CRL.M.(BAIL)1257/2022 (suspension of sentence)
1. By way of the present application, the applicants seek regular
suspension of sentence during the pendency of the present appeal filed by
the applicants against the judgment dated 2nd June, 2022 and the order of
sentence dated 5th July, 2022 passed by the learned Additional Sessions
Judge-05, Shahdara District, Karkardooma Courts, Delhi.
2. Vide judgment of conviction, the applicants were convicted of
offences under Sections 308/34 of the Indian Penal Code, 1860 (IPC) and
vide order on sentence, the applicants have been awarded rigourous
imprisonment of three years and six months along with fine. Counsel for the
applicants submits that the fine has been paid.
3. As per the Nominal Roll on record, the applicants have already
completed half of the sentence awarded to them. Further, their conduct in

the jail has been satisfactory and they are not involved in any other offence.
4. Considering the aforesaid facts and circumstances and that the appeal
is unlikely to come up for hearing in the near future and in view of the
directions of Supreme Court in Sonadhar v. The State of Chhattisgarh,
SLP (Crl.) 529/2021, this Court deems it fit to suspend the sentence of the
applicants and they shall be released on bail during the pendency of the
appeal, on furnishing a personal bond in sum of Rs.25,000/- each with one
surety of the like amount subject to the satisfaction of the Trial Court,
further subject to the following conditions:
i. The applicants shall provide their mobile number(s) to the
Investigating Officer (IO) concerned, which shall be kept in working
condition at all times and shall not switch off or change the mobile
number without prior intimation to the IO concerned, during the
period of suspension of sentence.

ii. The applicants shall furnish their permanent address to the IO within
two weeks of their release and in case they change their address, they
will inform the IO concerned and this Court.
iii. The applicants shall appear before the Court as and when the appeal is
taken up for hearing.
iv. The applicants shall not leave the country without the permission of
this Court.
v. The applicants shall not indulge in any criminal activity and shall not
communicate with or come in contact with the complainant/victim or
any member of the complainant/victim’s family or tamper with the
evidence of the case.

5. Copy of the order be sent to the Jail Superintendent for information
and necessary compliance.
