nurse's office for student's
medication. Sgt McCluskie stood by while I escorted . I was then informed by staff
members that approximately 4 students were hiding in room 123. I used the Master key to unlock
the office door and escorted the group from the building through the southeast exit doors. Sgt
McCluskie covered my post during this time as well.
I then remained in position until relieved at approximately 1300 Hrs. The master key was given
to the on scene detective.

A search was conducted for video at the intersection of Hwy 285 and County Road 68. A
restaurant, was found to have exterior
video. Camera 13 at the location provides a clear view of traffic driving eastbound on CR 68
from Hwy 285. The video system records motion for the exterior camera, the time on displayed
on the live system is approximately 3 minutes behind actual time. Sgt Eric Denke reviewed the
video and was able to observe a maroon SUV consistent with the 2005 Volvo XC90 suspect
vehicle passes the camera at 10:58 (DVR time) directly behind a semi-tractor trailer empty
logging truck. A review of the motion captures following that time did not show the vehicle
return. The video was downloaded, unable to be shared to Axon digitally, onto a USB drive.
The downloaded content was the motion video for the date of 03/22/2023 with the time period
from 10:30 to 16:00.

On 03/22/2023 at 0950 hours, while working partner car 191A with Technician Kaylan
Campbell (18022), in full uniform and driving an unmarked patrol vehicle, we responded to East
High School, 1600 N City Park Esplanade, on a report of an active shooter.

When we arrived on scene, we started towards the front doors of the school. At that time,
paramedics were walking out with a young woman on a stretcher. They explained to me that this
female was completely unrelated to the shooting, and that paramedics had already been on scene
for a different call involving the female when the shooting came out and that the involved
victims had already been transported. Initially, our plan was to follow the ambulance to the
hospital, but since it was determined that she was unrelated we made entry into the school
instead. We assisted with clearing the classrooms throughout the hallway south of the front
doors, then assisted with putting up crime scene tape. The scene was located in a room off of that
hallway, so I remained on the southernmost end to keep the scene secured. I remained at that
post until I was relieved around 1300 hours.

reference to two people being shot inside of the school. Information from witnesses on scene
related to 911 Dispatch that the suspect was a teenaged black male known to school staff as
Austin Lyle 08/31/05. Denver Health Medical personnel arrived with responding Denver Police
Officers. Two victims were located and identified as and
, who were transported to the Denver Health Medical Center (DHMC) for multiple
gunshot wounds. Denver Police Department SORT Detectives responded to DHMC shortly after

On March 22, 2023, Detective Tana Cunningham #16053, interviewed at Denver


Health Medical Center in an emergency room who told her that on today's date, Austin arrived
on school grounds at approximately 9:40 hours. at East High School,
, was sitting at the front desk at the entrance to the school. related to
Investigators that he saw a student walk in the front doors. did recognize this student but
could not remember his name. He described the student and suspect as being a light-skinned
black male, with a short afro hair cut and wearing a green hooded sweatshirt and black pants.

for assistance over their radios and responded
and took the student to Room 129 on the first floor.

A few moments later, heard asking for help over the radio and went to Room 129
to assist. When opened the door, he saw the student, who was later positively identified
as Austin Lyle 8-31-2005, struggling over a firearm with related that
yelled out that Lyle had a gun. attempted to assist in detaining Lyle and at some point
during the struggle, Lyle was able to get away, pointed a green / grayish in color handgun and
fired multiple times at . fell to the ground and Lyle then turned and fired at
at least two times, striking him in the chest. After and were shot,
reported Lyle stood over the two of them and he believed Lyle was going to shoot them again.
Lyle then backed away and fled on foot in an unknown direction. related that both he and
were the only parties in Room #129, along with the student who shot them. At this point
in time, did not know the student who shot him by name but told Detective Cunningham
that he could pick him out of a crowd of thousands of people.
Responding Officers and Investigators located several spent 9mm shell casings inside of Room
#129, where the attempted murder occurred. Information was given to responding officers who
located the address of Lyle's father, , which was 10 N Elizabeth St . Officers
arrived at this address at 0958 hours. Officers were able to hold the door and did not observe
anyone enter or exit this residence. This address is also the same residence that officers
responded to on March 2, 2023 in reference to Lyle possibly having a firearm. At 1039 hours,
Sergeant Ethan Antonson #05031 sent Detective Hall a photograph of the rental application from
12/15/22 for one year in tenancy for apartment number , at 10 N Elizabeth St, Denver,
Colorado 80206. The listed residents are noted as his son Austin Lyle and
. It is also noted on the rental application that a listed vehicle described as a
Volvo XC90, is related to the apartment.

