1. Name of the Work: “Hiring the services of Screening Plant and other AGREE
machineries for excavation, loading, transport, screening, loading &
transportation of screened products up to various locations for secondary
recovery of SM Grade Manganese ore from old Dump at Tirodi Mine.”
2. Scope of Work: The successful bidder shall deploy all necessary equipments AGREE
i.e. Hydraulic Excavator, Tippers, Mobile/Skid Mounted Screening Plant,
Loader, DG Set (if required for operation of screening plant), Road Weigh
Bridge etc. complete with required manpower for comprehensive operation &
maintenance of all equipments for executing the work of “Hiring the services
of Screening Plant and other machineries for excavation, loading, transport,
screening, loading & transportation of screened products up to various
locations for secondary recovery of SM Grade Manganese ore from old Dump
at Tirodi Mine.” Please refer “Additional Technical Terms & conditions” for
details of activities covered under the scope of bidder.
3. Duration of the Contract: The works are required to be completed within 24 AGREE
months (Excluding rainy season i.e. July, August & September) from the
date of work order, allowing a mobilization period of 45 days from date of
placement of work order or from the date of handing over of the site by the
Mine Manager, whichever is later.
“If contractor fails to start the work on or before the scheduled date of
commencement of work after mobilization period as per terms & conditions
of tender document, penalty @ 0.5% per month of total contract value
(excluding GST) shall be imposed on contractor on prorata basis for the period
delayed by nos. of working days, considering 25 working days per month. The
penalty amount shall be deducted from payment of running bill of the
contractor.
VL = W x (A/100) x (L-L0)/L0
W = Value of work done during the period under reckoning to which the
price variation relates.
A = Component of labour expresses as percentage of the value of
work. In this case, 20.58% for excavation & shifting of dump ore,
screening plant including shifting of all products.
2. Price Variation for Diesel: Diesel prices are changing very frequently and
therefore, it is proposed to incorporate price variation clause in the
NIT. Based on HO Cost Estimate Committee, the cost of diesel required
for the operation of all equipment needed for excavation, shifting of dump
ore to screening plant, operation of plant and shifting of products is app.
44.44% of the total estimated cost of work. Hence following formulae and
clauses shall be incorporated in the tender document.

Diesel Price Variation clause: If the price of Diesel increases or decreases, the
contractor shall be compensated for such increase or recoveries shall be made
from the dues of the contractor for such decrease as per provisions detailed
above.
Whereas the contract period is more than 6 months where the contractor will
be paid /recovered as per the escalation formula provided in the terms &
conditions.
1. Where the contract period is more than 6 months, compensation for price
variation will be paid/recovered.
2. The base date for working out such price variation shall be the last date
on which Part-1 of tenders were stipulated to be opened.

2.1 Excavation and Loading of Dump Ore from Old Dumps: The existing old dumps at Tirodi
Mine having low grade manganese ore, which is to excavated and transported to mobile/skid
mounted screening plant. The contractor should deploy one Hydraulic Excavator of
minimum 0.9 Cu.M. and minimum 2 Nos. of Tippers of 16 MT GVW or above capacity along
with required O&M manpower for shifting of about 23,000 MT/Month of dump ore to the
site of mobile/skid Screening Plant at Tirodi Mine, to be installed within one kilometre from
dumps.
2.2 The tippers carrying dump ore will unload near Screening Plant site at stacking location
from the site and Front End Loader shall fill the ore continuous to feeding hopper of
Screening Plant for its uninterrupted operation.
2.3 Mobile/skid mounted screening plant shall consist of feeding hopper with rigid type grizzly
of app. 300 x 300 mm size at top, vibratory feeder, triple deck vibratory screen and series
of belt conveyors for handling four products of vibratory screen i.e. +25 mm, -25+10 mm, -
25+10 mm & -6 mm.
2.4 All the four products of Screening Plant will be loaded & transported to Road Weigh Bridge
for its weighment by deploying Front End Loader and Tippers, the same shall be unloaded
at different locations within a lead of app. 1 Km.
2.5 The contractor shall also supply, install & operate Road Weigh Bridge, duly stamped by
weight & Measures Department of Legal Metrology of M.P., for weighment of all products of
Screening Plant.
2.6 The oversize ore (more than about 300 mm size) separated out through grizzly at top of
receiving hopper of shall be stored separately by the successful bidder.
2.7 In case, bidder wishes to use higher capacity of Tippers instead of 16 MT GVW capacity,
they can use the same however altogether capacity of higher capacity of tippers should not
be less than 40 MT payload.
3. MOIL will provide the necessary work site for setting up a skid/mobile screening plant and
temporary work shop/works by the Contractor.
