Constitutional History of the Philippines

1. How do you think the historical developments of the Philippine government and

constitution contribute to our current state of the nation?

The historical development of the Philippine government and constitution has high

impact contribution to our current state of the nation. This can be easily seen through the

practicing manner of the Filipino in many things such as expressing and speaking freely

for what we want to say, choosing of what religion we want to choose. In addition, our

government was also applying their best experience to improve our present government

status for the sake of our Filipinos.

2. With the current standing of the Philippines in democracy world rankings, will you

consider the state of Philippines democracy as “flawed and problematic”? Give at

least 3 situations or scenarios that will support your claim.

The state of Philippines democracy can be considers as “flawed and problematic”.

a. No law shall be passed abridging the freedom of speech, of expression, or of the

press, or the right of the people peaceably to assemble and petition the government for

redress of grievances. However for this case, we are still seeing different people

fighting and taking bad conversation against each other once other person say for their

thought.

b. No law shall be made respecting an establishment of religion, or prohibiting the free

exercise thereof. The free exercise and enjoyment of religious profession and worship,

without discrimination or preference, shall forever be allowed. However for this kind

of law, some of the company have discrimination for other religion thinking that it

may affect the performance if they are from other religion thinking that they have

different beliefs in life.

c. The right of the people to information on matters of public concern shall be

recognized. Access to official records, and to documents and papers pertaining to

official acts, transactions, or decisions, as well as to government research data used as

basis for policy development, shall be afforded the citizen, subject to such limitations

as may be provided by law. However for this kind of law, why we are suffering for

difficulty of getting information. Even for own information, we need to get like own

birth certificate with expensive payment and we need to wait for how many days to

get it.

3. Explain the principles of separation of powers and checks and balances and indicate

its significance in a democratic state. Provide examples which show separation of

powers and checks and balances between the three branches of the government.

The separation of powers is a model for the governance of a state. Under this

model, a state's government is divided into branches, each with separate and

independent powers and areas of responsibility so that the powers of one branch are

not in conflict with the powers associated with the other branches. The typical

division is into three branches: a legislature, an executive, and a judiciary, which is

the trias politica model. It can be contrasted with the fusion of

powers in parliamentary systems and semi-presidential systems where the executive

and legislative branches overlap. Separation of powers, therefore, refers to the

division of responsibilities into distinct branches of government to limit any one

branch from exercising the core functions of another. The intent of separation of

powers is to prevent the concentration of unchecked power by providing for checks

and balances to avoid autocracy, over-reaching by one branch over another, and the

attending efficiency of governing by one actor without need for negotiation and

compromise with any other. An example of separation of powers at work, is that,

while federal judges are appointed by the President (the executive branch), and

confirmed by the Senate; they can be impeached by the legislative branch (Congress),

which holds sole power to do that.

There are 'checks and balances' within our political system that limit

the power of each branch in order to prevent the abuse of power. The separation of

power is important because it provides a vital system of 'checks and balances': Firstly,

it ensures that the different branches control each other. Checks and balances are an

extremely important part of the Constitution. With checks and balances, each one of

the three branches of government can limit the powers that the other branches have.

This way no one branch becomes too powerful. Example of checks and balances is

the presidential veto of legislation (which Congress may override by a two-thirds

vote) and executive and judicial impeachment by Congress. Only Congress can

appropriate funds, and each house serves as a check on possible abuses of power or

unwise action by the other.