Based on the above information, Detective Hall authored a search warrant for the residence of
Lyle at 10 N Elizabeth St. for any possibly related evidence that pertains to this incident.
At 1350 hours, The Honorable Judge Tanya Wheeler signed the Search Warrant and Affidavit in
Support of Search Warrant for the residence. FAST Detective Joshua Catlett and Homicide
Detective Ernie Sandoval along with personnel from the Denver Police Department Crime Lab,
searched the residence.
Detective Hall forwarded the search warrant and affidavit in support of search warrant via email
to Detective Catlett for the report.

At the time of this report, the suspect Austin Lyle is at large. Lyle was last seen driving a red
Volvo XC90.

On March 22nd, 2023, at approximately 9:50 a.m., while assigned to the Denver Police Firearm
Assault Shoot Team (FAST), Detective Andrew Landon 13077 was monitoring the radio when
Denver 911 aired a shooting at East High School, located at 1600 N Esplanade Parkway.
Sergeant Troy Bisgard directed Detective Landon to respond to the school to assist with scene
management and investigative resources for command staff on scene.

At approximately 10:15 a.m., Detective Landon arrived on-scene and coordinated with
responding officers in securing the scene for processing at a later time. Detective Landon
assisted command staff in obtaining information for the suspect, who was identified as a student
of the school. Detective Landon obtained phone numbers for the suspect's parents, as well as the
suspect, from school administrators and provided this information to the coordinating command
officer at the scene.

Detective Landon was relieved by Detective Katherine Urbina, who took control of the scene
and coordinated its processing with the Denver Crime Lab. Detective Landon was directed to
respond to the suspect's listed home address, at E 11th Avenue and N Elizabeth Street, to
coordinate with SORT officers that were with the suspect's father.

Detective Landon arrived at the residence, which was secured by SORT and SWAT officers
pending a search warrant. Detective Landon spoke with the suspect's father on body worn
camera several times in an attempt to obtain additional information about the suspect's
whereabouts, such as friends, family members, or acquaintances he associates with. The
suspect's father was uncooperative with Detective Landon and provided minimal additional
information to Detective Landon at this time. Detective Landon was advised the search warrant
for the apartment was being drafted by SORT detectives, therefore, Detective Landon cleared the
address and responded to Denver Police Headquarters to meet with Detective Derrick Keeton,
who was assigned as the primary detective in the investigation. All relevant information obtained
by Detective Landon was provided to Detective Keeton for further investigation.

On 3/22/23 at about 0950 hours while working car 612D I (Logue 14027) responded to reports of
a shooting at 1600 N City Park Esplanade (East High School). Upon arrival dispatch aired that
the suspect had left out the West doors 10-15 minutes prior. I activated my BWC and entered
the building. I was quickly handed a paper with the suspects info (Lyle, Austin 8/31/05) by a
DPS officer. I then checked in with officers near the scene and was asked to get scene tape and
statements for possible witnesses. Once I retrieved those, I assisted in securing the hall with tape
and clearing additional rooms in the same hallway as the incident.

I was then asked by Mall 14 (Tinnin) to transport a potential witness


to police HQ to speak with Detectives. I transported him to the 2nd floor where he spoke with
Major Crimes detectives. <all 14 had already completed a video statement with I
transported him to the 2nd floor of HQ and waited while he talked with Detectives. He and
another witness then stated they had a friend in the lobby that would give them a ride and did not
need transport back to the school. Once I ensured they met their friend I completed this

On 093/22/23 at approximately 1000 hours, while working partner car 694D with officer Briggs
13089, I responded as cover to 1600 N City Park Esplanade (East High School) on a call of a
shooting. This location is in the City and County of Denver; State of Colorado.

Upon arrival, Dispatch aired out a suspect description of a black male student (with an afro hair
style and wearing a green sweatshirt with an astronaut print on the front). Officer Briggs and I
searched the area in City Park. Over by the tennis courts, We saw a black male wearing a hoodie
by the tennis courts. As We approached the male, I saw that the male was much older than high
school age and did not match the suspect description.

