CANNABIS (MEDICAL CANNABIS AND RECOGNISED


JURISDICTIONS) ORDER, 2023
The Minister, in exercise of the powers conferred by sections 37 and 46(2) of the
Cannabis Act, 2023, and on the recommendation of the Medical Cannabis Committee,
hereby makes the following order —

1. Citation and commencement.


(1) This Order may be cited as the Cannabis (Medical Cannabis and
Recognised Jurisdictions) Order, 2023.
(2) This Order shall come into force on such date as may be appointed by the
Minister published by notice in the Gazette.

2. Qualifying medical conditions.


The qualifying medical conditions for which a medical practitioner may
prescribe medical cannabis are specified in the First Schedule.

3. Maximum THC concentration.


The cannabis specified in column one of the Second Schedule shall have the
maximum THC concentration specified in column two of that Schedule.

4. Recognised jurisdictions.
For the purposes of section 46(2) of the Act, the jurisdictions listed in the Third
Schedule are the recognised jurisdictions from which a medical card authorising
the dispensing and use of cannabis may be accepted in a pharmacy or cannabis
dispensary.

(a) Chemotherapy Induced Nausea and Vomiting (CINV);
(b) Chronic Pain;
(c) Multiple Sclerosis;
(d) Human Immunodeficiency Virus (HIV)/ Acquired
Immunodeficiency Syndrome (AIDS)
(e) severe intractable epilepsy;
(f) damage to the nervous tissue of the spinal cord with objective
neurological indication of intractable spasticity;
(g) post-traumatic stress disorder;
(h) rheumatoid arthritis or any similar chronic autoimmune
inflammatory disorder with severe or debilitating conditions;
(i) autism;
(j) glaucoma;
(k) sickle cell anaemia;
(l) anxiety;
(m) sleep disorders;
(n) Alzheimer’s disease;
(o) Crohn’s disease;
(p) Hepatitis B;
(q) Dravet’s syndrome;
(r) Depression;
(s) Amyotrophic Lateral Sclerosis (Lou Gehrig’s disease).
