ASSIGNMENT 1

SEMESTER 1 2022

You are required to find a recent newspaper article relating to a safety, employment, health or
environmental health law issue – eg. Death on a mine site, worksite or within a factory, damage
caused by flood or bushfires, public health issue such as Covid 19, food contamination or anything
similar within Western Australia. Alternately you may use an article from another state or territory
but be aware that different laws would apply Eg. Use Victorian laws for a Victorian article on
Occupational health and Safety such as the Occupational Health and Safety Act 2004 (Vic) rather
than the W.A act. There are plenty of newspaper articles of these or similar nature around. Of course
you may download the article from a news website such as news.com.au.

NOTE: THE ARTICLE NEEDS TO BE DATED FROM JULY 2021 ONWARDS TO THE PRESENT

NOTE: Offshore students can use a local article but remember that Western Australian law will not
be relevant so make sure you refer to local laws for example.

TASK: You are to briefly summarise the facts of the article and then provide an analysis covering
issues such as:

(a) Where did the event take place and what legal jurisdiction would apply?
(b) What type of safety, employment or environmental health law issue does the article
address? Eg: occupational health, workers compensation, public health etc
(c) What body if any is mentioned as the instigator of an enquiry – eg. Worksafe WA,
WorkCover WA?
(d) Is there any mention as to what party/parties may be liable?
(e) Is there mention of any breach of any Act or relevant Standards etc?
(f) Is there any mention of claims for compensation and if so, against whom?

These points are just a guide so you do not need to address all of them and remember that they
may not all be relevant to your article. Word Count - 1000 words maximum

This assignment is due Monday of week 5 (March 28th) at 1 pm WST or before by upload into Grade
Centre. There is no need for an official cover sheet-just make your own.

Ensure you upload the news article with your assignment (web link or scan is fine). This is just a
report so you do not need to use a 4 step answer for example. There is no minimum or maximum
amount of references etc. Just use what you need. Please use Chicago referencing. Refer to the
library website for guidance in this referencing system.
Marking Rubric

Main body including explanation of law and application to the scenario in the article 15 marks

Analysis of the facts of the article 5 marks

Presentation and referencing along with structure 5 marks

25 marks

You should allow a 2 week turnaround for marking
