WHAREAS all that piece and parcel of Bastu Land without any structure Measuring about 10 (Ten) Decimals out of 18 decimal in the extreme southern portion of the plot comprised within L.R. Dag no. 6046, appertaining to L.R. Khatian no. 2907, situated at Mouza – Shibpur, J.L. no. 18, Police Station – Udaynarayanpur, District – Howrah, morefully and specifically described in the schedule hereunder, hereinafter referred to as the schedule property, is the subject matter of the present Deed of Gift. AND WHEREAS one Gostha Bihari Gangopadhyay was the original owner and occupier in respect of the aforesaid and schedule noted property. While said Gostha Bihari Gangopadhyay seized and possessed in respect of the same along with other landed properties by mutating his name in the L.R.R.O.R. and paid Govt. cessess year to year, died leaving behind his two sons namely Debdas Gangopadhyay and Prabhas Chandra Gangopadhyay and one daughter namely Kalpana Ghoshal. AND WHEREAS thus the legal heirs of Late Gostha Bihari Gangopadhyay inherited the schedule noted gifted property along with other landed properties and became the joint owners and occupiers in respect of the schedule noted property along with other landed properties, having 1/3rd share each over the same. It is to be mentioned here that the names of Debdas Gangopadhyay, Prabhas Chandra Gangopadhyay and Kalpana Ghoshal have been duly recorded in the L.R.R.O.R. under Khatian No. 1858, 1859 and 1860 respectively and they jointly possessed the same peacefully and uninterruptedly, without any hindrance from any corner, by paying Govt. cesses year to year. AND WHEREAS thereafter said Kalpana Ghoshal died leaving behind her only son namely Asish Ghoshal (The DONOR herein) as her only legal heir and successor and thus the DONOR herein became the co-sharer in respect of the estate left by said Gostha Bihari Gangopadhyay by way of inheritance from his mother, having 1/3rd share over the same and jointly possessed the same with the aforesaid other co-sharers. It is to be mentioned here that the names of Asish Ghoshal (The DONOR herein) has been duly recorded in the L.R.R.O.R. under Khatian No. 2907 and the DONOR jointly possessed the same peacefully and uninterruptedly, without any hindrance from any corner, by paying Govt. cesses year to year. AND WHEREAS due to some problems in joint possession as well as due to some unavoidable circumstances the all aforesaid co-sharers i.e. Debdas Gangopadhyay, Prabhas Chandra Gangopadhyay and Asish Ghoshal (The DONOR herein) have mutually partitioned their estate along with schedule noted plot by virtue of a registered deed of partition dated 15.12.2017, registered at the office of S.R. Pancharul-Samantanagar, being deed no. 051002408 for the year 2017. AND WHAREAS according to the terms of the said deed of partition the DONOR herein obtained the ‘D’ schedule noted allotment to the deed of partition in his favour absolutely and solely and thereby the DONOR herein became the absolute and sole owner in respect of the aforesaid and schedule noted property and possessing the same absolutely and solely peacefully and uninterruptedly and without any hindrance from any corner and the DONOR herein has absolute and full right to make any kind of transfer in respect of the aforesaid and schedule noted property. AND WHAREAS the DONEE is a registered society as abobe and doing its committed duties at the locality for the benefit of the students as well as local villagers as well as for the benefit of the society voluntarily impressively. The DONOR being impressed about the activities of the DONEE/Society as well as being the secretary of the society like to gift the schedule noted property to the DONEE/Society, for further development of the society as well as for the benefit of the students, local villagers and society. The present managing committee of the society by its meeting held on 31/03/2018, has unanimously resolved to accept the proposal of the DONOR as above. There is no transaction of money as consideration of the present deed of gift. The impressive activities of the DONEE to the society and the will of the DONOR to do something for the benefit of the students and society is the actual consideration of this deed of gift but due to input the market value of the gifted property described in the schedule have under the deed is valued at Rs. 4,00,000/- (Four Lakh) upon which the stamp duty and registration fees paid. AND WHAREAS the said property more particularly mentioned and described in the schedule written hereunder free from all encumbrances. NOW THIS INDENTURE WITNESSETH as follows:- The DONOR doth hereby grant, transfer, assign and assure unto the DONEE absolutely and forever ALL THAT piece and parcel of Bastu Land without any structure Measuring about 10 (Ten) Decimals out of 18 decimal in the extreme southern portion of the plot comprised within L.R. Dag no. 6046, appertaining to L.R. Khatian