While searching the area, another call at 2001 N Colorado Blvd (Museum of Nature and Science)
came out. The call notes read that security saw a potential suspect sitting on the southwest pad in
City Park by the Museum. The call notes had the description of a unknown race male (20s,
unknown build and last seen wearing a green sweatshirt and Jeans.) Officer Briggs and I checked
the area and was unable to locate anyone matching that suspect description. Officer Briggs and I
then went to check the security cameras for the Museum. The footage was blurry and I was not
able to see any suspect in the footage.

I then went back to the front parking lot of the school to check for a Silver Chevy Malibu that
was aired as the suspect's vehicle. After checking the lot, I did not locate any silver Chevy
Malibus.

On March 22, 2023, at approximately 10:35 a.m. Detective McIver was informed there was a
shooting at East High School; 1600 N. City Park Esplanade where two parties were shot. There
were two witnesses that were brought to headquarters for follow up interviews.

Detective McIver responded to the 2nd floor hallway at Denver Police headquarters and met
briefly with each witness to get their names.

At approximately 10:46 a.m. while unarmed and in plain clothing, Detective McIver met with
the witness identified as , (hereafter referred to as ) while
unarmed an. was escorted to interview room 2 B for and audio/video recorded
interview. (It should be noted the recording system is currently inoperable) Detective McIver
utilized her Body Worn camera to conduct the voluntary interview. The video advisement form
was completed with . After the interview she was escorted back to the 2nd floor
hallway to the officers.

Detective McIver also accessed the Denver Combined Communication Center cad report and
located the EMS call that happened prior to the shooting.

At 11:22 a.m. Detective McIver was requested from Sgt. Lopez to obtain vehicle information
that was just aired for the suspect vehicle and to complete a Special Bulletin and a Crime
stoppers bulletin for the case.

Detective McIver contacted the communications bureau and was provided the license plate
number. Detective McIver accessed NCIC/CCIC to get registration information for the vehicle.

Detective McIver wrote a Special bulletin for dissemination to law enforcement statewide and
completed a Crime stoppers bulletin to be released to the public. Both of these were reviewed
and approved by Commander Matt Clark.

On 03/22/23 at approximately 0930 hours while working car 2z32 with Ofc Wickiser we were
responding to East Highschool on a report of a shooting. While enroot the shooting had been
confirmed and suspect identified by Victims as Lyle Austin Scott 083105 was seen leaving the
school. Information for the Suspect was that he lived at 10 N Elizabeth St Apt (in the City
and County of Denver state of Colorado.)

We began heading that direction in our fully marked DPD vehicle in full DPD uniform. We held
E 11th Ave/ N Elizbeth ST and secured the area around the complex. Once Metro was in place
and secured the door we stayed and held the parameter. At some point the father of the Suspect
came to the door and Metro called him out of the apartment and detained him. They
walked him outside to me and I took him to my squad car and sent him in the back.

Det Lashey talked with about what had happened with at the school and just kept
saying that it was all just a big plot between the school and DPD to have an excuse to kill his
son. was told he had called his son today before police arrival but said his son didn't
answer and had no idea where his son would go. then was told that a search warrant for
his house was underway and that his phone would also be collected for possible evidence with
Lyle.

did not feel we could legally hold his phone and get a search warrant for his house. I
instructed him that we could. was told he was free to leave but could not take his
phone with him or go back to his house. I told every hour on the hour that I would take
him anywhere but his house and drop him off, but he refused and then would continue about us
holding him against his will. He eventually agreed to be dropped off at E 11th Ave/ N
Pennsylvania St at around 1400 hours. In which I did and returned to the scene.

When the warrant was executed, Metro cleared the apartment and did noy find Lyle. I then
moved up to the door and held the door until detectives were done collecting evidence. Once all
evidence was collected, they decided phone was not needed and placed it inside of his
apartment. Later, that day I got a phone call from a man claiming to be attorney asking
about his phone and house I instructed them that police were done at the house and his phone
was inside of it.

Police District Six undercover Narcotics Unit I, Detective Raelene Norris, P14089 was requested

While in route to East High School, I was tasked with checking the general vicinity for the
suspected shooter.

