LETTER OF ACCEPTANCE
Date: May 25, 2023
Dear Sirs,
With reference to your tender and negotiation held between yourselves and our representatives whereby,
we have agreed to accept your tender in the sum of Ringgit Malaysia Two Hundred Forty Five
Thousand Seven Hundred Thirty Eight Only (RM 245,738.00) as attached Bill of Quantities
No work under this Contract shall commence unless and until you have complied with the provision
under Paragraph 8 of this letter.

Please note that we reserve the right to omit any part of the works and no claim for whatever
losses and expenses incurred including loss of profit arising from such omissions shall be
entertained.
In the event if there is any breach of the contract viz. without reasonable cause fail to commence
Package 2B, the Employer may call on and utilise the performance bond for package 2B as outlined
in clause 10.2 for reimbursement of loss and/ or expense suffered by Employer (COC clause 37.5)
In the event that you omit to proceed with package 2B upon our notice for commencement after
the Certificate of Practical Completion of Package 2A, we reserve the right to forfeit the
Performance Bond for Package 2B as outlined in Clause 10.2. No other claims for whatever losses
and expenses incurred including loss of profit arising from such omissions shall be entertained.
The Defects Liability Period shall be 12 months from the Date of Certificate of Practical
Completion (CPC).
Time is of the essence and it is hereby agreed that Liquidated Damages (LD) shall be imposed and
become payable by you without having to show proof of actual loss or damage in the event that
you fail to complete the works at the stipulated Date of Completion subject to the provision of
Extension of Time under Clause 23 of the Conditions of Contract.
Time is of the essence and it is hereby agreed that Liquidated Damages (LD) of RM 100 per
calendar day shall be imposed and become payable by you without having to show proof of actual
loss or damage in the event that you fail to complete the works at the stipulated Date of
Completion subject to the provision of Extension of Time under Clause 23 of the Conditions of
Contract.
You shall comply with the Local Authorities existing safety requirements and cleanliness including
provision of, and not limited to the following:-
a) Provision of safe passages for workmen, visitors and consultants.
b) Provision of safety helmets and boots.
c) You have agreed to make good, reinstate existing infrastructure works and maintain the site
cleanliness throughout the currency of the contract.
7.1 You will be required to co-ordinate with the Project Manager, Guards and the nominated
subcontractor and shall program your works so as to allow the continuing operation of auto card
access entry / manual control access to run smoothly.
7.2 You have examined the site and site constraints shall not be a reason for delay nor costs.
7.3 If you find any inconsistency/ discrepancy between contract drawings and construction drawings
issued during commence date, you shall highlight to Architect before construction for eligibility
of variation order or any other contractual matters.
7.4 You shall ensure that no ponding within the site or areas surrounding the site will occur as a
result of the building and infrastructure works.
7.5 You have agreed to properly protect all finished works to the Architect’s satisfaction and
continuously maintain the protective measures throughout the construction period.
7.6 You have committed to a principle to carrying out the works as much as possible to a
‘getting it right the first time’ basis, instead of rushing the works and then returning to
rectify later.
7.7 Window mullions shall be to a minimum depth of 60mm. ‘Santoprene’ or other equal and
approved gasket and weatherstrip shall be provided to all doors and windows. All aluminium
windows and doors extrusion shall be using Comsach (casement windows) and Comdor
(sliding doors) system or equivalent. All Shop drawings must be submitted.
7.8 Your scope of work shall include mechanical and electrical (M&E) services and you have
agreed to accept the sub-contractors nominated by the Consultants for the following trades:
• Electrical, Telephone & Air Conditioning
• Plumbing & Sanitary
• Card Access and Internal Security Services
7.9 You agreed that the Employer may prepare separate cheques to sub-contractors for M&E
services, supplier for PC rated items and the said cheques shall be handed to you for issue.

7.10 No worker accommodations shall be erected on site . Any accommodation erected adjacent
to the site shall be .

8.0 Contract Pre-Requisites
8.1 All Risks Insurance Policy comprising Insurance of the Works for the full amount of the
contract plus 10% to cover for professional fees and Public Liability Insurance against
personal injuries and damage to property of an insured value not less than
RM1,000,000.00.
8.2 Insurance Policy for your plant, equipment, temporary buildings etc. for a sum equivalent to
their replacement value.
1. 8.3 Insurance Policy for Workmen’s Compensation of an amount not less than 15% of
the Builder’s Work portion of the Contract Sum.

8.6 The contractor shall propose worker logistic layout plan for approval before commencement
of works.
10.10 You shall not use Jalan 13/119 and Jalan Desa Bukit Tiara for facilitation of construction works and
for workers movement and access.
10.11 You shall provide guard to control traffic and your access along Jalan 31/119.
10.12 You shall at all times put in sufficient security patrolling / checking at your site and worker
accommodation and implement sufficient security measures to prevent intrusion from your site into
the Tiara Hills neighbourhood.
This letter is sent to you in triplicate. Please retain one duplicate copy and return to us the original and
one (1) copy duly signed and witnessed.
