AFFIDAVIT

I SANDEEP MAHESHWARI son of VISHNU KUMAR MAHESHWARI aged


about 49 years by faith HINDU working for gain as the proprietor / owner of
the brick field in the name and style SHRI SHYAM ENT UDHYOG having its
postal address at VILLAGE MADHORA, Post Office - IGLAS , Police Station -
IGLAS , Pin - 202124 , AADHAAR number , PAN number – XXXXX , GSTN –
09AAXPM0052D2ZN , do hereby solemnly affirm this affidavit for self being
the proprietor / owner of the above name brick field as such I am competent
to sign , affirm and file this affidavit.

1. That I have gone through the memorandum being number 2648-


M&M/LR/A-II-26/2010 & 2649-M&M -26/2010 of the L&LR Deptt .
M & M Branch, Nabanna dated 27th October , 2016 and it’s
subsequent amendment through memorandum being number
297/M&M/LR/A-II-26/2010 dated 09.02.2022 and made myself well
acquainted with the conditions, guidelines and parameters laid down
in the above memorandums and solemnly affirm to abide by them.

2. That I also affirm to carry out the operation of my above mentioned


unit as per directions and guidelines issued by the Ministry of
Environment, Forest & Climate Change, Govt. of India and the West
Bengal Pollution Control Board and their amendments made from
time to time.

3. That I shall abide by the terms and conditions as may be notified by


the Government of West Bengal from time to time regarding operation
of brick field.

4. That I also undertake that the operation of the above mentioned brick
field will not cause any damage to any public road , bridge, culvert,

and will also cause no obstruction to the canal / river/ drainage or
water body of any description in any manner whatsoever.

5. (i) That I have developed Multilayer Green Belt of 10 meters width


along the periphery of the brick field/kiln leaving two 10 meters width
gaps in the boundary for entry and exit of materials and vehicles. **

(ii) That I shall develop Multilayer Green Belt of 10 meters width


within a period of 12(twelve) months from the date of filing this
affidavit, along the periphery of the brick fields/ kilns leaving two 10
meters width gaps in the boundary for entry and exit of materials and
vehicles. **

6. (i) That I have constructed a 3(three) meters high wall on the sides of
the brick fields/kilns as no land was available for Green Belt
Development in order to prevent fugitive dust emission. **

(ii) That I shall construct a 3(three) meters high wall within a period of
6(six) months from the date of filing this affidavit on the sides of the
brick fields/kilns as no land is available for Green Belt Development
in order to prevent fugitive dust emission. **

7. (i) That I shall utilize at least 25% fly ash on weight to weight basis of
total raw materials required for the brick field/kilns ( depending on it’s
availability ) from any coal based Thermal Power Plant located within
a radius of 100 km. from the location of my brick field unit as per the
Fly Ash Utilization Rules, 1999 and its amendment made thereafter by

(ii) That we use only alluvial soil / silt for making of bricks. As per
Pollution Control Board’s Memo No.1808(6)-13 / WPB/ EX(97) /
2001, dtd.24.8.2004, brick-fields which use alluvial soil / silt for
making of bricks are not required to use Fly-Ash as per earlier order of
the State Board and hence we are not required to use fly-ash for brick
making. However, fly-ash generated in our own production process in
fully utilised for making of bricks by mixing with clay.

8. (i)That I shall obtain Environmental Clearance (EC) under category ‘B”


from the State Environmental Impact Assessment Authority (SEIAA)
for mining of brick earth / ordinary clay for running the production of
my unit if the mining depth at the excavation site exceeds 1.5 meters.
**

(ii) That the mining depth at the excavation site for brick earth /
ordinary clay for running the production of my unit shall not exceed
1.5 metres. **

9. (i) That I have already converted and equipped my brick field unit
with zig-zag technology or vertical shaft ( * strike of whichever is not
applicable) and shall comply to the standards as stipulated in the
notification G.S.R. 143 ( E ) dated New Delhi, the 22nd February,
2022 of the Ministry of Environment, Forest & Climate Change, Govt.
of India. **

(ii) That I shall convert and equip my brick field unit with zig-zag
technology or vertical shaft ( * strike of whichever is not applicable)
and shall comply to the standards as stipulated in the notification
G.S.R. 143 ( E ) dated New Delhi, the 22nd February, 2022 of the
Ministry of Environment, Forest & Climate Change, Govt. of India
within a period of 01 (one) year from the date of the above notification

(iii) That I shall convert and equip my brick field unit with zig-zag
technology or vertical shaft ( * strike of whichever is not applicable)
and shall comply to the standards as stipulated in the notification
G.S.R. 143 ( E ) dated New Delhi, the 22nd February, 2022 of the
Ministry of Environment, Forest & Climate Change, Govt. of India
within a period of 02 (two) years from the date of the above notification
as the unit does not fall within 10 (ten) kilometre radius of non-
attainment cities as defined by Central Pollution Control Board. **

10. That I shall register myself and my brick field unit with the
Brick Field Module prepared and developed by the L&LR&RR&R
Department within a period of 01 (one) month from the issuance of
Consent to Operate certificate.

11. That I shall deposit all government dues ( royalty/cess/price of


mineral/interest/ etc) that stands credited to my brick field unit for
any season within the 31 th day of March each year.

12. That I shall deposit all government arrear dues (


royalty/cess/price of mineral/interest/ etc) that stands credited to
my brick field unit within the timeframe as may be fixed by the
District Authority. I shall also be liable to deposit any amount that
may subsequently be found credited to my unit.

13. That the Gross Capital Investment on land, machineries,


building & plant (without depreciation) excluding capital investment
on pollution control equipment of my brick field unit is Rs.
XXXXXX.XX ( in words).

I undertake that my failure to comply with any of the above mentioned


commitments shall make me liable for prosecution as per provisions of
existing laws .