4. HSD and oil will need to be arranged by the contractor for the execution of the contract.
MOIL will not provide any stores or spares for the contractor's equipment.
5. All costs towards loading, unloading, transport (to & fro), shifting of equipments, complying
Local Government Regulations, operation & maintenance manpower and servicing of the
offered equipments including the cost of consumables, spare parts, materials, diesel, tools,
periodical replacement and topping up of oil & lubricants as recommended by OEM, are to
be borne by the contractor.
6. The successful bidder shall supply, install & Commission the Electronic Road Weigh Bridge
(with print out facility for each truck & other reports etc., with provision for all the necessary
stationary and fool proof system) to take weighment of empty and loaded trucks at his/their
cost at the locations to be specified by Mine Manager, Tirodi Mine at the mine site, within
45 Days from date of issue of Letter of Intent (LOI). It is the responsibility of contractor to
get calibrated the weighment machine once in a year by the concerned Certification
Authority.
7. The contractor has to operate all the equipments covered in the contract in minimum 2
Shifts/Day & 6 Days/Week basis availing 1 day rest weekly on Monday. However, weekly
maintenance of all equipments shall be carried out on weekly day of rest.
8. Screening Plant, Tippers, Front End Loader & Excavators should be of reputed make.
9. In case, wherever applicable, all equipments, so offered, shall be either registered with the
local R.T.O., or got exempted from such registration from the said R.T.O. All liability on
account of any taxes/penalty, as imposed by the said R.T.O. or any other Government
agency shall be to the Contractor’s account.
10. The equipment’s proposed to be used, by the bidder, should be listed, in details along with
capacity, make, model, year of manufacture etc. The equipment’s, so offered shall be in and
continue to remain in, safe working conditions.
11. The contractor shall produce all vehicles and equipments for inspection at the company’s
premises before start of work to the Engineer In-charge/Mine Manager or his representative.
Only such vehicles and equipments which are allowed by the Engineer In-charge / Mine
Manager shall be deployed.
12. All the operations such as loading, unloading and transport and levelling at unloading points
of waste/rejects materials etc. shall be carried out simultaneously.
13. The contractor has to maintain waste dump, level the dumping sites/platforms, pit and the
service roads from pit-head to approved/specified waste dump yard(s) at his own cost and
arrange for his own labour & equipment, tools, tackles required for the job.
14. The contractor should ensure that the excavation being done by him or materials
loaded/transported by him to the specified places do not interfere / hamper the
production/development activities of the Mine, or working of any other contractor.
15. The contractor from his side shall intimate the Mine Manager in writing as to who will be
the person in-charge from his/their side for operation at the Mine. The authorised
representatives of contractor should always be available at the site of work during working
hours.
16. The bidder must satisfy themselves about the deposit and other conditions of the work
before submitting the tender.
17. The contractor shall make his own arrangement to provide all materials and services and
labour and all tools, tackles, plant, storage and transport necessary for the proper operation
& maintenance of his equipment’s, execution and completion of the work to the satisfaction
of the Engineer In-charge/Mine Manager.
18. MOIL will not responsible for any failure of components/equipment, accident of men or
machines during operation or handling of machines. Safety of the machines & deployed
manpower shall be bidder’s sole responsibility.
19. MOIL shall not pay any amount to contractor other than those indicated in price schedule
and any other taxes, duties or levies as applicable and not mentioned by Bidder in Price Bid,
will be borne by the Bidder.
20. The MOIL shall issue TDS Certificate at the end of contract period or after closure of the
contract.
21. Transportation of equipments from bidder’s site/any other location to the MOIL’s site (i.e.
Tirodi Mine) & back is under the scope of the bidder. The transit & other insurances will be
bidder’s responsibility
22. The equipments should be maintained properly to keep those in satisfactory running
condition at all times in the Mine.
23. The contract will remain in force for a period of 24 months from the date of satisfactory
commissioning of the equipments and commencement of work at the site. However, the
contract is subject to termination at any time if the services are not found satisfactory or for
any other reason whatsoever. However, the company reserves the right to increase/decrease
the quantity by +/-20% on the same terms and conditions depending on the requirement.
24. Prospective Bidder shall visit the site and make himself thoroughly acquainted with the local
site conditions, nature and requirements of the works and MOIL shall not entertain any
claim from the bidder on any account, whatsoever.
25. The payment shall be made after completion of the month on satisfactory service and
submission of bill. Prescribed statutory deductions will be made from the bill. The deduction
shall be made on account of penalties as per tender Terms and conditions or any deficiencies
observed during the month. However, any charges recoverable by MOIL can be recovered
from any dues payable to the bidder.
