Emergency Declaration On Trees
WHEREAS, immediately after the storms, the area experienced a severe drought,
further weakening the already stressed trees throughout the City of Madison; and
WHEREAS, as a result of those two extreme weather events, the weakened trees
were attacked by invasive, damaging beetles which infested thousands of trees as they
spread throughout the City, and while the destruction became evident immediately on
some trees, as the Spring season approaches, the City is seeing an increase in the
number of dead or dying trees around homes and City streets that, if not removed soon,
will faIl; and
WHEREAS, efforts to address this damage are ongoing by both the City of
Madison and its residents, with expectations that hundreds, if not thousands of trees, will
still have to be removed to provide for the safety of residents and to prevent further
destruction to homes and property; and
WHEREAS, the City has heard from numerous residents directly affected by this
issue and it is actively seeking options to aid the residents of Madison, and to address
the removal of trees on City property and rights-of-way; and
WHEREAS, should emergency funding from the Federal Emergency Management
Agency, the Mississippi Emergency Management Agency, or any State Agency become
available, the Mayor and Board of Aldermen declare their intention to seek this funding to
aid the City and its residents; and
IT IS HEREBY PROCLAIMED, for the health, safety and welfare of the City of
Madison, the Mayor and Board of Aldermen of the City of Madison, Mississippi, do hereby
declare and proclaim that a “State of Emergency” in the City of Madison, Mississippi,
pursuant to the authority granted by Miss. Code Ann. Sec. 45-17-3 et seq . and related
statutes, hereby finds and declares that a “Civil Emergency” presently exists in the City
of Madison, Mississippi and under the authority of Miss. Code Ann . Sec. 33-15-17(d), and
related statutes, finds and declares that a “Local Emergency” presently exists in the City
of Madison, Mississippi; and
FURTHER, pursuant to Miss. Code Ann. §21-35-19, and related statutes, the
Mayor and Board further authorize City Departments to take any and all necessary action
to provide for the safety of the residents of the City, to include without limitation, removing
trees on City property and right-of-way, and further authorizes the active search, and if
available, application for funding to assist in addressing this Local Emergency.
IT IS FURTHER DECLARED AND ORDERED that said State of Emergency shall
be deemed to continue to exist in the City of Madison until its termination is ordered and
proclaimed by the Mayor or Governing Authority; a copy of this proclamation is hereby
filed with the Municipal Clerk of the City of Madison and made a public record.
SO ORDERED AND PROCLAIMED on this the 2nd day of January, 2024.