The suspect description provided via radio was a light skin black male, with an afro type of hair
style wearing a green sweatshirt with an astronaut on the front. It was also related that the
suspected name was Austin Lyle, date of birth 08/31/2005.

Upon arrival, I completed a detailed check of City Park and completed a check around the
Denver Zoo and Denver Nature and Science Museum. All these locations are located across the
street from East High School.

Dispatch then advised that a neighbor at 15 Detroit St located a large amount of blood splatter
outside of the building, in the doorway leading up to an apartment.

Detective Traudt (Z653) and I responded to this location. Upon arrival, a large amount of blood
was observed outside the building and appeared to be some type of animal prints. Detectives
followed the blood trail to the second floor unit. Detectives made contact with the home owner
who advised he went for a jog with his dog the previous evening and his dog suffered a foot
wound. Detectives confirmed the dog injury and confirmed no other parties were inside and
injured.

short time later yelled on the two way radios that he needed help. ran to the
office and entered the room and saw wrestling with the student. said the student
had a gun. grabbed the student and he fired a gun two or three times.The shots struck
and then the student turned the gun on him.Two of the shots were directed toward me.
The student ran, turned as if to fire more shots, but did not. The student then ran away into the
hallway. told he was going to die. grabbed a towel and applied pressure to
wounds.

recognized the student, but could not remember his name. He described the suspect as a
light complected black male, 507-508, 160 pounds, with a short afro wearing a green hoodie.

Hospital staffed bagged clothing. I took custody of the items and placed them into
property. I met with Det Ernie Sandoval. A SBI form was completed and left for Dr Ellerman to
complete.

Network Investigations Unit. I responded to East High School, 1600 Esplenade Pkwy, reference
a shooting. DPD dispatch advised that two people had been shot in the classroom and the shooter
was outstanding. While enroute, Officers on scene identified the suspect as Austin Lyle
(DOB/083105). Austin was last seen leaving the school in a green hooded sweatshirt with an
astronaut on it. Austin's last known address is 10 N Elizabeth St Apt , which is nearby the
scene of the shooting. I responded to that address and upon arrival, provided outer containment
on the northwest corner in the 1000 Blk N Columbine/N Elizabeth Alley.

During the course of this investigation, Metro/SWAT arrived and maintained an inner perimeter
around and inside the building. I learned that Austin was associated to two vehicles, a maroon
Volvo XC70 and a Silver Chevrolet Malibu. I was put in touch with , who is a
manager at the apartment building with access to the security cameras. explained that the
cameras record and also detect motion. was familiar with the investigation thus far and
explained that the suspect's vehicle is generally parked on the north side of the building. I was
able to view surveillance footage and saw that the Volvo was parked on the north side of the
building as of 9am. I reviewed motion activations and found a party matching Austin's
description exiting building at about 0922 hours. The suspect is wearing a green hooded
sweatshirt with the hood up, blue jeans and wearing a black backpack. The suspect then walks
over to the Volvo and gets into the driver seat. The suspect is the only individual I could see
getting into the vehicle. The vehicle leaves the parking lot through the N Columbine St/N
Elizabeth St Alley at about 0925 hours.

reviewed footage until police arrived on scene and I did not see the vehicle or suspect return to

On 3/22/23 at appx 0950 hours, I (Officer WICKISER/19022) was working in a fully marked
DPD patrol car as 2Z32. I was dressed in full blue BDUs with Officer NICCUM (17051) as part
of D2's Placed Network Investigations Unit when we responded to a shooting call at East High
School, 1600 N City Park Esplanade.

While en route to the location, information was aired that the suspect was no longer on scene and
was likely en route to his address of 10 N Elizabeth, . 2Z30/Sgt Antonson aired he was
responding to the location and Officer NICCUM and I also decided to respond to the additional
address as well.

When we arrived on scene, we decided to stage at E 12th Ave / N Elizabeth St where METRO
and TAC units quickly arrived. Once the apartment was locked down, officers advised
exited the residence and was detained. He was identified as the suspect's
father. was placed in the back of our patrol car. He initially consented to another
officer attempting to call the suspect on his cell phone but it went straight to voicemail. I then
took the cell phone from until a detective was on scene.

