A4: Sa pagbuno patay sang akon nga bana nga si Matias Lalaguna. (For killing my husband Matias

about the death of your husband?)
A5: Sang October 1, 2022 banda 6:00 na sang aga Ma’am, nabatian ko na may gasyagit sa guwa
sa balay namon na nagresulta sa akon na maglantaw sa bintana. Nakita ko sila si Simon Alteza
ginbuno nya bana ko sa ulo dason si Alfredo Herila ginbuno nya pud banda sa kanan balikat nya
kag natumba sya. (On October 1, 2022 around 6:00 in the morning Ma’am, I heard a shout from
outside our house that caused me to look at the window. There I saw Simon Alteza hack the head
of my husband while and Alfredo Herila hacked the right elbow of my husband that caused him to
fall on the ground.)

A6: Tenant namon si Alfredo Herila kag trabahante nya man si Simon Alteza. (Alfredo Herila is our
tenant and Simon Alteza is his laborer.)

Q7: Ano ang gihimo mo tong nakita mo na natumba na bana mo? (What did you do after you saw
your husband fell on the ground?
A7: Gikaadtuan ko siya dayon kay ara pud sa guwa and dalawa ka bata namon nagahibi na kag
nangita bulig. (I immediately went to my husband because our two children were also outside crying
and asked for help.)

Q8: Nadala nyo pa bana mo sa hospital? (Have you brought your husband to the hospital?)
A8: Oo Ma’am pero napatay na sya sa hospital banda alas 9 sang aga. (Yes Ma’am but he died in
the hospital around 9 o’clock in the morning.)

I, NILDA LALAGUNA, 18 years old, single, Daughter of the victim Matias Lalaguna and her
mother Benita Lalaguna the widowed, A resident of Bagong Lipunan, Brgy. Kenram, Isulan,
Sultan Kudarat.

Preliminary Statement

The person interrogating me is PCpl Alice S Llagas, Investigation PNCO at the office of the
Investigation Section, Isulan Municipal Police Station, Sultan Kudarat. I am answering her
questions fully conscious that I do so under oath and may face criminal liability for false
testimony and perjury or may face criminal liability if I commit falsity or falsehood in these
proceedings.

A2. Para magwitness sa natabo sa pagpatay sa akon tatay na si Matias Lalaguna na ang
suspek nga ginatudlo ko ay sila Alfredo Herila kag Simon Alteza.
(To be a witness against Alfredo Herila and Simon Alteza, the suspects who killed my
father Matias Lalaguna.)

Q3. Saan at kailan nangyari ang insidente?

(When and where did the Incident happen?)
A3. October 1, 2022 sir, mga 6 sang kaagahon, sa Bagong Lipunan, Brgy. Kenram, Isulan,
Sultan Kudarat.
(On October 1, 2022/OOA 6:00AM at Bagong Lipunan, Brgy. Kenram, Isulan, Sultan
Kudarat.)

Q4. Pwede mo ba sabihin kung ano ang nangyari?

