FACTS OF THE CASE:

10:30AM of January 8, 2016 at Zone-6, Brgy. Del Rosario, Pilar, Sorsogon, a minor was
stabbed to death by Gregorio Rosin Quezon Jr, 39 years old, single, deaf-mute, farmer and a
resident of same place. Victim sustained several stabbed wounds on her body and was rushed to
Doctor Peralta Medical Hospital, Cumadcad, Castilla, Sorsogon but was declared dead on arrival
by the attending physician thereat. Suspect was able to arrest by the responding elements of
Castilla MPS and was turned to Pilar MPS personnel together with the weapon used.

DISPOSITION : For record as requested.

2. ICOW the above cited subject and reference, please be informed that on or about
10:00 pm of November 3 2012 along V.V. Soliven Avenue, Cainta Rizal a stabbing incident
transpired wherein victim identified as one ROEL JOHN POSADAS y SANTOS, 22 years
old, single, Student, a native of Pampanga and presently residing at No. 10. Aquino St., Taytay,
Rizal, was stabbed by the suspect identified as one JAKE REYES y CRUZ, aka “JR”, 22 years
old, single, laborer, a native of Northern Samar and presently residing at No. 11 M. H. Del Pilar
St., Cainta, Rizal.

3. Initial investigation conducted showed that on cited TDPO, while the victim was
walking along VV. Soliven Avenue, Cainta Rizal way back to their house. Suddenly, he noticed
Jake Cruz Reyes following him. When he reached the corner of the street, JAKE REYES y
CRUZ blocked the way of ROEL JOHN POSADAS y SANTOS and said “GAGO KA!
SINULOT MO SYOTA KO!”. After his words, he got his knife to his pocket and stabbed Roel
John Posadas three times that caused him fell to the ground. Jake Cruz Reyes immediately
escaped the place after the incident but he immediately caught by the concern citizens. The
residents of the place immediately helped the victim and sent to the nearest hospital that caused
him to survive from the death.

4. Suspect was turned over to the station investigation division together with the
confiscated evidence for proper action and disposition.

“Actual use of explosive” of RA 8550)

1. On or about 2:30 in the afternoon of November 3, 2013, information received from CBIN, that
group of illegal fishers conducted blast fishing activities at vicinity seawaters of Sitio Talaga Barangay
Ipag, Mariveles, Bataan. Immediately upon receipt of an information a team dispatched and led by SPO1
Allan L Balbutin PNP together with PO2 Ido T Abdullah PNP and one (1) civilian operator, while
conducting seaborne patrol operation along the coastal waters of Sitio Talaga, Barangay Ipag, Mariveles,
Bataan, they spotted one (1) unmarked paddled banca colored gray boarded by one male factor while on
actual gathering of fish at more or less fifty (50) meters from the shoreline of the said Barangay, the
team immediately rush to his position and introduced as PNP Maritime police and asked permission to
conduct inspection of his banca which was granted by the suspect and recovered more or less five (5)
kilos of fish (BATALAY) believed to be caught thru the use of dynamite explosive and they effected the
arrest and appraised of his constitutional rights.

2. At about 4:30 pm of same date, the suspect together with confiscated banca and accessories
were brought to this station for proper investigation and filling of appropriate charges in court. The
suspect later identified as BOYCLARK ESGUERRA y MADRIAGA, 31 years old, married and
resident of Purok 6 Barangay Ipag, Mariveles, Bataan.

3. On November 4, 2013 at about 9:00 o’clock in the morning the illegally caught fish was
brought to the Office of the Municipal Agriculturist Mariveles, Bataan for scientific examination
wherein the result was POSITIVE.
4. At about 11:05 AM of November 4, 2013, a violation of sec 88 para 1 in relation to para 3
(actual use of explosive) of RA 8550 was filed at the office of the Provincial Prosecutor Balanga City,
Bataan with Criminal Case No.ML 4565.