FAST/Detective LANDON responded to our location to speak with . was


very uncooperative with him and only wanted to go back to his apartment, grab a jacket, grab a
wallet, get his cell phone. etc. eventually told the suspect he was free to leave but
LANDON refused to go anywhere else other than to his apartment for appx an hour or so.
Eventually, agreed for us to give him a ride to E 11th Ave / N Pennsylvania St.

METRO, TAC cars, and eventually detectives were able to obtain a search warrant for the
premises where they discovered the suspect was not at the location. Officer NICCUM then stood
by the front door while detectives completed the search while I remained outside to keep media
members from the scene. Once the search was completed, I handed cell phone to the
FAST detectives and we were cleared from the location.

School located at 1600 N. City Park Esplanade on a report of a shooting.

I arrived on scene and proceeded to room 129. From past calls at East High School, I knew this
to be an administration area and not a classroom. I entered the room and observed two adults
with what appeared to be gunshot wounds. Both victims were evacuated from the school by
EMS.

I then assisted with clearing classrooms and taping off the hallway where room 129 is located
with yellow crime scene tape.

I then assisted with clearing the student parking lot located northeast corner of E. 16th Ave. and
N. Josephine St. I remained in this area during the controlled release of students still inside East
High School who were placed on lock down following the shooting.
After all students were released from the school, I went back inside the school and assisted with
scene security until the scene was fully processed. I was then informed the crime scene could be
broken down.

On the date of 03-22-23 I was working a two officer car with Tac44 Officer A. Bolton 14026 we
were in a fully marked Denver Police SUV and wearing fully marked DPD BDU's. At
approximately 10:30 hours we responded to East High School on a report of a shooting where
there were at least two victims down. Several officers were already on scene and handling the
shooting scene. We responded to the area to search for the suspect that was described as a B/M
5-05 150 slight afro and wearing a green hoodie with an astronaut on it. The subject was
identified as Austin Lyle 08-31-05. This subject was advised to live at 10 N Elizabeth St with
his dad in apartment We were given the suspects vehicle description of a 2011
Silver Chevy Malibu with a TP. We searched the outer perimeter area to include City Park and
the Denver Zoo and Museum Of Nature and Science. No contact was made with the suspect
Lyle. We ran associates of Lyle and found his mother and information that she no
longer lived in the state and was currently living in Florida. We located a possible work address
of the suspect and checked 7 N. Colorado Blvd for his vehicle and the vehicle was
not located. We were giving the fathers vehicle description as a 2005 Maroon Volvo XC90
CO/PA We checked all the previous locations for that vehicle again and did not
locate that vehicle.
At approximately 13:45 hours I dropped off Officer Bolton at Disirict Six station for his
Corporal test and responded to 10 N Elizabeth St to assist SORT Detectives with a search
warrant at that location on apartment . I was uniform security for the Detectives and did not
enter the apartment. I stayed by the front door until released by FAST and Homicide Detectives.

On March 22, 2023, Detective BAKER completed a search of the suspect through records held
within the Denver Police Department.

Detective BAKER conducted a Query History and Query Rap Sheet search of the National
Crime Information Center for a criminal history and rap sheet of the suspect.

Detective BAKER conducted multi-agency searches of the suspect.

Detective BAKER obtained school records for the suspect and collected other records from law
enforcement databases, telephone databases, banking records, and driver history records.

Detective BAKER attempted to locate social media records for the suspect.

At approximately 1:14 p.m., a Special Bulletin was prepared and disseminated to local
jurisdiction and officers.

At approximately 1:38 p.m., a Crime Stoppers Bulletin was prepared and disseminated to local
jurisdiction and officers.

At approximately 1:42 p.m., a Fugitive Bulletin was prepared and disseminated to local
jurisdiction and officers.

At approximately 8:09 p.m., search team found a deceased male along a ridgeline, that was
believed to be Mr. LYLE. The male had an apparent self-inflicted gunshot wound to the head
and was wearing a green hoodie and blue jeans.

On March 23, 2023, at 12:30 a.m., Detective URBINA was notified by Coroner KINTZ that the
deceased male was positively identified as Mr. LYLE. Coroner KINTZ stated Mr. LYLE had
died of a single gunshot wound to his head. The bullet entered Mr. LYLE’s right temple and
exited out the left temple. One 3D printed handgun was recovered near Mr. LYLE’s body, and a
set of car keys were found on his person.

