2020 INTERIM RULES ON REMOTE NOTARIZATION OF PAPER DOCUMENTS

A.M. NO. 20-07-04-SC

Rules on Acknowledgement by Videoconference:

1. The Principal shall cause delivery of the document to the notary public; signed and placed
with an envelope with the initials of the principal.

2. If the principal is not personally known to the notary public the following must be required:
two (2) copies of any competent evidence of identity. If through representative capacity, two (2)
certified copies of the document granting his or her capacity to sign in such capacity as well as
two (2) copies of competent evidence of identity.

3. Submit to the notary public a video clip showing that he/she actually signed the document
delivered for acknowledgement. The principal may choose to submit the document via CD or
USB/Flash Drive which shall be placed in an envelope. Or through E-Mail.

4. The notary public shall schedule the Videoconferencing and

a. Confirm the identity of the principal.


b. require the principal to show proof of his location via GPS or by showing the notary
public identifiable landmarks and buildings within the vicinity.
c. open the envelope within the full view of the principal for confirmation.
d. ensure that the document is within the full view of the principal at all times during the
videoconference.
e. require the principal to affix his signature on a blank piece of paper
f. require the principal to confirm his signature
g. review the video clip submitted by the principal to verify that he/she actually signed
the document.
h. require the principal to declare that he or she has executed the instrument or document
as his or her free and voluntary act and deed, and if acting in a particular representative
capacity, that he or she has authority to sign in such capacity.
i. the notary public shall issue a Notarial Certificate attached to the document with his
Official Seal. The Notarial Certificate shall state that the notarial act was done through
the use of Videoconferencing facilities.

(SAME PROCEDURE WITH AFFIRMATION, OATH OR JURAT

MISCELLANEOUS MATTERS

The Notary Public shall:

1. Take a photograph or a screenshot of the videoconference clearly showing all the


parties who participated in the notarial act. The notary public must be seen holding the
instrument or document to make the first page of the notarized document visible and
identifiable. The screenshot must also bear a date and time stamp which reflects the date
and time that the videoconference was conducted.