26. Not-withstanding anything mentioned above/herein, the MOIL reserves the right to
terminate the contract with immediate effect without assigning any reasons, if MOIL of the
opinion that the performance is not satisfactory at any stage of the contract. No payments
will be made for shifting of equipments or personnel. The performance of the equipments
would be monitored continuously from the date of commencement of work.
27.1 The Contractor shall adhere to safe mining practices and shall guard against hazardous
and unsafe working conditions and shall comply with all the statutory provisions.
27.2 Regular preventive maintenance and test checks of all the equipments, directly or
indirectly deployed for execution of the work and maintenance of records of such checks
will be the Contractor's responsibility.
27.3 Contractor shall get all the equipments checked and okayed for safe operation inside the
mining area, at least once a week by the Engineer, authorized by Mine Manager for the
purpose and the result of such inspections shall be recorded &maintained by the
contractor.
27.4 The Contractor shall maintain suitable Log books of all the machines used, together with
the hours run, P.O.L. used, work done etc. Such log books shall be signed by the
Supervisor of the Contractor and got countersigned by the Mines Manager or his
authorized representative, once a week.
28.1 The staff /employees engaged by the contractor shall not be below the age of 18 years.
28.2 The contractor will have to submit the details of the persons i.e. name, age, photograph,
qualifications, experience, etc., to be employed for this work within 15 days of award of
work.
28.3 The employees deployed by the contractor in terms of this contract at Tirodi Mine shall,
in no case, be deemed to be in the employment of MOIL for any purpose whatsoever. The
contractor shall abide by the rules, laws and regulations that may be enforced from time
to time regarding the employment conditions of service of his employees. MOIL will not
be held responsible to the employees of the contractor or his dependents under any
circumstances. MOIL shall have the right to recover any expenses incurred by MOIL, if
any, as a result of non-payment of dues on the part of employees of the contractor from
the contractor. MOIL shall be entitled to recover/ claim dues/compensation from the
contractor in that event.
28.4 Persons selected by contractor shall be deputed for vocation training at Tirodi Mine. The
contractor will be allowed to start the work only after successful competition of vocational
training of persons. All the expenditure towards medical examination of persons shall be
borne by the contractor.
28.5 Supervisors to be engaged by contractor should have sufficient experience for similar
work of operation & maintenance of equipments.
28.6 The contractor shall immediately remove any person(s) employed on the work, whose
misbehaviour causes any nuisance in the opinion of the Engineer In-charge. Such
person(s) shall not be re-employed or allowed on the work without the prior written
permission of the Engineer In-charge.
29. Transportation & accommodation to employees of contractor: MOIL will not provide
any accommodation or transportation facility to employees of contractor. The contractor
shall make his own arrangement for the same. The vehicle, if deployed by the contractor
for manpower/ material transportation, etc., shall be registered with transport department
and the drivers deployed shall have valid license. Equipment declared unfit by Engineer
In-charge of Mine shall be removed immediately and healthy equipment shall be deployed.
30. Insurance: The contractor shall ensure & maintain insurance policy against his liability
for accident or injury to workmen deputed by contractor and shall submit two copies of
the policy & receipts of premiums paid or satisfactory evidence of insurance coverage at
their own cost valid for whole working/contract period for all the persons to be engaged,
to the Mine Manager or his representative of Tirodi Mine before the commencement of
work. Contractor shall also submit the proof of new/renewal of the insurance policy at
least two days before the expiry date of the previous policy. The contractor will not be
allowed to carry out any activity without necessary insurance coverage of their persons.
Insurance policy shall also indemnify MOIL against any claim raised by the
injured/affected workmen or his family, if any.
31. Indemnity: Contractor will fully indemnify MOIL against all responsibility and whatsoever
arising out of accident/injury to contractor’s workmen, third party or to MOIL’s personnel
and properties. The Contractor shall be responsible for all risks arising in connection with
or on account of the operations covered by the agreement and he shall make good all the
losses and damages arising there from. In case the MOIL incurs any cost, expenses or loss
on account of any claim, or cause of action brought against them arising out of the
operations covered by the agreement, the MOIL shall be entitled to recover such cost,
expenses or loss from the contractor. The MOIL shall have the power, without being bound
to do so, to defend, contest or compromise any such claim, demand or cause of action, and
any amount that may become payable by the MOIL and any expense that may be incurred
by MOIL on this behalf shall also be recoverable from the firm.
32. Medical facilities:-The contractor shall be fully responsible for any first aid/ emergency
treatment or serious medical treatment to his employees.
