Employers in Tanzania may be face legal action as a result of failure to follow
Tanzania labour related to disciplinary hearing and its procedures and the
hearing procedures are governed by employment and labour relation act
CAP3660F 2004, the employment and labour relations code of good practice
GN 42 of 2007 and guidelines for disciplinary incapacity and incapability.

HEARING DESCRIPTION
Around 0115hrs Monday of 21 August 22, 2023 the chairperson of hearing
madam BIRIHI HAJI she initiated the hearing by asking the accused Frank Joel that
he recognized the call of hearing
Answer from Frank Joel was accepted to recognize the call hearing for him and
agreed to receive the notice of hearing and to get enough time to be prepared for
hearing.
The chairperson before to welcome the complainant to take battle reminded
Frank Joel to give out any suggestion, opinion or request on his suspicious of
offences while he has no any argument on it.
COMPLAINANTS human resource manager as employer raised complains to Frank
Joel as employee of ASKB security rank of normal guard committed offence of not
attending job place from 02 August 2023 to 09 August 2023 without any legally
authorized notification.
FRANK JOEL agreed to committee the stated offences to him by his employer.
Chairperson as main judge of hearing she sentenced him due to the Zanzibar
labor law the pain of being fired to him is to loss his job contracts with ASKB
SECURITY from 21 August 22, 2023.
Chairman and main judge of hearing closed the hearing by reminded the
employer to be responsible by provide all right payments and certificate of
services in accordance with the law, falling to do so, legal measures can be taken
toward ASKB COMPANY OF SECURITY.
