INTRODUCTION TO 1973 CONSTITUTION PLAN!

BACKGROUND:
On 17th April, 1972 the national assembly Pakistan appointed a committee to prepare
a draft of the permanent constitution of Pakistan. A bill to provide a constitution was
introduced by the committee in the assembly on February 2,1973 the assembly
passed the bill on 10th April, 1973 and at last the constitution came into force on 14
August, 1973.

• 1973 constitution was noticeably different from earlier 1956 and 1962
constitution, because it was not abrogate.
• Third Martial law suspended constitution plan on 5 July, 1977.
• On 12th Oct, 1999 Musharaf declared emergency in Pakistan and again
suspended 1973 constitution plan.

Ø WRITTEN CONSTITUTION:

The constitution of 1973 is in written form having 280 Articles divided into
12 parts and it also includes six schedules.


Ø OBJECTIVE RESOLUTION:

Preamble in 1973 constitution plan,Islam shall be state religion, , sovereignty all over
the universe belongs to Allah and power 1s a trust to be exercised by the elected
representatives of the people.

Ø FUNDAMENTALS RIGHTS:

In the constitution of 1973 Basic rights were given to the people of Pakistan le. Security
of Person, freedom of association. Freedom of movement, freedom of trade, freedom
of speech, Freedom of religion, protection of property rights etc.The parliament and
provincial Assemblies do not make any law that negates any fundamental right.

Ø BICAMERAL LEGISLATURE:

Parliament consists of two houses,senate house is upper house which consist of 63


members and National assembly is lower house which consists of 200 members.

Ø FORM OF GOVERNMENT:

The constitution of 1973 has a parliamentary form of government. The president is


the head of the state, while the prime Minister is the head of the Government. The
prime Minister and his cabinet are accountable to parliament of Pakistan, elected by
the people. The president is elected by the parliament and the provincial assemblies,
whereas the Prime Minister is elected by a majority in the National Assembly.

Ø LANGUAGE:

According to the constitution Urdu was declared the National language of Pakistan. In
a period of fifteen years arrangements will be made to implement the status of Urdu
as the official language. During this period English will be used as the official Language.
Ø INDEPENDENCE OF JUDICIARY:

In the constitution of 1973 judiciary was declared fully independent and free from all
pressures. A guarantee has been provided for an independent judiciary. The judges
are paid handsome salaries and they have job security. The judiciary has been
separated from the executive. The judges will perform their duties without any fear
or pressure.


Ø DIRECT ELECTION METHOD:

The member of national and provisional assemblies elected directly by people

Ø ISLAMIC SYSTEM:

The head of the state must be Muslims. Islamic provisions ensures Islamic system in
the country. According to the constitution-|973, the Muslim is one who believes in the
oneness of Allah, the finality of the prophet-hood of Hazrat Muhammad (SAW),Divine
books and the day of judgement, the government will establish the Islamic ideology
Council, which will guide the legislature to make the laws in accordance with Islamic
teachings and bring the existing laws into the conformity with Islam.

Ø FEDERAL SYSTEM:

According to the constitution federal system was introduced in the country.


The federation of Pakistan consists of four provinces. federal capital and some tribal
areas which are called FATA (Federally Administered Tribal Areas). The constitution
has enumerated the powers of the federal government in the federal legislative list
and powers which the federal and provincial legislature share together in the
concurrent list of subject. All the residuary powers not mentioned in the two lists. are
left to the provinces that are autonomous in the exercise of these residuary powers.

Ø RIGID CONSTITUTION:

The constitution of 1973 is fairly rigid because under its article 239. it can he amended
only by two-third votes of the total memberShip of the National Assembly and then
the senate should pass the amendment bill by a majority of its total membership. The
method of amendment is neither too difficult nor too easy.


Conclusion:
1973 Constitution enlisted the main principles of state policy. Maximum
efforts were made to improve the character of this constitution. Like other
constitutions, 1973 constitution also provide principals for the protection,
propagation and enforcement of Islamic Ideology.