I. AUTHORITY:

II. MATTERS INVESTIGATED:

4. A theft incident that transpired on or about 3:00PM of March 30, 2017 in Brgy.
Mabuhay , General Santos City; and

5. To determine the criminal liabilities of the suspect and to know the premises
surrounding this particular incident.

III. FACTS OF THE CASE:

6. On or about 3:00PM of March 30, 2017, a theft incident transpired along the
Mabuhay road, the victim Carlito Georgie, 21 years old, single of No.123 Brgy.
Mabuhay, General Santos City, wherein he was in a hurry in going to his work he
rodes a taxi, As a consequence thereof, the victim lost his phones and ACER
Laptop.The driver of the taxi was not identified by the victim. The PNP Cyber
Crime Investigator service, of Camp Fermin G. Lira, General Santos City, try to
track the location of the phones that also tracks the location of the perpetrator.

7. On April 8, 2017, a case of Theft against the driver was referred to the Office
of the City Prosecutor, General Santos City and docket under I.S Number 12-0016 for
final disposition. Commitment Order was issued by the court and the suspect was
subsequently transferred to the BJMP District Jail, Lanton Apopong, General Santos
City.
IV. DISCUSSION:

8. The victim was in a hurry at that time when he forgot his phones and laptop at
the taxi. But the driver of the taxi never report or give to the authority the lost things of
the victim, herein the suspect violated the Art.308 of the Revised Penal Code of the
Philippines that states Theft is committed by any person who with intent to gain but
without violence or intimidation of person nor force upon things, shall take personal
property of another without latters consent .

V. CONCLUSION:

9. The investigator concluded that the suspect violated the law as prescribed in
the recent discussion. Therefore, it is necessary to file a Theft case against him.

VI. RECOMMENDATION:

10. WHEREFORE, in view of the foregoing, the undersigned respectfully


recommends that this case be considered solve and close.

I. AUTHORITY:

Verbal instruction of the Provincial Director to submit After Operation Report.

II. MATTERS INVESTIGATED:

Robbery and hostage taking transpired in M. Lhuillier at P. Zamora, corner M.H.


del Pilar Sts., Tacloban City on April 5, 2011 perpetrated by “Batang Minda Group” a notorious
robbery/hold-up gang in Eastern Visayas headed by a certain Lito Mitra and three others.

III. FACTS OF THE CASE:

OOA 10:00 o’clock in the morning of April 5, 2011 at M. LLuiller Pawnshop


located at Zamora corner MH Del Pilar Street, Tacloban City a robbery and hostage taking
occurred involving “Batang Minda Group” a notorious robbery/hold-up gang in Eastern Visayas
headed by a certain Lito Mitra and three other malefactors.

IV. DISCUSSION:

On April 5, 2011 at about 10:00 o’clock in the morning, this Office received an
information regarding a robbery and hostage taking at M. Lhuillier located Zamora corner M.H.
del Pilar, Tacloban City, operatives were immediately sent to the area to verify the report. Upon
confirmation, tactical units such as SWAT, EODT, Snipers, and others were dispatched without
delay to the incident area. Immediately thereafter, the crime scene was isolated and secured.
Formal negotiation was subsequently conducted and it lasted only for two (2) hours and the
suspects surrendered peacefully.

Appropriate charges have been filed against the suspects for violation of Art. 268
– Slight Illegal Detention, Art. 294 – Robbery & Violation of PD 1866 as amended by RA
8294 against the leader of the robbery gang Lito Mitra, et., al.

V. ASSESSMENT/EVALUATION:

The crisis has been resolved peacefully with the collective effort of all the units
under Leyte PPO with the indispensable cooperation of all the tactical units and other friendly
forces in the area.
Leyte PPO has strictly adhered to the Standard Operating Procedures (SOPs) in
addressing such a kind of critical situation.

VI. RECOMMENDATION:

This Office strongly recommends that appropriate awards be given to all


personnel involved in the peaceful resolution of the robbery and hostage crisis and further
recommends the meritorious promotion of the Ground Commander and the Hostage Negotiator
and all personnel who played a vital role in the diplomatic resolution of the problem to the next
higher rank as a recognition of their effort and invaluable services rendered during the said
hostage situation.