(Could you narrate what really happened?)
A4. Kami ni tatay ko kag manghud ko naghalin sa balay sang mga alas 6 sang kaagahon
kay magkuha sang kahoy pangdabok. Habang galakat kami nauna si tatay sa amon habang
kami sang manghud ko ara sa likod niya banda. Sa sobra kadasig sang tatay ko maglakat
naulihi na kami samtang may Nakita kami sa unahan nga may tao nga gatago nga amu
ginakilala ko nga si Alfredo Herila kag Simon Alteza. Si tatay ko wala gid kakita saila kay
samtang palapit si tatay sa pwesto nga ginataguan nila ga amat amat sila gawas kay kami
ara kami sa likod kag layo na kami kay tatay ko, makita ko gid ang mga galaw sang mga
gihambal ko nga suspek. Atung naggawas na sila sa ila nga ginataguan, nagsinggit ko sang
kusog “tay dalagan!! Kay may manglabo saimo!!” Sa kadasig sang panghitabo, si tatay ko
wala gid nakabantay kag nangita ko si Simon Alteza gamit sang bolo niya naigo ang tatay
ko sa ulo niya, pero pag igo sa to nakadalagan pa ang tatay ko pero hindi niya makaya
magdalagan kag natumba siya dahilanan sang igo niya sa ulo, tapos ang isa ka suspek nga
si Alfredo Herila dalidali gipalapitan ang tatay ko kag gitaga ang tatay ko sa may bandang
siko. Tapos sang natabo nga to, dalidali nagdalagan ang mga suspek palayo.
(I, together with my father and my younger sibling went out around 6am in the morning to
gather firewood. While walking, since father walks faster than us, we followed him behind.
While we’re behind him from a far distance, we saw Alfredo Herila and Simon Alteza hiding
in the footpath. My father did not notice that Alfredo Herila and Simon Alteza were hiding.
While father got close to their hiding location, I could clearly see the suspects slowly moved
towards the direction to my father. When the suspects went out from their hiding path and
they went directly straight to my father I shouted “Father!! Run!! There’s someone who’s
going to hack you!!”. As the incident happened very fast, my father is unconscious to what
is going to happen, and Simon Alteza went too him directly and hack him in his head with a
bolo. While father was hit in the head, he did run but fell off due to his injury then there goes
Alfredo Herila who swung his bolo around my father’s elbow. After that incident, the suspects
fled off the crime scene.)

A6. Si tatay nakaabot pa sa balay kay may mga nagbulig sa amon na kapitbahay teacher
sa school namon. Tapos gidiretso siya sa hospital para mabulong ang iya nga mga pilas.
(Our father was brought to our house with the help of our neighbor, a school teacher and
immediately we brought him to the hospital so that his wounds would be treated.)

Q7. Ano pa ang nangyari?

(Then, what more happened?)
A7. Pag abot sa hospital, ang pagbulong saiya steady lang gyapon asta na nabawian sang
kinabuhi si tatay ko paglipas sang tatlo kaoras pagtapos sa insidente nga natabo dahilan
sang sobra kacritical ang mga igo niya kag nahubsan siya sang dugo.
(While we arrived at the hospital, treatments and medications had been promptly given but
after 3 hours, father passed away due to his critical condition and blood loss.)

I, PCpl Sumaya K. Usman, 25 years old, single and a resident of Poblacion, Ampatuan,
Maguindanao and presently assigned at Isulan Municipal Police Station and designated as
an Arresting Officer.

Preliminary Statement

The person interrogating me is PCpl Alice Llagas, Investigation PNCO at the office of the
Investigation Section, Isulan Municipal Police Station, Sultan Kudarat. I am answering her
questions fully conscious that I do so under oath and may face criminal liability for false
testimony and perjury or may face criminal liability if I commit falsity or falsehood in these
proceedings.

QUESTIONS and ANSWERS

Q1. In what language do you want this interrogation be conducted?

A1. I can understand either English or Tagalog.

Q2. Why are you here at The Office of Investigation – Isulan Municipal Police Station?
A2. To give my voluntary statement in connection to the filing of formal complaint against
Simon Alteza, 25 years old, Single, farmer and a resident of Bagong Lipunan, Brgy. Kenram,
Isulan, Sultan Kudarat.

Q3. When and where did the Incident happen?

A3. On October 1, 2022/OOA 6:00AM at Bagong Lipunan, Brgy. Kenram, Isulan, Sultan
Kudarat.

Q4. Could you narrate what really happen?

A4. On October 1, 2022 at about 8:30AM while we were performing our tour of duty at Isulan
Municipal Police Station, we were informed by the Sultan Kudarat Provincial Hospital located
in Isulan, Sultan Kudarat that they have a patient, a victim of a hacking incident from Bagong
Lipunan, Brgy. Kenram, Isulan, Sultan Kudarat.

Q5. After receiving those informations, what did you do?