35. Fire prevention: The Contractor shall take all possible precautions to prevent fires of any
nature in the general vicinity of his operations and shall be responsible for all damages
from fire due directly or indirectly to his own activities or to those of his employees or to
the activities of its agents or its employees.
36. The successful bidder shall make adequate lighting arrangement for safe & smooth
operation of plant.
37. Cleanness & general maintenance of plant area is also under the scope of bidder.
38. Procedure for billing and terms of payment: Monthly payment for Screening of dump
ore shall be released for the quantities executed by contractor during the month @ the
ordered rate (Rs./Ton) + GST as applicable. The total quantity of products of all four
fractions i.e. – 6 mm, +6 to 10 mm, +10 to -25 mm & + 25 mm size, shall be finalized on
tonnage basis duly weighed in the Road Weigh bridge installed by successful bidder at
Tirodi Mine site. All the products shall be weighed before unloading on Electronic Road
Weigh Bridge, duly stamped by weight & Measures Department of Legal Metrology and
weighment shall be carried out in presence & witness of MOIL’s representative, authorized
by Mine Manager, Tirodi Mine.
39. Monthly Target: The schedule of screening of Dump Ore per month will be given to the
contractor's representative at site (app. 20,000 to 25,000 MT per Month during non-
monsoon period), in advance, by the Mine Manager, Tirodi Mine or his authorized
representative.
Basis of Penalty: The monthly as well as quarterly target shall be derived from the total
quantity of work to be executed by dividing the period of contract. Penalty will be worked
out under each slab on the value of quantity target, as applicable for that specific period.
The said amount will be payable, on demand without there being any proof of the actual
loss, caused by such delay.
It is also agreed that in case of over/excess achievement over and above the set targets in
any quarter, the contractor shall be entitled to get a set off of the amount of work achieved
in excess in any particular quarter towards the next or subsequent quarter(s), so as to
enable him to achieve the total targeted amount of work and hence shall not be liable to
penalty if after such set off the target for the next or subsequent quarter is achieved.
The target shall not be fixed for the period of 3 months of Monsoon (July, August &
September) due to the safety reasons. Any work executed during this period will be
adjusted in preceding and succeeding months of monsoon.
In case, MOIL fails to provide the site for excavation of dump to the contractor for certain
period, the target quantity for such period shall be reduced on prorata basis and penalty
shall be imposed on reduced target quantity.
Example: If target quantity for any month is 20000 MT and scheduled working days for
the month are 25 days i.e. 50 working shifts and Company failed to provide dump site for
excavation for 10 shifts to the contractor. The reduced target quantity for the month will
be 20000 x (50-10)/50 = 16,000 MT only.
41. Commencement of Work of Screening of dump: All the preliminary works such as
deployment of equipments along with operation & maintenance manpower at site,
commissioning of mobile/skid screening plant along with other equipments (i.e. Excavator,
Loader, Tippers & Weigh Bridge etc.) should be completed within 45 days (mobilization
period) from the date of issue of Letter of Intent (LOI) or work order and production should
commence immediately to achieve the targets as per the schedules.
42. Cleaning up: During the progress of the work, the Contractor shall keep the premises
occupied by it in a neat and clean condition and free from any accumulation of rubbish on
the completion of any portion of work. The Contractor shall promptly remove all of its
equipment, temporary structures and surplus construction materials not to be used at or
near the same location during later stages of the work. Upon completion of the work and
before the final payment is made, the Contractor shall at its own cost and expense
satisfactorily dispose of or remove from the vicinity of the work and from all other land
made available to him by the MOIL all construction plant, building rubbish, unused
materials and other equipment and materials belonging to it and use its direction during
construction and shall leave the premises in a neat and clean condition. In the event of its
failure to do so the same may be removed and disposed of by the MOIL at the Contractor’s
expenses.
43. Dust suppression: It will be the responsibility of the Contractor to arrange for the dust
suppression in the working area. Water required for the dust suppression will be supplied
by the MOIL.
44. Disclaimer: Not-with-standing that anything contained or stipulated in any of the Para of
this Tender Document the quantities, no. and specifications of the equipment indicated
are only indicative / suggestive and subject to variance to any percentage. Since mining is
a sequential process, no Contractor can claim any damages or compensation due to the
failure of any sequential jobs which results in variance of the quantity etc. No claim for
idle charges or loss or profit at consequential losses will be entertained. No claim of
opportunity loss, notional loss shall be entertained. If the time is extended at the request
of the Contractor, the Contractor is continued to be liable for payment of liquidated
damages and time shall be continued to be the essence of the contract, despite extension
of the contract.