At approximately 12:23 p.m., Detective KEETON received an email from Major Crimes
Analyst Craig SPINGARN regarding an Englewood Police Department report (23-00374).

Department Report (2021-45096) and the protection order related to that case.

At approximately 10:20 a.m., Detective KEETON received the protection order and arrest

On April 10, 2023, at approximately 7:59 a.m., contacted Detective KEETON,


seeking to have his vehicle released. At approximately 11:21 a.m., Detective KEETON released
the vehicle and waived 16 days of storage fees.

On April 11, 2023, at approximately 1:41 p.m., contacted Detective KEETON


seeking additional fees be waived. Detective KEETON put an additional request in to waive
additional fees (Impound Fee Standard) associated to his vehicle. called two more
times (1:56 p.m. and 2:13 p.m.) regarding his vehicle.

On April 20, 2023, at approximately 10:39 a.m., Detective KEETON received information
Rocky Mountain Safe Streets Task Force and learned that no employment records from 2017-
2023 and no unemployment records were located for Mr. LYLE.

On April 26, 2023, at approximately 11:05 a.m., Detective KEETON learned that Mr. LYLE
worked at . Detective KEETON then called located at 7 N
Colorado Blvd via phone number . Detective KEETON contacted a store employee
who stated that the store owner was not available and would have him call Detective KEETO
back. At approximately 2:12 p.m., Detective KEETON received a phone call from the store
owner via phone number . The owner identified himself as
and stated that Mr. LYLE was employed with his business for approximately two and half
months and worked 20 hours a week. described Mr. LYLE as a hard worker and
very smart. was not able to provide banking information for Mr. LYLE, as
provided a check to Mr. LYLE when he paid him.

On June 28, 2023, Detective KEETON contacted Senior Criminal Investigator Teresa
WERTSCH of the Economic Crime Unit (Denver District Attorney’s Office) seeking assistance
with recovering any banking information related to Mr. LYLE.

On July 03, 2023, Investigator WERTSCH notified Detective KEETON that she did not locate
anything regarding Mr. LYLE banking information.

LAB REQUESTS AND RESULTS:

On March 23, 2023, Detective KEETON reviewed the firearms NIBIN entry report 23-01901. A
cartridge case (9mm) from this case was entered into the NIBIN system.

On April 12, 2023, Detective KEETON requested the Crime Lab complete the following
test/analysis.

Firearms Analysis on the following property 1327315-15 (cartridge case from High School
scene), 1328423-3 (cartridge casing recovered from Park County), and 1328423-1 (ghost gun).

On September 15, 2023, Detective KEETON received a Firearm Report related to the recovered
firearm (ghost gun) and cartridge casing recovered from Park County and the cartridge casings
recovered from the East High School scene. The report analysis and results are below:

Mechanical function examination of the pistol of item #1328423-1 disclosed that it is a


functional firearm. This firearm is consistent with a privately made firearm with a frame
produced using a 3D printer. This pistol was test-fired for cartridge case and bullet recovery
using a remote firing device and ammunition selected from laboratory stock and it did function
properly.

The test-fired cartridge cases and bullets were returned to property as item #1364655-1. The
fired cartridge cases, items #1327315-15 (A-D – East High School Crime Scene) and 1328423-3
(Park Count Crime Scene), were microscopically identified as having been fired in the submitted
firearm #1328423-1. For complete details refer to the report that’s attached in this case.

SEARCH WARRANTS:

Search Warrant: 10 North Elizabeth Street Denver, Colorado 80206

On March 22, 2023, at approximately 9:50 a.m., the Denver Police Department
Communication’s Bureau received a call of a shooting at 1600 North City Park Esplanade, which
is located in the City and County of Denver, State of Colorado. This a known address of the
suspect identified as Austin LYLE dob: 08/31/2005.

At approximately 1:45 p.m., Detective CATLETT arrived at the residence and met with
Detective SANDOVAL #06051 who was already on-scene. Detective CATLETT observed the
residence to be located in an apartment building on the West side of North Elizabeth Street and
North of East 10th Avenue. Upon arrival, the weather was clear, and the outside temperature was
approximately 43 degrees Fahrenheit. Detective CATLETT observed the entire apartment
building to be secured with fully marked Denver Police vehicles posted on the street and Metro
SWAT along with plainclothes officers posted around the building. All vehicular and pedestrian
traffic were restricted from access inside the perimeter and apartment building.

