ORDER: United APTRANSCO regularized certain employees who were appointed on contract basis in the cadre of Assistant Engineer, Sub-Engineer, Junior Accounts Officer, LDC- cum -Computer Operator and Junior Lineman, 2, In 7.0.0 2™ cited, orders were issued to count the service rendered under contract appointments in the cadres of Assistant Engincer, Sub-Engineer, Junior Accounts Officer, LDC -cum -Computer Operator and JLM as regular service for the purpose of Seniority only, without any monetary benefit such as increments, notional pay fixation, leave benefits etc. 3. In T.0.0 7 & 8" cited read with 7.0.0 3" & 4" cited it was ordered that those Employees who have rendered Contract Service from 2002 and thereafter for a period of 18 (eighteen) months and more shall be allowed Two Notional Increments and those Employees who have rendered Contract Service for less than 18 (eighteen) months shall be allowed One Notional Increment 4, _ In 7.0.0 6" cited, orders were issued that the contract service rendered by the Employees from the year 2002 and thereafter shall be considered for the purpose of 6/ 12/ 18/ 24 years Automatic Advancement Scheme. It was further ordered therein that appointed made under Automatic Advancement Scheme as above shall be subject to outcome of the Writ Appeal No.1104 of 2011 filed by B.Gopalu and others against the Hon'ble High Court of AP Judgment in W.P.No.29418/ 2010 and batch, dt.18 -10-2011. 5. ‘The Hon'ble High Court in its common order dt.18-10-2011 in WP No.29418 of 2010 upheld the orders issued in TOO Ms.No.231 dt.23-12-2008. Aggrieved by the learned Single Judge common order dt.18-10-2011 in WP No.29418 of 2010, certain AEs appointed by transfer filed WA No.1182 of 2011. Subsequently, the Division Bench of Hon'ble High Court in its common order dt.17-9-2013 in WA No.1104 of 2011 and batch set aside the common order dt.18-10-2011 and held that the AEs appointed on contract basis are not entitled to reckon their service as such, for the purpose of seniority and that they arc entitled to compute their Service for the purpose of seniority only from the date of their regularisation in that post, but not otherwise” 6. The issue was discussed in the TSPCC Meeting held on 07-06-2018 and agreed to count the contract service for the purpose of Leave Benefits, Automatic Advancement Scheme, Service Weightage Increments. 11. After careful examination, TSTRANSCO hereby orders that though the contract service is neither permanent service nor temporary service, as a special privilege, it is ordered that the contract service rendered by the Employees viz., Assistant Engineer, Sub-Engincer, Junior Accounts Officer, LDC-Cum-Computer Operator and Junior Lineman from the year 2002 and thereafter shall be counted only for the following purposes: a. For Leave benefits (EL, HPL etc.,) b. For Automatic Advancement Scheme c. For service weightage while calculating weightages if any at the time of Revision of Pay Scales in future. 12. Itis further orders that the benefits allowed in para (11) above does not confer any right on the employee and its interpretation cannot be further elongated to claim any other benefits. It is also ordered that, the account of leave of the Contract employees shall be credited with 16 days Earned Leave in a year in two instalments of 8 days on the first of January and July every year (during the period of contract) as is eligible to emergency Board Employees and no HPL is credited. Already sanctioned leaves shall not be revised but for crediting of the above leaves. 13. These orders are also available on TSTRANSCO website and can be accessed at the address www.tstransco.in.