A5. Immediately together with other personnel of this station, we proceed to the hospital to
verify the report. And after few moments we identified the victim as Mr. Matias Lalaguna and
the attending physician declared him as critical due to the hack resulting to serious and deep
wounds but after three hours the victim expired. Further, we identified one of the suspects
as Simon Alteza, resident of Bagong Lipunan, Brgy. Kenram, Isulan, Sultan Kudarat.

Q6. Then what happened next?

A6. After we gathered the information from the victim and the witnesses, at around 11am
we proceed to Bagong Lipunan, Brgy. Kenram, Isulan, Sultan Kudarat purposely to arrest
the suspects Simon Alteza and Alfredo Herila. We arrived at the area of Simon Alteza
around 12nn, but to no avail because we did not see the suspect at his house. Moments later,
a concerned citizen approached and informed us that the person we are looking for was
hiding at the back of his (concerned citizen) house.

Q7. After that, what happened next?

A7. The concerned citizen point us to the direction to where Simon Alteza was
hiding. We approached Simon Alteza and since there was no resistance on his person,
at around 1:00pm, I arrested Simon Alteza and I informed him of his constitutional
rights in the language (Ilonggo) which the arrested suspect understood.

Q8. What about the other suspect?

A8. At around 1:30pm of same date, we proceeded to the house of Alfredo Herila
which is only 50meters away from the house of Simon Alteza. When we arrived there,
we saw Alfredo Herila at his house. Upon seeing the police officers, he tried to elude
his arrest but was timely subdued by PCpl Ventura. PCpl Ventura, arrested him and
apprised him in his constitutional rights in the language (Ilonggo) which he understood.

Q9. What happened next?

A9. We brought the arrested suspects to Isulan Municipal Police Station for safekeeping
and proper disposition.

Q10. For now, I have no more questions to ask you. Do you have something else to say?

Lipunan, Brgy. Kenram, Isulan, Sultan Kudarat.

Q5. After receiving those informations, what did you do?

A5. Immediately together with other personnel of this station, we proceed to the hospital to
verify the report. And after few moments we identified the victim as Mr. Lalaguna Matias and
the attending physician declared him as critical due to the hacks resulting to serious and
deep wounds but after three hours the victim expired. Further, we identified one of the
suspects as Alfredo Herila, resident of Bagong Lipunan, Brgy. Kenram, Isulan, Sultan
Kudarat.

a. Simon Alteza, male, 27 years old, single, laborer and a resident of Bagong Lipunan,
Brgy Kenram, Isulan, Sultan Kudarat;

b. Alfredo Herila, male, 25 years old, single, farmer and a resident of Bagong Lipunan,
Brgy. Kenram, Isulan, Sultan Kudarat;

VI. Status: Arrested

VII. Brief Narrative of Incident:

Please be informed that around 6:00 in the morning of October 1, 2022,

wherein the victim identified as Matias Lalaguna, male, 47 years old, married, Barangay
Captain and a resident of Bagong Lipunan, Brgy Kenram, Isulan, Sultan Kudarat was
hacked by the assailants identified as Simon Alteza, male, 27 years old, single, farmer and
Alfredo Herila, male, 25 years old, single, laborer both are residents of the aforementioned
address. Initial investigation conducted and divulged that while the victim was gathering
firewood, assailants suddenly emerged and hacked the victim using a bolo who sustained
one (1) hacked wound on his head and one (1) hacked wound on the right elbow.
Accordingly, Benita Lalaguna the victim’s wife and also the complainant asked for help
nearby and applied tourniquet, but her efforts were futile. The victim was brought to Sultan
Kudarat Provincial Hospital and was pronounced dead by the attending physician at the
said hospital. Suspects fled after the incident but fortunately, they were arrested by the
elements of Isulan Municipal Station led by PLT Nepthalie Bedua Jr, COP of this station
during the hot pursuit operation conducted by this office. Suspects are presently detained
at detention facility of this station for proper disposition. Cadaver of the victim is presently
lying at St. Peter Chapel for Postmortem Examination.

Action Taken: The above-named suspects were informed of their constitutional rights by
the apprehending officers and brought to Isulan Municipal Police Station for proper
disposition.