FACTS OF THE CASE:

Investigation disclosed that on the above stated TDPO, V-1 travelling South-east
Direction along Highwar Lane turning right as RPC Avenue when it was bumped and hit by V-
2 travelling West direction along fast way Drive while turning left at RPC Avenue.

As a consequence thereof, V-1 Driver 1 sustained severe head injury and was rushed to
Davao District Hospital for treatment but pronounced dead-on-arrival (DOA) by the attending
physician. Driver-2 voluntarily surrenders to police authority.

DISPOSITION:

For appropriate filing of charge before Davao City Prosecutor’s Office.

COMPLAINT

Plaintiffs through the undersigned counsel and unto this Honorable


Court respectfully states that:

1. Plaintiff Spouses GERRY and EDITH LAMINOZA are residents of Blk


20 Lot 11, Brgy. San Rafael 1, Area-H, City of San Jose del Monte,
Bulacan, where they may be served with court order and other
processes;

2. Defendants MICHAEL ANDRES, MARCELINA ANDRES, and all


persons claiming rights under them, are residents of Blk 20 Lot 12,
Brgy. San Rafael 1, City of San Jose del Monte, Bulacan where he
may be serve with summons, order and other court processes;

3. Plaintiff became owners of a certain parcel of land, through a Deed of


Sale from the original owner, Mariano Soriano Laminoza.

4. The parcel of land is situated in Blk 20 Lot 12, Brgy. San Rafael 1,
City of San Jose del Monte, covered by TCT No. T-414462 (M).
Attached is the photocopy of the Title as Annex “A” and made an
integral part hereof.

5. Herein Defendants requested Mr. MARIANO LAMINOZA to allow


them to stay in the subject property because at that time, defendants
have no place to live in and considering that Mr. Mariano Laminoza
and herein defendants are siblings, the former allowed the latter to
stay and occupied the parcel of land in question.

6. Mr. Mariano Laminoza sold the property to herein plaintiff spouses


GERRY and EDITHA LAMINOZA on August 8, 2013. Attached is the
photocopy of Deed of Sale executed between Mr. Mariano Laminoza
and plaintiff spouses as Annex “B” and made an integral part hereof.

7. On January 2014 herein plaintiff spouses already wanted to use the


property they bought from Mr. Mariano Laminoza, so the plaintiff
demanded the defendants to vacate the property subject of this case.
But defendants adamantly refused to do so and even further told the
plaintiff spouses that herein defendants will never vacate the property
subject of this case.

8. Due to the evident manifestation of the defendants to vacate and


surrender the possession of the property to the plaintiffs, the latter
brought the matter before the Barangay for possible conciliation and
settlement. Lamentably, no settlement happened and as a
consequence thereof, Barangay San Rafael I have issued a
“Katunayan Upang Makadulog sa Mataa na Tanggapan” in favor of
herein plaintiffs, a copy of which is hereto attached as Annex “C”
and made an integral part hereof.

9. To give the defendants another chance to peacefully surrender the


possession and vacate the property, the plaintiffs delivered personally
a Demand letter on May 23, 2014. But again, defendants did not
heed the demand. As proof, attached hereto is the Demand Letter as
Annex “D” and the Joint Affidavit of Service as Annex “E”.
10. The same acts of the Defendant compelled the Plaintiff to incur
litigation expenses consisting of attorneys fees in the amount of
TWENTY THOUSAND (Php 20,000.00), twenty thousand pesos FOR
MORAL DAMAGES, and exemplary damages of TWENTY
THOUSAND PESOS (Php 20,000.00).

7. That, for this reason, I am now formally charging BERNADETTE


NIELO and JESUS ALIMAGNO of B. NIELO ENTERPRISES located at 90
Limcaoco Subdivision, Brgy.Tres (POB.) Cabuyao, Laguna (Calabarzon),
the offense of ESTAFA defined and penalized under Art. 315 of the
Revised Penal Code and for Violation of Batas Pambansa Blg. 22;

8. That, I am executing this Affidavit to establish the truth of the


foregoing.