no. 2907, situated at Mouza – Shibpur, J.L. no. 18, Police Station – Udaynarayanpur, District – Howrah, more particularity and fully described in the schedule hereunder written and all the estate right title interest use possession inheritance trusts claim and the demand whatsoever both at law and equity of the DONOR into and upon the said property hereditaments and premises and reversion or reversions remainder or remainders and all the rents issues and profit according to the true nature thereof and every part thereof TOGETHER WITH the yard fences water course ways paths and common passage thereto belonging or held or occupied therewith whatsoever and every manner of present right title and interest liberties privileges easements emoluments appendages and appurtenances thereto unto belonging to or appertaining to or usually held used occupied accepted enjoyed or reputed to belong or be appurtenant thereto TO HAVE AND TO HOLD own and possess the same unto and to the use of the DONEE absolutely and forever free from all encumbrances attachments charges liens lispendens claims demands liabilities and trust whatsoever and together with all deeds pattahs monuments writings and evidences of the title whatsoever in anywise exclusively relating to conveying the said property hereditaments and premises. THE DONOR DOTH HEREBY COVENANT WITH THE DONEE as follows:- 1) Notwithstanding any acts deed or thing whatsoever by the DONOR or his predecessors and ancestors in the title or interest done or executed or knowingly suffered to the contrary he the DONOR is lawfully and absolutely entitle to the said land hereditaments and premises and the DONOR has and had acquired indefeasible title to grant sell convey assure transfer and assign the said property hereby sold conveyed and transferred or expressed or intended so to be unto and to the use of the DONEE for a perfect title without any manner of dispute or hindrance or condition or use or other such things to alter defect encumber or to make void the same. 2) The DONEE shall and may at all time hereafter peaceable and quietly own possess and enjoy the said property hereby granted and conveyed and to receive and realize rents issues and profits thereto without any lawful eviction interruption claim or demand whatsoever from or by the DONOR or any person or persons lawfully or equitably claiming any estate or interest from under or in trust for the DONOR. 3) That the DONOR shall always remain bound to indemnify the DONEE if for any act of the DONOR, the DONEE is put to loss and /or suffering and / or if it is subsequently detected that DONOR created any charge and / or encumbrances upon the said property and/ or the DONOR knowingly suffered any adverse right and / or encumbrances in any form in the said property and / or if the DONOR receive any notice for acquisition and/or requisition of the said property AND THAT the DONOR declares specifically that within best of his knowledge the said property is not affected by way of attachment and / or affected by any notice or scheme of Metropolitan Development Authority and/or of the Government and/or of any other public body or Authority AND THAT the DONOR hereby declares further that to the best of their knowledge no declaration has been made or published for acquisition of the said property or any part thereof under the land acquisition Act, West Bengal Estate Acquisition Act or any others acts for the time being in force AND FUTURE the DONOR hereby undertakes that at all times hereafter upon every reasonable request and at the cost and expences of the DONEE, the DONOR shall execute and/or cause to be executed all such further and other deeds assurances acts and things in favour of the purchaser as may be required by the DONEE, for removing any ambiguity and/or for more perfectly assuring the said property unto and in favour of the DONEE. :: Schedule Property :: ALL THAT piece and parcel of Bastu Land without any structure Measuring about 10 (Ten) Decimals out of 18 decimal in the extreme southern portion of the plot comprised within L.R. Dag no. 6046, appertaining to L.R. Khatian no. 2907, situated at Mouza – Shibpur, J.L. no. 18, Police Station – Udaynarayanpur, District – Howrah, butted and bounded as follows:- On the North :-Rest Property of the DONOR. On the South :-Property of Chandu Santra. On the East :-Property of Bikash Maji. On the West :-Property of the DONOR in Plot No. 6042. All the above plot lies within the jurisdiction of Sub-Registry Office at Pancharul-Samantanagar, District Registry Office at Howrah. This DEED OF GIFT consists of 10 pages with 1 (one) non-Judicial Stamp paper of below mentioned denomination including 2 (two) witness and 2 (two) finger impression pages being page number 9 & 10 which is the part of this deed. IN WITNESSES WHEREOF the DONOR and DONEE hereto have set and subscribed their respective hands and seal on the day, month and year first above written.