At approximately 1:50 p.m., Detective Dean HALL #0609 with S.O.R.T., secured a search
warrant for 10 North Elizabeth Street . The search warrant was reviewed by Denver
District Attorney Juan SILVA and signed by Honorable Judge Wheeler. See attached search
warrant for complete detail.

At approximately 2:06 p.m., Metro SWAT executed the search warrant and entered the
residence. The residence was cleared, and no contact was made inside.

At approximately 2:18 p.m., Detective CATLETT requested the Crime Scene Unit to process the
residence. Detective CATLETT entered the residence and noted the unit consisted of a kitchen
and dining area to the North, a centrally located bathroom and living area, and bedrooms to the
Southeast and Southwest of the residence.

At approximately 2:40 p.m., Criminalist (CR) GIANNASCA #13043 with the Crime Scene Unit
arrived at the residence. (CR) GIANNASCA collected photographs of the scene. After the scene
was documented in its sterile condition, CR GIANNASCA began marking and collecting the
items of evidentiary value.

Detective CATLETT noted the following items as evidence that was marked and collected:

Marker 1: Acer Laptop located on desk in the Northeast corner of the Southeast
bedroom.

Marker 2: Dremel tool, pieces of green plastic and sandpaper located on the desk in the
Northeast corner of the Southeast bedroom.

All items of evidence were collected by CR GIANNASCA and transported to the Denver Police
Department Headquarters and placed into the Property Bureau.

Detective CATLETT cleared the scene at approximately 4:05 p.m. (JEC)

On April 6, 2023, Detective KEETON drafted a computer search warrant for Mr. LYLE’s
computer. This search warrant was reviewed and approved by Denver Senior Deputy District

TERRY of the Forensic Computer Unit via phone number . Detective TERRY
emailed Detective KEETON the Rocky Mountain Regional Computer Forensic Laboratory
(RMRCFL) request for service form.
On April 07, 2023, at approximately 11:55 a.m., Detective KEETON sent the business warrant
to MDX Corp.
On April 10, 2023, at approximately 11:06 a.m., Detective KEETON completed and sent the
RMRCFL request for service form to RMRCFL. The RMRCFL form was attached to this case.
On April 11, 2023, at approximately 10:20 a.m., Detective KEETON dropped off the computer
(property invoice# 1327342-7) with Dana PLUMHOFF at the Rocky Mountain Computer
Forensics Laboratory located at 9195 E Mineral Ave. The intake receipt was attached to this

On April 16, 2023, Detective KEETON drafted a search warrant for VISA Inc. This search
warrant was reviewed and approved by Denver Deputy District Attorney Matthew SCHLAGER.
Detective KEETON then sent the business search warrant and affidavit electronically to the
Honorable Judge Renee GOBLE. The Honorable Judge GOBLE reviewed and approved the
VISA Inc. search warrant and affidavit on May 16, 2023, at approximately 2:42 p.m. (DEK)

On April 17, 2023, at approximately 2:46 p.m., Detective KEETON received an email from
MDX Arms with three attached documents. Detective KEETON reviewed the documents all
related to Austin LYLE. Attached were the documentation for one order along with the invoice,
packing slip with tracking, and credit card receipt. On February 05, 2023, Mr. LYLE purchased a
MDX Arms G26 V1 Build Kit – No Frame. For details refer to the MDX Arms documents that
were attached to this case. A Return and Inventory was completed and attached to this case.

On May 16, 2023, at approximately 4:00 p.m., Detective KEETON sent the search warrant to
VISA Inc. via email

On August 23, 2023, at approximately 10:30 a.m., Detective KEETON contacted the Rocky
Mountain Computer Forensics Laboratory seeking the status of the computer. Detective
KEETON was advised that the examiner would be left a message requesting to call Detective
KEETON.

On September 07, 2023, Detective KEETON received the written report related the Mr. LYLES
computer. Detective TERRY reported that he located possible items of evidentiary value for this
investigation that include pictures, documents, and internet artifacts. For complete details refer to
